		<section id="HAB1CAD19E8664440823B4713977BF595" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Energy Innovation Hubs Authorization
			 Act of 2010</short-title></quote>.</text>
		</section><section id="H6845710EC95A41A38783A6BCE248A408" section-type="subsequent-section"><enum>2.</enum><header>Energy Innovation
			 Hubs</header>
			<subsection id="H394921C0D61A42E09E0C52792C545CC1"><enum>(a)</enum><header>Establishment of
			 program</header>
				<paragraph id="HC06C5FC0912047FF8491746752EA8E3A"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Energy shall carry out a program to
			 enhance the Nation’s economic, environmental, and energy security by making
			 grants to consortia for establishing and operating Energy Innovation Hubs to
			 conduct and support, whenever practicable at one centralized location,
			 multidisciplinary, collaborative research, development, demonstration, and
			 commercial application of advanced energy technologies in areas not being
			 served by the private sector.</text>
				</paragraph><paragraph id="HA0504788202B4D468A68167702E6A97F"><enum>(2)</enum><header>Technology
			 development focus</header><text>The Secretary shall designate for each Hub a
			 unique advanced energy technology development focus.</text>
				</paragraph><paragraph id="H9697268EBB294B45840E19F26423E0C7"><enum>(3)</enum><header>Coordination</header><text display-inline="yes-display-inline">The Secretary shall ensure the coordination
			 of, and avoid unnecessary duplication of, the activities of Hubs with those of
			 other Department of Energy research entities, including the National
			 Laboratories, the Advanced Research Projects Agency—Energy, and Energy Frontier
			 Research Centers, and within industry. Such coordination shall include
			 convening and consulting with representatives of staff of the Department of
			 Energy, representatives from Hubs and the qualifying entities that are members
			 of the consortia operating the Hubs, and representatives of such other entities
			 as the Secretary considers appropriate, to share research results, program
			 plans, and opportunities for collaboration.</text>
				</paragraph><paragraph id="HF5748B391771493C824BACCEE68CA2E2"><enum>(4)</enum><header>Administration</header><text display-inline="yes-display-inline">The Secretary shall administer this section
			 with respect to each Hub through the Department program office appropriate to
			 administer the subject matter of the technology development focus assigned
			 under paragraph (2) for the Hub.</text>
				</paragraph></subsection><subsection id="H60438E91771F4A36821081935E34CBD4"><enum>(b)</enum><header>Consortia</header>
				<paragraph id="HC9D58175267641788C0CAD4145D258D2"><enum>(1)</enum><header>Eligibility</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
			 this section for the establishment and operation of a Hub, a consortium
			 shall—</text>
					<subparagraph id="H2DB17300086C4884BBF4F575D6AB3308"><enum>(A)</enum><text>be composed of no
			 fewer than 2 qualifying entities;</text>
					</subparagraph><subparagraph commented="no" id="H470E8D457DB84554BB14B0EEEFB88449"><enum>(B)</enum><text>operate subject to
			 a binding agreement entered into by its members that documents—</text>
						<clause commented="no" id="H84A04B12932F45DFA6B7FD4ACE41F225"><enum>(i)</enum><text>the proposed
			 partnership agreement, including the governance and management structure of the
			 Hub;</text>
						</clause><clause commented="no" id="HDB46499534BC453DB45DF4D0580C1099"><enum>(ii)</enum><text>measures to
			 enable cost-effective implementation of the program under this section;</text>
						</clause><clause commented="no" id="HA55E04154AD948B2B9467C475656BB4D"><enum>(iii)</enum><text>a proposed
			 budget, including financial contributions from non-Federal sources;</text>
						</clause><clause commented="no" id="H634D000EF83B40ECBD4B48ACC9155840"><enum>(iv)</enum><text>conflict of
			 interest procedures consistent with subsection (d)(3), all known material
			 conflicts of interest, and corresponding mitigation plans;</text>
						</clause><clause commented="no" id="H9366AD26446C4A79B2683790FC52F728"><enum>(v)</enum><text>an accounting
			 structure that enables the Secretary to ensure that the consortium has complied
			 with the requirements of this section; and</text>
						</clause><clause commented="no" id="HD6A3B70EC8744DA59A740CB06A7CECD0"><enum>(vi)</enum><text>an external
			 advisory committee consistent with subsection (d)(2); and</text>
						</clause></subparagraph><subparagraph id="HC6A626CB5CE14D31BB96EA78E60D9BA7"><enum>(C)</enum><text>operate as a
			 nonprofit organization.</text>
					</subparagraph></paragraph><paragraph id="H59A01EC19FEC45DDA2E4E3E9B47D602B"><enum>(2)</enum><header>Application</header><text>A
			 consortium seeking to establish and operate a Hub under this section, acting
			 through a prime applicant, shall transmit to the Secretary an application at
			 such time, in such form, and accompanied by such information as the Secretary
			 shall require, including a detailed description of the elements of the
			 consortium agreement required under paragraph (1)(B).</text>
				</paragraph></subsection><subsection id="HA80CD1B7224E4609961F0C51DE921603"><enum>(c)</enum><header>Selection and
			 schedule</header><text>The Secretary shall select consortia for grants for the
			 establishment and operation of Hubs through competitive selection processes.
