		  discrimination on the basis of sexual orientation or gender identity, to amend
		  the Civil Rights Act of 1964 to prohibit such discrimination in public

		<section id="H29D2C94721CD47B98D4898562BC0D095" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Housing Nondiscrimination Act of
			 2010</short-title></quote>.</text>
		</section><section id="HBE37EA22A1854D268455E31673F43ACB" section-type="subsequent-section"><enum>2.</enum><header>Amendments to Fair
			 Housing Act</header>
			<subsection id="H3B88E1B259D243A38207E936212807DD"><enum>(a)</enum><header>Housing sale and
			 rental, residential real-Estate-Related transactions, and brokerage
			 services</header><paragraph commented="no" display-inline="yes-display-inline" id="H5C0EF63438C048728A60BD36B1D54661"><enum>(1)</enum><text>Section 804 of the Civil
			 Rights Act of 1968 (42 U.S.C. 3604) is amended by striking <quote>sex,</quote>
			 each place it appears and inserting <quote>sex, sexual orientation, or gender
			 identity,</quote>.</text>
				</paragraph><paragraph id="idDF3A777C92FD4D5C8FA0DC7A2AE55733" indent="up1"><enum>(2)</enum><text>Section 805 of such Act (42 U.S.C.
			 3605) is amended by striking <quote>sex,</quote> each place it appears and
			 inserting <quote>sex, sexual orientation, or gender identity,</quote>.</text>
				</paragraph><paragraph id="idD19E98CBAF614D54B8BA3D00E64F3E8F" indent="up1"><enum>(3)</enum><text>Section 806 of such Act (42 U.S.C.
			 3606) is amended by striking <quote>sex,</quote> and inserting <quote>sex,
			 sexual orientation, or gender identity,</quote>.</text>
				</paragraph></subsection><subsection id="H713A382F92A741EDA1242261501FAA6A"><enum>(b)</enum><header>Prevention of
			 intimidation</header><text>Section 901 of the Civil Rights Act of 1968 (42
			 U.S.C. 3631) is amended by striking <quote>sex,</quote> each place it appears
			 and inserting <quote>sex, sexual orientation, gender identity,</quote>.</text>
			</subsection><subsection id="H4068F91ADEED40B083282D94C99A7974"><enum>(c)</enum><header>Definition</header><text>Section
			 802 of the Civil Rights Act of 1968 (42 U.S.C. 3602) is amended by adding at
			 the end the following:</text>
				<quoted-block id="H4563D32E22BB43F8B47E9D833A95F252" style="OLC">
					<subsection id="HE6DF40B4566B41A8BECF1459DD62D34E"><enum>(p)</enum><text><quote>Sexual
				orientation</quote> means homosexuality, heterosexuality, or
				bisexuality.</text>
					</subsection><subsection id="H8BFC2CDE8A2148B99C3BAAAFBA7FA76B"><enum>(q)</enum><text display-inline="yes-display-inline"><quote>Gender identity</quote> means the
				gender-related identity, appearance, or mannerisms or other gender-related
				characteristics of an individual, with or without regard to the individual's
				designated sex at
				birth.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H0FC28B3EA3774604BA6210D2B4C344F5"><enum>(d)</enum><header>Rule of
			 interpretation</header><text>Title VIII of the Civil Rights Act of 1968 (42
			 U.S.C. 3601 et seq.) is amended by adding at the end the following new
			 section:</text>
				<quoted-block id="H3792C135F2F0422493363C5EAB44BEB4" style="traditional">
					<section id="HCECECA40437F474CA2F8C37BD3E282D7"><enum>821.</enum><header>Rule of interpretation regarding sexual orientation or
		  gender identity</header><text display-inline="yes-display-inline">Nothing in this Act or in the Civil Rights
				Act of 1964 shall be construed to require any person to disclose a personal
				sexual orientation or gender
				identity.</text>
					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HE61D587B57484C9AAB5D1833D1591626"><enum>3.</enum><header>Public
			 accommodations</header><text display-inline="no-display-inline">Section 202 of
			 the Civil Rights Act of 1964 (42 U.S.C. 2000a–1) is amended by striking
			 <quote>national origin,</quote> and inserting <quote>national origin, sexual
			 orientation (as defined in section 802 of the Civil Rights Act of 1968), or
			 gender identity (as defined in section 802 of the Civil Rights Act of
			 1968),</quote>.</text>
		</section><section id="H653D4AF839EA4C9DA449183F8D1A96CA"><enum>4.</enum><header>Public
			 facilities</header><text display-inline="no-display-inline">Section 301 of the
			 Civil Rights Act of 1964 (42 U.S.C. 2000b) is amended by striking
			 <quote>national origin,</quote> and inserting <quote>national origin, sexual
			 orientation (as defined in section 802 of the Civil Rights Act of 1968), or
			 gender identity (as defined in section 802 of the Civil Rights Act of
			 1968),</quote>.</text>
		</section><section id="HC226B903209F4DA184C991F63E46590B"><enum>5.</enum><header>Effective Date
			 and Initial Rulemaking</header>
			<subsection id="HC7B7500AE5A44D988BA71F07E53B679B"><enum>(a)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">This Act and the
			 amendments made by this Act shall take effect on the 180th day beginning after
			 the date of the enactment of this Act.</text>
			</subsection><subsection id="H5E16003716344D588612989A0006B4EB"><enum>(b)</enum><header>Initial
			 rulemaking</header><text display-inline="yes-display-inline">In consultation
			 with other appropriate Federal agencies, the Secretary of Housing and Urban
			 Development shall, not later than the 180th day after the date of the enactment
			 of this Act, issue rules to implement title VIII of the Fair Housing Act as
			 amended by this Act. The Secretary shall give public notice and opportunity for
			 comment with respect to such rules.</text>
