<section id="HF65488277B454015A35CAE8489F2BCC5"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="H4E959A4C01624A65BD2F3313CEF5A5C9"><enum>(1)</enum><header>Authorization</header><text display-inline="yes-display-inline">The terms <quote>authorized</quote> and <quote>authorization</quote> refer to the issuance of a special use permit for the use and occupancy of National Forest System land derived from the public domain by a cabin owner under the Recreation Residence Program.</text></paragraph>
<paragraph id="H7B6A1EB616F04C6A91B6B38E97AA8E51"><enum>(2)</enum><header>Cabin</header><text display-inline="yes-display-inline">The term <quote>cabin</quote> means a privately built and owned recreation residence and related improvements on National Forest System land derived from the public domain that is authorized for private use and occupancy and may be sold or transferred between private parties.</text></paragraph>
<paragraph id="HDCE6C2DA3B2D449CBBA991B414BD85BA"><enum>(3)</enum><header>Cabin owner</header><text display-inline="yes-display-inline">The term <quote>cabin owner</quote> means—</text>
<subparagraph id="H9743680566FE4A3CB7F0618DC7A79B51"><enum>(A)</enum><text display-inline="yes-display-inline">a person authorized by the Secretary to use and to occupy a cabin on National Forest System land derived from the public domain; and</text></subparagraph>
<subparagraph id="HEE09FBA70A8F46798B555430BF64F158"><enum>(B)</enum><text>a trust or an heir or assigns of such a person.</text></subparagraph></paragraph>
<paragraph id="H3D2DE0B775A04F50AFB025FAFCF69199"><enum>(4)</enum><header>Cabin transfer fee</header><text display-inline="yes-display-inline">The term <quote>cabin transfer fee</quote> means a fee paid to the United States upon the transfer of a cabin between private parties for money or other consideration that also includes issuance of a new permit.</text></paragraph>
<paragraph id="HAEB7C5797A5F4C7A80B759F5470801B1"><enum>(5)</enum><header>Cabin user fee</header><text display-inline="yes-display-inline">The term <quote>cabin user fee</quote> means an annual fee paid to the United States by a cabin owner pursuant to an authorization for the use and occupancy of a cabin on National Forest System land derived from the public domain.</text></paragraph>
<paragraph id="H05DDB74521B446F8A67AB95541719BC7"><enum>(6)</enum><header>Current cabin user fee</header><text>The term <quote>current cabin user fee</quote> means the most recent cabin user fee, which results from an annual adjustment to the prior cabin user fee under section 3(d).</text></paragraph>
<paragraph id="H1D0624E06A97485492B907B6BF444DF7"><enum>(7)</enum><header>Lot</header><text display-inline="yes-display-inline">The term <quote>lot</quote> means a parcel of National Forest System land derived from the public domain on which a person is authorized to build, use, occupy, and maintain a cabin.</text></paragraph>
<paragraph id="H2DFE9959B92D4F3C8A26B93807E6717F"><enum>(8)</enum><header>National Forest System land</header><text display-inline="yes-display-inline">The term <quote>National Forest System land</quote> is limited to National Forest System land derived from the public domain.</text></paragraph>
<paragraph id="HEA65DB1F7E934E59A26B967C19BD8812"><enum>(9)</enum><header>Recreation residence program</header><text>The term <quote>Recreation Residence Program</quote> means the Recreation Residence Program established pursuant to the last paragraph under the heading <quote>FOREST SERVICE</quote> in the Act of March 4, 1915 (38 Stat. 1101, chapter 144; 16 U.S.C. 497).</text></paragraph>
<paragraph id="H2DD90AF289314D809549E230570A4162"><enum>(10)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></paragraph>
<paragraph id="HDE70EF476DAA4EF9B6FD40844DFF8E27"><enum>(11)</enum><header>Typical lot</header><text>The term <quote>typical lot</quote> means a cabin lot, or group of cabin lots, in a tract that is selected for use in an appraisal as being representative of, and that has similar value characteristics as, other lots or groups of lots within the tract.</text></paragraph></section>
<section id="H312156BD4F174CE49A2DAA1A27C96882"><enum>3.</enum><header>Cabin user fees</header>
<subsection id="HA85C96E8EFEE41CEAB2C746488030710"><enum>(a)</enum><header>Payment of cabin user fees</header>
<paragraph id="H0059D4313BCF4DFA86450B937499FD86"><enum>(1)</enum><header>Annual payment</header><text display-inline="yes-display-inline">A cabin user fee shall be paid annually by the cabin owner.</text></paragraph>
<paragraph id="H103F38CFE3984B3DAAAA356C2EED5475"><enum>(2)</enum><header>Installments</header><text display-inline="yes-display-inline">Payment of the cabin user fee for a year may be made in two installments.</text></paragraph></subsection>
