		<section id="H9772D94A155B4426B5175D72AEAAFCE3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Foreign Manufacturers Legal
			 Accountability Act of 2010</short-title></quote>.</text>
		</section><section id="H83918AA5085C44C192184A220D38F8B4"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HAED3DBF1B6754AE8B36A414E486C6EDE"><enum>(1)</enum><header>Applicable
			 agency</header><text>The term <term>applicable agency</term> means, with
			 respect to covered products—</text>
				<subparagraph id="H687DEFDC191F40FA9F5FFE8126C1C818"><enum>(A)</enum><text>described in
			 subparagraphs (A) and (B) of paragraph (3), the Food and Drug
			 Administration;</text>
				</subparagraph><subparagraph id="H80AA79965315433AA9953B2D3A4EA778"><enum>(B)</enum><text>described in paragraph
			 (3)(C), the Consumer Product Safety Commission;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3CE6CCC63B164FFA9F62B62520D429C9"><enum>(C)</enum><text>described in
			 subparagraphs (D) and (E) of paragraph (3), the Environmental Protection
			 Agency;</text>
				</subparagraph><subparagraph id="H4C11BAAC67D743239F1481792F0884B4"><enum>(D)</enum><text display-inline="yes-display-inline">described in paragraph (3)(F), the National
			 Highway Traffic Safety Administration; and</text>
				</subparagraph><subparagraph id="HDEBB9FF3243F4723A77020499C0AAA7E"><enum>(E)</enum><text>described in paragraph
			 (3)(G)—</text>
					<clause id="H96E390F8738A4EB0B4E89598DE9A77F7"><enum>(i)</enum><text>the Food and Drug
			 Administration, if the item is intended to be a component part of a product
			 described in subparagraphs (A) or (B) of paragraph (3);</text>
					</clause><clause id="H19CB82A41F8644C2A704746BADC243A6"><enum>(ii)</enum><text>the Consumer Product
			 Safety Commission, if the item is intended to be a component part of a product
			 described in paragraph (3)(C);</text>
					</clause><clause id="H2E5D29A861A04F83B089617D9BD6E4D3"><enum>(iii)</enum><text>the Environmental
			 Protection Agency, if the item is intended to be a component part of a product
			 described in subparagraphs (D) or (E) of paragraph (3); and</text>
					</clause><clause id="H606BCE6BF36C4F34BE594962F1ED6684"><enum>(iv)</enum><text>the National Highway
			 Traffic Safety Administration, if the item is intended to be a component part
			 of a product described in paragraph (3)(F).</text>
					</clause></subparagraph></paragraph><paragraph id="H14292D14E5264AEBA9B8E6DD70D3559E"><enum>(2)</enum><header>Commerce</header><text>The
			 term <term>commerce</term> means trade, traffic, commerce, or
			 transportation—</text>
				<subparagraph id="H551A36973D9244F7B000070086DCB4CD"><enum>(A)</enum><text>between a place in a
			 State and any place outside thereof; or</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H77F945191BDD488C8D1834717DFA32A2"><enum>(B)</enum><text>which affects trade,
			 traffic, commerce, or transportation described in subparagraph (A).</text>
				</subparagraph></paragraph><paragraph id="H40B2EFE96F5F4CDB838D2853631D61F6"><enum>(3)</enum><header>Covered
			 product</header><text>The term <term>covered product</term> means any of the
			 following:</text>
				<subparagraph id="HD7F1D48580F24F18BA97259E09ABCECC"><enum>(A)</enum><text>Drugs, devices, and
			 cosmetics, as such terms are defined in section 201 of the Federal Food, Drug,
			 and Cosmetic Act (21 U.S.C. 321).</text>
				</subparagraph><subparagraph id="H21C13E26647E4E89ABE24AADCB5FA42E"><enum>(B)</enum><text>A biological product, as
			 such term is defined in section 351(i) of the Public Health Service Act (42
			 U.S.C. 262(i)).</text>
				</subparagraph><subparagraph id="H9B18E9EBF8604347B4C6E82A8BF4C027"><enum>(C)</enum><text>A consumer product, as
			 such term is used in section 3(a) of the Consumer Product Safety Act (15 U.S.C.