			 Grants made to a Hub shall be for a period not to exceed 5 years, after which
			 the grant may be renewed, subject to a competitive selection process.</text>
			</subsection><subsection id="H0F13A70B7B8C4DE09DD0AA9DBA3FB089"><enum>(d)</enum><header>Hub
			 operations</header>
				<paragraph id="HD901FEB0395C45C799F659CC3866B8A7"><enum>(1)</enum><header>In
			 general</header><text>Hubs shall conduct or provide for multidisciplinary,
			 collaborative research, development, demonstration, and commercial application
			 of advanced energy technologies within the technology development focus
			 designated for the Hub by the Secretary under subsection (a)(2). Each Hub
			 shall—</text>
					<subparagraph id="H319BA907D13A46A78A78EF6E53F2B26D"><enum>(A)</enum><text>encourage
			 collaboration and communication among the member qualifying entities of the
			 consortium and awardees by conducting activities whenever practicable at one
			 centralized location;</text>
					</subparagraph><subparagraph id="H5AC67551F1974409A6ACD32C6DCE6E35"><enum>(B)</enum><text>develop and
			 publish on the Department of Energy’s website proposed plans and
			 programs;</text>
					</subparagraph><subparagraph id="HA0ABBCB237594F1EAE1518C68684AC06"><enum>(C)</enum><text>submit an annual
			 report to the Secretary summarizing the Hub’s activities, including detailing
			 organizational expenditures, listing external advisory committee members, and
			 describing each project undertaken by the Hub; and</text>
					</subparagraph><subparagraph id="H4EB02A70633E4708A800AD5769685B54"><enum>(D)</enum><text>monitor project
			 implementation and coordination.</text>
					</subparagraph></paragraph><paragraph id="H6F187388FA334BD38EC80B0348E7EEBD"><enum>(2)</enum><header>External
			 advisory committee</header><text>Each Hub shall establish an external advisory
			 committee, the membership of which shall have sufficient expertise to advise
			 and provide guidance on scientific, technical, industry, financial, and
			 research management matters.</text>
				</paragraph><paragraph id="H7E24EBFCEA1C4CD08F592AE57A40BEC1"><enum>(3)</enum><header>Conflicts of
			 interest</header>
					<subparagraph id="HD69830B7606A472ABC37481A3C3007DA"><enum>(A)</enum><header>Procedures</header><text>Hubs
			 shall establish conflict of interest procedures, consistent with those of the
			 Department of Energy, to ensure that employees and consortia designees for Hub
			 activities who are in decisionmaking capacities disclose all material conflicts
			 of interest, including financial, organizational, and personal conflicts of
			 interest.</text>
					</subparagraph><subparagraph id="H1AFA700EBF704A02A8B7BBE5A434F5E8"><enum>(B)</enum><header>Disqualification
			 and revocation</header><text>The Secretary may disqualify an application or
			 revoke funds distributed to a Hub if the Secretary discovers a failure to
			 comply with conflict of interest procedures established under subparagraph
			 (A).</text>
					</subparagraph></paragraph></subsection><subsection id="H0693099FF3D64731856178551485998A"><enum>(e)</enum><header>Prohibition on
			 construction</header><text>No funds provided pursuant to this section may be
			 used for construction of new buildings or facilities for Hubs. Construction of
			 new buildings or facilities shall not be considered as part of the non-Federal
			 share of a Hub cost-sharing agreement.</text>
			</subsection><subsection id="H6600EFBD6C244F2CA8EE363900F0BEDB"><enum>(f)</enum><header>Oversight
			 board</header><text>The Secretary shall establish and maintain within the
