<section id="HCAB111C6D048442189D3BB4F6EE9CF9D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Great Lakes Ecosystem Protection Act of 2010</short-title></quote>.</text></section> 
<section id="H6D40800D4DC949DFBB9625C3B704844E" section-type="subsequent-section"><enum>2.</enum><header>Great Lakes provision modifications</header> 
<subsection id="H2F4AE8EE95B34FE29CD396CA2AFC94C7"><enum>(a)</enum><header>Findings; purpose</header><text display-inline="yes-display-inline">Section 118(a) of the Federal Water Pollution Control Act (33 U.S.C. 1268(a)) is amended—</text> 
<paragraph id="HE4CD02569F604541976CCB958181C323"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text> 
<subparagraph id="HFC308A73449449AB98148075F6E5A41F"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subparagraph (B) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H512A1BA3516A4A3EA55602D6C5782DC7" style="OLC"> 
<subparagraph id="HF38043CE4ECB43158AE226C7FF29D8E3"><enum>(B)</enum><text>the United States should seek to attain the goals embodied in the Great Lakes Restoration Initiative Action Plan, the Great Lakes Regional Collaboration Strategy, and the Great Lakes Water Quality Agreement; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph>

<paragraph id="H660B593F7161496A95F1B9FD63E113AD"><enum>(2)</enum><header>Purpose</header><text>The purpose of this section is to achieve the goals established in the Great Lakes Restoration Initiative Action Plan, the Great Lakes Regional Collaboration Strategy, and the Great Lakes Water Quality Agreement through—</text> 
<subparagraph id="H1DC19FCF34B8429B8486EF408E2675DD"><enum>(A)</enum><text>improved organization and definition of mission on the part of the Agency;</text></subparagraph> 
<subparagraph id="HB5E046EAA5C8448D80C4406A2CE4A49C"><enum>(B)</enum><text>the funding of grants for protection, restoration, and pollution control in the Great Lakes area; and</text></subparagraph> 
<subparagraph id="H22C9F1C364E94140BCFEA9D708544016"><enum>(C)</enum><text>improved accountability.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HD1E1EF1FF0E8410B8D4A53803B769D9F"><enum>(b)</enum><header>Great Lakes management</header><text>Section 118(c) of the Federal Water Pollution Control Act (33 U.S.C. 1268(c)) is amended—</text> 
<paragraph id="H6E677D512EC243ABB7870C764E27C1C5"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="H2B4A44DAFBC34BA18A63CC36B0571BB9"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>,;</quote> and inserting a semicolon;</text></subparagraph> 
<subparagraph id="HD468B5356D694759B3E6D6A33C3ECE6E"><enum>(B)</enum><text>by striking subparagraph (E);</text></subparagraph>

<clause id="H0A77DF22699B479C8B97794F0BA399D8"><enum>(i)</enum><header>Establishment</header><text>There is established a council, to be known as the Great Lakes Leadership Council (referred to in this paragraph as the <term>Council</term>).</text></clause> 
<clause id="HE7FE78C8F0564A8581CE4847500C6480"><enum>(ii)</enum><header>Duties</header><text>The Council shall—</text> 
<subclause id="H971769FCD7334CFDB3952D0F931805A4"><enum>(I)</enum><text>develop and establish Great Lakes protection and restoration policy;</text></subclause> 
<subclause id="H0E31A5AB5E6B4255A60D925ACC1B6AB7"><enum>(II)</enum><text>approve long-term goals and objectives relating to Great Lakes protection and restoration, including the Great Lakes Restoration Initiative;</text></subclause> 
<subclause id="HCC6372F0EFE74875832DFC592529826A"><enum>(III)</enum><text>establish annual priorities with respect to Great Lakes protection and restoration, including priorities for the Great Lakes Restoration Initiative;</text></subclause> 