			 2052).</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB4511F924DA14C7F8107338DBE66201B"><enum>(D)</enum><text>A chemical substance or
			 new chemical substance, as such terms are defined in section 3 of the Toxic
			 Substances Control Act (15 U.S.C. 2602).</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H11DDE10730B445F1967062F850F96AEC"><enum>(E)</enum><text>A pesticide, as such term
			 is defined in section 2 of the Federal Insecticide, Fungicide, and Rodenticide
			 Act (7 U.S.C. 136).</text>
				</subparagraph><subparagraph id="H50DFAB2C33C64289B9935A1880367847"><enum>(F)</enum><text display-inline="yes-display-inline">A motor vehicle or motor vehicle equipment,
			 as such terms are defined in section 30102 of title 49, United States Code.</text>
				</subparagraph><subparagraph id="HF375E54862954DB390BDE5888092B004"><enum>(G)</enum><text>An item intended to be a
			 component part of a product described in subparagraph (A), (B), (C), (D), (E),
			 or (F) but is not yet a component part of such product.</text>
				</subparagraph></paragraph><paragraph id="H9DDE71FC32FE4E18A54679B2B475BCAF"><enum>(4)</enum><header>Distribute in
			 commerce</header><text>The term <term>distribute in commerce</term> means to
			 sell in commerce, to introduce or deliver for introduction into commerce, or to
			 hold for sale or distribution after introduction into commerce.</text>
			</paragraph><paragraph id="H031146158DF84BE8938CE60FE7282DE8"><enum>(5)</enum><header>Foreign manufacturer or
			 producer</header><text display-inline="yes-display-inline">The term
			 <quote>foreign manufacturer or producer</quote> does not include—</text>
				<subparagraph id="H28ADED898A4B446991E80ED89C2EF763"><enum>(A)</enum><text display-inline="yes-display-inline">a foreign manufacturer or producer of
			 covered products that is owned or controlled, directly or indirectly, by one or
			 more United States natural or legal persons, if—</text>
					<clause id="H423AED9675644FAEB441E7C9DD532187"><enum>(i)</enum><text display-inline="yes-display-inline">the United States natural or legal person
			 has assets in excess of the foreign manufacturer or producer; or</text>
					</clause><clause id="HEFF71BDAEF5E4A5899AB38D6325F313C"><enum>(ii)</enum><text display-inline="yes-display-inline">the United States natural or legal person
			 owns or controls more than one foreign manufacturer or producer of covered
			 products and such person has assets in excess of the average assets held by
			 each foreign manufacturer or producer; or</text>
					</clause></subparagraph><subparagraph id="HFF0B97D3C4DE4B8682BCF279B679ED64"><enum>(B)</enum><text display-inline="yes-display-inline">a foreign manufacturer or producer of
			 covered products that owns or controls, or through common ownership or control
			 is affiliated with, directly or indirectly, one or more United States operating
			 legal persons if the principal executive officer residing in the United States
			 of each United States operating legal person certifies in writing to the
			 applicable agency that such person—</text>
					<clause id="H79E490331B3B4313A4A43AFADA8758A4"><enum>(i)</enum><text display-inline="yes-display-inline">is responsible for any liability from a
			 covered product of the foreign manufacturer or producer, including liability
			 from the design, testing, assembly, manufacturing, warnings, labeling,
			 inspection, packaging, or any other cause of action related to the covered
			 product; and</text>
					</clause><clause id="H94168FF64549483988C9EB2683615956"><enum>(ii)</enum><text>will serve as the
			 initial point of contact for the applicable agency in case of a voluntary or
			 mandatory recall or other issue involving the safety of a covered
			 product.</text>
					</clause></subparagraph></paragraph></section><section id="H4A5303E1080648C583234C4D5B7FF867"><enum>3.</enum><header>Registration of agents
			 of foreign manufacturers authorized to accept service of process in the United
			 States</header>
			<subsection id="H05704C81084C4C94B312C0797F36BE0B"><enum>(a)</enum><header>Registration</header>
