<paragraph commented="no" display-inline="yes-display-inline" id="HFF7620A2C83A4AF3AFC03D77F156CE03"><enum>(1)</enum><text display-inline="yes-display-inline">Section 4007 of the Supplemental Appropriations Act, 2008 (Public Law 110–252; 26 U.S.C. 3304 note) is amended—</text>

<subsection id="HCC88A52240AB4DEEAB50B1A2EB2226B8"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect as if included in the enactment of the Temporary Extension Act of 2010 (Public Law 111–144).</text></subsection></section>

<subsection id="HE92A26E7408045E0A31E8DA76A0DBD12"><enum>(a)</enum><header>Extension of eligibility period</header><text>Subsection (a)(3)(A) of section 3001 of division B of the American Recovery and Reinvestment Act of 2009 (Public Law 111–5), as amended by section 3(a) of the Temporary Extension Act of 2010 (Public Law 111–144), is amended by striking <quote>March 31, 2010</quote> and inserting <quote>May 31, 2010</quote>.</text></subsection> 
<subsection id="H192DE52ED35E44FBBC056B8A16F9537A"><enum>(b)</enum><header>Rules relating to 2010 extension</header><text>Subsection (a) of section 3001 of division B of the American Recovery and Reinvestment Act of 2009 (Public Law 111–5), as amended by section 3(b) of the Temporary Extension Act of 2010 (Public Law 111–144), is amended by adding at the end the following:</text>

<paragraph id="H42C2CD3BFE4541AEBE8EE4879AD1F2A0"><enum>(18)</enum><header>Rules related to April and May 2010 extension</header><text>In the case of an individual who, with regard to coverage described in paragraph (10)(B), experiences a qualifying event related to a termination of employment on or after April 1, 2010 and prior to the date of the enactment of this paragraph, rules similar to those in paragraphs (4)(A) and (7)(C) shall apply with respect to all continuation coverage, including State continuation coverage programs.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDF6187174D674908AF0D661265DE5BD1"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect as if included in the provisions of section 3001 of division B of the American Recovery and Reinvestment Act of 2009.</text></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="HEFEBACFF2B5149558E7570E89D534536" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Increase in the Medicare physician payment update</header><text display-inline="no-display-inline">Paragraph (10) of section 1848(d) of the Social Security Act, as added by section 1011(a) of the Department of Defense Appropriations Act, 2010 (Public Law 111–118) and as amended by section 5 of the Temporary Extension Act of 2010 (Public Law 111–144), is amended—</text>

<subsection commented="no" display-inline="no-display-inline" id="H1CA7436BB41A44B29619A54C40C85D75"><enum>(a)</enum><header display-inline="yes-display-inline">Qualification for clinic-based physicians</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H45B2C97F2C3A4BB996511455E5F86AF6"><enum>(1)</enum><header display-inline="yes-display-inline">Medicare</header><text display-inline="yes-display-inline">Section 1848(o)(1)(C)(ii) of the Social Security Act (42 U.S.C. 1395w–4(o)(1)(C)(ii)) is amended by striking <quote>setting (whether inpatient or outpatient)</quote> and inserting <quote>inpatient or emergency room setting</quote>.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HEEE55BD403CF4786BB3BF6DC25A4D798"><enum>(2)</enum><header display-inline="yes-display-inline">Medicaid</header><text display-inline="yes-display-inline">Section 1903(t)(3)(D) of the Social Security Act (42 U.S.C. 1396b(t)(3)(D)) is amended by striking <quote>setting (whether inpatient or outpatient)</quote> and inserting <quote>inpatient or emergency room setting</quote>.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H1B9C6DFDCF7C4C74B3741D7DA950A29C"><enum>(b)</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall be effective as if included in the enactment of the HITECH Act (included in the American Recovery and Reinvestment Act of 2009 (Public Law 111–5)).</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H922B6385FFB34A54B753FF864EC631EA"><enum>(c)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary of Health and Human Services may implement the amendments made by this section by program instruction or otherwise.</text></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="HB51AE4DCBB194908B3E13F2F0292FA0E" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Extension of use of 2009 poverty guidelines</header><text display-inline="no-display-inline">Section 1012 of the Department of Defense Appropriations Act, 2010 (Public Law 111–118), as amended by section 7 of the Temporary Extension Act of 2010 (Public Law 111–144), is amended by striking <quote>March 31, 2010</quote> and inserting <quote>May 31, 2010</quote>.</text></section> 
<section commented="no" display-inline="no-display-inline" id="H612DB4C8EA3948FB86EB655FCCA4C89B" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Extension of national flood insurance program</header> 
<subsection commented="no" display-inline="no-display-inline" id="H8AEBFBC190ED490CAE4648A77CC41F1D"><enum>(a)</enum><header display-inline="yes-display-inline">Extension</header><text display-inline="yes-display-inline">Section 129 of the Continuing Appropriations Resolution, 2010 (Public Law 111–68), as amended by section 8 of Public Law 111–144, is amended by striking <quote>by substituting</quote> and all that follows through the period at the end and inserting <quote>by substituting May 31, 2010, for the date specified in each such section.</quote>.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HBAE19EB23B1948BCA4022DB82E44A9D0"><enum>(b)</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall be considered to have taken effect on February 28, 2010.</text></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="H7D18CF188755441F8AA1E61E6DFBDD8C" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Compensation and ratification of authority related to lapse in highway programs</header> 
<subsection commented="no" display-inline="no-display-inline" id="H325AAF3171E34EF1BAECBEE8D63E3E27"><enum>(a)</enum><header display-inline="yes-display-inline">Compensation for Federal employees</header><text display-inline="yes-display-inline">Any Federal employees furloughed as a result of the lapse in expenditure authority from the Highway Trust Fund after 11:59 p.m. on February 28, 2010, through March 2, 2010, shall be compensated for the period of that lapse at their standard rates of compensation, as determined under policies established by the Secretary of Transportation.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H26E49DF19B294874A951DDA20191AB3D"><enum>(b)</enum><header display-inline="yes-display-inline">Ratification of essential actions</header><text display-inline="yes-display-inline">All actions taken by Federal employees, contractors, and grantees for the purposes of maintaining the essential level of Government operations, services, and activities to protect life and property and to bring about orderly termination of Government functions during the lapse in expenditure authority from the Highway Trust Fund after 11:59 p.m. on February 28, 2010, through March 2, 2010, are hereby ratified and approved if otherwise in accord with the provisions of the Continuing Appropriations Resolution, 2010 (division B of Public Law 111–68).</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HEDBA0FAD32564B31AB815DB47C08B2FD"><enum>(c)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">Funds used by the Secretary to compensate employees described in subsection (a) shall be derived from funds previously authorized out of the Highway Trust Fund and made available or limited to the Department of Transportation by the Consolidated Appropriations Act, 2010 (Public Law 111–117) and shall be subject to the obligation limitations established in such Act.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H0911F919260742718269D59563732B57"><enum>(d)</enum><header display-inline="yes-display-inline">Expenditures from Highway Trust Fund</header><text display-inline="yes-display-inline">To permit expenditures from the Highway Trust Fund to effectuate the purposes of this section, this section shall be deemed to be a section of the Continuing Appropriations Resolution, 2010 (division B of Public Law 111–68), as in effect on the date of the enactment of the last amendment to such Resolution.</text></subsection></section>

