<section id="HF3784F4A8A59493FB9604FDD492D3C52" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Bird-Safe Buildings Act of 2010</short-title></quote>. </text></section> 
<section id="H0BC51D210E9547999F4B0FD97590BFA5"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> 
<paragraph id="HDEF4EE607B6149AFB0D760CBFD1DAFD4"><enum>(1)</enum><text display-inline="yes-display-inline">a multi-agency report issued in 2009, entitled <quote>The State of the Birds, United States of America</quote>, provides the most comprehensive assessment to date on the status of bird populations;</text></paragraph> 
<paragraph id="HF826681590894122BCB33FBF3D13C777"><enum>(2)</enum><text>the multi-agency report concludes that nearly one-third of the Nation’s 800 bird species are endangered, threatened, or in significant decline;</text></paragraph> 
<paragraph id="HC422950DCCC942F3BCF67750CE29E393"><enum>(3)</enum><text>death from collisions with man-made structures is one of the most serious sources of avian mortality, and it is increasing;</text></paragraph> 
<paragraph id="HA616CD1542204839B9672FD74F3A6815"><enum>(4)</enum><text>not only are birds beautiful and interesting creatures that are eagerly welcomed by millions of Americans into their backyards every year, but birds also have an impact on the United States economy;</text></paragraph> 
<paragraph id="HE0F1BEBE54F24BF3B2EAE3BFC3EA6FA2"><enum>(5)</enum><text>the United States Fish and Wildlife Service has reported that birdwatchers contribute $36 billion annually to the United States economy, and birds naturally provide billions of dollars worth of pest control, benefitting farmers and consumers alike;</text></paragraph> 
<paragraph id="H9986ED60A1124B708A50DF0EEDFA26EE"><enum>(6)</enum><text>the U.S. Green Building Council has added bird-friendly language to the Leadership in Energy and Environmental Design (LEED) Reference Guide, which will have the impact of recognizing bird-friendly design in awarding LEED credits;</text></paragraph> 
<paragraph id="H000390F3764B4A2EA633C6609D700AAC"><enum>(7)</enum><text>bird-safe design features can be incorporated into new construction and major renovation projects at no extra cost, and existing buildings may be made bird-safe through the use of simple, low cost adaptations;</text></paragraph> 
<paragraph id="H565D0BDD7E564CFB9271F45CC30B93B7"><enum>(8)</enum><text>the General Services Administration is obligated, under Executive Order 13186, to <quote>support the conservation intent of the migratory bird conventions by integrating bird conservation principles, measures, and practices into agency activities and by avoiding or minimizing, to the extent practicable, adverse impacts on migratory bird resources when conducting agency actions</quote>; and</text></paragraph> 
<paragraph id="H8BDE22F29A9D48CE9E7A737CB0079FED"><enum>(9)</enum><text>the General Services Administration has already constructed many award-winning, bird-friendly buildings, including the San Francisco Federal Building, the Suitland Census Complex, the United States Courthouse in Eugene, Oregon, the Beltsville ATF Laboratory Center, and the United States Courthouse in Buffalo, New York.</text></paragraph></section> 
<section id="H6E9B3B8701B741DDA24FB821974F83A9"><enum>3.</enum><header>Use of bird-safe building materials and design features</header> 
<subsection id="H5835D4436671413AA7303C75D1101CF9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 33 of title 40, United States Code, is amended—</text> 
<paragraph id="H8E16C85A3C794FC2AB8AEEF94BE2E81E"><enum>(1)</enum><text>by redesignating sections 3314, 3315, and 3316 as sections 3315, 3316, and 3317, respectively; and</text></paragraph> 
<paragraph id="H3DCAFC3DB9994F24B9A076FE6E9B11FA"><enum>(2)</enum><text>by inserting after section 3313 the following:</text>

<section id="HDA83F611AF0D4248A5061EEB7FA51097"><enum>3314.</enum><header>Use of bird-safe building materials and design features</header> 
<subsection id="H1BF649237F3D4A23B9DD486FD21636BA"><enum>(a)</enum><header>Construction, alteration, and acquisition of public buildings</header><text display-inline="yes-display-inline">Each public building constructed, altered, or acquired by the Administrator of General Services shall incorporate, to the maximum extent feasible as determined by the Administrator, bird-safe building materials and design features.</text></subsection> 
<subsection id="HB1A71FC259064E24BDEE0C3C93E2342E"><enum>(b)</enum><header>Existing buildings and lighting</header><text display-inline="yes-display-inline">The Administrator, where practicable, shall—</text> 
<paragraph id="HCBA9EE4A39F84AF3B4F0A5F9EB42E255"><enum>(1)</enum><text>incorporate bird-safe building materials and design features into existing public buildings; and</text></paragraph> 
<paragraph id="H72B6FF3BE8BF46F581A6D803E93A8B2B"><enum>(2)</enum><text>address interior and exterior lighting’s impacts on native bird species.</text></paragraph></subsection> 
<subsection id="H1E1CE03D93F94385B283498E2DD416B5"><enum>(c)</enum><header>Bird-Safe building materials defined</header><text display-inline="yes-display-inline">In this section, the term <quote>bird-safe building materials and design features</quote> includes the materials and features recommended by—</text> 
<paragraph id="H1BFD4450644E432A9B0210977D5C1530"><enum>(1)</enum><text>the city of Chicago’s <quote>Bird-Safe Building Design Guide for New Construction and Renovation</quote>;</text></paragraph> 
<paragraph id="H79E76E2BC5564CCF9519F38C698FB533"><enum>(2)</enum><text>the city of Toronto’s <quote>Bird-Friendly Development Guidelines</quote>; and</text></paragraph> 
<paragraph id="H00801261D675451F99774B1C036A678A"><enum>(3)</enum><text>the American Bird Conservancy and New York City Audubon’s <quote>Bird-Safe Building Guidelines</quote>.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HAA2494D4C78D408A9A1E35271E79ACC7"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The analysis for such chapter is amended by striking the items relating to sections 3314, 3315, and 3316 and inserting the following:</text>
