		  certain health benefits plan information and to amend title XIX of the Social
		  Security Act to provide transparency in hospital price and quality

		<section id="H66940A55F93345818CAE8DAEEA229079" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Patients’ Right to Know
			 Act</short-title></quote>.</text>
		</section><section id="H4E1A55C5A053459B9D33A2E83A6E55E2"><enum>2.</enum><header>Health benefits
			 plan information transparency</header>
			<subsection id="H2BB67A44321B426DA1BAA51560E5AEC5"><enum>(a)</enum><header>Ensuring
			 consumer and provider access to health benefits plan information</header>
				<paragraph id="H829790DA49BD498797EE7DE529C5B098"><enum>(1)</enum><header>In
			 general</header><text>Each entity offering a health benefits plan (as defined
			 in subsection (d)) shall make available to enrollees and potential enrollees of
			 such plan the following information:</text>
					<subparagraph id="H2243D1954D1448BCB1A33F8109C728B7"><enum>(A)</enum><text>The items and
			 services that are included as part of the coverage offered by such plan and the
			 items and services that are not so included.</text>
					</subparagraph><subparagraph id="H29A93566A9554B2ABF8C382A21FF40AE"><enum>(B)</enum><text display-inline="yes-display-inline">An explicit and clear list of limitations
			 and restrictions in the health insurance coverage offered, along with a
			 description of such limitations and restrictions.</text>
					</subparagraph><subparagraph id="HFC634B4990614769B7EB21B042AB7713"><enum>(C)</enum><text>A description of
			 the process available for appealing coverage decisions made by such
			 plan.</text>
					</subparagraph><subparagraph id="HE766BBBA5EA043EB939C2EBFAC31B820"><enum>(D)</enum><text display-inline="yes-display-inline">The number of appeals related to coverage
			 decisions made during the previous calendar year and the outcomes of such
			 appeals.</text>
					</subparagraph><subparagraph id="H2D33C728767A4621B51BC0EC659A2640"><enum>(E)</enum><text>The amount of
			 cost-sharing (including premiums, deductibles, copayments, co-insurance,
			 maximum possible annual out-of-pocket expenditure, and maximum possible
			 lifetime out-of-pocket expenditure) required by such plan.</text>
					</subparagraph><subparagraph id="H96C571526FD34EE6AF36AB93693FE4F2"><enum>(F)</enum><text>The number of
			 participating providers according to medical specialty type.</text>
					</subparagraph><subparagraph commented="no" id="HBBE2F2F0DF424E0E9E51A895869ECA9E"><enum>(G)</enum><text>The extent to
			 which a particular health care provider accepts coverage provided by such plan
			 and the extent to which such a provider participates in the provider network of
			 such plan.</text>
					</subparagraph><subparagraph id="H5AAF8616FA614102A02624C247BEBF64"><enum>(H)</enum><text>The percentage of
			 total expenditures made by such plan during the previous calendar year that are
			 attributable to administrative costs and an explanation of all the assumptions
			 and factors used to calculate such percentage.</text>
					</subparagraph><subparagraph id="H12B70538ACA449669DB7BC628C966CDD"><enum>(I)</enum><text>The plan terms and
			 conditions, claims payment policies and practices, periodic financial
			 disclosure, data on enrollment and dis­en­roll­ment, data on the number of
			 claims denials, data on rating practices, information on cost-sharing and
			 payments with respect to in-network and out-of-network coverage, and any other
			 information determined by the Secretary of Health and Human Services to be
			 beneficial to consumers or medical providers.</text>
					</subparagraph><subparagraph id="H8F3A22C4AAA84740A8F2529B85D3E8E7"><enum>(J)</enum><text display-inline="yes-display-inline">Information the Secretary of Health and
			 Human Services deems appropriate regarding the amount of waste and fraud in the
			 operations of such plan, efforts to address such waste and fraud, and the
			 outcomes of such efforts.</text>
					</subparagraph><continuation-text continuation-text-level="paragraph">The
			 requirement under this paragraph (including subparagraph (H)) shall apply only
			 to entities offering health benefits plans (as defined in subsection
			 (d)).</continuation-text></paragraph><paragraph id="HAD4569F46CE54CA98AC34045863697CE"><enum>(2)</enum><header>Out-of-pocket
			 cost-sharing transparency</header>
					<subparagraph id="H026EEEB83525480DA88AF218A0ACDFD5"><enum>(A)</enum><header>In
			 general</header><text>An entity offering a health benefits plan shall disclose,
			 upon request of an enrollee of such plan, the amount of out-of-pocket
			 cost-sharing (including deductibles, copayments, and coinsurance) under such
