			 <quote><short-title>Formaldehyde Standards for Composite
			 Wood Products Act</short-title></quote>.</text>
		</section><section id="HDBD3CFD427034C27A1AABE69BAAF345A"><enum>2.</enum><header>Formaldehyde standards
			 for composite wood products</header>
			<subsection id="HF03D39093098475F8EF2D2DA430641CF"><enum>(a)</enum><header>Amendment</header><text>The
			 Toxic Substances Control Act (15 U.S.C. 2601 et seq.) is amended by adding at
			 the end the following:</text>

				FOR COMPOSITE WOOD PRODUCTS</header>
						<section id="HBBCCAAA4F84242E2A9A831C9242EAD73"><enum>601.</enum><header>Formaldehyde
				standards</header>
							<subsection id="HEEB14EDC6D764E4FAB11D36B4F97A2AF"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="HA60946FC9E1E4DC39F326165F43805CD"><enum>(1)</enum><header>Finished good</header>
									<subparagraph id="HA637E4629EE64B7993F46C207C3B175C"><enum>(A)</enum><header>In
				general</header><text>The term <quote>finished good</quote> means any good or
				product (other than a panel) containing—</text>
										<clause id="H2F32E87A1D5B4231837F7E9CD2944D5D"><enum>(i)</enum><text>hardwood plywood;</text>
										</clause><clause id="H33531B86FF594A828CCD17D672DC219D"><enum>(ii)</enum><text>particleboard; or</text>
										</clause><clause id="H1ED5F87EC50D428A8D94270DA0D14E7B"><enum>(iii)</enum><text>medium-density
				fiberboard.</text>
										</clause></subparagraph><subparagraph id="HF3AF984C2D234D26A992952DE61DC391"><enum>(B)</enum><header>Exclusions</header><text>The
				term <quote>finished good</quote> does not include—</text>
										<clause id="HB07C70BE6C0741DCBAA21BFD31C3F694"><enum>(i)</enum><text>any component part or
				other part used in the assembly of a finished good; or</text>
										</clause><clause id="H8FCA35A499054AE78F9ECC279C60AE8B"><enum>(ii)</enum><text>any finished good that
				has previously been sold or supplied to an individual or entity that purchased
				or acquired the finished good in good faith for purposes other than resale,
				such as—</text>
											<subclause id="HA31C41125B304F45A84E3A1A5507398E"><enum>(I)</enum><text>an antique; or</text>
											</subclause><subclause id="HF349659BFE3C45C4BE3FA6EF93E11E77"><enum>(II)</enum><text>secondhand
				furniture.</text>
											</subclause></clause></subparagraph></paragraph><paragraph id="H009E618019E141CB93D518D06070CB0D"><enum>(2)</enum><header>Hardboard</header><text>The
				term <quote>hardboard</quote> has such meaning as the Administrator shall
				establish, by regulation, pursuant to subsection (d).</text>
								</paragraph><paragraph id="HEBD399482DA44246B69CE3CCAE700260"><enum>(3)</enum><header>Hardwood
				plywood</header>
									<subparagraph id="H7CDB2E954AFC49A4993219A0C5368AB2"><enum>(A)</enum><header>In
				general</header><text>The term <quote>hardwood plywood</quote> means a hardwood
				or decorative panel that is—</text>
										<clause id="H6EE058965536436D94D042D33E899B00"><enum>(i)</enum><text>intended for interior
				use; and</text>
										</clause><clause id="H8B1703292C3E444592AC11684C5C5D29"><enum>(ii)</enum><text>composed of (as
				determined under the standard numbered ANSI/HPVA HP–1–2009) an assembly of
				layers or plies of veneer, joined by an adhesive with—</text>
											<subclause id="HE1AFF47F86D640C9BD85D2A5171475CD"><enum>(I)</enum><text>lumber core;</text>
											</subclause><subclause id="HFCD7C2BF978048E5812A2C768A896C98"><enum>(II)</enum><text>particleboard
				core;</text>
											</subclause><subclause id="H916F46E6BBF1490EA5E9292FD8D1A1F7"><enum>(III)</enum><text>medium-density
				fiberboard core;</text>
											</subclause><subclause id="H630050D07C914B328FBD9DE012170392"><enum>(IV)</enum><text>hardboard core;
				or</text>
											</subclause><subclause id="H1810F5205BCE4792A3B8CA76E81C7ECC"><enum>(V)</enum><text>any other special core or
				special back material.</text>
											</subclause></clause></subparagraph><subparagraph id="HB4B4EF92499F4BDB82DC67BB5D9A018D"><enum>(B)</enum><header>Exclusions</header><text>The
				term <quote>hardwood plywood</quote> does not include—</text>
										<clause id="H2D0DA28775F649809F995F1B30CBA764"><enum>(i)</enum><text>military-specified
				plywood;</text>
										</clause><clause id="HA9AA5ACB888C4B6FBCF9F246D465D918"><enum>(ii)</enum><text>curved plywood;
				or</text>
										</clause><clause id="HCA37F14163F64B8D906E47913AE29C6C"><enum>(iii)</enum><text>any other product
				specified in—</text>
											<subclause id="H8CEAA4221567401EB4FFD271FB82CFBE"><enum>(I)</enum><text display-inline="yes-display-inline">the standard entitled <quote>Voluntary
				Product Standard–Structural Plywood</quote> and numbered PS 1–07; or</text>
											</subclause><subclause id="HB396234282F2466886251538F3A7395D"><enum>(II)</enum><text>the standard entitled
