		<official-title display="yes">To encourage research, development, and
		  demonstration of technologies to facilitate the utilization of water produced
		  in connection with the development of domestic energy resources, and for other
		  purposes.</official-title>

		<section id="H5595D425FC0F4A218F22ADC66F74B849" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Produced Water Utilization Act of
			 2009</short-title></quote>.</text>
		</section><section id="H09C421C73DE8424DA26F4C7EA8C6779"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H199EDCC0BE1041569F9D3D507528ABB9"><enum>(1)</enum><header>Produced
			 water</header><text>The term <quote>produced water</quote> means water from an
			 underground source that is brought to the surface as part of the process of
			 exploration for or development of coalbed methane, oil, natural gas, or any
			 other substance to be used as an energy source.</text>
			</paragraph><paragraph id="H53041C497ABE4EABB9C2808411BD70C"><enum>(2)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Energy.</text>
			</paragraph></section><section id="H592E3B91FD564127BC19647DF4E7F1AE"><enum>3.</enum><header>Purposes</header>
			<subsection id="H00AD1739686B474F91154C00054D6F7C"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall carry out under this Act a program of
			 research, development, and demonstration of technologies for environmentally
			 sustainable utilization of produced water for agricultural, irrigational,
			 municipal, and industrial uses, or other environmentally sustainable purposes.
			 The program shall be designed to maximize the utilization of produced water in
			 the United States by increasing the quality of produced water and reducing the
			 environmental impacts of produced water.</text>
			</subsection><subsection id="H8B222C0E4AA4449AACB9E08D7DACF966"><enum>(b)</enum><header>Program
			 Elements</header><text>The program under this Act shall address the following
			 areas, including improving safety and minimizing environmental impacts of
			 activities within each area:</text>
				<paragraph id="HC492B4D8D55849E1A947A90452F41BD"><enum>(1)</enum><text>Produced water
			 recovery, including research for desalination and demineralization to reduce
			 total dissolved solids in the produced water.</text>
				</paragraph><paragraph id="H5B58D8DE7A964D22BAABC7BD57F0760"><enum>(2)</enum><text>Produced water
			 utilization for agricultural, irrigational, municipal, and industrial uses, or
			 other environmentally sustainable purposes.</text>
				</paragraph><paragraph id="H64FC4AAF0D1E4F398F4F4F1242FBDB9B"><enum>(3)</enum><text>Re-injection of
			 produced water into subsurface geological formations to increase energy
			 production.</text>
				</paragraph></subsection><subsection id="H88C2767B9C9A431A83C263C5F2E1A016"><enum>(c)</enum><header>Program
			 Administration</header><text>To carry out the purposes under this Act, the
			 Secretary may enter into an agreement with a consortium whose members have
			 collectively demonstrated capabilities and experience in planning and managing
			 research, development, demonstration, and commercial application programs for
			 unconventional natural gas and other petroleum production and produced water
			 utilization.</text>
			</subsection><subsection id="H24C8D46614AF4718B0BCA63CE31BED3"><enum>(d)</enum><header>Activities at the
			 National Laboratories</header><text>The Secretary, through the appropriate
			 National Laboratory, shall carry out a program of research, development, and
			 demonstration activities complementary to and supportive of the research,
			 development, and demonstration programs under subsection (b).</text>
			</subsection></section><section id="HE24CB4EE4E5F496284B9000030A658F7"><enum>4.</enum><header>Consultation and
			 coordination</header>
			<subsection id="H65CAEF89AB6D41778722BFCFCF0105F3"><enum>(a)</enum><header>Consultation</header><text>In
			 carrying out this Act, the Secretary shall consult with the Secretary of the
			 Interior and the Administrator of the Environmental Protection Agency.</text>
			</subsection><subsection id="H907B830FD34B4FD19CE97256785BDD8B"><enum>(b)</enum><header>Coordination</header><text>To
			 the maximum extent practicable, the Secretary shall ensure that the activities
			 under this Act are coordinated with, and do not duplicate the efforts of,
			 programs at the Department of Energy and other government agencies.</text>
			</subsection></section><section id="H54DCF0C06596489982C5BE7064ACC563"><enum>5.</enum><header>Funding</header>
			<subsection id="H24C1F0270F6645C7B84FE8335FC857B8"><enum>(a)</enum><header>Allocation</header><text>Amounts
			 appropriated for this Act for each fiscal year shall be allocated as
			 follows:</text>
				<paragraph id="H10B49D9362B74DBDB715098B8548FC89"><enum>(1)</enum><text>75 percent shall
			 be for activities under section 3(a), (b), and (c).</text>
				</paragraph><paragraph id="HFBA28BB68C934574BF4BE9E77A2A032"><enum>(2)</enum><text>25
			 percent shall be for activities under section 3(d) and other activities under
			 section 3, including administrative functions such as program direction,
			 overall program oversight, and contract management.</text>
				</paragraph></subsection><subsection id="H00A5EE8A7FCA40FDAED5E080C3F88845"><enum>(b)</enum><header>Authorization of
			 Appropriations</header><text>There are authorized to be appropriated to carry
			 out this Act $20,000,000 for each of fiscal years 2010 through 2014.</text>