			 plan that the enrollee would be responsible for paying with respect to the
			 furnishing of a specific item or service by a provider participating in such
			 plan in a timely manner. At a minimum, such information shall be made available
			 to the enrollee, upon request, prior to seeking care, and shall be provided in
			 a manner that allows such enrollee to compare providers based on such
			 information.</text>
					</subparagraph><subparagraph id="H5792E28463F04D7796EB07B80ED1B55D"><enum>(B)</enum><header>Health care
			 quality information to be disclosed</header><text display-inline="yes-display-inline">In disclosing information described in
			 subparagraph (A), an entity offering a health benefits plan shall, to the
			 extent practicable and appropriate, associate such information with any
			 available risk-adjusted quality data measures. The Secretary may specify that
			 such measures include those that have been endorsed by the National Quality
			 Forum.</text>
					</subparagraph></paragraph><paragraph id="HECECA7F3ED8643D9AD22B2E81CB030CE"><enum>(3)</enum><header>Advance notice
			 of plan changes</header><text>An entity offering a health benefits plan shall
			 not make a change to such plan without reasonable and timely advance notice of
			 such change to enrollees of such plan.</text>
				</paragraph><paragraph commented="no" id="HBC38170AC7C54432A3F6FB85CA2131BB"><enum>(4)</enum><header>Contracting
			 reimbursement transparency</header><text>An entity offering a health benefits
			 plan shall disclose to each health care provider information relating to the
			 reimbursement arrangements between such plan and such provider.</text>
				</paragraph></subsection><subsection commented="no" id="HC6AD91E9224C4A97952D13A01320E84A"><enum>(b)</enum><header>Administrative
			 provisions and information design</header>
				<paragraph id="H625E6A8D778A4E938E12EF1CEF5E4469"><enum>(1)</enum><header>Timely
			 disclosure and updates; additional information disclosures</header>
					<subparagraph id="H6160CA29CC244FEE8D643817DD720F1D"><enum>(A)</enum><header>Timely
			 disclosure and updates</header><text>Each entity offering a health benefits
			 plan shall provide for timely access to information described in subsection (a)
			 and consistent with such subsection, including through an Internet website.
			 Such information shall first be made available not later than 18 months after
			 the date of the enactment of this Act. Such information shall be updated as
			 often as is deemed feasible by the Secretary of Health and Human Services, but
			 not less than once a calendar quarter.</text>
					</subparagraph><subparagraph id="H591D06DBF1BB42468C3DC06511B24E72"><enum>(B)</enum><header>Additional
			 information disclosures</header><text display-inline="yes-display-inline">The
			 Secretary may undertake rulemaking as necessary in order to ensure that
			 additional information, as specified by the Secretary, is progressively made
			 available by entities offering health benefits plans, in order to provide for
			 the maximum feasible reporting of information to meet the needs of consumers
			 and providers of health care in making determinations with regard to health
			 care items, insurance, and services. In no case shall such additional
			 information be required to be made available by any entity other than an entity
			 offering a health benefits plan (as defined in subsection (d)).</text>
					</subparagraph></paragraph><paragraph id="HC50792586E12436884E22309DDE8A6A0"><enum>(2)</enum><header>Information
			 design</header>
					<subparagraph id="HFE696D84508B4B54A57C7C9E04F51788"><enum>(A)</enum><header>In
			 general</header><text>Each entity offering a health benefits plan shall ensure
			 that the information described in paragraph (1) is made available in a manner
			 that—</text>
						<clause id="H54CE9C7B65AC47D89CB36987577D2575"><enum>(i)</enum><text>is
			 in a format that is easily accessible, useable, and understandable to enrollees
			 and potential enrollees of the plan as well as health care providers as
			 applicable;</text>
						</clause><clause id="H4562394F7FDA44C5860FB86A8CB59385"><enum>(ii)</enum><text>uses language
			 that the intended audience can readily understand and that is clean, concise,
			 well-organized, and follows other best practices of language writing;
			 and</text>
						</clause><clause id="H4166ED4BA35D49F687A3CA0AEEAFD588"><enum>(iii)</enum><text>to
			 the greatest extent feasible, permits an individual to search the information
			 by a user-defined geographic area, such as within a 50-mile radius of the
			 user’s home address.</text>
						</clause></subparagraph><subparagraph id="H6737E18E0DFF4466827B7D580B750139"><enum>(B)</enum><header>Enabling