				<quote>Voluntary Product Standard–Performance Standard for Wood-Based
				Structural-Use Panels</quote> and numbered PS 2–04.</text>
											</subclause></clause></subparagraph><subparagraph id="HB0A2CC4DCC8F4D298ACC9C6EF7A5764F"><enum>(C)</enum><header>Laminated
				products</header>
										<clause id="H0ED118467ECA497C9B2DD1AB0FDBCE5D"><enum>(i)</enum><header>Rulemaking</header>
											<subclause id="H5F9DB7050A6B42DB94716B56F38CBFA2"><enum>(I)</enum><header>In
				general</header><text>The Administrator shall conduct a rulemaking process
				pursuant to subsection (d) that uses all available and relevant information
				from State authorities, industry, and other available sources of such
				information, and analyzes that information to determine, at the discretion of
				the Administrator, whether the definition of the term <quote>hardwood
				plywood</quote> should exempt engineered veneer or any laminated
				product.</text>
											</subclause><subclause id="HE6F0318239BA43A68591750491036098"><enum>(II)</enum><header>Modification</header><text>The
				Administrator may modify any aspect of the definition contained in clause (ii)
				before including that definition in the regulations promulgated pursuant to
				subclause (I).</text>
											</subclause></clause><clause id="HE9D8BC8ACD5E4C7A8564775408BE7FB6"><enum>(ii)</enum><header>Laminated
				product</header><text>The term <quote>laminated product</quote> means a
				product—</text>
											<subclause id="H43ADCB4C206047B8A2B68B0C481F4934"><enum>(I)</enum><text>in which a wood veneer is
				affixed to—</text>
												<item id="H81137D9CE0E7454696BA9F07489AF17B"><enum>(aa)</enum><text>a particleboard
				platform;</text>
												</item><item id="H79ADCD81987A4A86A051B45E1974C047"><enum>(bb)</enum><text>a medium-density
				fiberboard platform; or</text>
												</item><item id="H9DE5F4DA59EB49D1B141AD88C84FB706"><enum>(cc)</enum><text>a veneer-core platform;
				and</text>
												</item></subclause><subclause id="H102E3408FEE84C2B86B639A5C07125E9"><enum>(II)</enum><text>that is—</text>
												<item id="HB8130E3928E148E0AFEFEE3B00B96814"><enum>(aa)</enum><text>a component part;</text>
												</item><item id="H83D9A7731A8A4D37BFEBB1C16C98A0B2"><enum>(bb)</enum><text>used in the construction
				or assembly of a finished good; and</text>
												</item><item id="HDF1F0FC5751D48B7873048733D46819E"><enum>(cc)</enum><text>produced by the
				manufacturer or fabricator of the finished good in which the product is
				incorporated.</text>
												</item></subclause></clause></subparagraph></paragraph><paragraph id="H4D7EA77F26AE4518A20F065498DF1448"><enum>(4)</enum><header>Manufactured
				home</header><text>The term <quote>manufactured home</quote> has the meaning
				given the term in section 3280.2 of title 24, Code of Federal Regulations (as
				in effect on the date of promulgation of regulations pursuant to subsection
				(d)).</text>
								</paragraph><paragraph id="H6F254D9A2640477E859496705654881D"><enum>(5)</enum><header>Medium-density
				fiberboard</header><text>The term <quote>medium-density fiberboard</quote>
				means a panel composed of cellulosic fibers made by dry forming and pressing a
				resinated fiber mat (as determined under the standard numbered ANSI
				A208.2–2009).</text>
								</paragraph><paragraph id="HFAC9003027A94B1E9B95EFAFF98F5FB9"><enum>(6)</enum><header>Modular
				home</header><text>The term <quote>modular home</quote> means a home that is
				constructed in a factory in 1 or more modules—</text>
									<subparagraph id="HE44945B72BA542C58DD92CE121926FB5"><enum>(A)</enum><text>each of which meet
				applicable State and local building codes of the area in which the home will be
				located; and</text>
									</subparagraph><subparagraph id="H2DB1C5927A784DB8B186EEDAF13EDBC3"><enum>(B)</enum><text>that are transported to
				the home building site, installed on foundations, and completed.</text>
									</subparagraph></paragraph><paragraph id="H99C291C4286E49B58E45662118868C47"><enum>(7)</enum><header>No-added
				formaldehyde-based resin</header>
									<subparagraph id="H08EEAF6219924156BB24B3C6F06D77EF"><enum>(A)</enum><header>In
				general</header><clause commented="no" display-inline="yes-display-inline" id="H298B70D486B14D3A9287FC7D511B141B"><enum>(i)</enum><text display-inline="yes-display-inline">The term <quote>no-added formaldehyde-based
				resin</quote> means a resin formulated with no added formaldehyde as part of
				the resin cross-linking structure in a composite wood product that meets the
				emission standards in subparagraph (C) as measured by—</text>
