		  to award grants to eligible entities for farm to school

		<section id="H0F5B19F1676A4F5AAB22A02083A6F661" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Farm to School Improvements Act of
			 2010</short-title></quote>.</text>
		</section><section id="H2F6A0A10103F443E82320C3FA7F0F2D1"><enum>2.</enum><header>Farm to school
			 program</header>
			<subsection id="HE22BF6D19FDC4502B380EA3301F1072C"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">The Richard B. Russell National School
			 Lunch Act (42 U.S.C. 1751 et seq.) is amended by inserting after section 19,
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H3BDCFBD3E82E4F15B17CFFD926C8715C" style="OLC">
					<section id="H74D7BAD5BC084D4CB28355394BEF7090"><enum>19A.</enum><header>Farm to school
				program</header>
						<subsection id="H1EA64D7EEE174C94ABFAE8DE3CDFF451"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				provide assistance, through competitive matching grants and technical
				assistance, to eligible entities for farm to school programs that—</text>
							<paragraph id="H397B0D091CE542A0B534195FFC346BD1"><enum>(1)</enum><text>improve access to
				local foods in schools and institutions participating in programs under this
				Act and section 4 of the Child Nutrition Act of 1966 (42 U.S.C. 1773) through
				farm to school activities, including the purchase of local food, establishment
				of effective relationships between school and institutional food service
				providers, distributors, and producers or groups of producers, school gardens,
				appropriate equipment, and the provision of training and education; and</text>
							</paragraph><paragraph id="HDD5CA6F69B2D41CD911A940EC3ADE675"><enum>(2)</enum><text>are designed
				to—</text>
								<subparagraph id="HA7FA3362AF1F441AA8E59A18A3468BD2"><enum>(A)</enum><text>improve the
				nutritional health and well being of children;</text>
								</subparagraph><subparagraph id="HA74E6D18BD024A4D990876DFC5EB4A4D"><enum>(B)</enum><text display-inline="yes-display-inline">procure healthy local foods from small and
				medium-sized farms for meals at eligible schools and institutions;</text>
								</subparagraph><subparagraph display-inline="no-display-inline" id="H84FF0806A2AD41F29D308E62091C46FF"><enum>(C)</enum><text>support
				experiential nutrition education activities and curriculum planning that
				incorporates the participation of school children in farm and garden-based
				agricultural education activities;</text>
								</subparagraph><subparagraph id="H35568C76717A47A8B2062BA4417A8FE7"><enum>(D)</enum><text>develop a
				sustained commitment to farm to school programs in the community by linking
				schools and institutions, State and local agencies including Indian Tribal
				Organizations, institutions of higher education, agricultural producers,
				parents, community garden groups and other community stakeholders; and</text>
								</subparagraph><subparagraph id="H04C63B9D071E4768A8EBE61CDFE02C14"><enum>(E)</enum><text>increase farm
				income by facilitating farmers’ access to institutional markets including
				schools.</text>
								</subparagraph></paragraph></subsection><subsection id="H81CB8D0EE90D4D1BABD292F9DE48EF16"><enum>(b)</enum><header>Eligible
				entity</header><text>For purposes of this section, the term <term>eligible
				entity</term> means—</text>
							<paragraph id="H90B5BA79227543C785C6EED4C6233440"><enum>(1)</enum><text>a school;</text>
							</paragraph><paragraph id="HB4DC8F200BF44CA58A83AC24BC239A70"><enum>(2)</enum><text>nonprofit
				organization; or</text>
							</paragraph><paragraph id="H8428B76E58324FAEAE0732D865945282"><enum>(3)</enum><text>other entity that
				the Secretary determines offers a unique ability to provide services or
				farm-to-school programs.</text>
							</paragraph></subsection><subsection id="H8B139A6880C6435BBF4755F3D9925A26"><enum>(c)</enum><header>Grants</header>
							<paragraph id="H2CF7D513B6C549ECACBA9D408839D6D4"><enum>(1)</enum><header>Types of
				grants</header><text>A grant awarded under this section may include—</text>
								<subparagraph id="H4A6A96D5646F479F809B6F759E6EAADD"><enum>(A)</enum><text display-inline="yes-display-inline">an implementation grant to support the cost
				of implementing a farm to school program;</text>
								</subparagraph><subparagraph id="H74BBE42E453D4C36A21426A99699CD89"><enum>(B)</enum><text display-inline="yes-display-inline">a training and technical assistance grant
				to support the cost of—</text>