<subclause id="H9D5362A8F291425A941F38A9F9C9C2C4"><enum>(IV)</enum><text>submit to Congress, the President, and the public reports describing progress made during the reporting period with respect to Great Lakes protection and restoration;</text></subclause> 
<subclause id="H157C2AA238DC43B99F80B828EC8CE107"><enum>(V)</enum><text>seek consensus among units of government and stakeholders regarding disputes relating to Great Lakes protection and restoration;</text></subclause> 
<subclause id="HE54B34FC8B8549C98C0BEEC679A617F5"><enum>(VI)</enum><text>determine a process for participation in relevant international forums, such as the Great Lakes Water Quality Agreement; and</text></subclause> 
<subclause id="H0771B64CFC8C47668914D84E325D48D5"><enum>(VII)</enum><text>provide input annually regarding Federal budget priorities and levels for Great Lakes protection and restoration, including the Great Lakes Restoration Initiative.</text></subclause></clause> 
<clause id="H16FF8CFAB4684D99AC2AD8E4CFB065F4"><enum>(iii)</enum><header>Membership</header> 
<subclause id="HAE43B2E72FD642E188ADD4662A901694"><enum>(I)</enum><header>In general</header><text>The membership of the Council shall include—</text> 
<item id="HB43C0109402640D0A3A25381D9C2FF0C"><enum>(aa)</enum><text>8 heads of Federal departments and agencies, to be appointed by the President, including—</text> 
<subitem id="HE216474BD63E4241AFA1F67A5EDD017D"><enum>(AA)</enum><text>the Administrator;</text></subitem> 
<subitem id="H9E7D72526AC14342A0805E06CAB335A9"><enum>(BB)</enum><text>the Chief of Engineers;</text></subitem> 
<subitem id="H6CE504E2795E4D00978F8E0ABDD26C30"><enum>(CC)</enum><text>the Secretary of the Interior;</text></subitem> 
<subitem id="H38EF2E4AACAA440899C20A9437424511"><enum>(DD)</enum><text>the Secretary of Agriculture;</text></subitem> 
<subitem id="HB2CEA14556C1476896EA092E4E5A5FE6"><enum>(EE)</enum><text>the Secretary of Commerce; and</text></subitem> 
<subitem id="H72B0C3FFE1D04B439685E21720411633"><enum>(FF)</enum><text>the head of the department in which the Coast Guard is operating;</text></subitem></item> 
<item id="H83D904E781D941E6A9B489FD193BCAD4"><enum>(bb)</enum><text>the governors of the Great Lake States;</text></item> 
<item id="HDD4C4AA855E24598B3ED9DC63FC8FA31"><enum>(cc)</enum><text>8 representatives of tribal governments, to be appointed by the Indian tribes located in the Great Lakes basin; and</text></item> 
<item id="HF0248EB3FD244937911960C99FD40FF1"><enum>(dd)</enum><text>8 mayors, including mayors participating in the Great Lakes and St. Lawrence Cities Initiative, to be appointed by the mayors of areas located in the Great Lakes basin.</text></item></subclause> 
<subclause id="H6CD31BDF649B413A8C461F7DCEB30611"><enum>(II)</enum><header>Chairperson</header><text>The Administrator shall serve as chairperson of the Council.</text></subclause> 
<subclause id="H9C847C449B714AE790989623DF5D1AE3"><enum>(III)</enum><header>Secretary</header><text>The Director of the Program Office shall serve as secretary of, and provide administrative support to, the Council.</text></subclause> 
<subclause id="HB004467522164DEB84C0AACBC485E14E"><enum>(IV)</enum><header>Observer members</header><text>The membership of the Council shall include 1 observer member from each of—</text> 
<item id="H814D5085A69E4C97B2C19C1657C5984D"><enum>(aa)</enum><text>the International Joint Commission;</text></item> 
<item id="H44A818CCB3C1445EBB6486A4466276FC"><enum>(bb)</enum><text>the Great Lakes Fishery Commission;</text></item> 
<item id="H8E9578FABFC34F2C8B39BBAB4F875B13"><enum>(cc)</enum><text>the Great Lakes Commission; and</text></item> 
<item id="H67CAED971F7F4BD6A9A4F7C57FA837D1"><enum>(dd)</enum><text>Canada.</text></item></subclause></clause> 