											<subclause changed="added" committee-id="HIF00" id="HCCE66BE5E42346CEADA56D166D405E1F" indent="up1" reported-display-style="italic"><enum>(I)</enum><text display-inline="yes-display-inline">one test conducted pursuant to test method
				ASTM E-1333-96 (2002) or, subject to clause (ii), ASTM D-6007-02; and</text>
											</subclause><subclause changed="added" committee-id="HIF00" id="H54D97613349E4ADC8144285EB10E55C8" indent="up1" reported-display-style="italic"><enum>(II)</enum><text>3 months of routine
				quality control tests pursuant to ASTM D-6007-02 or ASTM D-5582 or such other
				routine quality control test methods as may be established by the Administrator
				through rulemaking.</text>
											</subclause></clause><clause changed="added" committee-id="HIF00" id="H4725E9A05593426D8F8C4465C100A25E" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>Test results obtained
				under clause (i)(I) or (II) by any test method other than ASTM E-1333-96 (2002)
				must include a showing of equivalence by means established by the Administrator
				through rulemaking.</text>
										</clause></subparagraph><subparagraph id="HA62614B4742B45968F3B59CE10C497A8"><enum>(B)</enum><header>Inclusions</header><text>The
				term <quote>no-added formaldehyde-based resin</quote> may include any resin
				made from—</text>
										<clause id="HE6D234601C404497A7E4EA6B5E976BE4"><enum>(i)</enum><text>soy;</text>
										</clause><clause id="HC2DE87E477B24F36ACD25697D3B8353C"><enum>(ii)</enum><text>polyvinyl acetate;
				or</text>
										</clause><clause id="H9EB6A8EFDDC24D9FAAE550099E5AB7B0"><enum>(iii)</enum><text>methylene
				diisocyanate.</text>
										</clause></subparagraph><subparagraph display-inline="no-display-inline" id="HFBD850BDD93F4D619D787805BB4043DD"><enum>(C)</enum><header>Emission
				standards</header><text>The following are the emission standards for composite
				wood products made with no-added formaldehyde-based resins under this
				paragraph:</text>
										<clause id="H066E298BBF1745D69FE104208FF644B6"><enum>(i)</enum><text>No higher than 0.04 parts
				per million of formaldehyde for 90 percent of the 3 months of routine quality
				control testing data required under subparagraph (A)(ii).</text>
										</clause><clause id="HF91A15805B824BC180AA4C600B53B30A"><enum>(ii)</enum><text>No test result higher
				than 0.05 parts per million of formaldehyde for hardwood plywood and 0.06 parts
				per million for particleboard, medium-density fiberboard, and thin
				medium-density fiberboard.</text>
										</clause></subparagraph></paragraph><paragraph id="HB6A7F37673F147E4AAB75DA297A52877"><enum>(8)</enum><header>Particleboard</header>
									<subparagraph id="HCC99546B40AF47B685D9B505C4A7936E"><enum>(A)</enum><header>In
				general</header><text>The term <quote>particleboard</quote> means a panel
				composed of cellulosic material in the form of discrete particles (as
				distinguished from fibers, flakes, or strands) that are pressed together with
				resin (as determined under the standard numbered ANSI A208.1–2009).</text>
									</subparagraph><subparagraph id="H688BB6225FAB4B0BAC1703D5830FAB46"><enum>(B)</enum><header>Exclusions</header><text>The
				term <quote>particleboard</quote> does not include any product specified in the
				standard entitled <quote>Voluntary Product Standard–Performance Standard for
				Wood-Based Structural-Use Panels</quote> and numbered PS 2–04.</text>
									</subparagraph></paragraph><paragraph id="HD67FE7BCE00D4BEF80EF0827512A46F6"><enum>(9)</enum><header>Recreational
				vehicle</header><text>The term <quote>recreational vehicle</quote> has the
				meaning given the term in section 3282.8 of title 24, Code of Federal
				Regulations (as in effect on the date of promulgation of regulations pursuant
				to subsection (d)).</text>
								</paragraph><paragraph id="HE65CF3B33FE14600948A680DF5FBDD84"><enum>(10)</enum><header>Ultra low-emitting
				formaldehyde resin</header>
									<subparagraph id="H24619D62777F469FBD10A22CA6E78A48"><enum>(A)</enum><header>In
				general</header><clause commented="no" display-inline="yes-display-inline" id="HC942AF0B465E4E66823836C80CA58EEF"><enum>(i)</enum><text display-inline="yes-display-inline">The term <quote>ultra low-emitting
				formaldehyde resin</quote> means a resin in a composite wood product that meets
				the emission standards in subparagraph (C) as measured by—</text>
											<subclause changed="added" committee-id="HIF00" id="H7ABEED57DF024831AA1F631CAF35850A" indent="up1" reported-display-style="italic"><enum>(I)</enum><text display-inline="yes-display-inline">2 quarterly tests conducted pursuant to
				test method ASTM E-1333-96 (2002) or, subject to clause (ii), ASTM D-6007-02;
				and</text>
											</subclause><subclause changed="added" committee-id="HIF00" id="H49B0F167382E4A9A856CCAE4E469DDA5" indent="up1" reported-display-style="italic"><enum>(II)</enum><text>6 months of routine
