			 49, United States Code</header><text display-inline="no-display-inline">Except
			 as otherwise specifically provided, whenever in this Act an amendment or repeal
			 is expressed in terms of an amendment to, or repeal of, a section or other
			 provision of law, the reference shall be considered to be made to a section or
			 other provision of title 49, United States Code.</text>
		</section><section id="H91D504ABDE004991950BB3B47E7F1DD5"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 1101 is amended to read as
			 follows:</text>

				<section commented="no" id="H69C471D77727455397C5370162D9CE45"><enum>1101.</enum><header>Definitions</header>
					<subsection commented="no" id="H751F99829C504DFC843F50B15F2EA9F1"><enum>(a)</enum><header>Accident
				defined</header><text display-inline="yes-display-inline">In this chapter, the
				term <quote>accident</quote>—</text>
						<paragraph commented="no" id="HCAF586D27F5D4B10B1111FEE74A2C8DE"><enum>(1)</enum><text display-inline="yes-display-inline">means an event associated with the
				operation of a vehicle, aircraft, or pipeline, which results in damage to or
				destruction of the vehicle, aircraft, or pipeline, or which results in the
				death of or serious injury to any person, regardless of whether the initiating
				event is accidental or otherwise; and</text>
						</paragraph><paragraph commented="no" id="HBBD29CAEF0224CA28132E83BB008C7AD"><enum>(2)</enum><text display-inline="yes-display-inline">may include an incident that does not
				involve destruction or damage of a vehicle, aircraft, or pipeline, but affects
				transportation safety, as the Board prescribes by regulation.</text>
						</paragraph></subsection><subsection commented="no" id="HCFAC6D508C604520988BCA69DD606442"><enum>(b)</enum><header>Applicability of
				definitions in other laws</header><text>The definitions contained in
				<external-xref legal-doc="usc" parsable-cite="usc/46/2101">section
				2101(17a)</external-xref> of title 46 and section 40102(a) of this title apply
				to this
				chapter.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			 organization</header><text display-inline="no-display-inline">The last sentence
			 of section 1111(d) is amended by striking <quote>absent</quote> and inserting
			 <quote>unavailable</quote>.</text>

			<subsection id="H95F9CF93CE7E4F439988FCDF03E0D157"><enum>(a)</enum><header>General
			 authority</header><text display-inline="yes-display-inline">Section 1113(a) is
			 amended—</text>
				<paragraph id="HE9C802D4C01E4FFAA900C83AFD825621"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="H1F6B2C1E990F4A9A9CFA6C291FEEF9A8"><enum>(A)</enum><text>by inserting

			 powers</header>
				<paragraph id="H98E356EC3B564AF3BF979D8606E7EAFA"><enum>(1)</enum><header>Authority of
			 Board to enter into contracts and other agreements with nonprofit
			 entities</header><text>Section 1113(b)(1)(H) is amended by inserting <quote>and
			 other agreements</quote> after <quote>contracts</quote>.</text>
				</paragraph><paragraph id="HFC565951B41F468FB6A3C1F54ABA4569"><enum>(2)</enum><header>Authority of
			 Board to enter into and perform contracts, agreements, leases, or other
			 transactions</header><text>Section 1113(b) is amended—</text>
					<subparagraph id="HE50F4EFCD9424A2F993D6C725F588133"><enum>(A)</enum><text>by striking
			 paragraph (1)(I) and inserting the following:</text>

