<official-title>To amend title XVIII of the Social Security Act to provide for an option for any citizen or permanent resident of the United States to buy into Medicare.</official-title>

<section id="H3BD27D1F097B4DC3981829A06ACD4F00" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Option Act</short-title></quote> or the <quote><short-title>Medicare You Can Buy Into Act</short-title></quote>.</text></section> 
<section id="HE2F8DAA111BB46DFB79B40202344B2AD"><enum>2.</enum><header>Universal Medicare buy-in option</header> 
<subsection id="H3F63029ABA574A2BBCFD052A76A0ADA7" display-inline="no-display-inline"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part A of title XVIII of the Social Security Act is amended—</text> 
<paragraph id="H86EBCFCCEE424434BEFAB3230145664D"><enum>(1)</enum><text>in section 1818(a), by striking <quote>or 1818A</quote> and inserting <quote>, 1818A, or 1818B</quote>; and</text></paragraph> 
<paragraph id="HF210CA260A3840DCBB8E9440427B4BDC"><enum>(2)</enum><text>by inserting after section 1818A the following new section:</text>

<section id="HAE076960AF18412084CC05806E286B71"><enum>1818B.</enum><header>Universal buy-in</header> 
<subsection id="H8A1B87E161A6425391AE7D6967476F1A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">(a) Every individual who—</text> 
<paragraph id="H9CE55C637D65426CB08C3156CF0D5D75"><enum>(1)</enum><text>is a resident of the United States;</text></paragraph> 
<paragraph id="HBA021B3A073C4D949E3E1EA66F9667A9"><enum>(2)</enum><text>is either (A) a citizen or national of the United States, or (B) an alien lawfully admitted for permanent residence; and</text></paragraph> 
<paragraph id="HC448F0ACB0FF4878A889CAE1958ADE21"><enum>(3)</enum><text>is not otherwise entitled to benefits under this part or eligible to enroll under this part; </text></paragraph><continuation-text continuation-text-level="subsection">shall be eligible to enroll in the insurance program established by this part. An individual may enroll under this section only in such manner and form as may be prescribed in regulations, and only during an enrollment period prescribed in or under this section.</continuation-text></subsection> 
<subsection id="HFC7832CBDD7042ADADC20FB17061E613"><enum>(b)</enum><header>Enrollment; coverage</header><text>The Secretary shall establish enrollment periods and coverage under this section consistent with the principles for establishment of enrollment periods and coverage for individuals under section 1818, except that no entitlement to benefits under this part shall be effective before the first day of the first calendar year beginning after the date of the enactment of this Act. </text></subsection> 
<subsection id="H9DC8A84AA6C54C00AEAC04506FA050C2"><enum>(c)</enum><header>Premiums</header> 
<paragraph id="HF514CC5C0D364326AE3A4EDE7DFD514E"><enum>(1)</enum><header>In general</header><text>The provisions of subsections (d)(1), (d)(2), and (d)(3) of section 1818 insofar as they apply to premiums (including collection of premiums) shall apply to premiums and collection of premiums under this section, except that—</text> 
<subparagraph id="HFCE25BFA88794312BC618DE93896B62E"><enum>(A)</enum><text>paragraphs (4) and (5) of section 1818 shall not be applicable; and</text></subparagraph> 
<subparagraph id="H1E5594612BB2459B88D5168BF1B199C1"><enum>(B)</enum><text>the estimate of the monthly actuarial rate under section 1818(d) shall be computed and applied under this paragraph based upon costs incurred for individuals within each age cohort specified in paragraph (2) rather than for all individuals age 65 and older.</text></subparagraph></paragraph> 
<paragraph id="H1C3C1C19D6AE4A5684F3F024D4143CC1"><enum>(2)</enum><header>Age cohorts</header><text>The age cohorts specified in this paragraph are as follows:</text> 
<subparagraph id="H7087D9F730FB4B75BE0EC42300A1FC9E"><enum>(A)</enum><text>Individuals under 19 years of age.</text></subparagraph> 
<subparagraph id="H92FD11AA5C6F43229FB3E946733DD070"><enum>(B)</enum><text>Individuals at least 19 years of age but not more than 25 years of age.</text></subparagraph> 
<subparagraph id="HEB2C72BD53584632B43EA4999A1E7E3F"><enum>(C)</enum><text>Individuals at least 26 years of age and not more than 35 years of age.</text></subparagraph> 
<subparagraph id="HC4A6AF10A9BF4168B7F42C6C341C9788"><enum>(D)</enum><text>Individuals at least 36 years of age and not more than 45 years of age.</text></subparagraph> 
<subparagraph id="HBD74538C3B8B4E31AD1E243EA0F229F6"><enum>(E)</enum><text>Individuals at least 46 years of age and not more than 55 years of age.</text></subparagraph> 
<subparagraph id="HFBD15389FCB44DDF920202DFA7C54BD3"><enum>(F)</enum><text>Individuals at least 56 years of age and not more than 64 years of age.</text></subparagraph> </paragraph></subsection> 
<subsection id="H3FFAB935B8464EF99ACE0D1E553559DD" commented="no"><enum>(d)</enum><header>Treatment</header><text>An individual enrolled under this part pursuant to this section shall not be treated as enrolled under this part (or any other part of this title) for purposes of obtaining medical assistance for medicare cost-sharing or otherwise under title XIX. </text></subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section>