									<clause id="HE5A0CA0394D04FD2A1F0631917472584"><enum>(i)</enum><text>providing the
				training, operational support, information, and access to resources necessary
				to implement a successful farm to school program; and</text>
									</clause><clause id="H1F154A1A35384577936ABA2D7F7C2D17"><enum>(ii)</enum><text>encouraging
				collaboration between public and private entities; or</text>
									</clause></subparagraph><subparagraph id="HA688B9C17CA84A93AF38A7F50CC63247"><enum>(C)</enum><text display-inline="yes-display-inline">a planning grant to support the cost of
				conducting research, identifying resources, and developing partnerships to
				design a successful and sustainable farm to school program.</text>
								</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H660D450051184D359DDB516A923D0397"><enum>(2)</enum><header>Grant
				Amounts</header><text>A grant awarded under this section to an eligible entity
				shall not exceed—</text>
								<subparagraph id="HDE16257A49FF429C8207CA7613F0E817"><enum>(A)</enum><text>in the case of an
				implementation or training and technical assistance grant, $100,000; and</text>
								</subparagraph><subparagraph id="H75475195A81446D59B0D156DD54066E4"><enum>(B)</enum><text>in the case of a
				planning grant, $25,000.</text>
								</subparagraph></paragraph><paragraph id="HCD8CDF02B6A848409E41F1F9A97562D9"><enum>(3)</enum><header>Grant
				Duration</header><text>A grant under this section shall be awarded for a
				period—</text>
								<subparagraph id="H722F6680484241CAB1F2BCD5982C1209"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of an implementation or
				training and technical assistance grant, not to exceed 2 years; and</text>
								</subparagraph><subparagraph id="H17876EA32F0A4BBD8219766596251E90"><enum>(B)</enum><text>in the case of a
				planning grant, not to exceed 1 year.</text>
								</subparagraph></paragraph></subsection><subsection id="H20ABAE604B5B488A800AED2EF46ED37A"><enum>(d)</enum><header>Cost
				share</header>
							<paragraph id="H1B54947D82714DF8A24F4DE8BCEC9A13"><enum>(1)</enum><header>In
				general</header><text>The amount of a grant made under this section shall not
				exceed 75 percent of the cost of the proposed grant activities.</text>
							</paragraph><paragraph id="H0C6B46DC981844589542AA09A5EAE38C"><enum>(2)</enum><header>Non-Federal
				Support</header><text>A recipient of a grant under this section shall be
				required to provide at least 25 percent of the cost of the proposed grant
				activities in the form of cash or in-kind contributions (including facilities,
				equipment, training, or services provided by State and local governments and
				private sources).</text>
							</paragraph></subsection><subsection id="HF161891B6569413D89BF8C24F57EEB29"><enum>(e)</enum><header>Evaluation</header><text display-inline="yes-display-inline">A recipient of a grant under this section
				shall cooperate in an evaluation by the Secretary of the programs carried out
				using such grant funds.</text>
						</subsection><subsection id="HF8D64F67E34E43FBB461DECC34F3683F"><enum>(f)</enum><header>Regional
				balance</header><text>In making awards and providing technical assistance under
				this section, the Secretary shall to the maximum extent practicable,
				ensure—</text>
							<paragraph id="H43A6F2ECEC494623828C5E527DDAC7CE"><enum>(1)</enum><text>geographical
				diversity; and</text>
							</paragraph><paragraph id="H1B9F2534E20842588198FD98E563702D"><enum>(2)</enum><text>equitable
				treatment of urban, rural, and tribal communities.</text>
							</paragraph></subsection><subsection commented="no" id="HAD947971E0C9428095213B36B5E8F8FC"><enum>(g)</enum><header>Technical
				assistance</header><text display-inline="yes-display-inline">The Secretary
				shall provide recipients of grants under this section with technical
				assistance, which shall include sharing information, best practices, research,
				and data on existing farm to school programs.</text>
						</subsection><subsection id="H9DB579310B52451E9DD90EABFFD913D1"><enum>(h)</enum><header>Proposals</header>
							<paragraph id="H599F07BE39DA4C1E972C7B3AE87CE26D"><enum>(1)</enum><header>In
				general</header><text>An eligible entity desiring to receive a grant under this
				section shall submit a proposal to the Secretary at such time, in such manner,
				and containing such information as the Secretary may require.</text>
							</paragraph><paragraph id="HD57BF3D3860D40C6B1ED15A0F4968B69"><enum>(2)</enum><header>Competitive