<clause id="H4492DAFAD2FE4D1892EBE652B4C91C9D"><enum>(iv)</enum><header>Committees</header><text>The Council may establish such committees as the Council determines to be appropriate for issues including—</text> 
<subclause id="HC05FFC5CCFAC4A7DA8B0879921D3D3F5"><enum>(I)</enum><text>executive issues;</text></subclause> 
<subclause id="H83431F2C1C91472DB2AFF29845087E5B"><enum>(II)</enum><text>science issues;</text></subclause> 
<subclause id="H562225D16D084E098B098FC44C65640C"><enum>(III)</enum><text>implementation issues; and</text></subclause> 
<subclause id="HE007B2E4E9804B0E870699ADA924B11E"><enum>(IV)</enum><text>funding issues.</text></subclause></clause> 
<clause id="HD6C87352F5E34F7EBFEA2443FA142F04"><enum>(v)</enum><header>Meetings</header> 
<subclause id="HA57A99D2996247429A849D324601C306"><enum>(I)</enum><header>In general</header><text>The Council shall meet not less frequently than once each year.</text></subclause> 
<subclause id="HF89421DEBEFD4C59810012DF6F6268EB"><enum>(II)</enum><header>Open to public</header><text>The meetings of the Council shall be held open to the public.</text></subclause></clause> 
<clause id="HAD37064359FC4A8B9DCD652CCFD2FBED"><enum>(vi)</enum><header>Operation</header><text>The Council shall operate on a consensus basis.</text></clause> 
<clause id="H60C99E6C51AB4AB9B522722A39A2BAD8"><enum>(vii)</enum><header>Costs</header><text>The Agency shall pay the operating costs of the Council.</text></clause></subparagraph> 
<subparagraph id="H0D257FBF50894876A2A92EDC43D4BE74"><enum>(B)</enum><header>Great Lakes Management Committee</header> 
<clause id="HF247A16E52B2422E89D52AFE9D28E675"><enum>(i)</enum><header>Establishment</header><text>There is established within the Council a committee, to be known as the <quote>Great Lakes Management Committee</quote>.</text></clause> 
<clause id="H3CFE500304044BCCA8512A44655A2206"><enum>(ii)</enum><header>Duties</header><text>The Great Lakes Management Committee shall—</text> 
<subclause id="HCBD3EF707D5441D4BD5CF974B3A1B79A"><enum>(I)</enum><text>submit reports to the Council, including recommendations regarding relevant issues;</text></subclause> 
<subclause id="HC9A40BC98C9744EC9EFCD446EC98FE5A"><enum>(II)</enum><text>provide direction for the planning, assessment, and reporting efforts of the Council;</text></subclause> 
<subclause id="H10D59B4143B440B9910852E00268929A"><enum>(III)</enum><text>monitor and assist in implementation activities relating to Great Lakes management; and</text></subclause> 
<subclause id="H6DF29A1280A74D1683B0810C356F7653"><enum>(IV)</enum><text>engage in ongoing problem solving regarding Great Lakes management.</text></subclause></clause> 
<clause id="HEAE2F44200AD4D5EA88EA489539C913C"><enum>(iii)</enum><header>Membership</header> 
<subclause id="H06C9CCF7C9E24F359264B93812B0236F"><enum>(I)</enum><header>Membership</header><text>The Great Lakes Management Committee shall consist of 11 members, of whom—</text> 
<item id="HBA18CCA128AB45AB811372F234FB9B7F"><enum>(aa)</enum><text>1 shall be appointed by each unit of government included in the membership of the Council;</text></item> 
<item id="H914F944F15B94CAC833CB86B73DB3DE7"><enum>(bb)</enum><text>1 shall be appointed by the Great Lakes Commission;</text></item> 
<item id="H3DC61D80056B4E23AA1284B7C37C583B"><enum>(cc)</enum><text>1 shall be appointed by the International Joint Commission;</text></item> 
<item id="H833B085EACAC42A9B5F998D2E39DB115"><enum>(dd)</enum><text>1 shall be appointed by the Great Lakes Fishery Commission;</text></item> 
<item commented="no" id="HDC923630936B4221BB778F12C458CCFE"><enum>(ee)</enum><text>1 shall be a representative of the environmental community in the Great Lakes, to be appointed by the Administrator, after soliciting advice from that community;</text></item> 