				<paragraph id="HCCEF304D2E8E44EB80216419FAE869E1"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Beginning on the date
			 that is 180 days after the date on which the regulations are prescribed
			 pursuant to section 3(d) and except as provided in this subsection, the head of
			 each applicable agency shall require foreign manufacturers and producers of
			 covered products distributed in commerce to register an agent in the United
			 States who is authorized to accept service of process on behalf of such
			 manufacturer or producer for the purpose of any State or Federal regulatory
			 proceeding or any civil action in State or Federal court related to such
			 covered product, if such service is made in accordance with the State or
			 Federal rules for service of process in the State in which the case or
			 regulatory action is brought.</text>
				</paragraph><paragraph id="H1FBA62420BE24E81A870F82C2C6F8822"><enum>(2)</enum><header>Location</header><text>The
			 head of each applicable agency shall require that an agent of a foreign
			 manufacturer or producer registered under paragraph (1) be—</text>
					<subparagraph id="HBE4276DF797C4662A3576AF8E6404B8D"><enum>(A)</enum><text>located in a State chosen
			 by the foreign manufacturer or producer with a substantial connection to the
			 importation, distribution, or sale of the products of the foreign manufacturer
			 or producer; and</text>
					</subparagraph><subparagraph id="H9A56E888201A4ECF99723FB9136F9805"><enum>(B)</enum><text display-inline="yes-display-inline">an individual, domestic firm, or domestic
			 corporation that is a permanent resident of the United States.</text>
					</subparagraph></paragraph><paragraph id="H06A0559F1591446B955C64D262BEE412"><enum>(3)</enum><header>Designation by
			 manufacturer or producer and acceptance by agent</header><text display-inline="yes-display-inline">The head of each applicable agency shall,
			 at a minimum, require a—</text>
					<subparagraph id="H69411EB6AE764B8F9265E7622B91B703"><enum>(A)</enum><text>written designation by a
			 foreign manufacturer or producer with respect to which paragraph (1)
			 applies—</text>
						<clause id="H03ED0ED145B948AABFC7F4FF6DA343BD"><enum>(i)</enum><text>signed by an official or
			 employee of the foreign manufacturer or producer with authority to appoint an
			 agent;</text>
						</clause><clause id="H6564F475657C49A99AB565180BED676F"><enum>(ii)</enum><text>containing the full
			 legal name, principal place of business, and mailing address of the
			 manufacturer or producer; and</text>
						</clause><clause id="HC9DD30E0F2184E56BC329BFBC4542A63"><enum>(iii)</enum><text>containing a statement
			 that the designation is valid and binding on the foreign manufacturer or
			 producer for the purposes of this Act.</text>
						</clause></subparagraph><subparagraph id="H4452BC641D0846E19C21D8E337F9F4A2"><enum>(B)</enum><text>written acceptance by the
			 agent registered by a foreign manufacturer or producer with respect to which
			 paragraph (1) applies—</text>
						<clause id="HED1B056A2C5843DB972AEE0BE6F1D6A8"><enum>(i)</enum><text>signed by the agent or,
			 in the case in which a domestic firm or domestic corporation is designated as
			 an agent, an official or employee of the firm or corporation with authority to
			 sign for the firm or corporation;</text>
						</clause><clause id="HF573E56534854274A2FA671A7B5B5BCE"><enum>(ii)</enum><text>containing the agent’s
			 full legal name, physical address, mailing address, and phone number; and</text>
						</clause><clause id="H43351F2775284366B628780317663132"><enum>(iii)</enum><text>containing a statement
			 that the agent accepts the designation and acknowledges that the duties of the
			 agent may not be assigned to another person or entity and the duties remain in
			 effect until withdrawn or replaced by the foreign manufacturer or
			 producer.</text>
						</clause></subparagraph></paragraph><paragraph id="HFC86F9ECD647451FA6EB5659C4D159BF"><enum>(4)</enum><header>Applicability</header>
					<subparagraph id="H92B82B9632624DBAB20CABE32117C38A"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Paragraph (1) applies
