		<section id="H5E47AEA16FE04A0490F9D84613FB51A2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Victims of Crime Act Preservation Fund
			 Act of 2009</short-title></quote>.</text>
		</section><section id="H384BD7C894094E4FBD16F6906027F3A0"><enum>2.</enum><header>Exclusion of
			 Crime Victims Fund from all budgets</header><text display-inline="no-display-inline">Notwithstanding any other provision of law,
			 the receipts and disbursements of the Crime Victims Fund (established under
			 section 1402 of the Victims of Crime Act of 1984 (42 U.S.C. 10601)) shall not
			 be counted as new budget authority, outlays, receipts, or deficit or surplus
			 for purposes of—</text>
			<paragraph id="HB9CE5D31A35A4BE3BD7B7FF9B3AF4831"><enum>(1)</enum><text>the budget of the
			 United States Government, as submitted by the President; or</text>
			</paragraph><paragraph id="HD494964E170346F6BA6000AA00EF7429"><enum>(2)</enum><text>the congressional
			 budget.</text>
			</paragraph></section><section id="H3B67DDFA951545CF9D0777D5D20964E9"><enum>3.</enum><header>Lock-box
			 protection</header>
			<subsection id="HEFB2DA30387449C4A600DC2F5F363F5"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Notwithstanding any
			 other provision of law, it shall not be in order in the House of
			 Representatives or the Senate to consider any measure that would authorize the
			 use of, or appropriate, amounts in the Crime Victims Fund, established under
			 section 1402 of the Victims of Crime Act of 1984 (42 U.S.C. 10601), including
			 amounts in such Fund that are designated to remain in the Fund for obligation
			 in future fiscal years, for any purpose other than a purpose authorized under
			 such Act.</text>
			</subsection><subsection commented="no" id="H3326103E066C488E84191D54CF6023B8"><enum>(b)</enum><header>60-Vote waiver
			 required in the Senate</header>
				<paragraph commented="no" id="H8CE52F1400284E6E97BD0026E9A88F90"><enum>(1)</enum><header>In
			 general</header><text><internal-xref idref="HEFB2DA30387449C4A600DC2F5F363F5" legis-path="3.(a)">Subsection (a)</internal-xref> may be waived or suspended in
			 the Senate only by the affirmative vote of three-fifths of the Members, duly
			 chosen and sworn.</text>
				</paragraph><paragraph commented="no" id="H65896D7EF0514AE100ABA8D395C1D04"><enum>(2)</enum><header>Appeals</header>
					<subparagraph commented="no" id="H40654E3B03304018BE40645C75A4ACB5"><enum>(A)</enum><header>Procedure</header><text display-inline="yes-display-inline">Appeals in the Senate from the decisions of
			 the Chair relating to
			 <internal-xref idref="H8CE52F1400284E6E97BD0026E9A88F90" legis-path="3.(b)(1)">paragraph (1)</internal-xref> shall be limited to 1 hour,
			 to be equally divided between, and controlled by, the mover and the manager of
			 the measure that would authorize the payment or use of amounts in the Crime
			 Victims Fund for a purpose other than a purpose authorized under the Victims of
			 Crime Act of 1984 (42 U.S.C. 10601).</text>
					</subparagraph><subparagraph commented="no" id="H7268AB8814A24700A6D98D758F836C12"><enum>(B)</enum><header>60-Votes
			 required</header><text>An affirmative vote of three-fiths of the Members, duly
			 chosen and sworn, shall be required in the Senate to sustain an appeal of the
			 ruling of the Chair on a point of order raised in relation to
			 <internal-xref idref="H8CE52F1400284E6E97BD0026E9A88F90" legis-path="3.(b)(1)">paragraph (1)</internal-xref>.</text>
					</subparagraph></paragraph></subsection><subsection id="H2E77456A699E41A495E5FF042000521E"><enum>(c)</enum><header>Exercise of
			 rulemaking powers</header><text>This section is enacted by Congress—</text>
				<paragraph id="H359389BAE0CC4EB39CCCC3AF79357C2C"><enum>(1)</enum><text display-inline="yes-display-inline">as an exercise of the rulemaking power of
			 the House of Representatives and the Senate, respectively, and as such they
			 shall be considered as part of the rules of each House, respectively, or of
			 that House to which they specifically apply, and such rules shall supersede
			 other rules only to the extent that they are inconsistent therewith; and</text>
				</paragraph><paragraph id="H982FC72F69B7423D00FE5FCB7FE88982"><enum>(2)</enum><text display-inline="yes-display-inline">with full recognition of the constitutional
			 right of either House to change the rules (so far as relating to such House) at
			 any time, in the same manner, and to the same extent as in the case of any
			 other rule of that House.</text>