<subsection id="HC980880A74B44E049D33A696A5A5394C"><enum>(b)</enum><header>Initial cabin user fees</header>
<paragraph id="H1F49B98E670D48D58B909D9285CC4992"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish initial cabin user fees in the manner required by this subsection.</text></paragraph>
<paragraph id="HB004D4ECAB93428099D2019855A375A1"><enum>(2)</enum><header>Assignment to value tiers</header><text display-inline="yes-display-inline">Upon completion of the current appraisal cycle, as required by paragraph (4), the Secretary shall assign each permitted lot on National Forest System land to one of five tiers based on the following:</text>
<subparagraph id="HFFC1AA881D454E33AE5F9CEBCCB84891"><enum>(A)</enum><text>All appraised lot values shall be adjusted, or normalized, for price changes from its date of value according to the national NAHB/Wells Fargo Housing Opportunity Index prior to tier assignment.</text></subparagraph>
<subparagraph id="HBCE72FDEF0B743D99B7A5F2F39673417"><enum>(B)</enum><text>The tiers shall be established according to relative lot value, using all fully completed appraisal data with lots having the lowest adjusted appraised value assigned to Tier 1 and lots having the highest adjusted appraised value assigned to Tier 5.</text></subparagraph>
<subparagraph id="H3AA1896981474D8BB19F5CEDA597D154"><enum>(C)</enum><text>The number of lots (by percentage) assigned to each tier is specified in the table contained in paragraph (3).</text></subparagraph>
<subparagraph id="H63AD67AB87C94E4F9D027843AA0D188D"><enum>(D)</enum><text>Data from incomplete appraisals may not be used to establish the fee tiers.</text></subparagraph>
<subparagraph id="HDAA0BA39512D4E0A8BD322AE64650244"><enum>(E)</enum><text>Until assigned to a tier, permitted cabin lots, including lots with incomplete appraisals, are assigned an interim fee of $4000 or their current annual fee, indexed in accordance with subsection (d), whichever is less.</text></subparagraph></paragraph>
<paragraph id="HA353AA97882F4649BA6833E5DF2A68DB"><enum>(3)</enum><header>Table of initial cabin user fees</header><text>The initial cabin user fees, based on the assignments made by the Secretary under paragraph (2) are as follows:</text>

<paragraph id="HD062E46442B6444BBD0CFD09C7658726"><enum>(4)</enum><header>Deadline for completion of current appraisal cycle</header><text display-inline="yes-display-inline">The Secretary shall complete the current appraisal cycle within three years after the date of the enactment of this Act. </text></paragraph>
<paragraph id="H1736C0C0AF4040DAABDD74906174822A"><enum>(5)</enum><header>Effective date</header><text display-inline="yes-display-inline">The initial cabin user fees required by this subsection shall take effect beginning with the first calendar year beginning after the completion of the current appraisal cycle.</text></paragraph></subsection>
<subsection id="H7C07437DE5E841FCB1DE29C8891FE931"><enum>(c)</enum><header>Overpayments or underpayments</header><text display-inline="yes-display-inline">If, upon assignment to a tier under subsection (b), the Secretary determines that the fee charged to a cabin owner during the preceding three years resulted in an overpayment or underpayment totaling more than $500, the fee for the next three years shall be adjusted, if such a fee adjustment is requested by the Secretary or by the affected cabin owner, as necessary to correct the overpayment or underpayment. </text></subsection>
<subsection id="H59B096ABC1F84A8087F8BD3262AAF0D9"><enum>(d)</enum><header>Annual Adjustments of cabin user fee</header><text display-inline="yes-display-inline">The Secretary shall use changes in the Implicit Price Deflator for the Gross Domestic Product published by the Bureau of Economic Analysis of the Department of Commerce, applied on a five-year rolling average, to determine and apply an annual adjustment to cabin user fees.</text></subsection>
<subsection id="H6B7D3B6684D14253B9AFA9B3160BCA98"><enum>(e)</enum><header>Effect of destruction, substantial damage, or loss of access</header><text display-inline="yes-display-inline">If a cabin is destroyed or suffers substantial damage amounting to greater than 50 percent of replacement cost, or if access to a cabin is significantly impaired, whether by catastrophic events, natural causes or governmental actions, such that the cabin is rendered unsafe or unable to be occupied as a result, the Secretary shall reduce the cabin user fee for the affected lot to $100 per year. This fee shall be in effect for the remainder of the year in which the destruction occurs and until such time as the cabin may be lawfully reoccupied and normal access has been restored.</text></subsection></section>
<section id="H125AA4D6472547178314766914D13EE3"><enum>4.</enum><header>Cabin transfer fees</header>