				and local governments, and governments of foreign countries on such terms and
				conditions as the Chairman of the Board considers appropriate to carry out the
				functions of the Board and require that such entities provide appropriate
				consideration for the reasonable costs of any facilities, goods, services, or
				training provided by the Board.</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H10047CF72ECF4E42BCCC87182A225C38"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H003D2EFB7ADE40BDB2492F8DCBD0864D" style="OLC">
							<paragraph id="H10B8877186F8482DBDA6429200B1AADB"><enum>(3)</enum><header>Lease
				limitation</header><text display-inline="yes-display-inline">The authority of
				the Board to enter into leases shall be limited to the provision of special use
				space related to an accident investigation, or for general use space, at an
				average annual rental cost of not more than $300,000 for any individual
				property.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HC251D7322DF643C7BA13601EB067AC73"><enum>(3)</enum><header>Authority of
			 other Federal agencies</header><text>Section 1113(b)(2) is amended to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="HC8DCF13DF34D498788E44EFDF1C8DCC9" style="OLC">
						<paragraph id="HBAB09E781FD84D26BF1FB8DEE14EBD12"><enum>(2)</enum><header>Authority of
				other Federal agencies</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
				the head of a Federal department, agency, or instrumentality may transfer to or
				receive from the Board, with or without reimbursement, supplies, personnel,
				services, and equipment (other than administrative supplies and
				equipment).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H58FEA92F444D4342BA1FD6FC461F2744"><enum>(c)</enum><header>Criteria on
			 public hearings</header>
				<paragraph id="HC6602E3D37584FED8CC5FDB4E3C3AF98"><enum>(1)</enum><header>In
			 general</header><text>Section 1113 is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H8B259559293D47FA9F9BFCD350D6516F" style="OLC">
						<subsection id="H8AC38F20A0104522B5FF1CF841D4D02B"><enum>(i)</enum><header>Public
				hearings</header>
							<paragraph id="H0965F2FD498D47EB83E6DA72B44DABDE"><enum>(1)</enum><header>Development of
				criteria</header><text>The Board shall establish by regulation criteria to be
				used by the Board in determining, for each accident investigation and safety
				study undertaken by the Board, whether or not the Board will hold a public
				hearing on the investigation or study.</text>
							</paragraph><paragraph id="HD48E57A2F45C41FB81D18AECA3A39169"><enum>(2)</enum><header>Factors</header><text>In
				developing the criteria, the Board shall give priority consideration to the
				following factors:</text>
								<subparagraph id="HBD62B79439C34102BBEC7F6C373BCE30"><enum>(A)</enum><text>Whether the
				accident has caused significant loss of life.</text>
								</subparagraph><subparagraph id="H886B209A38EF471FA0FB649F6442085A"><enum>(B)</enum><text>Whether the
				accident has caused significant property damage.</text>
								</subparagraph><subparagraph id="HF435B7E5DBBE4B9592356F8DF5035679"><enum>(C)</enum><text>Whether the
				accident may involve a national transportation safety issue.</text>
								</subparagraph><subparagraph id="H8467D0D2B7484F4FBE311BE4F94DF719"><enum>(D)</enum><text>Whether a public
				hearing may provide needed information to the Board.</text>
								</subparagraph><subparagraph id="H9987AE03A929448C8A42AFDCBDBD632F"><enum>(E)</enum><text>Whether a public
				hearing may offer an opportunity to educate the public on a safety
				issue.</text>
								</subparagraph><subparagraph id="H387D0787A7F94E1FB0D4785F0BB5D8E8"><enum>(F)</enum><text>Whether a public
				hearing may increase both the transparency of the Board’s investigative process
				and public confidence that such process is comprehensive, accurate, and
				unbiased.</text>
								</subparagraph><subparagraph id="H784E2A6DD7B3447A9E515AEAEC617CD2"><enum>(G)</enum><text display-inline="yes-display-inline">Whether a public hearing is likely to
				significantly delay the conclusion of an investigation and whether the possible
				adverse effects of the delay on safety outweigh the benefits of a public
				hearing.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HCF07ADEACADB411E965AD11F2F9EA0C4"><enum>(2)</enum><header>Annual
			 report</header><text>Section 1117 is amended—</text>
					<subparagraph id="H74E22E6CE2224E5D9DFE12B85DC7978D"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (5);</text>
					</subparagraph><subparagraph id="H1B06BB196D2F44EBBBAA50BB63BFBDBD"><enum>(B)</enum><text>by striking the
			 period at the end of paragraph (6) and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="H25B077F9630E481E9D779D665E012E91"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H083F361753F140138E575FDB5640E4D1" style="OLC">