				quality control tests pursuant to ASTM D-6007-02 or ASTM D-5582 or such other
				routine quality control test methods as may be established by the Administrator
				through rulemaking.</text>
											</subclause></clause><clause changed="added" committee-id="HIF00" id="HFF089EA35DFA48C0B935E51B78C9BE60" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text display-inline="yes-display-inline">Test results obtained under clause (i)(I)
				or (II) by any test method other than ASTM E-1333-96 (2002) must include a
				showing of equivalence by means established by the Administrator through
				rulemaking.</text>
										</clause></subparagraph><subparagraph id="H754EDC689F114E3D957C28F000589970"><enum>(B)</enum><header>Inclusions</header><text>The
				term <quote>ultra low-emitting formaldehyde resin</quote> may include—</text>
										<clause id="HBA1798DEE6AF48FFAABAA31B25223AFB"><enum>(i)</enum><text>melamine-urea-formaldehyde
				resin;</text>
										</clause><clause id="H1D835AAE971B43E3BB77F6689C6FEE8E"><enum>(ii)</enum><text>phenol formaldehyde
				resin; and</text>
										</clause><clause id="H61361D4723DE4016B1BFABCBE23BE8E9"><enum>(iii)</enum><text>resorcinol formaldehyde
				resin.</text>
										</clause></subparagraph><subparagraph display-inline="no-display-inline" id="H3C30F6A72D4E4CF7A080E9498233909E"><enum>(C)</enum><header>Emission
				standards</header>
										<clause id="H1DF488AC061B43DABD06E9403EA57FBA"><enum>(i)</enum><text>The Administrator may,
				pursuant to regulations issued under subsection (d), reduce the testing
				requirements for a manufacturer only if its product made with ultra
				low-emitting formaldehyde resin meets the following emission standards:</text>
											<subclause id="HF98A9F264EB94CAF8ACAF3FEAE308A08"><enum>(I)</enum><text>For hardwood plywood, no
				higher than 0.05 parts per million of formaldehyde.</text>
											</subclause><subclause id="H6406C6C01D094C86AA48A58FA8E32DDB"><enum>(II)</enum><text>For medium-density
				fiberboard—</text>
												<item id="HE9D7173D22FC4590A42E82CBDA45A415"><enum>(aa)</enum><text>no higher than 0.06
				parts per million of formaldehyde for 90 percent of 6 months of routine quality
				control testing data required under subparagraph (A)(ii); and</text>
												</item><item id="HF7BB1C43C0654EC3B18173101DC9C1E7"><enum>(bb)</enum><text>no test result higher
				than 0.09 parts per million of formaldehyde.</text>
												</item></subclause><subclause id="H02DA40557CC047838F0E339E6AE30D63"><enum>(III)</enum><text>For
				particleboard—</text>
												<item id="H8033DD1EAE33474E8741520AF19460EE"><enum>(aa)</enum><text display-inline="yes-display-inline">no higher than 0.05 parts per million of
				formaldehyde for 90 percent of 6 months of routine quality control testing data
				required under subparagraph (A)(ii); and</text>
												</item><item id="H687B7FFE8B0844C1817EAA5B72085A50"><enum>(bb)</enum><text>no test result higher
				than 0.08 parts per million of formaldehyde.</text>
												</item></subclause><subclause id="HCA71145E1AAA4BE8B671AA8C6474956F"><enum>(IV)</enum><text>For thin medium-density
				fiberboard—</text>
												<item id="HCFB8CD0FAF9545F78027A7A0D5857225"><enum>(aa)</enum><text display-inline="yes-display-inline">no higher than 0.08 parts per million of
				formaldehyde for 90 percent of 6 months of routine quality control testing data
				required under subparagraph (A)(ii); and</text>
												</item><item id="H38F0D5E154BB4720BB14CF07B6275EBD"><enum>(bb)</enum><text>no test result higher
				than 0.11 parts per million of formaldehyde.</text>
												</item></subclause></clause><clause id="H3E7C1A363A5F4B18B483106199FBC32C"><enum>(ii)</enum><text display-inline="yes-display-inline">The Administrator may not, pursuant to
				regulations issued under subsection (d), exempt a manufacturer from third party
				certification requirements unless its product made with ultra low-emitting
				formaldehyde resin meets the following emission standards:</text>
											<subclause id="H00221D4EF6D64518B30268FD57CF96F3"><enum>(I)</enum><text display-inline="yes-display-inline">No higher than 0.04 parts per million of
				formaldehyde for 90 percent of 6 months of routine quality control testing data
				required under subparagraph (A)(ii).</text>
											</subclause><subclause id="H1758465710FC4FB7BF69E8EA8D53B4B5"><enum>(II)</enum><text>No test result higher
				than 0.05 parts per million of formaldehyde for hardwood plywood and 0.06 parts
				per million for particleboard, medium-density fiberboard, and thin
				medium-density fiberboard.</text>
											</subclause></clause></subparagraph></paragraph></subsection><subsection id="H4F7181BC045E41169F143C609F53F942"><enum>(b)</enum><header>Requirement</header>
