		<official-title>To ensure that the victims and victims’ families of the
		  November 5, 2009, attack at Fort Hood, Texas, receive the same treatment,
		  benefits, and honors as those Americans who have been killed or wounded in a
		  combat zone overseas and their families.</official-title>

		<section id="H4533C7B152BC4A60AB1D92C8C5D3F627" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fort Hood Victims and Families
			 Benefits Protection Act</short-title></quote>.</text>
		</section><section id="HECB990D5855043F6B8DE43D0E796FE54"><enum>2.</enum><header>Findings; sense
			 of Congress</header>
			<subsection id="HC21132D5ECD04A3CA4875B14E855D0C3"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress makes the following
			 findings:</text>
				<paragraph id="H6BC5F6D531654C17A46351881786FC89"><enum>(1)</enum><text>Fort Hood, Texas,
			 has played a highly prominent role in the Global War on Terror, deploying more
			 members of the Armed Forces into overseas theaters of combat since September
			 11, 2001, than any other United States military installation.</text>
				</paragraph><paragraph id="H18841E93D834417F898683B5F44B5BD5"><enum>(2)</enum><text>The members of the
			 Armed Forces and community of Fort Hood have answered the call to service with
			 honor and distinction, and the post has paid a steep price, suffering more
			 combat casualties in Operation Iraqi Freedom and Operation Enduring Freedom
			 than any other United States military installation.</text>
				</paragraph><paragraph id="HEF0C72382B3C4C398EFDF91F45A34EC5"><enum>(3)</enum><text>In the wake of the
			 brutal September 11, 2001, terrorist attacks on the United States, the Federal
			 Government set a historical precedent when it awarded the victims of those
			 attacks who were members of the Armed Forces with the Purple Heart medal and
			 the victims of those attacks who were civilian employees of the Department of
			 Defense with the Secretary of Defense Medal for the Defense of Freedom.</text>
				</paragraph><paragraph id="H5FD8024ABD274CDF933F97EBCE5DE78F"><enum>(4)</enum><text>In the aftermath
			 of the attack that occurred at Fort Hood, Texas, on November 5, 2009, this
			 precedent should be followed.</text>
				</paragraph></subsection><subsection id="H43487B03C8D64A869360D52012B28937"><enum>(b)</enum><header>Sense of
			 Congress</header><text>It is the sense of Congress that—</text>
				<paragraph id="HF0F32289FEE0415688F98EC65FDDC478"><enum>(1)</enum><text>any member of the
			 Armed Forces or civilian employee of the Department of Defense who was killed
			 or wounded in the attack that occurred at Fort Hood, Texas, on November 5,
			 2009, and the family members of those victims, should receive the same
			 treatment and benefits as the victims and families of victims of the September
			 11, 2001, terrorist attacks on the United States;</text>
				</paragraph><paragraph id="H2F89CC9C363F42BC8E9F2B71A9EC0C63"><enum>(2)</enum><text>these Americans
			 have made tremendous sacrifices, and the United States should provide them with
			 the maximum level of benefits available, identical to the level of benefits
			 available to those who have been killed or wounded in an overseas combat zone
			 such as Iraq or Afghanistan; and</text>
				</paragraph><paragraph id="HD4C000545F794E358B2D962510F42232"><enum>(3)</enum><text>the Department of
			 Defense should duly honor the Americans who were killed or injured in the
			 attack at Fort Hood with awards that serve to recognize their physical
			 sacrifices, including the Purple Heart Medal for members of the Armed Forces
			 and the Secretary of Defense Medal for the Defense of Freedom for civilian
			 employees of the Department of Defense.</text>
				</paragraph></subsection></section><section id="HA809414E29F04365BBE310C2D339A471"><enum>3.</enum><header>Treatment of
			 members of the Armed Forces and civilian employees of the Department of Defense
			 who were killed or wounded in the November 5, 2009, attack at Fort Hood,
			 Texas</header>
			<subsection id="HC259D028B8D644B6B0E14F3F3AEE4506"><enum>(a)</enum><header>Treatment</header><text>For
			 purposes of all applicable Federal laws, regulations, and policies, a member of
			 the Armed Forces or civilian employee of the Department of Defense who was
			 killed or wounded in the attack that occurred at Fort Hood, Texas, on November
			 5, 2009, shall be deemed as follows:</text>
				<paragraph id="H587848B1220441B2A4834A93E8B9980F"><enum>(1)</enum><text>In the case of a
			 member, to have been killed or wounded in a combat zone as the result of an act
			 of an enemy of the United States.</text>
				</paragraph><paragraph id="H7BA24B53752A41D9846FB65739B61471"><enum>(2)</enum><text>In the case of a
			 civilian employee of the Department of Defense—</text>
					<subparagraph id="H1576F9E113634AC38D5849DC4A4C0AF5"><enum>(A)</enum><text>to have been
			 killed or wounded while serving with the Armed Forces in a contingency
			 operation; and</text>
					</subparagraph><subparagraph id="HF7EF55FAF09B4A6282675822FCAF0430"><enum>(B)</enum><text>to have been
			 killed or wounded in a terrorist attack.</text>
					</subparagraph></paragraph></subsection><subsection id="H5AEFE5272A134951867060BD2A9A6D3C"><enum>(b)</enum><header>Exception</header><text>Subsection
			 (a) shall not apply to a member of the Armed Forces whose death or wound as
			 described in that subsection is the result of the willful misconduct of the
			 member.</text>