<subsection id="HC7C1798931764D61B80C7ABB218AAEC2"><enum>(a)</enum><header>Payment of cabin transfer fees</header><text display-inline="yes-display-inline">In conjunction with the transfer of ownership of any cabin and the issuance of a new permit, the transferor shall file with the Secretary a sworn statement declaring the amount of money or other value received, if any, for the transfer of the cabin. As a condition of the issuance by the Secretary of a new authorization for the use and occupancy of the cabin, the transferor shall pay, or cause to be paid, to the Secretary a cabin transfer fee in an amount determined as follows:</text>

<subsection id="H32D29B85BDBE4A4DB3C4A045A363E132"><enum>(b)</enum><header>Index</header><text>The Secretary shall use changes in the Implicit Price Deflator for the Gross Domestic Product published by the Bureau of Economic Analysis of the Department of Commerce, applied on a five-year rolling average, to determine and apply an annual adjustment to the cabin transfer fee threshold amounts ($250,000.01 and $500,000.01) set forth in the table contained in subsection (a).</text></subsection></section>
<section id="H00E10E86509A4AF7927B52E08F4266A9"><enum>5.</enum><header>Allocation of cabin user fee and cabin transfer fee revenue</header>
<subsection id="H60B8E4C772BB420487897E1BE8F2FA36"><enum>(a)</enum><header>Retained fees to cover costs</header><text>Subject to subsection (b), the Secretary shall retain the amount of revenue from cabin user fees and cabin transfer fees necessary to fully cover the costs incurred by the Forest Service to administer the Recreation Residence Program. Revenue collected in excess of that amount shall be deposited in the Treasury.</text></subsection>
<subsection id="H9D0C0B7EEF74481C962F9D88F203EEBD"><enum>(b)</enum><header>Limitation</header><text display-inline="yes-display-inline">The total retained by the Secretary under subsection (a) for a fiscal year may not exceed $500 per cabin. The Secretary shall use changes in the Implicit Price Deflator for the Gross Domestic Product published by the Bureau of Economic Analysis of the Department of Commerce, applied on a five-year rolling average, to determine and apply an annual adjustment to this limitation. Revenue collected from cabin user fees and cabin transfer fees in excess of this limitation shall be deposited in the Treasury.</text></subsection></section>
<section id="H98DE7C9D1712483ABB02901AD0D08106"><enum>6.</enum><header>Right of appeal and judicial review</header>
<subsection id="HE066929494234E50BBDBC0DECA47E6A0"><enum>(a)</enum><header>Right of appeal</header><text display-inline="yes-display-inline">Notwithstanding any action of a cabin owner to exercise rights in accordance with section 7, the Secretary shall by regulation grant the cabin owner the right to an administrative appeal of the determination of a new cabin user fee, fee tier, transfer fee, or whether or not to reduce a cabin user fee under section 3(e). Such appeal shall be pursuant to the appeal process provided under subpart C (Appeal of Decisions Relating to Occupancy and Use of National Forest System Lands) of part 251 of title 36, Code of Federal Regulations (section 251.80 et seq.).</text></subsection>
<subsection id="H93190C61F0BC48CD85B76EFD70A711AF"><enum>(b)</enum><header>Judicial review</header><text display-inline="yes-display-inline">A cabin owner that contests a final decision of the Secretary under this Act may bring a civil action in United States district court. The venue for actions brought before the United States District Court shall be in the United States Judicial District where the cabin is located or the permit holder resides. Nothing in this Act precludes the parties from seeking mediation.</text></subsection></section>
<section id="H3F3E45D2EB6149FDA306682F1EAF97CA"><enum>7.</enum><header>Consistency with other law and rights</header>
<subsection id="H83C1BA8D6F3F454FA162B4E20E551AAA"><enum>(a)</enum><header>Consistency with rights of the united states</header><text>Nothing in this Act limits or restricts any right, title, or interest of the United States in or to any land or resource.</text></subsection>
<subsection id="H04F86534A132442CA116F0B22881927A"><enum>(b)</enum><header>Special rule for alaska</header><text>In determining a cabin user fee in the State of Alaska, the Secretary shall not establish or impose a cabin user fee or a condition affecting a cabin user fee that is inconsistent with 1303(d) of the Alaska National Interest Lands Conservation Act (16 U.S.C. 3193(d)).</text></subsection></section>
<section id="H4575492F5F3045618FA002DC65ED2054"><enum>8.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary shall promulgate regulations to carry out this Act not later than the December 31, 2012.</text></section>
