		  investment in certain industries by providing an exclusion from tax on certain

		<section id="H7B438334D9A648E3BD1CFDFC40DAEC60" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Community Bank and Automotive Industry
			 Recapitalization Act of 2010</short-title></quote>.</text>
		</section><section id="H6B1E415D152541388BBBA1F6CCBDA1F1"><enum>2.</enum><header>Exclusion of
			 capital gains on investments in certain industries</header>
			<subsection id="HD0BFF6212D0C4D088D2AF4F81647C483"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part III of
			 subchapter B of chapter 1 of the Internal Revenue Code of 1986 is amended by
			 inserting after section 139C the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HB9579EAB8CAB4BE998D714BAA53AB1AA" style="OLC">
					<section id="H738F81BA94494865898D5842E66DDBEE"><enum>139D.</enum><header>Capital gains
				on investments in certain industries</header>
						<subsection id="H65BB50EC2A9E4BEDBDA72BA860B8E8D7"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Gross income shall
				not include gain from the sale of qualified investment property if—</text>
							<paragraph id="H1D529A23900343428914AE20A53B80B1"><enum>(1)</enum><text>such property is
				acquired during the 18-month period beginning on the date of the enactment of
				this section, and</text>
							</paragraph><paragraph id="H0D001FD84C2E47C189A155398F91D89D"><enum>(2)</enum><text>such property is
				held for more than 5 years.</text>
							</paragraph></subsection><subsection id="H77EA85531B9344278DBD136A4A0F9473"><enum>(b)</enum><header>Qualified
				investment property</header><text>For purposes of this section—</text>
							<paragraph id="H3A6A7DA3F4A2498396BE09D4F457236B"><enum>(1)</enum><header>In
				general</header><text>The term <term>qualified investment property</term> means
				any—</text>
								<subparagraph id="HB587A1C50020486A9B34996720769695"><enum>(A)</enum><text>stock in a
				specified domestic corporation acquired by the taxpayer at its original issue,
				and</text>
								</subparagraph><subparagraph id="HC919642DA83347EB8ED9D93BB807A046"><enum>(B)</enum><text>any capital or
				profits interest in a specified domestic partnership acquired by the taxpayer
				from the partnership.</text>
								</subparagraph></paragraph><paragraph id="H3FECF9CD850C4AD69CB50D709197D4C3"><enum>(2)</enum><header>Specified
				corporations and partnerships</header>
								<subparagraph id="H1159EF8EF0BF4D6981DBAA92F20B9B3C"><enum>(A)</enum><header>In
				general</header><text>A corporation or partnership shall be treated as
				specified for purposes of paragraph (1) if such corporation or partnership is a
				community bank or an automotive company.</text>
								</subparagraph><subparagraph id="H8CE888BACCC045E9802B7D93DE3F65CB"><enum>(B)</enum><header>Community
				bank</header><text display-inline="yes-display-inline">The term <term>community
				bank</term> means any community bank with less than $10,000,000,000 in assets
				which is established and regulated under the laws of the United States or any
				State, territory, or possession of the United States, the District of Columbia,
				Commonwealth of Puerto Rico, Commonwealth of Northern Mariana Islands, Guam,
				American Samoa, or the United States Virgin Islands, and having significant
				operations in the United States, but excluding any central bank of, or
				institution owned by, a foreign government.</text>
								</subparagraph><subparagraph id="H219D0187278A46BAA5B89F16BBD79288"><enum>(C)</enum><header>Automotive
				company</header><text>The term <term>automotive company</term> means any person
				the majority of the gross receipts of which are derived from the research,
				design, production, or sale of personal or mass transportation vehicles or
				components for such vehicles.</text>
								</subparagraph></paragraph></subsection><subsection id="HA44197A1BC5A40128734C3DF61C53F3C"><enum>(c)</enum><header>Ineligibility
				for TARP assistance</header><text display-inline="yes-display-inline">In any
				corporation or partnership issues stock or any capital or profits interest
				during the 18-month period beginning on the date of the enactment of this
				section which results in the aggregate fair market value of all such stock and
				interests (determined, in each case, as of the date of issuance) issued by such
				corporation or partnership during such period to equal or exceed $500,000, such
				corporation or partnership shall not be eligible to receive any assistance
				under title I of the Emergency Economic Stabilization Act of 2008 after the
				date of such
				issuance.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H60EC864A16CD49F6B20372CEE6FE2B83"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections for part III of subchapter B of
			 chapter 1 of such Code is amended by inserting after the item relating to
			 section 139C the following new item:</text>

			</subsection><subsection id="HB228B128B35440D79EA052F21691BC63"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to property
			 acquired after the date of the enactment of this section.</text>