			 only with respect to a foreign manufacturer or producer that exceeds minimum
			 requirements established by the head of the applicable agency under this
			 section.</text>
					</subparagraph><subparagraph id="HABFFAB5C55EC4122B81305D28B6F3D62"><enum>(B)</enum><header>Factors</header><text display-inline="yes-display-inline">In determining the minimum requirements for
			 application of paragraph (1) to a foreign manufacturer or producer, the head of
			 the applicable agency shall, at a minimum, consider the following:</text>
						<clause id="HD27EE76F4F9640558FA8ACAF22495866"><enum>(i)</enum><text>The value of all covered
			 products imported from the manufacturer or producer in a calendar year.</text>
						</clause><clause id="HE02556236D184EB2B7E804C2DA3CA7AE"><enum>(ii)</enum><text>The quantity of all
			 covered products imported from the manufacturer or producer in a calendar
			 year.</text>
						</clause><clause id="H7773F2E05EE54A36B988A20D6ABAD692"><enum>(iii)</enum><text>The frequency of
			 importation from the manufacturer or producer in a calendar year.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H394D002E7E974D5984DD7650089DDCBA"><enum>(b)</enum><header>Registry of agents of
			 foreign manufacturers and certifications</header>
				<paragraph id="H01704552040C484C84144384A612970E"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Commerce shall, in cooperation with each head of an applicable agency,
			 establish and keep up to date a registry of agents registered under subsection
			 (a), certifications submitted under section 2(5)(B), and certifications removed
			 pursuant to subsection (e).</text>
				</paragraph><paragraph id="HED41720B8747443DAAC1E80EFB787E5B"><enum>(2)</enum><header>Availability</header><text display-inline="yes-display-inline">The Secretary of Commerce shall make the
			 registry established under paragraph (1) available—</text>
					<subparagraph id="H9227F77E0B98400A9DEFA3C188953852"><enum>(A)</enum><text>to the public in a
			 searchable format through the Internet website of the Department of Commerce;
			 and</text>
					</subparagraph><subparagraph id="H2AC0CA64026C4B3E90DB272098202EB7"><enum>(B)</enum><text>to the Commissioner
			 responsible for U.S. Customs and Border Protection in a format prescribed by
			 the Commissioner.</text>
					</subparagraph></paragraph></subsection><subsection id="H187468211A8D4985BA6C0A68FEBB8D2A"><enum>(c)</enum><header>Consent to
			 jurisdiction</header>
				<paragraph id="HFC63E467BE0E4EAEA0530A94D0D0DE53"><enum>(1)</enum><header>In
			 general</header><text>A foreign manufacturer or producer of a covered product
			 that registers an agent under this section thereby consents to the personal
			 jurisdiction of the State and Federal courts of the State in which the
			 registered agent is located for the purpose of any judicial proceeding related
			 to such covered product.</text>
				</paragraph><paragraph id="H5BAAAC2093FC4F59B6FAF47BFABEEB17"><enum>(2)</enum><header>Rule of
			 construction</header><text display-inline="yes-display-inline">Paragraph (1)
			 shall not apply to actions brought by foreign plaintiffs where the alleged
			 injury or damage occurred outside the United States.</text>
				</paragraph></subsection><subsection id="HDFDF39B841A74717BC0282659FAD0496"><enum>(d)</enum><header>Regulations</header>
				<paragraph id="H3292B121454E4838ACAE8557CB198DA1"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than one
			 year after the date of the enactment of this Act, the Secretary of Commerce,
			 the Commissioner responsible for U.S. Customs and Border Protection, and each
			 head of an applicable agency shall prescribe regulations to carry out this
			 section.</text>
				</paragraph><paragraph id="HDA83C4B4BD0246B89B7FD16350B7C2D5"><enum>(2)</enum><header>Interagency
			 cooperation</header><text display-inline="yes-display-inline">The Secretary of
			 Commerce, the Commissioner responsible for U.S. Customs and Border Protection,
			 and each head of an applicable agency shall cooperate and consult with one
			 another for the purpose of—</text>
					<subparagraph id="HAA22790E2A674094A5B462E2C71ED290"><enum>(A)</enum><text>prescribing consistent