							<paragraph id="HB02E3CD15A044D4A9086CFD764B552B0"><enum>(7)</enum><text display-inline="yes-display-inline">an analysis of the Board’s implementation
				of the criteria established pursuant to section 1113(i) during the prior
				calendar year, including an explanation of any instance in which the Board did
				not hold a public hearing for an investigation of an accident that has caused
				significant loss of life or property damage or that may involve a national
				transportation safety
				issue.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H0D04413AF0604745B568101FF7DF7F83"><enum>(d)</enum><header>Accidental death
			 and dismemberment insurance</header><text display-inline="yes-display-inline">Section 1113 is further amended by adding
			 at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HF3407A6694A54B8090A3726DA53F6997" style="OLC">
					<subsection id="HBEAD42CE101D4984B7DFCDD21470B01F"><enum>(j)</enum><header>Accidental death
				and dismemberment insurance</header>
						<paragraph id="H0C2996724B524C8A9E1EF89DCE60C2B6"><enum>(1)</enum><header>Authority to
				provide insurance</header><text>The Board may procure accidental death and
				dismemberment insurance for an employee of the Board who travels for an
				accident investigation or other activity of the Board outside the United States
				or inside the United States under hazardous circumstances, as defined by the
				Board.</text>
						</paragraph><paragraph id="HCCDFFA9F4E7449E1811A52041853265E"><enum>(2)</enum><header>Crediting of
				insurance benefits to offset United States tort liability</header><text display-inline="yes-display-inline">Any amounts paid to a person under
				insurance coverage procured under this subsection shall be credited as
				offsetting any liability of the United States to pay damages to that person
				under <external-xref legal-doc="usc" parsable-cite="usc/28/1346">section
				1346(b)</external-xref> of title 28,
				<external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28,
				<external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/163">chapter 163</external-xref> of title 10, or
				any other provision of law authorizing recovery based upon tort liability of
				the United States in connection with the injury or death resulting in the
				insurance payment.</text>
						</paragraph><paragraph id="H0FF2F8879A4142EBBE77309B78C05D6B"><enum>(3)</enum><header>Treatment of
				insurance benefits</header><text display-inline="yes-display-inline">Any
				amounts paid under insurance coverage procured under this subsection shall
				not—</text>
							<subparagraph id="H80DEB57D90C2469495B3E22BA4B38CAD"><enum>(A)</enum><text>be considered
				additional pay or allowances for purposes of
				<external-xref legal-doc="usc" parsable-cite="usc/5/5536">section
				5536</external-xref> of title 5; or</text>
							</subparagraph><subparagraph id="H6193A3BAA9334D85B61F38642A3082AB"><enum>(B)</enum><text>offset any
				benefits an employee may have as a result of government service, including
				compensation under
				<external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">chapter
				81</external-xref> of title 5.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAA64540AA7664654BDCC55C49CDA5685"><enum>(4)</enum><header>Entitlement to
				other insurance</header><text>Nothing in this subsection shall be construed as
				affecting the entitlement of an employee to insurance under
				<external-xref legal-doc="usc" parsable-cite="usc/5/8704">section
				8704(b)</external-xref> of title
				5.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section display-inline="no-display-inline" id="H145A2E66C50F4D049A7B7C0115BBDAEF" section-type="subsequent-section"><enum>6.</enum><header>Disclosure,
			 availability, and use of information</header>
			<subsection id="H8B7180E3DFFA4F7CA0158770F7E36C4C"><enum>(a)</enum><header>Trade secrets,
			 commercial information, and financial information</header><text display-inline="yes-display-inline">Section 1114(b) is amended—</text>
				<paragraph id="H8FA07220F371484C94C35C14B17DE922"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the subsection heading and
			 inserting the following: <quote><header-in-text level="subsection" style="USC">Trade secrets, commercial information, and financial
			 information</header-in-text></quote>;</text>
				</paragraph><paragraph id="H791913F3AD7243B2B6A4B8E40D6E5531"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (1) in the matter preceding
			 subparagraph (A)—</text>
					<subparagraph id="H90D76851C86843AF99BEFAE0FB95897C"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting ‘‘submitted to the Board in
			 the course of a Board investigation or study and’’ after ‘‘information’’;
			 and</text>

