<official-title>To allow small public water systems to request an exemption from the requirements of any national primary drinking water regulation for a naturally occurring contaminant, and for other purposes.</official-title>

<section display-inline="no-display-inline" id="HBA282027F7BA48C6A83832E23C638FD8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Community Options for Regulatory Equity Act of 2010</short-title></quote>.</text></section> 
<section id="HC8DC82F83AE24AA68DCAE374B8D971EC"><enum>2.</enum><header>Exemption for nonprofit small public water systems respecting naturally occurring contaminants</header><text display-inline="no-display-inline">The Safe Drinking Water Act (42 U.S.C. 300f et seq.) is amended by inserting after section 1416 the following:</text>

<section id="H223E2AA0B0074B35B5689D1C217F3365"><enum>1416A.</enum><header>Exemption for nonprofit small public water systems respecting naturally occurring contaminants</header> 
<subsection commented="no" display-inline="yes-display-inline" id="H672388C3086F46E99AFFF63B77BA5529"><enum>(a)</enum><header>Exemption</header><text display-inline="yes-display-inline">A State exercising primary enforcement responsibility for public water systems under section 1413 (or the Administrator in any nonprimacy State) shall exempt any nonprofit small public water system that submits a request in accordance with subsection (b) from the requirements of any national primary drinking water regulation for a naturally occurring contaminant.</text></subsection> 
<subsection id="H35A9B105D9F04E7CA53BBF4B7902D78A"><enum>(b)</enum><header>Request</header><text>To seek an exemption under this section, a nonprofit small public water system—</text> 
<paragraph id="H42E113FF7B8347CF9B2FF8AC99BE351E"><enum>(1)</enum><text>shall submit a written request to the State exercising primary enforcement responsibility with respect to the system (or the Administrator in any nonprimacy State); and</text></paragraph> 
<paragraph id="H057E5DE270674E699C137E1F1D48DD0D"><enum>(2)</enum><text>shall include in such request a finding under subsection (c).</text></paragraph></subsection> 
<subsection id="H12CB0896BB884C48A214DD9DA158FF7C"><enum>(c)</enum><header>Economic feasibility</header> 
<paragraph id="HAAA369BE470243668CAC4B5D3BF071BF"><enum>(1)</enum><header>Finding</header><text>To seek an exemption under this section, a nonprofit small public water system must find that compliance by the system with the national primary drinking water regulation involved is not economically feasible.</text></paragraph> 
<paragraph id="H73CB01D03338441D87A704F739034791"><enum>(2)</enum><header>No review</header><text>A finding by a nonprofit small public water system under this subsection shall not be subject to judicial or administrative review.</text></paragraph></subsection> 
<subsection id="H91BCAD678A8A453489ECA68EBD9F1828"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HDA20E9D563A2435588B7AEEA1652A226"><enum>(1)</enum><text>The term <term>naturally occurring contaminant</term> includes arsenic, radon, radium, uranium, and any contaminant that is a disinfection byproduct (including bromate, chlorite, haloacetic acids, and total trihalomethanes).</text></paragraph> 
<paragraph id="H73ECA1E1E5E74861AB92184E155E9A1B"><enum>(2)</enum><text>The term <term>small public water system</term> means a public water system serving 10,000 or fewer persons.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