								<paragraph id="H8669A172622346078940E3B3097F82B4"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided in
				an applicable sell-through regulation promulgated pursuant to subsection (d),
				effective beginning on the date that is 180 days after the date of promulgation
				of those regulations, the emission standards described in paragraph (2), shall
				apply to hardwood plywood, medium-density fiberboard, and particleboard sold,
				supplied, offered for sale, or manufactured in the United States.</text>
								</paragraph><paragraph display-inline="no-display-inline" id="HF6116199B60448969C17651BABB6D6D7"><enum>(2)</enum><header>Emission
				standards</header><text>The emission standards referred to in paragraph (1),
				based on test method ASTM E-1333-96 (2002), are as follows:</text>
									<subparagraph id="H1584E13E9A944A3DACF98C8BDB7C803B"><enum>(A)</enum><text>For hardwood plywood with
				a veneer core, 0.05 parts per million of formaldehyde.</text>
									</subparagraph><subparagraph id="H0B61D094CBF04422BF7EF49815FA1C52"><enum>(B)</enum><text>For hardwood plywood with
				a composite core—</text>
										<clause id="HAE34A7E733E64ED083606D5E6D231105"><enum>(i)</enum><text>0.08 parts per million of
				formaldehyde for any period after the effective date described in paragraph (1)
				and before July 1, 2012; and</text>
										</clause><clause id="H222ECB7B06D943FDABA02E8EE50907AF"><enum>(ii)</enum><text display-inline="yes-display-inline">0.05 parts per million of formaldehyde,
				effective on the later of the effective date described in paragraph (1) or July
				1, 2012.</text>
										</clause></subparagraph><subparagraph id="H713BC546C5174A6584703B5B134B7A22"><enum>(C)</enum><text>For medium-density
				fiberboard—</text>
										<clause id="HFFF184E701104A24ACF4B7AD103A7651"><enum>(i)</enum><text>0.21 parts per million of
				formaldehyde for any period after the effective date described in paragraph (1)
				and before July 1, 2011; and</text>
										</clause><clause id="HB3BC693873BF4B54BF2411A07BD584CE"><enum>(ii)</enum><text display-inline="yes-display-inline">0.11 parts per million of formaldehyde,
				effective on the later of the effective date described in paragraph (1) or July
				1, 2011.</text>
										</clause></subparagraph><subparagraph id="H81C46A4A384A4A5087FC264FA1CBB9D7"><enum>(D)</enum><text>For thin medium-density
				fiberboard—</text>
										<clause id="HD1BF7451289648DAA59AB51A391D4BD3"><enum>(i)</enum><text>0.21 parts per million of
				formaldehyde for any period after the effective date described in paragraph (1)
				and before July 1, 2012; and</text>
										</clause><clause id="HC8D3C4A800B2463BBB76E861B13C4CF9"><enum>(ii)</enum><text display-inline="yes-display-inline">0.13 parts per million of formaldehyde,
				effective on the later of the effective date described in paragraph (1) or July
				1, 2012.</text>
										</clause></subparagraph><subparagraph id="HB15CFFF6FA544A22A44E7C10F64A68B1"><enum>(E)</enum><text>For particleboard—</text>
										<clause id="H3DC3F3D75221443EB815B206C3D1BFED"><enum>(i)</enum><text>0.18 parts per million of
				formaldehyde for any period after the effective date described in paragraph (1)
				and before July 1, 2011; and</text>
										</clause><clause id="H539B61F2D1944D418EBCA5AFDD81ECBB"><enum>(ii)</enum><text display-inline="yes-display-inline">0.09 parts per million of formaldehyde,
				effective on the later of the effective date described in paragraph (1) or July
				1, 2011.</text>
										</clause></subparagraph></paragraph><paragraph id="HAD4EBEAC81F94D90ACB5AB7715F0E671"><enum>(3)</enum><header>Compliance with
				emission standards</header><subparagraph commented="no" display-inline="yes-display-inline" id="HAA5FD448FF6D4694936991228A7CCF1B"><enum>(A)</enum><text display-inline="yes-display-inline">Compliance with the emission standards
				described in paragraph (2) shall be measured by—</text>
										<clause changed="added" committee-id="HIF00" id="H70D8600FC4944AC98A8886DAD56EA183" indent="up1" reported-display-style="italic"><enum>(i)</enum><text display-inline="yes-display-inline">quarterly tests shall be conducted pursuant
				to test method ASTM E-1333-96 (2002) or, subject to subparagraph (B), ASTM
				D-6007-02; and</text>
										</clause><clause changed="added" committee-id="HIF00" id="H2FC5A5A25B164171868AA00A066EF172" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>quality control tests
				shall be conducted pursuant to ASTM D-6007-02, ASTM D-5582, or such other test
				methods as may be established by the Administrator through rulemaking.</text>
										</clause></subparagraph><subparagraph changed="added" committee-id="HIF00" id="H43AF5341503F4F42B2A99D1400658F2E" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">Test results obtained under subparagraph