			 information if the information would otherwise be withheld under

			 552(b)(4)</external-xref> of title 5,’’ after ‘‘title 18’’;</text>
					</subparagraph></paragraph><paragraph id="H6A4DA05BE2654A06B517079EE67D11E4"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (2) by striking ‘‘paragraph
			 (1) of this subsection’’ and inserting ‘‘subparagraphs (A) through (C) of
			 paragraph (1)’’; and</text>

				submitting to the Board trade secrets, commercial information, financial
				information, or information that could be classified as controlled under the
				International Traffic in Arms Regulations shall appropriately annotate the
				information to indicate the restricted nature of the information in order to
				facilitate proper handling of such materials by the Board. In this paragraph,
				the term ‘International Traffic in Arms Regulations’ means those regulations
				contained in parts 120 through 130 of title 22, Code of Federal Regulations (or
				any successor regulations).</text>
						</paragraph><paragraph id="HD0E6445E2CAD40FA95029EA5E8E73EF9" indent="up1"><enum>(5)</enum><header>Disclosures to protect public
				health and safety</header><text display-inline="yes-display-inline">Disclosures
				of information under paragraph (1)(D) may include disclosures through accident
				investigation reports, safety studies, and safety
				recommendations.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HEFC87618E55D4C49AF91025D4EED8F65"><enum>(b)</enum><header>Surface vehicle
			 recordings and transcripts</header><text display-inline="yes-display-inline">The second sentence of section 1114(d)(1)
			 is amended by striking ‘‘that’’ after ‘‘information’’.</text>
			</subsection><subsection id="HF92CF4C513D04D558675DDD141E35D77"><enum>(c)</enum><header>Vessel
			 recordings and transcripts</header><text>Section 1114 is amended—</text>
				<paragraph id="H4E88649ECDFD424F9609577D763D8C39"><enum>(1)</enum><text>in subsection
			 (a)(1) by striking <quote>and (f)</quote> and inserting <quote>(e), and
			 (g)</quote>;</text>
				</paragraph><paragraph id="HAEEA6D82DCB7447288235086FEE785F6"><enum>(2)</enum><text>in subsection
			 (d)(1) by striking <quote>or vessel</quote>;</text>
				</paragraph><paragraph id="HDA96A65002B34AA1B332E12926F6970D"><enum>(3)</enum><text>by redesignating
			 subsections (e) and (f) as subsections (f) and (g), respectively; and</text>

				of recordings and transcripts</header><text display-inline="yes-display-inline">The Board may not disclose publicly any
				part of a vessel’s voice or video recorder recording or transcript of oral
				communications by or among the crew, pilots, or docking masters of a vessel,
				vessel traffic services, or other vessels, or between the vessel’s crew and
				company communication centers, related to a marine casualty investigated by the
				Board. However, the Board shall make public any part of a transcript or any
				written depiction of visual information the Board decides is relevant to the
				marine casualty—</text>