<item commented="no" id="HAB97583643A047158A93768822DE076D"><enum>(ff)</enum><text>1 shall be a representative of the agricultural community, to be appointed by the Administrator, after soliciting advice from that community;</text></item> 
<item commented="no" id="HC034AF92BED248F79D2110F62F320EE5"><enum>(gg)</enum><text>1 shall be a representative of Great Lakes industry, to be appointed by the Administrator, after soliciting advice from that industry;</text></item> 
<item commented="no" id="H1A9BD18FD2454C7597B7D9BFF80E4557"><enum>(hh)</enum><text>1 shall be a representative of the scientific community, to be appointed by the Administrator, after soliciting advice from that community; and</text></item> 
<item commented="no" id="HA9FCA703EC454322B9503E2D41C1C1B7"><enum>(ii)</enum><text>1 shall be a representative of Canada, who shall serve as an observer member.</text></item></subclause> 
<subclause id="HF1C33B76116148208A84AE903F5A0518"><enum>(II)</enum><header>Chairperson</header><text>The senior advisor on Great Lakes of the Agency (or a designee) shall serve as chairperson of the Great Lakes Management Committee.</text></subclause> 
<subclause id="H8EE40F12D0F14CD89B38664476D271F0"><enum>(III)</enum><header>Secretary</header><text>The Director of the Program Office shall serve as secretary of, and provide administrative support to, the Great Lakes Management Committee.</text></subclause></clause> 
<clause id="HEB1D61F8BBE240C08F7D63A5919CA89A"><enum>(iv)</enum><header>Meetings</header> 
<subclause id="H4FB04BC677A6477889A44B30DD696FBF"><enum>(I)</enum><header>In general</header><text>The Great Lakes Management Committee shall meet not less frequently than once each quarter.</text></subclause> 
<subclause id="H57B472BF9EB2468FA6F781D92CAFCDD0"><enum>(II)</enum><header>Open to public</header> 
<item id="H07DC920535D748FE99ED1899054A3F46"><enum>(aa)</enum><header>In general</header><text>Subject to item (bb), the meetings of the Great Lakes Management Committee shall be held open to the public.</text></item> 
<item id="HD5194D738F67420F9C394804C4C495D2"><enum>(bb)</enum><header>Executive sessions</header><text>The Great Lakes Management Committee may hold executive sessions that are closed to the public.</text></item></subclause></clause> 
<clause id="H5512A588675044B58CBBE162C11E0BDA"><enum>(v)</enum><header>Operation</header><text>The Great Lakes Management Committee shall operate on a consensus basis.</text></clause>

<subparagraph commented="no" id="H43CA31FD1E834D48AAEE74D4C2EAAB2D"><enum>(B)</enum><header>Coordination</header><text>The Program Office shall coordinate, to the maximum extent practicable, with the Great Lakes Interagency Task Force established by subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H776730F12E1845E28AB95C53D35FE512"><enum>(5)</enum><text>in paragraph (8)—</text> 
<subparagraph id="H91791938E5C14F8688DFD50B833037D6"><enum>(A)</enum><text>by redesignating subparagraphs (A) through (C) as clauses (i) through (iii), respectively, and indenting the clauses appropriately;</text></subparagraph>

<subparagraph id="H44FB40C659884C109724CEFB334E13C2"><enum>(B)</enum><header>Annual reports</header><text>Not later than 30 days after the date of publication of the budget for a fiscal year, the Administrator shall submit to Congress a report that describes—</text> 
<clause id="H3272FAB3A9BA4232812DA3CE479AC6C2"><enum>(i)</enum><text>with respect to each organizational element of the Agency referred to in subparagraph (A)—</text> 
<subclause id="H31AE9C7DD9724733AF84DF236287C52A"><enum>(I)</enum><text>the budget of the element for Great Lakes restoration activities for the applicable fiscal year;</text></subclause> 