				(A)(i) or (ii) by any test method other than ASTM E-1333-96 (2002) must include
				a showing of equivalence by means established by the Administrator through
				rulemaking.</text>
									</subparagraph><subparagraph changed="added" commented="no" committee-id="HIF00" id="H07876B9CD5DD42D6BA692D0CBF928FE3" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>Except where otherwise
				specified, the Administrator shall establish through rulemaking the number and
				frequency of tests required to demonstrate compliance with the emission
				standards.</text>
									</subparagraph></paragraph><paragraph id="H076D9188F99D4EBB8C52924F3D934378"><enum>(4)</enum><header>Applicability</header><text>The
				formaldehyde emission standard referred to in paragraph (1) shall apply
				regardless of whether an applicable hardwood plywood, medium-density
				fiberboard, or particleboard is—</text>
									<subparagraph id="HD4937EA248234604BE9155FBF8A369DA"><enum>(A)</enum><text>in the form of an
				unfinished panel; or</text>
									</subparagraph><subparagraph id="H8A835BADE02A49E0BAAA6F025C86AB84"><enum>(B)</enum><text>incorporated into a
				finished good.</text>
									</subparagraph></paragraph></subsection><subsection id="HD7B24FABB5B240408DABEC901DF0F237"><enum>(c)</enum><header>Exemptions</header><text>The
				formaldehyde emission standard referred to in subsection (b)(1) shall not apply
				to—</text>
								<paragraph id="H25A16761BAA14E9A876DF5A6B6F1D8E1"><enum>(1)</enum><text>hardboard;</text>
								</paragraph><paragraph id="H23B33AB5559542AFA436A1ACFFC4C6F2"><enum>(2)</enum><text display-inline="yes-display-inline">structural plywood, as specified in the
				standard entitled <quote>Voluntary Product Standard–Structural Plywood</quote>
				and numbered PS 1–07;</text>
								</paragraph><paragraph id="H142985C7D7B141D4B10E5CA53884E97A"><enum>(3)</enum><text>structural panels, as
				specified in the standard entitled <quote>Voluntary Product
				Standard–Performance Standard for Wood-Based Structural-Use Panels</quote> and
				numbered PS 2–04;</text>
								</paragraph><paragraph id="H2D1CD2F24DED4062B6450A08EF799722"><enum>(4)</enum><text>structural composite
				lumber, as specified in the standard entitled <quote>Standard Specification for
				Evaluation of Structural Composite Lumber Products</quote> and numbered ASTM D
				5456–06;</text>
								</paragraph><paragraph id="HCC4F280C9668469AA893B7F5D3532745"><enum>(5)</enum><text>oriented strand
				board;</text>
								</paragraph><paragraph id="HA46D9835911C4BDB94BB1C2E91929044"><enum>(6)</enum><text>glued laminated lumber,
				as specified in the standard entitled <quote>Structural Glued Laminated
				Timber</quote> and numbered ANSI A190.1–2002;</text>
								</paragraph><paragraph id="HC3E314AEEE764B0A9D1DEB797563440F"><enum>(7)</enum><text>prefabricated wood
				I-joists, as specified in the standard entitled <quote>Standard Specification
				for Establishing and Monitoring Structural Capacities of Prefabricated Wood
				I-Joists</quote> and numbered ASTM D 5055–05;</text>
								</paragraph><paragraph id="HEA634673474A4230A9AEEED6FDF3BCC6"><enum>(8)</enum><text>finger-jointed
				lumber;</text>
								</paragraph><paragraph id="H4C7E9D369D734E30AD47B69EF52C7772"><enum>(9)</enum><text>wood packaging (including
				pallets, crates, spools, and dunnage);</text>
								</paragraph><paragraph id="HA3CB38E222F04234A9DF79DFBC367CEF"><enum>(10)</enum><text>composite wood products
				used inside a new—</text>
									<subparagraph id="H3CE9B7A5C87143838475A1A0D54A80C8"><enum>(A)</enum><text>vehicle (other than a
				recreational vehicle) constructed entirely from new parts that has never
				been—</text>
										<clause id="H17DFC9DDDC804C9687024B8E8EABFB04"><enum>(i)</enum><text>the subject of a retail
				sale; or</text>
										</clause><clause id="H084191BE073242738F7CC1C05CFCD85B"><enum>(ii)</enum><text>registered with the
				appropriate State agency or authority responsible for motor vehicles or with
				any foreign state, province, or country;</text>
										</clause></subparagraph><subparagraph id="HE84A5D2FA2B14522B2FDBD94648C4C4E"><enum>(B)</enum><text>rail car;</text>
									</subparagraph><subparagraph id="HC1FCA6D1FADB44D88F2B33B71D826FDF"><enum>(C)</enum><text>boat;</text>
									</subparagraph><subparagraph id="H230FE0861EC544B481B327495B087F62"><enum>(D)</enum><text>aerospace craft;
				or</text>
									</subparagraph><subparagraph id="HD534576C5D73471D91E4B683CC7C5B27"><enum>(E)</enum><text>aircraft;</text>
									</subparagraph></paragraph><paragraph id="HBCD93875FC6E4660BAC148E569095ECA"><enum>(11)</enum><text>windows that contain