			 consumers to compare information</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services
			 shall, by final rule issued not later than 12 months after the date of the
			 enactment of this Act, require entities offering health benefits plans to
			 disclose the information described in subsection (a)(1) in such a format as to
			 allow individuals to compare the coverage options available to them in as
			 uniform a manner as possible.</text>
					</subparagraph></paragraph></subsection><subsection id="HECC6BB67CAFC40349F964CE61EFB44D0"><enum>(c)</enum><header>Penalty</header><text display-inline="yes-display-inline">The Secretary shall provide for a
			 methodology to impose a penalty fee against each entity offering a health
			 benefits plan that fails to substantially meet the requirements of subsections
			 (a) and (b). Such methodology shall—</text>
				<paragraph id="H3A92997867F34209B845E12482B2ED02"><enum>(1)</enum><text>provide for an
			 increased penalty amount in the case of such an entity that knowingly
			 misrepresents information required to be disclosed under subsection (a) or
			 under regulations issued pursuant to subsection (b)(1)(B);</text>
				</paragraph><paragraph id="H61973653CF79457C93D4491B5124151B"><enum>(2)</enum><text>vary the amount of
			 such fee based on the size of the entity involved and type of infraction.</text>
				</paragraph><continuation-text continuation-text-level="subsection">The
			 provisions of section 1128A (other than subsections (a) and (b)) shall apply to
			 a penalty fee imposed under this subsection in the same manner as such
			 provisions apply to a penalty or proceeding under section 1128A(a).</continuation-text></subsection><subsection id="HF178D9AF529F44A7955702F8E9BAF3E7"><enum>(d)</enum><header>Entity offering
			 a health benefits plan defined</header><text>For the purposes of this section,
			 the term <term>entity offering a health benefits plan</term> means a health
			 insurance issuer with respect to the offering of health insurance coverage,
			 including in the individual market and small and large group market (as such
			 terms are defined in section 2791 of the Public Health Service Act); a plan
			 sponsor with respect to the offering of a group health plan (as defined in such
			 section 2791); and entities responsible for the administration of governmental
			 health plans (including the Centers for Medicare &amp; Medicaid Services with
			 respect to the Medicare program under title XVIII of the Social Security Act,
			 State agencies responsible for administration of State plans under the Medicaid
			 program under title XIX of such Act or State child assistance plans under the
			 State Children’s Health Insurance Program under title XXI of such Act, and the
			 Office of Personnel Management with respect to the Federal Employees Health
			 Benefits Program under chapter 89 of title 5, United States Code).</text>
			</subsection></section><section id="H8E0BF161A1CC41A99267CEAE963C73FE"><enum>3.</enum><header>Hospital and
			 ambulatory surgical center price and quality transparency</header>
			<subsection id="HB5DD13E76C2242168773BC31B94607E8"><enum>(a)</enum><header>In
			 general</header><text>Section 1902(a) of the Social Security Act (42 U.S.C.
			 1396a(a)) is amended—</text>
				<paragraph id="HB83F2F984887436F907C90A7C63B6504"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (72);</text>
				</paragraph><paragraph id="HAB0F6D3FB2CB44E1894482D3D8F02D6C"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (73) and inserting <quote>; and</quote>;</text>
				</paragraph><paragraph id="H7BD0925E15CF4DF08D21637960555E12"><enum>(3)</enum><text>by inserting after
			 paragraph (73) the following new paragraph:</text>
					<quoted-block id="H51565B820B3D407D90D3C4A53A2107B1" style="OLC">
						<paragraph id="H7461582AF0DD4FB99B75A1FA82DCA4F9"><enum>(74)</enum><text>provide that the
				State will establish and maintain laws, in accordance with the requirements of
				section 1921A, to require disclosure of information on hospital and ambulatory
				surgical center charges and quality, to make such information available to the
				public and the Secretary.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HD229215102AE4AA8B575EB0F38031379"><enum>(4)</enum><text>by inserting after
			 section 1921 the following new section:</text>
					<quoted-block id="H95A00A0F8E5345B9A6C942BCA34383EA" style="OLC">
						<section id="H769BCDBC860F4CC083D2F77BF2E3A91B"><enum>1921A.</enum><header>Price and
				quality transparency</header>
							<subsection id="H2FAEC18CC0174401A521CF71F5AB8C3A"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The requirements
