<official-title display="yes">To amend the Public Health Service Act to provide for human stem cell research, including human embryonic stem cell research, and for other purposes.</official-title>

<section display-inline="no-display-inline" id="H17D7E982C1094246AEDB6E2B4413FC90" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stem Cell Research Advancement Act of 2009</short-title></quote>.</text></section> 
<section id="H81E8E3C4789A49899A453659201F66A6"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text> 
<paragraph id="HB233034636954E559D6DCF087573F904"><enum>(1)</enum><text>On March 9, 2009, President Barack Obama issued Executive Order 13505, entitled <quote>Removing Barriers to Responsible Scientific Research Involving Human Stem Cells</quote>.</text></paragraph> 
<paragraph id="H2AAF137F8FBB451DA9AC21BA0E2E5C8E"><enum>(2)</enum><text>On July 7, 2009, the National Institutes of Health issued guidelines on human stem cell research.</text></paragraph> 
<paragraph id="H4CBB82BBD7BB454DA22FC58D9EB8EA54"><enum>(3)</enum><text>The scientific field of stem cell research is continually advancing.</text></paragraph></section> 
<section id="H83325EF6DCDA4E188548EA173D69FD4C"><enum>3.</enum><header>Human stem cell research</header><text display-inline="no-display-inline">Part H of title IV of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C. 289 et seq.) is amended by inserting after section 498C the following:</text> 
<quoted-block act-name="Public Health Service Act" id="HFAB5B5F8EBF347FFA5F4733CF82BAFE1" style="OLC"> 
<section id="HF6363E00612942CCBF3B65315F3ED540"><enum>498D.</enum><header>Human stem cell research</header> 
<subsection id="H894846A768F447629B81F37739B48827"><enum>(a)</enum><header>In General</header><text>Notwithstanding any other provision of law, the Secretary shall conduct and support research that utilizes human stem cells, including human embryonic stem cells.</text></subsection> 
<subsection id="H728B43EB434049449F5E6FD81ED4102C"><enum>(b)</enum><header>Eligibility</header><text>Human embryonic stem cells eligible for use in research under subsection (a) shall include stem cells that meet each of the following:</text> 
<paragraph id="HA5AECE0F8F5C4625A2FB3E1CEF57F4E9"><enum>(1)</enum><text>The stem cells were derived from human embryos that have been donated from in vitro fertilization clinics, were created for the purposes of reproductive treatment, and were in excess of the clinical need of the individuals seeking such treatment.</text></paragraph> 
<paragraph id="H0021ABA70C9741958C6B9637AF257F5E"><enum>(2)</enum><text display-inline="yes-display-inline">It was determined through consultation with the individuals seeking reproductive treatment that the embryos to be donated would never be implanted in a woman and would otherwise be discarded.</text></paragraph> 
<paragraph id="HE201D2F0702644BD9B2492461E95BE85"><enum>(3)</enum><text>The individuals seeking reproductive treatment donated the embryos with written informed consent and without receiving any financial or other inducements to make the donation.</text></paragraph></subsection> </section> 
<section id="H413F67B08B7A40B9ACFB49CD22E8F729"><enum>498E.</enum><header>Guidelines</header><text display-inline="no-display-inline">The Secretary, in consultation with the Director of NIH, shall—</text> 
<paragraph id="HE4C98C8DADBF44888A21FB09ED6A2D2D"><enum>(1)</enum><text>maintain guidelines applicable to the conduct or support of human stem cell research by the Department of Health and Human Services;</text></paragraph> 
<paragraph id="H8177C5DF18D34EE8AEDC45596AA8D102"><enum>(2)</enum><text>review such guidelines not less than every 3 years; and</text></paragraph> 
<paragraph id="H26C169A5C54940B781CC83364BD72A9D"><enum>(3)</enum><text>update such guidelines as scientifically warranted.</text></paragraph></section> 
<section id="H67280A50418B423BBA8C26198AE377E2" commented="no"><enum>498F.</enum><header>Prohibition against funding for human cloning</header> 
<subsection id="H5A5AC34D55484D048580BE8FF194B67E" commented="no"><enum>(a)</enum><header>Prohibition</header><text>The Secretary shall not use any funds for the conduct or support of human cloning.</text></subsection> 
<subsection id="H07861AAB0A5F468392DF965D864BEB7F"><enum>(b)</enum><header>Guidelines</header><text>The Secretary shall update the guidelines maintained under section 498E for consistency with subsection (a).</text></subsection> 
<subsection id="H30A893A3AEF54DC4A9D87CA8B1980DD3" commented="no"><enum>(c)</enum><header>Definitions</header><text>In this section, the term <term>human cloning</term> means the implantation of the product of transferring the nuclear material of a human somatic cell into an egg cell from which the nuclear material has been removed or rendered inert into a uterus or the functional equivalent of a uterus.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HDA9A127FEAE24B3FA673527875066E66"><enum>4.</enum><header>Reporting requirements</header><text display-inline="no-display-inline">Section 403(a)(5) of the Public Health Service Act (42 U.S.C. 283(a)(5)) is amended—</text> 
<paragraph id="H940BF0F4B2AD4742A7BBBF3B50B31EE1"><enum>(1)</enum><text>by redesignating subparagraph (L) as (M); and</text></paragraph> 
<paragraph id="HD4264E7E05F4494BA841AF236550BC63"><enum>(2)</enum><text>by inserting after subparagraph (K) the following:</text>
