<legis-type>A BILL</legis-type> 
<official-title>To protect the civil rights of victims of gender-motivated violence and to promote public safety, health, and regulate activities affecting interstate commerce by creating employer liability for negligent conduct that results in an individual’s committing a gender-motivated crime of violence against another individual on premises controlled by the employer, and for other purposes.</official-title>

<section display-inline="no-display-inline" id="H16D5CD9EECB64DE09BFD7CB1770A32F9" section-type="section-one"><enum>1.</enum><header>Negligently allowing gender-motivated violence</header><text display-inline="no-display-inline">An employer—</text>
<paragraph id="H7BADFF38643A457388268466A5D5B4C5"><enum>(1)</enum><text>whose business is in or affects interstate or foreign commerce; and</text></paragraph>
<paragraph id="HC37FB5F1FF754E42A91FA4AAC981F30D"><enum>(2)</enum><text>whose negligent conduct results in a person’s (including a person who acts under color of statute, ordinance, regulation, custom, or usage of any State) committing a crime of violence motivated by gender against another person on premises under the control of the employer;</text></paragraph><continuation-text continuation-text-level="section">shall be liable to the party injured, in an action for the recovery of compensatory and punitive damages, injunctive and declaratory relief, and such other relief as a court may deem appropriate.</continuation-text></section>
<section id="H57A81D39495A4A7FA422F87FBA3C98C2"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this Act—</text>
<paragraph id="H2C9184C1A18C4298B841C02787637FEB"><enum>(1)</enum><text>the term <term>crime of violence motivated by gender</term> means a crime of violence committed because of gender or on the basis of gender; and</text></paragraph>
<paragraph id="HA71FF1376119443EBF8B7C7317CD6D7F"><enum>(2)</enum><text>the term <term>crime of violence</term>—</text>
<subparagraph id="H10B31214579945138267C4A6AE86A2F9"><enum>(A)</enum><text>means an act or series of acts that would constitute a crime, for which imprisonment of more than one year may be imposed, against the person of another if that crime is a crime of violence as defined in section 16 of title 18, United States Code; and</text></subparagraph>
<subparagraph id="HCBD1E05D921144C6B2FC996C64015F03"><enum>(B)</enum><text>includes any conduct that would constitute a crime described in subparagraph (A) but for the relationship between the person engaging in that conduct and the individual against whom such conduct is directed.</text></subparagraph></paragraph></section>
<section id="H55A3B768B9614D5D8F7135A786A42721"><enum>3.</enum><header>Limitation and procedure</header>
<subsection id="HCEC015288ED345449CC59C1FE2A0D70A"><enum>(a)</enum><header>Limitation</header><text>Nothing in this Act entitles a person to a cause of action under section 1 for random acts of violence unrelated to gender or for acts that cannot be demonstrated, by a preponderance of the evidence, to be motivated by gender.</text></subsection>
<subsection id="H1289182775D8475295DAC5B608FBD914"><enum>(b)</enum><header>No prior criminal action</header><text>Nothing in this section requires a prior criminal complaint, prosecution, or conviction to establish the elements of a cause of action under section 1.</text></subsection>
<subsection id="H8CD38EEA360A4AEE92B65D1E72FF3692"><enum>(c)</enum><header>Concurrent jurisdiction</header><text>The Federal and State courts shall have concurrent jurisdiction over actions brought pursuant to this Act.</text></subsection></section>
<section id="H7DA77C147B174079A05A23DC9DB1557A"><enum>4.</enum><header>Materials to assist employers</header><text display-inline="no-display-inline">The Equal Employment Opportunity Commission shall create and provide materials to employers regarding personnel policies and safety standards to assist employers in avoiding liability under this Act.</text></section>