<subclause id="HB3FE06D1366B4E5CA7AD15EA8B414FD2"><enum>(II)</enum><text>each Great Lakes restoration activity to be carried out by the element during the applicable fiscal year; and</text></subclause> 
<subclause id="H564BB771E52240BAA5B45969E47AF675"><enum>(III)</enum><text>the means by which progress made on those activities will be evaluated; and</text></subclause></clause> 
<clause id="H7124F87AE1524F0E819D44FC6A5892E0"><enum>(ii)</enum><text>with respect to each recommendation submitted by the Great Lakes Leadership Council during the preceding fiscal year, the reasons why the Administrator approved or disapproved the recommendation.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HF3D6E881AB964FD9BE912189151459A8"><enum>(6)</enum><text>in paragraph (12)(H), by striking clause (i) and inserting the following:</text>

<subparagraph id="H3FE56368D9524ABDA8654F6923EBE66D"><enum>(A)</enum><header>Findings</header><text>Congress finds that—</text> 
<clause id="HBF37A66D36EA4C41A31FA20C13872610"><enum>(i)</enum><text>the goal of the Great Lakes program of the Agency is to restore and maintain the chemical, physical, and biological integrity of the Great Lakes basin ecosystem; and</text></clause> 
<clause id="H2FC9835489C1457FBF9DF77557F8F00A"><enum>(ii)</enum><text>in 2010, the Agency, in coordination with Federal partners, will commence implementation of a new Great Lakes Restoration Initiative (referred to in this paragraph as the <term>Initiative</term>), which will—</text> 
<subclause id="H3151FB4EBA2C435A86A3E7262C15E299"><enum>(I)</enum><text>identify programs and projects that are strategically selected to target the most significant environmental problems in the Great Lakes ecosystem;</text></subclause> 
<subclause id="H29305BD2BA1348E0AC8FECE5A34DBB92"><enum>(II)</enum><text>be based on the work of—</text> 
<item id="H0533056850BF439288C2AFD97B6A9ED8"><enum>(aa)</enum><text>the Great Lakes Interagency Task Force established by paragraph (7)(A); and</text></item> 
<item id="H9048438064E04478A674043D943C8111"><enum>(bb)</enum><text>the stakeholders and nongovernmental partners of the Great Lakes Leadership Council; and</text></item></subclause> 
<subclause id="HBB458E9BE0F0467E9937B7386CF3B0FF"><enum>(III)</enum><text>represent the commitment of the Federal Government to significantly advancing Great Lakes protection and restoration.</text></subclause></clause></subparagraph> 
<subparagraph id="H44A8323A95BA414385AC05C4F373FD3B"><enum>(B)</enum><header>Priority</header><text>The Initiative shall give priority to work done by non-Federal partners using funding made available for the Great Lakes for—</text> 
<clause id="H3CB06DFB735D43CA8C743D73C987F235"><enum>(i)</enum><text>the remediation of toxic substances in Areas of Concern;</text></clause> 
<clause id="HE5CB3C37C84541E0ACC6832CE35054B3"><enum>(ii)</enum> 
<subclause commented="no" display-inline="yes-display-inline" id="H5BD1C2DC2CD84F72ABD85E2000D8E5FE"><enum>(I)</enum><text>the prevention of invasive species; and</text></subclause> 
<subclause id="HF100549CAE7947B19C9BC55AE5B1D394" indent="up1"><enum>(II)</enum><text>the mitigation and restoration of the impacts of invasive species;</text></subclause></clause> 
<clause id="H99BE87BFB7BE4DE1AE151931B21D7DED"><enum>(iii)</enum> 
<subclause commented="no" display-inline="yes-display-inline" id="H9E3698138A34413DB8406092C2823058"><enum>(I)</enum><text>the protection and restoration of nearshore health; and</text></subclause> 
<subclause id="H97CA067C3E5E4FEEAD2DD66628F0CD75" indent="up1"><enum>(II)</enum><text>the prevention of nonpoint source pollution;</text></subclause></clause> 
