<official-title>To direct the Administrator of the Federal Emergency Management Agency to establish a grant program to improve the ability of trauma center hospitals and airports to withstand earthquakes, and for other purposes.</official-title>

<section id="H1679C37EA8544F03AA07D8669DDA6F0D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Critical Infrastructure Earthquake Preparedness Act of 2010</short-title></quote>.</text></section> 
<section id="H77798B9A02244915B3D372205B6BE693"><enum>2.</enum><header>Grant program to assist trauma center hospitals and airports to withstand earthquakes</header> 
<subsection id="H69721C4ADACC40BAA267122DA4D08F9B"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator of the Federal Emergency Management Agency shall establish a program under which the Administrator is authorized to make grants to State and local governments to assist projects that improve the ability to withstand an earthquake of one or both of the following facilities:</text> 
<paragraph id="H6CD7C328EB374FFE8FC26DBEB0480812"><enum>(1)</enum><text>A trauma center hospital in a hazardous seismic zone.</text></paragraph> 
<paragraph id="HC77EC24F3F1A4DA0991EB32D1053EE67"><enum>(2)</enum><text>An airport in a hazardous seismic zone.</text></paragraph></subsection> 
<subsection id="H53DD89921F1A4129A420664A12D64044"><enum>(b)</enum><header>Grant priorities</header><text display-inline="yes-display-inline">In making a grant under subsection (a), the Administrator shall consider, with respect to a proposed project, the following:</text> 
<paragraph id="H3D1C91222BE5463E9A389C8F38B3697D"><enum>(1)</enum><text>The vulnerability to an earthquake of the facility to be improved.</text></paragraph> 
<paragraph id="H2510268F49494D01927AF5B5EB36605A"><enum>(2)</enum><text>The size of the population served by the facility to be improved.</text></paragraph> 
<paragraph id="H0DF204C4644F4EE38CC818392F43D7A6"><enum>(3)</enum><text>The availability of similar facilities in the area surrounding the facility to be improved.</text></paragraph> 
<paragraph id="H91492BE8F86A42C4A78119ADCE1BBD5D"><enum>(4)</enum><text>The ability to withstand an earthquake of the facility to be improved, if the proposed project is not carried out.</text></paragraph> 
<paragraph id="HA1D74F0F7A66424C8DF7F155B2E6B3C8"><enum>(5)</enum><text>The ability of the proposed project to be carried out without Federal assistance.</text></paragraph></subsection> 
<subsection id="H9888D9A637294CD09299AA37EE09BD55"><enum>(c)</enum><header>Federal share</header> 
<paragraph id="H2B22D4596F2E469C9E4D8D00C53ACDFD"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Federal share of the cost of a project carried out using grant funds made available under subsection (a) may not exceed 90 percent.</text></paragraph> 
<paragraph id="H20433752753549598574F50D56EF9E72"><enum>(2)</enum><header>Exception</header><text>The Administrator may treat, with respect to a project, the percentage specified in paragraph (1) as 100 percent, if—</text> 
<subparagraph id="H50351FDD703849848F4E164A5A40F4F6"><enum>(A)</enum><text>the Administrator determines there is substantial need for the project; and</text></subparagraph> 
<subparagraph id="H5EA13D80E75D4AC58F271A445A8B74A8"><enum>(B)</enum><text>the Administrator determines that the project will not otherwise be carried out.</text></subparagraph></paragraph></subsection> 
<subsection id="H5F59713FDC914587B6BAC9652A0C1F78"><enum>(d)</enum><header>Comprehensive strategic response plan</header><text display-inline="yes-display-inline">The Administrator shall require each State and local government that receives a grant under subsection (a), as a condition of the grant, to submit to the Administrator a comprehensive strategic earthquake response plan for the facility with respect to which the grant was made. Each State and local government may use not more than 5 percent of grant funds made available under subsection (a) to meet the requirement of this subsection.</text></subsection> 
<subsection id="H7FBCA7DDA1A54BD48B591719DA643B40"><enum>(e)</enum><header>Report on use of grant funds</header><text>The Administrator shall require each State and local government that receives a grant under subsection (a), as a condition of the grant, to submit to the Administrator each fiscal year during which grant funds are received a report that—</text> 
<paragraph id="H21DF73AFD16543BDA860B8197013025F"><enum>(1)</enum><text>lists and describes the activities carried out using grant funds; and</text></paragraph> 
<paragraph id="H2F833FEB0BC440269BA6C08680AE73E1"><enum>(2)</enum><text>describes and analyzes the impact of the activities.</text></paragraph></subsection> 
<subsection id="HB0B01207CB814B88AB705CA69FC86494"><enum>(f)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text> 
<paragraph id="HDD5E04A5113D4D5E996C41AC6A84C1E8"><enum>(1)</enum><header>Airport</header><text display-inline="yes-display-inline">The term <term>airport</term> has the meaning given that term under section 47102(2) of title 49, United States Code, except that the term is limited to airports located in the United States.</text> </paragraph> 
<paragraph id="HD0F84074C63547FBAF738CE575D6FD6D"><enum>(2)</enum><header>Hazardous seismic zone</header><text>The term <term>hazardous seismic zone</term> means an area determined by the Administrator, in consultation with the Director of the United States Geological Survey, to have a high probability of experiencing a severe earthquake.</text></paragraph> 
<paragraph id="HFF286CEC09294BB59BC3CFC0D7B01D71"><enum>(3)</enum><header>Trauma center hospital</header><text display-inline="yes-display-inline">The term <term>trauma center hospital</term> means a medical facility determined by the Administrator, in consultation with the Secretary of Health and Human Services, to—</text> 
<subparagraph id="H4B435A70D8A5479B872F76B8DF51207D"><enum>(A)</enum><text>provide surgical care to trauma patients;</text></subparagraph> 
<subparagraph id="H3CD950F5A9464BE6A17AE190195D6AB7"><enum>(B)</enum><text>be located in the United States;</text></subparagraph> 
<subparagraph id="HB19F307E062548C4B1819B46CB66C63C"><enum>(C)</enum><text display-inline="yes-display-inline">be obligated to treat all patients without regard to ability to pay; and</text></subparagraph> 
<subparagraph id="HE5B866B51E1C4FCB8BF84801166D044D"><enum>(D)</enum><text>provide care to more than 2,000 individuals admitted for shock trauma each year.</text> </subparagraph></paragraph></subsection> 
<subsection id="HDC95CEC01A1144A4BB3E92A420532AE4"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Administrator to carry out this section such sums as may be necessary.</text></subsection></section>