				composite wood products, if the window product contains less than 5 percent by
				volume of hardwood plywood, particleboard, or medium-density fiberboard,
				combined, in relation to the total volume of the finished window product;
				or</text>
								</paragraph><paragraph id="H811276477D5F4D45B99E0DBC2E7E3469"><enum>(12)</enum><text>exterior doors and
				garage doors that contain composite wood products, if—</text>
									<subparagraph id="H85239DD58F9E4C0BB1317FDA4945F542"><enum>(A)</enum><text>the doors are made from
				composite wood products manufactured with no-added formaldehyde-based resins or
				ultra low-emitting formaldehyde resins; or</text>
									</subparagraph><subparagraph id="HC8E8A443BC184195B603FB6A31466199"><enum>(B)</enum><text>the doors contain less
				than 3 percent by volume of hardwood plywood, particleboard, or medium-density
				fiberboard, combined, in relation to the total volume of the finished exterior
				door or garage door.</text>
									</subparagraph></paragraph></subsection><subsection id="H8B58F39F396A4250B5C51CB2DE2838A5"><enum>(d)</enum><header>Regulations</header>
								<paragraph id="H72918FB3E85B4EEBA266A08040D646F3"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than
				January 1, 2013, the Administrator shall promulgate regulations to implement
				the standards required under subsection (b) in a manner that ensures compliance
				with the emission standards described in subsection (b)(2).</text>
								</paragraph><paragraph id="H906F8E8EB05640659767FF29D7599474"><enum>(2)</enum><header>Inclusions</header><text>The
				regulations promulgated pursuant to paragraph (1) shall include provisions
				relating to—</text>
									<subparagraph id="HE876070DBD7F49418169624FC6FAB47D"><enum>(A)</enum><text>labeling;</text>
									</subparagraph><subparagraph id="H0F462B6EFFC24B54B3C923CEAC336AFB"><enum>(B)</enum><text>chain of custody
				requirements;</text>
									</subparagraph><subparagraph id="H9357989C2B4844E6A409B15655DFFBF6"><enum>(C)</enum><text>sell-through
				provisions;</text>
									</subparagraph><subparagraph id="HFCB2FAAC0D644A24B15AA56D168B4FEC"><enum>(D)</enum><text>ultra low-emitting
				formaldehyde resins;</text>
									</subparagraph><subparagraph id="HBA2ACFC917ED4216AD3875453A25B773"><enum>(E)</enum><text>no-added
				formaldehyde-based resins;</text>
									</subparagraph><subparagraph id="HE43CF6D6A1AE42C08DDDE5A42BE06A98"><enum>(F)</enum><text>finished goods;</text>
									</subparagraph><subparagraph id="HE9BFAA69E08B4AC091FF57881B69DC84"><enum>(G)</enum><text>third-party testing and
				certification;</text>
									</subparagraph><subparagraph id="H3C82F2B2F2F0469C8156C4D4554BF3A4"><enum>(H)</enum><text>auditing and reporting of
				third-party certifiers;</text>
									</subparagraph><subparagraph id="HF0076C02D70842C5B5529ED6C74B0F32"><enum>(I)</enum><text>recordkeeping;</text>
									</subparagraph><subparagraph id="H13885041815D478C848D9C11934943F2"><enum>(J)</enum><text>enforcement;</text>
									</subparagraph><subparagraph id="HEEEF189711284D4A9A649A13718BED10"><enum>(K)</enum><text>laminated products;
				and</text>
									</subparagraph><subparagraph id="H1B2D0113736B45389BFCC6AC806B18AA"><enum>(L)</enum><text display-inline="yes-display-inline">exceptions from the requirements of
				regulations promulgated pursuant to this subsection for products and components
				containing de minimis amounts of composite wood products.</text>
									</subparagraph><continuation-text continuation-text-level="paragraph">The
				Administrator shall not provide under subparagraph (L) exceptions to the
				formaldehyde emission standard requirements in subsection (b).</continuation-text></paragraph><paragraph id="H2919523BD0E144F49A112AD8A6797324"><enum>(3)</enum><header>Sell-through
				provisions</header>
									<subparagraph id="H9F0AD75E705D481E81DF10B3F3D9A3AD"><enum>(A)</enum><header>In
				general</header><text>Sell-through provisions established by the Administrator
				under this subsection, with respect to composite wood products and finished
				goods containing regulated composite wood products (including recreational
				vehicles, manufactured homes, and modular homes), shall—</text>
										<clause id="HAAAA3DC7A5DD451584AC16F98ACC57EA"><enum>(i)</enum><text>be based on a designated
				date of manufacture (which shall be no earlier than the date 180 days following
				the promulgation of the regulations pursuant to this subsection) of the
				composite wood product or finished good, rather than date of sale of the
				composite wood product or finished good; and</text>
										</clause><clause id="H4730A2CA5DC7445892B7D0070095190D"><enum>(ii)</enum><text>provide that any
				inventory of composite wood products or finished goods containing regulated