<clause id="H939E10EAC6E64731A6F4CF067ED7290B"><enum>(iv)</enum><text>habitat and wildlife protection and restoration; and</text></clause> 
<clause id="HD68A419C9D4F4CA387F5A9C7F42D9737"><enum>(v)</enum><text>accountability, monitoring, evaluation, communication, and partnership activities.</text></clause></subparagraph> 
<subparagraph id="H40581D6EC94B4ED29EFB3A7E82162729"><enum>(C)</enum><header>Projects</header><text>Pursuant to the Initiative, the Agency shall consult with Federal partners and take into consideration the recommendations of the Council to select the best combination of programs and projects for Great Lakes protection and restoration using principles and criteria such as—</text> 
<clause id="HC95C60B44AED4B828D0323A16BE1EB44"><enum>(i)</enum><text>the ability to achieve strategic and measurable environmental outcomes;</text></clause> 
<clause id="HE12EC61022664A87B7959E6EC5076088"><enum>(ii)</enum><text>the feasibility of—</text> 
<subclause id="HA14DDE06AE7A4A2BA37C4867E6AE6592"><enum>(I)</enum><text>prompt implementation;</text></subclause> 
<subclause id="HAACF72530A5E4837A6705C5EA57FEE77"><enum>(II)</enum><text>timely achievement of results; and</text></subclause> 
<subclause id="H65882DC2B97B49CEABCFD9D91B5F7CF8"><enum>(III)</enum><text>the ability to leverage resources; and</text></subclause></clause> 
<clause id="H3DD56023EFB74C63AE746F90108BEE17"><enum>(iii)</enum><text>opportunities for interagency and interorganizational coordination and collaboration.</text></clause></subparagraph> 
<subparagraph id="H075FC6A8B4DB48279E3962976483C8E8"><enum>(D)</enum><header>Implementation of projects</header> 
<clause id="H285187308A2D405CB3DD8229C16AFA78"><enum>(i)</enum><header>In general</header><text>Funds made available to carry out the Initiative shall be used to strategically implement—</text> 
<subclause id="HC2CCC80C297147E59C4A6C27165AFC7E"><enum>(I)</enum><text>Federal projects; and</text></subclause> 
<subclause id="HF0097602DE1848F9AF6A771FF0079429"><enum>(II)</enum><text>projects carried out in coordination with States, Indian tribes, municipalities, institutions of higher education, and other organizations.</text></subclause></clause> 
<clause id="H445043B8FB4B48208C17D7DC10BE6609"><enum>(ii)</enum><header>Transfer of funds</header><text>Of amounts made available for environmental programs and management for the Great Lakes Initiative, the Administrator may—</text> 
<subclause id="H63AAAAA2EED14A038500684F5B7C768E"><enum>(I)</enum><text>transfer not more than $475,000,000 to the head of any Federal department or agency, with the concurrence of the department or agency head, to carry out activities to support the Great Lakes Restoration Initiative and the Great Lakes Water Quality Agreement of 1978;</text></subclause> 
<subclause id="H8C4DCA30A4754D81A6584904AECF4504"><enum>(II)</enum><text>enter into an interagency agreement with the head of any Federal department or agency to carry out activities described in subclause (I); and</text></subclause> 
<subclause id="H560CA0AB44CE4391A1EE9CFA563A42D4"><enum>(III)</enum><text>make grants to governmental entities, nonprofit organizations, institutions, and individuals for planning, research, monitoring, outreach, and implementation relating to the activities described in subclause (I).</text></subclause></clause></subparagraph> 
<subparagraph id="HA68CE5BA5F3F4EF5911F3A7D674854A3"><enum>(E)</enum><header>Scope</header> 
<clause id="H3BED737EE53C4961BE49B01749617883"><enum>(i)</enum><header>In general</header><text>Projects shall be carried out pursuant to the Initiative on multiple levels, including—</text> 
<subclause id="HEE58B1EBA5E14536B68FAFEBDBA7921D"><enum>(I)</enum><text>local;</text></subclause> 
