<official-title>To amend title 18, United States Code, to place limitations on the possession, sale, and other disposition of a firearm by persons convicted of misdemeanor sex offenses against children.</official-title>

<section id="H1A6D8518E43646ECAFAAC021B59E1EF3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keep Kids Safe Act of 2010</short-title></quote>.</text></section> 
<section id="H0E8AAC1C89164F40BFBDEE0CCCA4F848"><enum>2.</enum><header>Limits on possession, sale, and disposition of firearms by persons convicted of misdemeanor sex offenses against minors</header> 
<subsection id="H14C94004BBFF41119C7EFC2A781B6B82"><enum>(a)</enum><header>Disposition of firearm</header><text>Section 922(d) of title 18, United States Code, is amended—</text> 
<paragraph id="HDEC86AD6783649BF9C120668BDE01773"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of paragraph (8);</text></paragraph> 
<paragraph id="H5E005FA257B049F1AF70B498E25C9449"><enum>(2)</enum><text>by striking the period at the end of paragraph (9) and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="H151E173B8E124721A31B04C7F14EF091"><enum>(3)</enum><text>by inserting after paragraph (9) the following:</text>

<paragraph id="H5CC94347D9584593868B27028368EE40"><enum>(10)</enum><text>has been convicted in any court of a misdemeanor sex offense against a minor.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HEA002712E24744F0A0E935035D6805CB"><enum>(b)</enum><header>Possession of firearm</header><text>Section 922(g) of title 18, United States Code, is amended—</text> 
<paragraph id="H6B45E171045E42A1B1D83EE02396DE59"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of paragraph (8);</text></paragraph> 
<paragraph id="HA9B64B79CB524D0AB1313A4780E1604E"><enum>(2)</enum><text>by striking the comma at the end of paragraph (9) and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="HD891E95500B44E25B34FBDB7AF1D2F2F"><enum>(3)</enum><text>by inserting after paragraph (9) the following:</text>

<paragraph id="HF86A1F4162C943B0977229515FD7133C"><enum>(10)</enum><text>who has been convicted in any court of a misdemeanor sex offense against a minor,</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H833573E7A09D43E2BD5B3414D44BB332"><enum>(c)</enum><header>Misdemeanor sex offense against a minor defined</header><text>Section 921(a) of such title is amended by adding at the end the following:</text> 
<quoted-block id="H26E19D3D33A04BDABD6ADE56AB15FFDC" style="OLC"> 
<paragraph id="H67BEB474F90F42DC80F559D515F7A76E"><enum>(36)</enum> 
<subparagraph id="H13A55AA1F38D4B5B811372ECA2947483" display-inline="yes-display-inline"><enum>(A)</enum><text>The term <quote>misdemeanor sex offense against a minor</quote> means a sex offense against a minor punishable by imprisonment for not more than one year.</text></subparagraph> 
<subparagraph id="H9AF2AE637C4848A88D6A8854A041C3E2" indent="up1"><enum>(B)</enum><text>The term <quote>sex offense</quote> means a criminal offense that has, as an element, a sexual act or sexual contact with another, or an attempt or conspiracy to commit such an offense.</text></subparagraph> 
<subparagraph id="H58A37E3933344A51AD70354C78EC5D29" indent="up1"><enum>(C)</enum><text>The term <quote>minor</quote> means an individual who has not attained 18 years of age.</text></subparagraph> 
<subparagraph id="HEB8D6EBFCB4E4C54B6AE0A9E285152D1" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">A person shall not be considered to have been convicted of a misdemeanor sex offense against a minor for purposes of this chapter—</text> 
<clause id="HE8D3AB33BBDA4400B997B28890FB38EA"><enum>(i)</enum><text>unless—</text> 
<subclause id="H528E3116BEC14E6EA65A37F42FFA3DEE"><enum>(I)</enum><text>the person was represented by counsel in the case, or knowingly and intelligently waived the right to counsel in the case; and</text></subclause> 
<subclause id="HA0322EEB87D94D07A22A350B19AC61E0"><enum>(II)</enum><text>in the case of a prosecution for the offense for which a person was entitled to a jury trial in the jurisdiction in which the case was tried—</text> 
<item id="HA05CD0B1B3494F69B68FFDEEE86028ED"><enum>(aa)</enum><text>the case was tried by a jury; or</text></item> 
<item id="H07BB524E97B74F99891016DBEE0057CB"><enum>(bb)</enum><text>the person knowingly and intelligently waived the right to have the case tried by a jury, by guilty plea or otherwise; or</text></item></subclause></clause> 
<clause id="H87B30B7EEEF34DE8B4DBAEDCE6C957D6"><enum>(ii)</enum><text>if the conviction has been expunged or set aside, or is an offense for which the person has been pardoned or has had civil rights restored (if the law of the applicable jurisdiction provides for the loss of civil rights under such an offense), unless the pardon, expungement, or restoration of civil rights expressly provides that the person may not ship, transport, possess, or receive firearms.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