			 regulations to the extent necessary for the effective and efficient sharing of
			 information and establishment of systems and procedures necessary to carry out
			 this section; and</text>
					</subparagraph><subparagraph id="H754AEBF4643446AE848D9C214FCE02AA"><enum>(B)</enum><text>establishing minimum
			 requirements described in subsection (a)(4), and to the extent advisable and
			 practicable for the purpose of establishing consistent minimum
			 requirements.</text>
					</subparagraph></paragraph></subsection><subsection id="H8BFD1BD6CDDB40A99ED99B8933D69703"><enum>(e)</enum><header>Certification
			 requirements</header><text display-inline="yes-display-inline">Upon actual
			 knowledge or verified information that any person to whom the requirements of
			 section 2(5)(B) applies has failed to fulfill such requirements the applicable
			 agency shall—</text>
				<paragraph id="HB6B52C86780A4169B3EAAC168F76372F"><enum>(1)</enum><text display-inline="yes-display-inline">notify the Secretary of Commerce that the
			 certification of such person must be removed from the registry under section
			 3(b); and</text>
				</paragraph><paragraph id="H2DC9F80FC31A492994764FC39F6F6011"><enum>(2)</enum><text>notify such person that
			 the related foreign manufacturer or producer must comply with section 3.</text>
				</paragraph></subsection></section><section id="HDEF769B6A50844E0A786C9A3958E5D4F"><enum>4.</enum><header>Prohibition of
			 importation of products of manufacturers without registered agents in United
			 States</header>
			<subsection id="H518862A45D284E22AD22BC4D69B00ACA"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Beginning on the date
			 that is 180 days after the date the regulations required under section 3(d) are
			 prescribed, a person may not import into the United States a covered product
			 (or component part that will be used in the United States to manufacture a
			 covered product) if such product (or component part) or any part of such
			 product (or component part) was manufactured or produced outside the United
			 States by a manufacturer or producer who does not have a registered agent
			 described in section 3(a) whose authority is in effect on the date of the
			 importation.</text>
			</subsection><subsection id="H4A290D7BD7E343318F9E7719CDC63DA0"><enum>(b)</enum><header>Enforcement</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall
			 prescribe regulations to enforce the prohibition in subsection (a).</text>
			</subsection></section><section id="H8A034991F5534697833EA7EBC014158F"><enum>5.</enum><header>Reporting of defects in
			 covered products in foreign countries</header>
			<subsection id="HCC09938728CE4BE1A2A4FF92827D2C9D"><enum>(a)</enum><header>Determination by
			 manufacturer or producer</header><text display-inline="yes-display-inline">Not
			 later than 5 working days after determining to conduct a safety recall or other
			 safety campaign in a foreign country of a covered product that is identical or
			 substantially similar to a covered product offered for sale in the United
			 States, the manufacturer or producer of the covered product shall report the
			 determination to the head of the applicable agency.</text>
			</subsection><subsection id="H0EC350D4495C4258A958F24B21D72E88"><enum>(b)</enum><header>Determination by
			 foreign government</header><text>Not later than 5 working days after receiving
			 notification that the government of a foreign country has determined that a
			 safety recall or other safety campaign must be conducted in the foreign country
			 of a covered product that is identical or substantially similar to a covered
			 product offered for sale in the United States, the manufacturer or producer of
			 the covered product shall report the determination to the head of the
			 applicable agency.</text>
			</subsection><subsection id="H0022DB5C69B64C00A827861C955BD3FF"><enum>(c)</enum><header>Reporting
			 requirements</header><text>Not later than the date described in subsection (d),
			 the head of each applicable agency shall prescribe the contents of the
			 notification required by this section.</text>
