		<official-title>To authorize the Secretary of Education to make grants to
		  local educational agencies to carry out teacher exchanges.</official-title>

		<section id="H94FBBA3038564E508883104478FD5851" section-type="section-one"><enum>1.</enum><header>Teacher exchange
			 program</header>
			<subsection id="H9FB5BB1407D74BABB78CD7B9E0ABF763"><enum>(a)</enum><header>Short
			 title</header><text display-inline="yes-display-inline">This Act may be cited
			 as the <quote><short-title>Teacher Exchange Act of
			 2010</short-title></quote>.</text>
			</subsection><subsection id="H2E08F15E42874EE68F697066B9052D94"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Education may make grants
			 to local educational agencies to carry out teacher exchanges in which one local
			 educational agency sends teachers to another local educational agency located
			 in a different geographic region for a school year.</text>
			</subsection><subsection id="H66BD4E78C5334FC0A2DF7A4C5A303D1A"><enum>(c)</enum><header>Eligibility</header><text>To
			 be eligible to receive a grant under this section, a local educational agency
			 shall submit an application to the Secretary certifying that such
			 agency—</text>
				<paragraph id="HFB0BACCEDB28409A96A175D7A69F4158"><enum>(1)</enum><text>has entered into a
			 partnership with a receiving local educational agency that is located in a
			 different geographic region, as determined by the Secretary, or has actively
			 sought such a partnership; and</text>
				</paragraph><paragraph id="H99BD9CEAD98042DA8C1F54D675A57CF3"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H0136C749F695471AAEE77836F0C25BA4"><enum>(A)</enum><text>is a high-need local
			 educational agency; or</text>
					</subparagraph><subparagraph id="HF72CF86E23B544B788FC503510C6CD4E" indent="up1"><enum>(B)</enum><text>has entered into a partnership
			 described in paragraph (1) with a high-need local educational agency, or has
			 actively sought such a partnership.</text>
					</subparagraph></paragraph></subsection><subsection id="H5202969234CB448D84585E7BFDB44350"><enum>(d)</enum><header>Use of
			 funds</header><text>The recipient of a grant under this section shall use the
			 grant for each of the following purposes:</text>
				<paragraph id="H5B6DDD1D266544A3AD766A1903F5F5FA"><enum>(1)</enum><text display-inline="yes-display-inline">Carrying out a teacher exchange under which
			 the recipient sends teachers employed by the recipient to a receiving local
			 educational agency to teach or perform a similar function at such agency as
			 such teachers had previously performed.</text>
				</paragraph><paragraph id="H4F470A3B17244FA9844161F841D4CE00"><enum>(2)</enum><text display-inline="yes-display-inline">Developing and implementing a plan, through
			 the partnership described in subsection (b), to provide participating teachers
			 with activities designed to promote professional development, including—</text>
					<subparagraph id="H5B615BF5BE654257A582AB73161F5FA2"><enum>(A)</enum><text>an orientation
			 session or courses to prepare such teachers for—</text>
						<clause id="H0154B51CEC2F425587B9D71C97C2FCE2"><enum>(i)</enum><text>the
			 exchange experience;</text>
						</clause><clause id="H28C951C632FA46DC93DEDEF52C957106"><enum>(ii)</enum><text>the
			 community in which the receiving local educational agency is located and the
			 schools in such agency; and</text>
						</clause><clause id="HFAAC28527CA24E26B2A1AE1C77342E18"><enum>(iii)</enum><text>the particular
			 grade level and curriculum assigned to the participating teacher by the
			 receiving local educational agency;</text>
						</clause></subparagraph><subparagraph display-inline="no-display-inline" id="HB3230D8C591345E3821DC3ED730FD37D"><enum>(B)</enum><text>a mentoring
			 program through which a participating teacher is paired with a mentor (who is
			 not also a participating teacher) employed by the receiving local educational
			 agency who teaches in the same grade level or subject area that the
			 participating teacher has been assigned to teach under the exchange;</text>