				party representative to an accident or marine casualty investigation of the
				Board is prohibited from disclosing, orally or in written form, investigative
				information, as defined by the Board, to anyone who is not an employee of the
				Board or who is not a party representative to such investigation,
				except—</text>
								<subparagraph id="HA5791946D0504D878FA8458C53D5AEB4"><enum>(A)</enum><text>as provided in
				paragraph (2); or</text>
								</subparagraph><subparagraph id="HB3A848AF31484CE3A17FEFF0ECB975CA"><enum>(B)</enum><text>at the conclusion
				of the fact finding stage of an investigation, which the investigator-in-charge
				shall announce by formal posting of a notice in the publicly available
				investigation docket.</text>
								</subparagraph></paragraph><paragraph id="H5B2C215CC0674AA0B23864381BB540D1"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">If the investigator-in-charge determines
				that a disclosure of information related to an accident or marine casualty
				investigation is necessary to prevent additional accidents or marine
				casualties, to address a perceived safety deficiency, or to assist in the
				conduct of the investigation, the investigator-in-charge may at any time
				authorize in writing a party representative to disclose such information under
				conditions approved by the investigator-in-charge. Such conditions shall ensure
				that, until the posting of a formal notice described in paragraph (1)(B), or
				until the information disclosed pursuant to this paragraph becomes publicly
				available by any other means, neither the entity represented by the party
				representative nor any other person may use such information in preparation for
				the prosecution of any claim or defense in litigation in connection with the
				accident or marine casualty being investigated or to make or deny any insurance
				claim in connection with such accident or marine casualty.</text>
							</paragraph><paragraph id="H9ADE5C6A67444A80983ACC8DB81A13B8"><enum>(3)</enum><header>Compliance</header><text>The
				Board shall require any individual who is a party representative to an
				investigation of the Board to sign a party agreement that includes language
				informing the individual of the prohibition in paragraph (1).</text>
							</paragraph><paragraph id="H1CF98B0D4B2145C986E892DA291EFA16"><enum>(4)</enum><header>Representatives
				of Federal agencies</header><text>Paragraph (3) shall not apply to an
				individual who is a representative of the Secretary of Transportation, the
				Secretary of the department in which the Coast Guard is operating, or any other
				Federal department, agency, or instrumentality participating in the
				investigation and deemed by the Board to be performing a law enforcement or
				similar function.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="HE6CCB0D010A244DC88F947C28ADE11D3"><enum>(5)</enum><header>Compliance with
				FAA statutory obligations</header><text display-inline="yes-display-inline">Nothing in this subsection prohibits the
				Federal Aviation Administration from fulfilling statutory obligations to ensure
				safe operations.</text>

				representative defined</header><text>In this subsection, the term <quote>party
				representative</quote> means an individual representing a party to an
				investigation pursuant to

				on the date of enactment of this

			 conducting the study, the Comptroller General shall examine, at a

			 on-going representatives from other entities that could provide independent,
			 technically qualified representatives to a Board investigation;</text>

			 participation of party representatives in a Board investigation results in any
			 unfair advantages for the entities represented by the party representatives

					</subparagraph><subparagraph id="H96FA28B3F60246F497293365202844A1"><enum>(C)</enum><text display-inline="yes-display-inline">whether the use of party representatives
			 leads to bias in the outcome of a Board investigation; and</text>
					</subparagraph><subparagraph id="H6AA98BE650EE4F37A3AE2BD17BB2DAB9"><enum>(D)</enum><text display-inline="yes-display-inline">whether Board investigations would be
			 compromised in any way absent the participation and expertise of party
			 representatives.</text>
					</subparagraph></paragraph><paragraph id="HF35AD97E429A499D8B2205118A20E9B8"><enum>(3)</enum><header>Report to
			 Congress</header><text>Not later than 18 months after the date of enactment of
			 this Act, the Comptroller General shall submit to the Committee on
			 Transportation and Infrastructure of the House of Representatives and the
			 Committee on Commerce, Science, and Transportation of the Senate a report on
			 the results of the study conducted under this subsection, including any
			 recommendations for improvements in the Board’s use of the party representative
			 process.</text>
				</paragraph></subsection></section><section id="H906B623BEA844DA0AE1862C438F90E1F"><enum>7.</enum><header>Training</header><text display-inline="no-display-inline">Section 1115(d) is amended—</text>

			 <quote>theory and techniques and on transportation safety methods to advance
			 Board safety recommendations</quote> before the period at the end of the first
			 sentence;</text>

			 <quote>or who influence the course of transportation safety through support or
			 adoption of Board safety recommendations</quote> before the period at the end

				safety pending implementation of more comprehensive responses by the
				department, agency, instrumentality, authority, or person.</text>
							</subparagraph></paragraph><paragraph id="H92CF7C6589D74424BE8122B99649D673"><enum>(2)</enum><header>Inclusion in
				final accident reports</header><text display-inline="yes-display-inline">If the
				Board makes an urgent safety recommendation or recommends an interim measure
				before completing a relevant final accident report, if any, the urgent safety
				recommendation or interim measure shall also be reflected in the final accident
				report.</text>

				in accordance with rules the Board may

			</subsection><subsection id="H4F82CC03D62E4BB2A9AC08D6F2538FD6"><enum>(d)</enum><header>Incident
			 investigations</header><text>Section 1131 is amended by adding at the end the
			 following:</text>