				referred to in section 1902(a)(74) are that the laws of a State must—</text>
								<paragraph id="HED889B4DB6F54585B9A599C57E1E0054"><enum>(1)</enum><text>require reporting
				to a State (or its agent) by each hospital located therein, of information
				on—</text>
									<subparagraph id="HD18E1DC89E574B00ABC2143F7788DA8B"><enum>(A)</enum><text>the charges for
				inpatient and outpatient services typically performed (as defined by the
				Secretary through notice and comment rulemaking) by such hospital;</text>
									</subparagraph><subparagraph id="H6DE80A9033554C60A05A3296266E5763"><enum>(B)</enum><text>the reimbursement
				amount under title XVIII and under the State plan under this title for such
				services; and</text>
									</subparagraph><subparagraph id="H7C92BF6D02D64A1EBA1CD1AD9C11E2D5"><enum>(C)</enum><text>if the hospital
				allows for or provides reduced charges for individuals based on financial need,
				the factors considered in making determinations for reductions in charges,
				including any formula for such determination and the contact information for
				the specific department of a hospital that responds to such inquiries;</text>
									</subparagraph></paragraph><paragraph id="H3BBE002960264447BFAF2E287EBA71C5"><enum>(2)</enum><text>provide for notice
				to individuals seeking or requiring such services of the availability of
				information on charges described in paragraph (1);</text>
								</paragraph><paragraph id="H1809C58718714D3086DF7139B61D5768"><enum>(3)</enum><text>provide for timely
				access to such information, including at least through an Internet website, by
				individuals seeking or requiring such services; and</text>
								</paragraph><paragraph id="H84FF27EF3DE3427E92D32FA033B0F74D"><enum>(4)</enum><text display-inline="yes-display-inline">provide for timely access to information
				regarding the quality of care at each hospital made publicly available in
				accordance with section 501 of the Medicare Prescription Drug, Improvement, and
				Modernization Act of 2003, section 1139A, or section 1139B.</text>
								</paragraph></subsection><subsection id="H2AC2E91FE2B247C0B2D7464252EDB5ED"><enum>(b)</enum><header>Application to
				ambulatory surgical centers</header><text display-inline="yes-display-inline">The requirements described in subsection
				(a) shall apply, to the greatest extent practicable, to ambulatory surgical
				centers in the same manner as such requirements apply to hospitals, except that
				in applying paragraph (4) of such subsection, the references described in such
				paragraph shall be deemed to be a reference to section 1833(i)(7).</text>
							</subsection><subsection id="H79975058D214490A91A33E7E50608046"><enum>(c)</enum><header>Consultation
				with stakeholders</header><text display-inline="yes-display-inline">For
				purposes of carrying out this section, the Secretary shall consult with
				appropriate stakeholders through a formal process to obtain guidance prior to
				issuing any implementing policies.</text>
							</subsection><subsection id="HB8ACDBEDCAF44C0196CFA99857578724"><enum>(d)</enum><header>Hospital
				defined</header><text display-inline="yes-display-inline">For the purposes of
				this section, the term <term>hospital</term> means an institution that meets
				the requirements of paragraphs (1) and (7) of section 1861(e) and includes an
				institution to which section 1820(c) applies.</text>
							</subsection><subsection id="H57358EBB23F64DAF927E62492419327F"><enum>(e)</enum><header>Ambulatory
				surgical center defined</header><text>For purposes of this section, the term
				<term>ambulatory surgical center</term> means a center described in section
				1832(a)(2)(F)(i).</text>
							</subsection></section><after-quoted-block></after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HA71BD2A0BED6458DB0307E7867517CDF"><enum>(b)</enum><header>Effective
			 date</header>
				<paragraph id="HD3E4BD8DBD574F6796E0DAD8AD493DE1"><enum>(1)</enum><header>In
			 general</header><text>The amendments made by subsection (a) shall apply to
			 State plans beginning not later than 2 years after the date of the enactment of
			 this Act.</text>
				</paragraph><paragraph id="H217509A70D154A4B89F5E7AC65B6BAC5"><enum>(2)</enum><header>Existing
			 programs</header><text display-inline="yes-display-inline">The Secretary of
			 Health and Human Services shall establish a process by which a State with an
			 existing program may certify to the Secretary that its program satisfies the
			 requirements of section 1921A of the Social Security Act, as inserted by
			 subsection (a).</text>
				</paragraph></subsection></section></legis-body>