			</subsection><subsection id="H17E56B29C7E740EEA850050B7A3B19D3"><enum>(d)</enum><header>Effective
			 date</header><text>Except as provided in subsection (c), this section shall
			 take effect on the date that is one year after the date of the enactment of
			 this Act.</text>
			</subsection></section><section id="HBFD93C6A6A504DF29DBF5BF12014CA14"><enum>6.</enum><header>Study on registration of
			 agents of foreign food producers authorized to accept service of process in the
			 United States</header><text display-inline="no-display-inline">Not later than 1
			 year after the date of the enactment of this Act, the Secretary of Agriculture
			 and the Commissioner of Food and Drugs shall jointly—</text>
			<paragraph id="H1C0A5867659543079B54410EBEDD331D"><enum>(1)</enum><text display-inline="yes-display-inline">complete a study on the feasibility and
			 advisability of requiring foreign producers of food distributed in commerce to
			 register an agent in the United States who is authorized to accept service of
			 process on behalf of such producers for the purpose of any State or Federal
			 regulatory proceeding or any civil action in State or Federal court related to
			 such food products; and</text>
			</paragraph><paragraph id="H1FAE9D5EB6E3464583FE650CA18FD645"><enum>(2)</enum><text>submit to Congress a
			 report on the findings of the Secretary with respect to such study.</text>
			</paragraph></section><section id="H7F663B0DF688445581AD4AD97C29B338"><enum>7.</enum><header>Study on registration of
			 agents of foreign manufacturers and producers of component parts within covered
			 products</header><text display-inline="no-display-inline">Not later than 1 year
			 after the date of the enactment of this Act, the head of each applicable agency
			 shall—</text>
			<paragraph id="H78732DF5D27E4F0D8DAABF21521316B8"><enum>(1)</enum><text>complete a study on
			 determining feasible and advisable methods of requiring manufacturers or
			 producers of component parts within covered products manufactured or produced
			 outside the United States and distributed in commerce to register agents in the
			 United States who are authorized to accept service of process on behalf of such
			 manufacturers or producers for the purpose of any State or Federal regulatory
			 proceeding or any civil action in State or Federal court related to such
			 component parts; and</text>
			</paragraph><paragraph id="H7C8CB3F44B3B421CAC102C2403C7E966"><enum>(2)</enum><text>submit to Congress a
			 report on the findings of the head of the applicable agency with respect to the
			 study.</text>
			</paragraph></section><section id="H8378208192804CDFB371AED522E9AC85"><enum>8.</enum><header>Study on enforcement of
			 United States judgments relating to defective drywall imported from
			 China</header><text display-inline="no-display-inline">Not later than 1 year
			 after the date of the enactment of this Act, the Comptroller General of the
			 United States shall—</text>
			<paragraph id="HC21F842654BC4EBCBD2374BEB7BE1F3A"><enum>(1)</enum><text>complete a study on
			 methods to enforce judgments of any State or Federal regulatory proceeding or
			 any civil action in State or Federal court relating to defective drywall
			 imported from the People’s Republic of China and distributed in commerce during
			 the period 2004 through 2007 and used in residential dwellings in the United
			 States; and</text>
			</paragraph><paragraph id="HDD1F2DAD62314237AE8C0367B944A4C7"><enum>(2)</enum><text>submit to Congress a
			 report on the findings of the Comptroller General with respect to the
			 study.</text>
			</paragraph></section><section id="HF2EFF81ADF024FD69357A5F096EFD40A"><enum>9.</enum><header>Relationship with other
			 laws</header><text display-inline="no-display-inline">Nothing in this Act shall
			 affect the authority of any State to establish or continue in effect a
			 provision of State law relating to service of process or personal jurisdiction,
			 except to the extent that such provision of law is inconsistent with the
			 provisions of this Act, and then only to the extent of such
			 inconsistency.</text>