			 Department an Oversight Board to oversee the progress of Hubs.</text>
			</subsection><subsection id="H984CBEED581D4B75BF7E1DFF08FA75D9"><enum>(g)</enum><header>Definitions</header><text>For
			 purposes of this section:</text>
				<paragraph id="H1BC5972C13C44186BEC93321AF7E27BD"><enum>(1)</enum><header>Advanced energy
			 technology</header><text>The term <quote>advanced energy technology</quote>
			 means an innovative technology—</text>
					<subparagraph id="HE0B381044FF04381A311001DA7D3286D"><enum>(A)</enum><text>that produces
			 energy from solar, wind, geothermal, biomass, tidal, wave, ocean, or other
			 renewable energy resources;</text>
					</subparagraph><subparagraph id="H1B4378E63F64417C9503852224B9211A"><enum>(B)</enum><text>that produces
			 nuclear energy;</text>
					</subparagraph><subparagraph id="H5954AE30CDC2464BA1475845CC002F8D"><enum>(C)</enum><text>for carbon capture
			 and sequestration; or</text>
					</subparagraph><subparagraph id="HD8F304B89F4641F7AF5908F587B8923C"><enum>(D)</enum><text>that generates,
			 transmits, distributes, utilizes, or stores energy more efficiently than
			 conventional technologies.</text>
					</subparagraph></paragraph><paragraph id="H6164892EF8BB4E1896A25C04C6EC7593"><enum>(2)</enum><header>Hub</header><text>The
			 term <quote>Hub</quote> means an Energy Innovation Hub established in
			 accordance with this section.</text>
				</paragraph><paragraph id="HC3B73C35453848A7B68E5C9D6A74C843"><enum>(3)</enum><header>Institution of
			 higher education</header><text>The term <quote>institution of higher
			 education</quote> has the meaning given that term in section 101(a) of the
			 Higher Education Act of 1965 (20 U.S.C. 1001(a)).</text>
				</paragraph><paragraph id="HEF6066A90B624DC68774D2AF9ED528FE"><enum>(4)</enum><header>Qualifying
			 entity</header><text>The term <quote>qualifying entity</quote> means—</text>
					<subparagraph id="HFA0429633727441CA580DE81DAF46783"><enum>(A)</enum><text>an institution of
			 higher education;</text>
					</subparagraph><subparagraph id="H31C56CEA50B045C3982EAD6FEC415047"><enum>(B)</enum><text>an appropriate
			 State or Federal entity;</text>
					</subparagraph><subparagraph id="H0D7FB24EDA3C4C5C9A10B6429ACFDA5A"><enum>(C)</enum><text>a nongovernmental
			 organization with expertise in advanced energy technology research,
			 development, demonstration, or commercial application; or</text>
					</subparagraph><subparagraph id="HA223B6566ECD4B33915E0AF177F45120"><enum>(D)</enum><text>any other relevant
			 entity the Secretary considers appropriate.</text>
					</subparagraph></paragraph><paragraph id="H99EA28A11A734B56B04262C8029562EB"><enum>(5)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Energy.</text>
				</paragraph></subsection><subsection id="H0685616BCA2F42958603A9E5B76A2C8A"><enum>(h)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to the
			 Secretary to carry out this section—</text>
				<paragraph id="HC6E994CC80D74CD39C27B5AD63A258D2"><enum>(1)</enum><text>$110,000,000 for
			 fiscal year 2011;</text>
				</paragraph><paragraph id="H5A919DE76D8C418BBE0198E5DBA47A38"><enum>(2)</enum><text>$135,000,000 for
			 fiscal year 2012;</text>
				</paragraph><paragraph id="H8112CBBB9DC34AF396A6BBAE8C5F2694"><enum>(3)</enum><text>$195,000,000 for
			 fiscal year 2013;</text>
				</paragraph><paragraph id="H27801CF206DB454AB057B8630D2605F3"><enum>(4)</enum><text>$210,000,000 for
			 fiscal year 2014; and</text>
				</paragraph><paragraph id="H2C2EC78F5F894EA28B69BCF21714CC45"><enum>(5)</enum><text>$210,000,000 for
			 fiscal year 2015.</text>