					<subsection id="H69C4CD56415E4A99AA1B3D688D59C995"><enum>(f)</enum><header>Incident
				investigations</header>

				understanding</header><text display-inline="yes-display-inline">Not later than
				90 days after the issuance of final regulations under section 1101(a)(2), the
				Chairman of the Board shall seek to enter into a memorandum of understanding
				with the Secretary of Transportation and the head of each modal administration
				of the Department of Transportation that sets forth—</text>

				which the Board will conduct an incident investigation that involves the
				applicable mode of transportation; and</text>

				parties to the memorandum when the Board is conducting an incident
				investigation.</text>
							</subparagraph></paragraph><paragraph id="HC01D6422108D484FB868CC4A6972BBC3"><enum>(2)</enum><header>Updates and
				renewals</header><text display-inline="yes-display-inline">Each memorandum of
				understanding required under paragraph (1) shall be updated and renewed not
				less than once every 5 years, unless parties to the memorandum agree that
				updating the memorandum is unnecessary.</text>
						</paragraph><paragraph id="H91EF76299A4A431C93161038C7866B80"><enum>(3)</enum><header>Board
				Authority</header><text display-inline="yes-display-inline">Nothing in this
				paragraph negates the authority of the Board to investigate an incident.</text>

						<subsection id="HC4EFACBB4BAF4B12BE7CE8BC9C8BFDCD"><enum>(a)</enum><header>Delegation of
				authority to Coast Guard</header>
							<paragraph id="H43BA1D2AE883473A8CEB080EB3F58D1A"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In an investigation
				of a major marine casualty under section 1131(a)(1)(E), the Board, with the
				consent of the Secretary of the department in which the Coast Guard is
				operating, may delegate to the Commandant of the Coast Guard full authority to
				obtain the facts of the casualty. In the case of such a delegation, the
				Commandant, acting through the Commandant’s on-scene representative, shall have
				the full authority of the Board.</text>
							</paragraph><paragraph id="H6D8BE12274C34DCB9B4BC7CEBF60894A"><enum>(2)</enum><header>Required
				training, experience, and qualifications</header><text display-inline="yes-display-inline">The Board may not make a delegation under
				paragraph (1) unless the Board determines that the Commandant’s on-scene
				representatives have sufficient training, experience, and qualifications in
				investigation, marine casualty reconstruction, evidence collection and
				preservation, human factors, and documentation to act in accordance with the
				best investigation practices of Federal and non-Federal entities.</text>
							</paragraph></subsection><subsection id="H377AC0D8B079437B954F2DDF59BED35E"><enum>(b)</enum><header>Participation of
				Commandant in marine investigations</header><text display-inline="yes-display-inline">The Board shall provide for the
				participation of the Commandant of the Coast Guard in an investigation by the
				Board of a major marine casualty under section 1131(a)(1)(E) if such
				participation is necessary to carry out the duties and powers of the
				Commandant, except that the Commandant may not participate in establishing the
				probable cause of the marine casualty (other than as provided in section
				1131(b)).</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF069F5E101DE4779ACE8BB146A06340A"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The analysis for chapter 11 is amended by inserting
			 after the item relating to section 1132 the following:</text>