					</subparagraph><subparagraph display-inline="no-display-inline" id="HD2A3470B8E934F338FACB55D67EF686A"><enum>(C)</enum><text display-inline="yes-display-inline">a forum for participating teachers, led by
			 an administrator or teacher at the receiving local educational agency, to
			 engage in ongoing professional development focused on improving classroom
			 instruction to result in improved student outcomes, including reading
			 educational research, reviewing student work, creating and reviewing formative
			 and summative assessments, analyzing data from student assessments, and
			 tracking student progress; and</text>
					</subparagraph><subparagraph display-inline="no-display-inline" id="H00F97DAD60F94186B90F161BC360FA58"><enum>(D)</enum><text>content-specific
			 programs designed to support participating teachers in teaching the specific
			 curriculum in place at the receiving local education agency and at the grade
			 level to which the participating teacher is assigned.</text>
					</subparagraph></paragraph><paragraph id="H5B9BD3772F804B99AB08A6F2241E6CE3"><enum>(3)</enum><text display-inline="yes-display-inline">Reimbursing each participating teacher for
			 travel expenses incurred by the participating teacher while traveling to and
			 from the receiving local educational agency, not more than twice per calendar
			 year, for the purpose of participating in a teacher exchange funded by a grant
			 under this section.</text>
				</paragraph><paragraph id="H0EB18BDB351E49318783816F3DF41F7F"><enum>(4)</enum><text display-inline="yes-display-inline">Providing housing for participating
			 teachers while participating in such an exchange, including cost of living
			 increases as necessary to provide such housing.</text>
				</paragraph><paragraph id="H72E4E915FC17412EB68F097F0EA15EF6"><enum>(5)</enum><text>Providing a living
			 stipend to participating teachers that—</text>
					<subparagraph id="H2F3B1F4F68234993862F098455247383"><enum>(A)</enum><text>is added to the
			 regular salary of such teachers each pay period, for the duration of the
			 exchange; and</text>
					</subparagraph><subparagraph id="H3288777D0C2E4C27BAF9E38CC8D7BC02"><enum>(B)</enum><text>includes an annual
			 cost-of-living adjustment.</text>
					</subparagraph></paragraph><paragraph id="HB8839248C7BC490C845DBE540D0D492C"><enum>(6)</enum><text>Reimbursing the
			 receiving local educational agency for supplies or other incidental items
			 purchased for use by participating teachers during such an exchange.</text>
				</paragraph></subsection><subsection id="H7FBF65C362DB4D4DAB3055C8D15849EE"><enum>(e)</enum><header>Restriction</header><text display-inline="yes-display-inline">The recipient of a grant under this section
			 may not use the grant to pay the regular salary of participating teachers
			 during the period of an exchange funded by a grant under this section.</text>
			</subsection><subsection id="HCCB1D91C9604412FAC82CD2CC79BA1F0"><enum>(f)</enum><header>Conditions</header><text display-inline="yes-display-inline">As a condition of receiving a grant under
			 this section, a grant recipient shall—</text>
				<paragraph id="H44A984E5DD124A1EBE156732564ABD2B"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that each participating teacher in
			 an exchange funded under this section has at least three years of teaching
			 experience prior to participating in such exchange;</text>
				</paragraph><paragraph id="H17F5EEEED6EB40458D2927F907501B09"><enum>(2)</enum><text>certify that such
			 participation shall not serve as grounds for the grant recipient terminating
			 the employment of a participating teacher;</text>
				</paragraph><paragraph id="HBDB8EE4E162942E38E14F86C5CC12912"><enum>(3)</enum><text>ensure by contract
			 or agreement with each participating teacher that each teacher agrees to
			 serve—</text>
					<subparagraph id="HD7B76961845442BA9C7AE8CA95A7B53D"><enum>(A)</enum><text display-inline="yes-display-inline">in the receiving local educational agency
			 for a school year; and</text>