<subclause id="H436F39F095664D28AB423F41ACEFD291"><enum>(II)</enum><text>Great Lake-wide; and</text></subclause> 
<subclause id="HD8DE18C5FE1E412982B0EC799C4FD75A"><enum>(III)</enum><text>Great Lakes basin-wide.</text></subclause></clause> 
<clause id="HA89968BE0AA446B78FCE1315A493E509"><enum>(ii)</enum><header>Limitation</header><text>No funds made available to carry out the Initiative may be used for any water infrastructure activity that is carried out using funds made available under the clean water or drinking water State revolving fund program.</text></clause></subparagraph> 
<subparagraph id="H26FBC3C3C014468E8A2E17AB456AB332"><enum>(F)</enum><header>Activities by other Federal agencies</header><text>Each relevant Federal department and agency shall, to the maximum extent practicable—</text> 
<clause id="HD1964C5202EF438285C019B51B5602D9"><enum>(i)</enum><text>maintain the base level of funding for the Great Lakes activities of the agency; and</text></clause> 
<clause id="H4698E84BEEC74D71A17947B399BE7FC9"><enum>(ii)</enum><text>identify new activities and projects to support the environmental goals of the Initiative.</text></clause></subparagraph> 
<subparagraph id="HC1080C220E70475785DD8AE87ED2968E"><enum>(G)</enum><header>Funding</header> 
<clause commented="no" id="HAE0BAA3C65C04F179B7CF14DEACD2107"><enum>(i)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out the Initiative $475,000,000 for each of fiscal years 2011 through 2016.</text></clause> 
<clause id="HE6E1F0F4B85042FEA201BA305F993ED4"><enum>(ii)</enum><header>Partnerships</header><text>Of the amounts made available to carry out the Initiative, the Administrator shall transfer expeditiously to the Federal partners of the Initiative such sums as are necessary for subsequent use and distribution by the Federal partners in accordance with this section.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H8CCE640553F245EF8B9582B97F94D835"><enum>(c)</enum><header>Authorization of appropriations</header><text>Section 118 of the Federal Water Pollution Control Act (33 U.S.C. 1268) is amended by striking subsection (h) and inserting the following:</text>

<subsection id="H9AE17EAE6B2A47859EEC6B9D32191D6C"><enum>(h)</enum><header>Authorization of appropriations for Program Office</header><text>There is authorized to be appropriated to the Administrator to carry out this section $25,000,000 for each of fiscal years 2011 through 2016.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD5D2CEB8252B406A9091F567BCC7A81A"><enum>(d)</enum><header>Effect of section</header><text>Nothing in this section or an amendment made by this section affects—</text> 
<paragraph id="H5C0F83556B844B3992062181A1954D2A"><enum>(1)</enum><text>the jurisdiction, powers, or prerogatives of—</text> 
<subparagraph id="HB193907000A94240AD605CB7697A4736"><enum>(A)</enum><text>any department, agency, or officer of—</text> 
<clause id="HC934ED38F17146F59612CB2AD6DF722D"><enum>(i)</enum><text>the Federal Government; or</text></clause> 
<clause id="HA3BA75CC11CD4990968636806DE25032"><enum>(ii)</enum><text>any State or tribal government; or</text></clause></subparagraph> 
<subparagraph id="HA0E26AD9326947F0A4A674B273046F7A"><enum>(B)</enum><text>any international body established by treaty with authority relating to the Great Lakes (as defined in section 118(a)(3) of the Federal Water Pollution Control Act (33 U.S.C. 1268(a)(3))); or</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H1555A652DE6A439B9D6C19341FF55E1E"><enum>(2)</enum><text>any other Federal or State authority that is being used or may be used to facilitate the cleanup and protection of the Great Lakes (as so defined).</text></paragraph></subsection></section>