				award selection</header><text display-inline="yes-display-inline">The Secretary
				shall form review panels to evaluate proposals submitted under paragraph (1)
				based on the criteria described in paragraph (3). Such review panels shall
				include—</text>
								<subparagraph id="H3A5FE1E607E44EE9B56D26895BCAB60F"><enum>(A)</enum><text>representatives of
				schools and eligible institutions;</text>
								</subparagraph><subparagraph id="HCF261011376E4A718389BD927F808BA0"><enum>(B)</enum><text display-inline="yes-display-inline">registered dietitians;</text>
								</subparagraph><subparagraph id="H9C10B9AFF51D4644B08B8F3238E485E4"><enum>(C)</enum><text>operators of small
				and medium-sized farms;</text>
								</subparagraph><subparagraph id="HA6943C407EA54A0497E7DEF7724E3212"><enum>(D)</enum><text>public agencies;</text>
								</subparagraph><subparagraph id="H2300F1A76CF3466E8BA6F3B1346ADF1E"><enum>(E)</enum><text>non-governmental
				and community-based organizations with expertise in local food systems and farm
				to school programs; and</text>
								</subparagraph><subparagraph id="H826F7A985BE646DA8527B8F251E905DD"><enum>(F)</enum><text>other appropriate
				parties as determined by the Secretary.</text>
								</subparagraph></paragraph><paragraph id="H844B8E9C01FB4F438E7D8949D6ED0938"><enum>(3)</enum><header>Proposal review
				criteria</header><text display-inline="yes-display-inline">In making awards
				under this section, the Secretary shall evaluate proposals based on the extent
				to which the proposed program—</text>
								<subparagraph id="H75D84073EE564BB4B9374A934289C3A1"><enum>(A)</enum><text display-inline="yes-display-inline">improves the nutritional health and well
				being of children;</text>
								</subparagraph><subparagraph id="H7159A259E6CF4EEEA525D04B54D4C62F"><enum>(B)</enum><text>makes local food
				products available on the menu of the school or institution;</text>
								</subparagraph><subparagraph id="H7F37F972A9414C028F4F967ECBE0754D"><enum>(C)</enum><text>benefits local
				small and medium-sized farms;</text>
								</subparagraph><subparagraph id="H1572DEE72FCC449EB4C7357F9569DD06"><enum>(D)</enum><text display-inline="yes-display-inline">incorporates experiential nutrition
				education activities and curriculum planning that incorporates the
				participation of school children in farm and garden-based agricultural
				education activities;</text>
								</subparagraph><subparagraph id="H97A4EA5E69954F649D24B604A0378A34"><enum>(E)</enum><text>serves schools and
				eligible institutions with a high proportion of children who are eligible for
				free and reduced price lunches;</text>
								</subparagraph><subparagraph id="H9F00719CE4EE499BB23DEE49780C2E68"><enum>(F)</enum><text>demonstrates
				collaboration between schools or institutions, non-governmental and
				community-based organizations, farmer groups, and other community partners;</text>
								</subparagraph><subparagraph id="HFCD0289E0A784E20941D328D627A88A5"><enum>(G)</enum><text>demonstrates the
				potential for long-term program sustainability;</text>
								</subparagraph><subparagraph id="HEE436ECF8B904085BBCA772AB4275EBA"><enum>(H)</enum><text>includes adequate
				and participatory evaluation plans; and</text>
								</subparagraph><subparagraph id="HC01B5EA941834B62B43206ECE5BDAFE7"><enum>(I)</enum><text>meets such other
				related criteria as the Secretary may determine relevant.</text>
								</subparagraph></paragraph></subsection><subsection id="H2D8068AB317146488F4F41F916F4DB05"><enum>(i)</enum><header>Funding</header><text>Beginning
				on October 1, 2010, or of any funds in the Treasury not otherwise appropriated,
				the Secretary of the Treasury shall transfer to the Secretary of Agriculture to
				carry out this section $10,000,000 each fiscal year, to remain available until
				expended.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H7C4C851E04584EBCB816FF5E78F29199"><enum>(b)</enum><header>Conforming
			 change</header><text>Section 18(g) of the Richard B. Russell School Lunch Act
			 (42 U.S.C. 1769(g)) is amended—</text>
				<paragraph id="H3070B7A36D34444C865D110689968C50"><enum>(1)</enum><text>by striking
			 paragraphs (1) and (2); and</text>
				</paragraph><paragraph id="H59BF69C5181043AA816F4F9EE44D76CC"><enum>(2)</enum><text>by redesignating
			 paragraphs (3) and (4) as paragraphs (1) and (2), respectively.</text>
				</paragraph></subsection></section></legis-body>