			</subsection></section><section id="HDC93D60439B649BC880BA0E3434397B7"><enum>12.</enum><header>Inspections and
			 autopsies</header>
			<subsection id="H4D9C0B17AE5C42DFA0D03B9D296F42B3"><enum>(a)</enum><header>Entry and
			 inspection</header><text display-inline="yes-display-inline">Section 1134(a) is
			 amended in the matter preceding paragraph (1)—</text>
				<paragraph id="HD4EC1A71B2D14F0EBED322AED78FE26C"><enum>(1)</enum><text>by striking
			 <quote>officer or employee</quote> and inserting <quote>officer, employee, or
			 Federal designee</quote>; and</text>
				</paragraph><paragraph id="HF96A488BF2494094A7750CDB7A565620"><enum>(2)</enum><text>by inserting
			 <quote>in the conduct of any accident investigation or study</quote> after
			 <quote>National Transportation Safety Board</quote>.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H64103E1FD31A4842879E4EC6CE5E2749"><enum>(b)</enum><header>Inspection,
			 testing, preservation, and moving of aircraft and parts</header><text display-inline="yes-display-inline">Section 1134(b) is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="HC995078598CA43E6BD7BEC474B16500F" style="USC">
					<subsection id="HD64232E931FF4DA1B02E4D00B4587A86"><enum>(b)</enum><header>Inspection,
				testing, preservation, and moving of aircraft and parts</header>
						<paragraph id="H4C10C56FC1F44915BA8776C79F4979E8"><enum>(1)</enum><header>Inspection and
				testing</header><text>In investigating an aircraft accident under this chapter,
				the Board may—</text>
							<subparagraph id="HF641CAA699A4497CA002C9CAF452820C"><enum>(A)</enum><text>inspect and test,
				to the extent necessary, any civil aircraft, aircraft engine, propeller,
				appliance, or property on an aircraft involved in an accident in air
				commerce;</text>
							</subparagraph><subparagraph id="H41F27B46520941AD8DC4F1F9DC4235A7"><enum>(B)</enum><text>seize or otherwise
				obtain any recording device and recording pertinent to the accident; and</text>
							</subparagraph><subparagraph id="HF43628413A754D6196708AB93D2CAD7A"><enum>(C)</enum><text>require specific
				information only available from the manufacturer to enable the Board to read
				and interpret any flight parameter or navigation storage device or media on
				board the aircraft involved in the accident.</text>
							</subparagraph></paragraph><paragraph id="H0569C3EEC20F4F5E9F0947B5A5F8B8D9"><enum>(2)</enum><header>Moving of
				aircraft and parts</header><text>Any civil aircraft, aircraft engine,
				propeller, appliance, or property on an aircraft involved in an accident in air
				commerce shall be preserved, and may be moved, only as provided by regulations
				of the Board.</text>
						</paragraph><paragraph id="H5148FE1E6C8D4A0FB4024C3A7A030B93"><enum>(3)</enum><header>Trade secrets,
				commercial information, and financial information</header><text>The provisions
				of section 1114(b) shall apply to materials provided under paragraph (1)(C) and
				properly identified as trade secrets, commercial information, or financial
				information.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H7F0D41C252854D3285F946A832E45D91"><enum>(c)</enum><header>Avoiding
			 unnecessary interference; preserving evidence</header><text display-inline="yes-display-inline">Section 1134(c) is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="HDEBBABE1FD30417EBB379969A2BB146E" style="USC">
					<subsection id="H5BAE0C4C94394A94977E7215AC760EB8"><enum>(c)</enum><header>Avoiding
				unnecessary interference; preserving evidence</header>
						<paragraph id="H6959B3BF75BD407B892120AE6D6D8702"><enum>(1)</enum><header>Inspection and
				testing</header><text>In carrying out subsection (a)(1), an officer or employee
				may—</text>
							<subparagraph id="H347C96D06B0A4EF9BF5093A9EC06C3E5"><enum>(A)</enum><text>examine or test
				any vehicle, vessel, rolling stock, track, or pipeline component;</text>
							</subparagraph><subparagraph id="H2A516BB82CD540E685075000EC358EC6"><enum>(B)</enum><text display-inline="yes-display-inline">seize or otherwise obtain any recording
				device and recording pertinent to the accident; and</text>
							</subparagraph><subparagraph id="H8B419983998743FD9E9152B5153DEF67"><enum>(C)</enum><text>require the
				production of specific information only available from the manufacturer to
				enable the Board to read and interpret any operational parameter or navigation
				storage device or media on board the vehicle, vessel, or rolling stock involved
				in the accident.</text>