				composite wood products, manufactured before the designated date of manufacture
				of the composite wood products or finished goods, shall not be subject to the
				formaldehyde emission standard requirements under subsection (b)(1).</text>
										</clause></subparagraph><subparagraph id="H4CB268DCCAB145B2910476A49FE30A25"><enum>(B)</enum><header>Implementing
				regulations</header><text>The regulations promulgated under this subsection
				shall—</text>
										<clause id="HA3651E89BD264AE7A336E0D51B103F41"><enum>(i)</enum><text>prohibit the stockpiling
				of inventory to be sold after the designated date of manufacture; and</text>
										</clause><clause id="H6D553CD521914476991AEC6CC7BFB84C"><enum>(ii)</enum><text>not require any labeling
				or testing of composite wood products or finished goods containing regulated
				composite wood products manufactured before the designated date of
				manufacture.</text>
										</clause></subparagraph><subparagraph id="HE90C17E910654E3A89EF9485E4706E23"><enum>(C)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this paragraph, the term
				<quote>stockpiling</quote> means manufacturing or purchasing a composite wood
				product or finished good containing a regulated composite wood product between
				the date of enactment of the Formaldehyde Standards for Composite Wood Products
				Act and the date 180 days following the promulgation of the regulations
				pursuant to this subsection at a rate which is significantly greater (as
				determined by the Administrator) than the rate at which such product or good
				was manufactured or purchased during a base period (as determined by the
				Administrator) ending before the date of enactment of the Formaldehyde
				Standards for Composite Wood Products Act.</text>
									</subparagraph></paragraph><paragraph id="HDC80EE24B04843E1B5E8127958986D18"><enum>(4)</enum><header>Import
				regulations</header><text>Not later than July 1, 2013, the Administrator, in
				coordination with the Commissioner of Customs and Border Protection and other
				appropriate Federal departments and agencies, shall revise regulations
				promulgated pursuant to section 13 as the Administrator determines to be
				necessary to ensure compliance with this section.</text>
								</paragraph><paragraph id="H4771647729D346A6BD7C0C416212DD7E"><enum>(5)</enum><header>Successor standards and
				test methods</header><text>The Administrator may, after public notice and
				opportunity for comment, substitute an industry standard or test method
				referenced in this section with its successor version.</text>
								</paragraph></subsection><subsection id="HA79807E8128D4B0CAF0BAD33CE13C458"><enum>(e)</enum><header>Prohibited
				acts</header><text>An individual or entity that violates any requirement under
				this section (including any regulation promulgated pursuant to subsection (d))
				shall be considered to have committed a prohibited act under section
				15.</text>
							</subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H48710DCC298847B29C76CBDFCDBB5530"><enum>(b)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">The table of
			 contents of the Toxic Substances Control Act (15 U.S.C. prec. 2601) is amended
			 by adding at the end the following:</text>

			 Congress</header><text display-inline="no-display-inline">Not later than one
			 year after the date of enactment of this Act, and annually thereafter through
			 December 31, 2014, the Administrator of the Environmental Protection Agency
			 shall submit to the Committee on Environment and Public Works of the Senate and
			 the Committee on Energy and Commerce of the House of Representatives a report
			 describing, with respect to the preceding year—</text>
			<paragraph id="H664BF80744614AA4BC57992A26F9EA8F"><enum>(1)</enum><text>the status of the
			 measures carried out or planned to be carried out pursuant to title VI of the
			 Toxic Substances Control Act; and</text>
			</paragraph><paragraph id="H9EEC227D779D4E0CBFD3F47453EF3248"><enum>(2)</enum><text>the extent to which
			 relevant industries have achieved compliance with the requirements under that
			 title.</text>
			</paragraph></section><section id="H61950E17F6C14966978050FF52271D98"><enum>4.</enum><header>Modification of
			 regulation</header><text display-inline="no-display-inline">Not later than 180
			 days after the date of promulgation of regulations pursuant to section 601(d)
			 of the Toxic Substances Control Act (as amended by section 2), the Secretary of
			 Housing and Urban Development shall update the regulation contained in section
			 3280.308 of title 24, Code of Federal Regulations (as in effect on the date of
			 enactment of this Act), to ensure that the regulation reflects the standards
			 established by section 601 of the Toxic Substances Control Act.</text>
