<official-title>To amend the Internal Revenue Code of 1986 to encourage the deployment of highly efficient combined heat and power property, and for other purposes.</official-title>

<section id="HD6E4F8C5016041039FCB88F2B3BC0C38" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Innovative Energy Systems Act of 2010</short-title></quote>.</text></section> 
<section id="HA1062EDF93E84B388D62D23FEA2C6EBC"><enum>2.</enum><header>Investment tax credit for highly efficient combined heat and power system property</header> 
<subsection id="H14EA5967073849B5BD56FA94C78AB931"><enum>(a)</enum><header>In general</header><text>Clause (i) of section 48(a)(2)(A) of the Internal Revenue Code of 1986 is amended by striking <quote>and</quote> at the end of subclause (III), by redesignating subclause (IV) as subclause (V), and by inserting after subclause (III) the following new subclause:</text>

<subclause id="H9889D01DC5454F57A926F1668533539E"><enum>(IV)</enum><text>energy property described in paragraph (3)(A)(viii), and</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H234616DEE34342699C6C2FFFA7E159C0"><enum>(b)</enum><header>Treated as energy property</header><text>Subparagraph (A) of section 48(a)(3) of such Code is amended by striking <quote>or</quote> at the end of clause (vi), by inserting <quote>or</quote> at the end of clause (vii), and by adding at the end the following new clause:</text>

<clause id="HCC1CC4AEE13F4935AEA0B4F12F0A3107"><enum>(viii)</enum><text display-inline="yes-display-inline">highly efficient combined heat and power system property,</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA5E25D883F954A5297468FA55CB83FCC"><enum>(c)</enum><header>Highly efficient combined heat and power system property</header><text>Subsection (c) of section 48 of such Code is amended by adding at the end the following new paragraph:</text>

<paragraph id="H4C091C4F3A32455E8F2CC63591B758F3"><enum>(5)</enum><header>Highly efficient combined heat and power system property</header> 
<subparagraph id="H51A2BFB466374F8B9870A6936B6D5753"><enum>(A)</enum><header>Highly efficient combined heat and power system property</header><text>The term <quote>highly efficient combined heat and power system property</quote> means property at an industrial, commercial, or institutional facility comprising a system which—</text> 
<clause id="HB43D5E43B5854D09B982825A44CAC90C"><enum>(i)</enum> 
<subclause id="HA2B7B502955E49E7B16BEC6877A852C3" display-inline="yes-display-inline"><enum>(I)</enum><text>uses the same energy source for the simultaneous or sequential generation of electrical power, mechanical shaft power, or both, in combination with the generation of steam or other forms of useful thermal energy (including heating and cooling applications),</text></subclause> 
<subclause id="H1149A19B593D4C19AF55CE69BC57F7F3" indent="up1"><enum>(II)</enum><text>has a system design that provides an energy efficiency percentage of at least 70 percent, and</text></subclause> 
<subclause id="H5ABA5244E51B4D03BCD58827F9038CFB" indent="up1"><enum>(III)</enum><text>is placed in service before January 1, 2017, or</text></subclause></clause> 
<clause id="H85C444D9C5684A2BBDD4682E0EBFC462"><enum>(ii)</enum> 
<subclause id="H6C132BC3C9894BCBADED77AAFBFD413C" display-inline="yes-display-inline"><enum>(I)</enum><text>recovers waste energy from which electricity is generated through the modification of an existing facility or addition of a new facility, and</text></subclause> 
<subclause id="HBFAEC5159476472D80456E01EC116A53" indent="up1"><enum>(II)</enum><text>is placed in service before January 1, 2017.</text></subclause></clause></subparagraph> 
<subparagraph id="H042216B9812842AFADB4AB2B1D2B8D86"><enum>(B)</enum><header>Limitation</header> 
<clause id="H5801D8668A694E31B084591FF1FFC502"><enum>(i)</enum><header>In general</header><text>In the case of highly efficient combined heat and power system property with an electrical capacity in excess of the applicable capacity, the credit under subsection (a)(1) (determined without regard to this paragraph) with respect to such property for the taxable year in which such property was placed in service shall not exceed the amount which bears the same ratio to such credit as the applicable capacity bears to the capacity of such property.</text></clause> 
<clause id="H168BE9AE27BE4227896ABCF1ED9D0C24"><enum>(ii)</enum><header>Applicable capacity</header><text>For purposes of clause (i), the term <quote>applicable capacity</quote> means 25 megawatts or a mechanical energy capacity of more than 34,000 horsepower or an equivalent combination of electrical and mechanical capacities.</text></clause></subparagraph> 
<subparagraph id="H74EA17E7514D4681A438AA24BA07ACC4"><enum>(C)</enum><header>Institutional facility</header><text>The term <quote>institutional facility</quote> means a hospital or a facility of an educational organization described in section 170(b)(1)(A)(ii).</text></subparagraph> 
<subparagraph id="H3869F4FC376D429EAC382AA1E5D6B1E2"><enum>(D)</enum><header>Commercial facility</header><text>The term <quote>commercial facility</quote> shall not include any facility of a utility. </text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H393CAFE6671E460BA8C72D4DF5480564"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to property placed in service after the date of the enactment of this Act.</text></subsection></section>