							</subparagraph></paragraph><paragraph id="H461CD90DF3C648E28D76FA5E6958F089"><enum>(2)</enum><header>Trade secrets,
				commercial information, and financial information</header><text>The provisions
				of section 1114(b) shall apply to materials provided under paragraph (1)(C) and
				properly identified as trade secrets, commercial information, or financial
				information.</text>
						</paragraph><paragraph id="HA098162FCB494F8F961AC9A13AF54334"><enum>(3)</enum><header>Conduct of
				examinations and tests</header><text>An examination or test under paragraph
				(1)(A) shall be conducted in a way that—</text>
							<subparagraph id="H3489C7EB02494C24BDC6EA70861423A0"><enum>(A)</enum><text>does not interfere
				unnecessarily with transportation services provided by the owner or operator of
				the vehicle, vessel, rolling stock, track, or pipeline component; and</text>
							</subparagraph><subparagraph id="HAD4294317A9C43C2B74FD4D626C7ED9E"><enum>(B)</enum><text>to the maximum
				extent feasible, preserves evidence related to the accident, consistent with
				the needs of the investigation and with the cooperation of that owner or
				operator.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H1A18EA6E078D4114801492B5CF2EB18C"><enum>13.</enum><header>Discovery and
			 use of cockpit and surface vehicle recordings and transcripts</header><text display-inline="no-display-inline">Section 1154(a)(1)(A) is amended by striking
			 <quote>; and</quote> and inserting <quote>; or</quote>.</text>
		</section><section id="HB3DDDFDFF11941A288BF247BBAFD23F0"><enum>14.</enum><header>Family
			 assistance</header>
			<subsection id="H69ACBF31BBAF49E4880CC479338031DA"><enum>(a)</enum><header>Family
			 assistance in commercial aviation accidents</header><text>Section 41113(b)(7)
			 is amended by inserting before the period at the end the following: <quote>,
			 and that at least 60 days before the planned destruction of any unclaimed
			 possession of a passenger a reasonable attempt will be made to notify the
			 family of the passenger</quote>.</text>
			</subsection><subsection id="H84605843D049470993BF1EECA74ECF3C"><enum>(b)</enum><header>Family
			 assistance in commercial aviation accidents involving foreign
			 carriers</header><text>Section 41313(c)(7) is amended by inserting before the
			 period at the end the following: <quote>, and that at least 60 days before the
			 planned destruction of any unclaimed possession of a passenger a reasonable
			 attempt will be made to notify the family of the passenger</quote>.</text>
			</subsection></section><section display-inline="no-display-inline" id="H8F4ED87781AE4B158B6EEEBE39E89A02" section-type="subsequent-section"><enum>15.</enum><header>Notification of
			 marine casualties</header><text display-inline="no-display-inline">Not later
			 than 6 months after the date of enactment of this Act, the National
			 Transportation Safety Board and the Secretary of the department in which the
			 Coast Guard is operating shall jointly prescribe regulations to ensure the
			 prompt notification and reporting of marine casualties by the Coast Guard to
			 the Board.</text>
		</section><section id="HC26A3369876D4F3CB6EACF5088D13BE8"><enum>16.</enum><header>Use of board
			 name, logo, initials, and seal</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/709">Section 709</external-xref> of title
			 18, United States Code, is amended—</text>
			<paragraph id="HCD3F20006B8D48B3BC6FEDB969232AC6"><enum>(1)</enum><text>by inserting
			 <quote>or</quote> at the end of the paragraph immediately preceding the
			 paragraph that begins <quote>Shall be punished as follows:</quote>; and</text>
			</paragraph><paragraph id="H1C4259CB3E1F49DBA6621DF7D3068799"><enum>(2)</enum><text>by inserting the
			 following before the paragraph that begins <quote>Shall be punished as

				Board</quote>, the logo of the Board, the initials <quote>NTSB</quote>, or the
				official seal of the Board, or any colorable imitation of such words, logo,
				initials, or seal, in connection with any advertisement, circular, book,
				pamphlet, or other publication, or any play, motion picture, broadcast,
				telecast, or other production, in a manner reasonably calculated to convey the
				impression that such advertisement, circular, book, pamphlet, or other
				publication, or such play, motion picture, broadcast, telecast, or other
				production, is <pagebreak></pagebreak>approved, endorsed, or authorized by the National
				Transportation Safety
				Board;</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
