<legis-type>AN ACT</legis-type> 
<official-title display="yes">To amend the Internal Revenue Code of 1986 to ensure that health coverage provided by the Department of Defense is treated as minimal essential coverage.</official-title>

<section id="HEDB7407441F14CB48F75B3313D60861A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>TRICARE Affirmation Act</quote>. </text></section> 
<section id="HE1DAA8794E8648D4AB20FFB817AA0A86"><enum>2.</enum><header>Treatment of Department of Defense health coverage as minimal essential coverage</header> 
<subsection id="H76032924D865431987BC2D9E3326F220"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5000A(f)(1)(A) of the Internal Revenue Code of 1986, as added by section 1501(b) of the Patient Protection and Affordable Care Act, is amended—</text> 
<paragraph id="H10B7FFD5AC9E48DEA0C34738C212E21C"><enum>(1)</enum><text>by striking clause (iv) and inserting the following new clause:</text> 
<quoted-block style="OLC" id="H45558A4396C145E685E322D5760504BE" display-inline="no-display-inline"> 
<clause id="H7CBB703E2E5A49388C34B3AF1934C844"><enum>(iv)</enum><text display-inline="yes-display-inline">medical coverage under chapter 55 of title 10, United States Code, including coverage under the TRICARE program;</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H52F171179C2D4750853E1A3AFF863AE3"><enum>(2)</enum><text>by striking <quote>or</quote> at the end of clause (v);</text></paragraph> 
<paragraph id="H85E7C2D325DC4191BA278901E3F3E6C4"><enum>(3)</enum><text>by striking the period at the end of clause (vi) and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="HBBC2ED89BF814DF48A23FB1B7CC859F0"><enum>(4)</enum><text>by inserting after clause (vi) the following new clause: </text>

<clause id="H493E0E8296D043E38C06391352862C00"><enum>(vii)</enum><text display-inline="yes-display-inline">the Nonappropriated Fund Health Benefits Program of the Department of Defense, established under section 349 of the National Defense Authorization Act for Fiscal Year 1995 (Public Law 103–337; 10 U.S.C. 1587 note). </text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H6CE92C1D2DBA41F2B95A36641764598B"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall take effect as if included in section 1501(b) of the Patient Protection and Affordable Care Act and shall be executed immediately after the amendments made by such section 1501(b).</text> </subsection></section>