					</subparagraph><subparagraph id="HB77F2AC51328497E911DEC6B14E09FDC"><enum>(B)</enum><text display-inline="yes-display-inline">in the local educational agency that
			 selected such teacher for participation in the exchange for the duration of the
			 two-year period following such participation unless the Secretary, after
			 determining that the performance of such service poses a significant hardship
			 to the teacher, waives such condition;</text>
					</subparagraph></paragraph><paragraph id="HE4DCB694A84045419C02BC95613334B6"><enum>(4)</enum><text display-inline="yes-display-inline">certify that upon the failure of a
			 participating teacher to satisfy a condition specified in paragraph (3), the
			 grant recipient shall—</text>
					<subparagraph id="H6387479ED97546ED8ACABD914543EB45"><enum>(A)</enum><text display-inline="yes-display-inline">recover from such teacher the amount of the
			 grant funds that have been remitted to or on behalf of such teacher on a
			 pro-rata basis (as determined by the Secretary); and</text>
					</subparagraph><subparagraph id="H67F5FF3CD828450C911E6A733CB1FC29"><enum>(B)</enum><text>return the funds
			 recovered under subparagraph (A) to the Secretary not later than 60 days after
			 the recovery of such funds; and</text>
					</subparagraph></paragraph><paragraph id="H16B453EF6E1F4531AE109C5A1E261C4E"><enum>(5)</enum><text display-inline="yes-display-inline">if the recipient has not entered into an
			 agreement with a receiving local educational agency by the date that is 6
			 months after the date of the the receipt of the grant, return the grant to the
			 Secretary.</text>
				</paragraph></subsection><subsection id="HD1B40042E8C64BDFB72CFC5217B45A5A"><enum>(g)</enum><header>Selection
			 criteria</header><text display-inline="yes-display-inline">In awarding grants
			 under this section, the Secretary of Education shall give priority to local
			 educational agencies that—</text>
				<paragraph id="H9F644084D2CE476A85108FDF42FF0E74"><enum>(1)</enum><text>have entered into
			 partnerships with receiving local educational agencies before applying for a
			 grant under this section;</text>
				</paragraph><paragraph id="HAA66114168AD4EC7A2E47BDDC28C4EFB"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary determines would be able to
			 provide participating teachers with training or experience such teachers would
			 not receive from teaching in the local educational agency where such teachers
			 are employed, including immersion in a linguistically different culture;
			 and</text>
				</paragraph><paragraph id="HFE8F1DB9BCA84CFB864374F49EE2794D"><enum>(3)</enum><text>focus on
			 instruction in science, math, English as a second language, special education,
			 or other subject areas that have a high need for qualified teachers, as
			 determined by the Secretary.</text>
				</paragraph></subsection><subsection id="H5F6A224FE52343569107A7A4D9643BDC"><enum>(h)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="HC4360946150943908098887DF7D2A92C"><enum>(1)</enum><text>The term
			 <term>local educational agency</term> has the meaning given such term in
			 section 9101(26) of the Elementary and Secondary Education Act of 1965 (20
			 U.S.C. 7801(26)).</text>
				</paragraph><paragraph id="HDCCBAE91E9EE42F9B6771F9B77417DAD"><enum>(2)</enum><text>The term
			 <term>high-need local educational agency</term> means an agency as defined in
			 section 2102(2) of the Elementary and Secondary Act of 1965 (20 U.S.C.
			 6602(3)).</text>
				</paragraph><paragraph id="HE667BD11FEFA44B3A1D614BA3B118C50"><enum>(3)</enum><text>The term
			 <term>receiving local educational agency</term> means a local educational
			 agency to which a participating teacher will be sent for the duration of the
			 exchange funded by a grant under this section.</text>
				</paragraph></subsection></section><section id="H58E72CDDDB7D4929A11E77B32E55212A"><enum>2.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated $20,000,000 for each of fiscal years 2011 through
			 2016 to carry out this Act.</text>