<paragraph commented="no" display-inline="no-display-inline" id="HDFFACCE3000848A6BEA9B78466706263"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 119 of title 17, United States Code, is amended—</text>

<subsection id="H6AA2FA32C763409A83FAE36561BCC29C"><enum>(a)</enum><header>Appropriation</header><text>There is appropriated, out of any funds in the Treasury not otherwise appropriated, $80,000,000, for an additional amount for <quote>Small Business Administration—Business Loans Program Account</quote>, to remain available until expended, for the cost of fee reductions and eliminations under section 501 of division A of the American Recovery and Reinvestment Act of 2009 (Public Law 111–5; 123 Stat. 151) and loan guarantees under section 502 of division A of the American Recovery and Reinvestment Act of 2009 (Public Law 111–5; 123 Stat. 152), as amended by this section:<italic> Provided</italic>, That such costs shall be as defined in section 502 of the Congressional Budget Act of 1974.</text></subsection> 
<subsection id="H5B98F6E1C9D84FDABD5BCC97E49B5A46"><enum>(b)</enum><header>Extension of sunset date</header><text display-inline="yes-display-inline">Section 502(f) of division A of the American Recovery and Reinvestment Act of 2009 (Public Law 111–5; 123 Stat. 153) is amended by striking <quote>April 30, 2010</quote> and inserting <quote>May 31, 2010</quote>.</text></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="HD3BE9CE8A9F74EA29A90DF7CB132C908" section-type="subsequent-section"><enum>11.</enum><header display-inline="yes-display-inline">Sense of the Senate regarding a value added tax</header><text display-inline="no-display-inline">It is the sense of the Senate that the Value Added Tax is a massive tax increase that will cripple families on fixed income and only further push back America’s economic recovery and the Senate opposes a Value Added Tax.</text></section> 
<section commented="no" display-inline="no-display-inline" id="H30A706E666FA4647ABCC898F9DCBC234" section-type="subsequent-section"><enum>12.</enum><header display-inline="yes-display-inline">Determination of budgetary effects</header> 
<subsection commented="no" display-inline="no-display-inline" id="HC2B715E29147431AB444602466A30C65"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the Senate Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HDC220512CDAC4DED9F6641F7EE58AA12"><enum>(b)</enum><header display-inline="yes-display-inline">Emergency Designation for Congressional Enforcement</header><text display-inline="yes-display-inline">This Act, with the exception of section 4, is designated as an emergency for purposes of pay-as-you-go principles. In the Senate, this Act is designated as an emergency requirement pursuant to section 403(a) of S. Con. Res. 13 (111th Congress), the concurrent resolution on the budget for fiscal year 2010.<pagebreak/></text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HFDCCE9376E274794BEF003B312C5F155"><enum>(c)</enum><header display-inline="yes-display-inline">Emergency Designation for Statutory PAYGO</header><text display-inline="yes-display-inline">This Act, with the exception of section 4, is designated as an emergency requirement pursuant to section 4(g) of the Statutory Pay-As-You-Go Act of 2010 (Public Law 111–139; 2 U.S.C. 933(g)).</text></subsection></section>
