		<official-title>To prohibit the release or parole of certain unprivileged
		  enemy belligerents into the United States, and for other
		  purposes.</official-title>

		<section id="HE2672B4421D443589951F93AF80B9901" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Keep Terrorists at Bay Act of 2010</short-title></quote>.</text>
		</section><section id="HA4693EE1AF824F06B9515F044DA2E94E"><enum>2.</enum><header>Treatment of
			 certain unprivileged enemy belligerents</header>
			<subsection id="H80DE2739A7934D0290D28B259C6CC4CB"><enum>(a)</enum><header>Denial of
			 entry</header>
				<paragraph id="H9CA232122B56486785BB6F7F6F9AF6EA"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In the case of an
			 alien described in paragraph (2), no court may order the alien’s release into
			 the United States and the Secretary of State may not issue any visa, and the
			 Secretary of Homeland Security may not admit or provide any type of status, to
			 the alien to enter into, or be admitted to, the United States.</text>
				</paragraph><paragraph id="H933EC32486C84BCA8217F495C76A29B6"><enum>(2)</enum><header>Aliens
			 described</header><text>An alien described in this paragraph is an alien (as
			 defined in section 101(a)(3) of the Immigration and Nationality Act (8 U.S.C.
			 1101(a)(3)))—</text>
					<subparagraph id="H718A5E1791EA48F9893DE0E2813BAB76"><enum>(A)</enum><text>who—</text>
						<clause id="H341B237C3AC14BEE9A4D56580971505C"><enum>(i)</enum><text>is
			 an unprivileged enemy belligerent (as defined in section 948a(7) of title 10,
			 United States Code); or</text>
						</clause><clause id="HDC60AF79F04F4C8CB127B118F0099DFE"><enum>(ii)</enum><text display-inline="yes-display-inline">has at any time been determined by a
			 Combatant Status Review Tribunal to be an enemy combatant (pursuant to the
			 definition employed by that tribunal); and</text>
						</clause></subparagraph><subparagraph id="H0D0BB12569BF41C4B0E1A2A61EB59C31"><enum>(B)</enum><text display-inline="yes-display-inline">who is or was in the custody of the United
			 States at Guantanamo Bay, Cuba, before, on, or after the date of the enactment
			 of this Act.</text>
					</subparagraph></paragraph></subsection><subsection id="HE69AD1117CAD42089F112037F464CC60"><enum>(b)</enum><header>Parole</header>
				<paragraph id="H21F3E482CFBA4B92BD410A9871EC5CFF"><enum>(1)</enum><header>In
			 general</header><text>Section 212(d)(5) of the Immigration and Nationality Act
			 (8 U.S.C. 1182(d)(5)) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H5F2D2B61388042B698B6A3077A47204D" style="traditional">
						<subparagraph id="H1851FE9BAF62457F88245FD54032ABB6" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security may not
				parole into the United States an alien—</text>
							<clause id="H7C405CB57CFA40C88D238187B47327C9"><enum>(i)</enum><text>who—</text>
								<subclause id="HBA52E2EC2BC0440B9F4933BE3142972D"><enum>(I)</enum><text>is an unprivileged enemy
				belligerent (as defined in section 948a(7) of title 10, United States Code);
				or</text>
								</subclause><subclause id="H2B7A0D93D8AE4B6F9BCA61B105FCF3FF"><enum>(II)</enum><text display-inline="yes-display-inline">has at any time been determined by a
				Combatant Status Review Tribunal to be an enemy combatant (pursuant to the
				definition employed by that tribunal); and</text>
								</subclause></clause><clause id="HE201D80D546041ADBFB4284B05638EF2"><enum>(ii)</enum><text display-inline="yes-display-inline">who is or was in the custody of the United
				States at Guantanamo Bay, Cuba, before, on, or after the date of the enactment
				of this
				subparagraph.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HA44F0DB07C9F42AD97892175A19894A2"><enum>(2)</enum><header>Technical and
			 conforming amendments</header><text>Section 212(d)(5) of the Immigration and
			 Nationality Act (8 U.S.C. 1182(d)(5)) is amended—</text>
					<subparagraph id="H3DF30ABEB296497698B91D546FF8244E"><enum>(A)</enum><text>by striking
			 <quote>Attorney General</quote> each place such term appears and inserting
			 <quote>Secretary of Homeland Security</quote>;</text>
					</subparagraph><subparagraph id="H9186DBB8952344A29AC918882877D384"><enum>(B)</enum><text>by striking
			 <quote>in his discretion</quote> and inserting <quote>in the Secretary’s
			 discretion</quote>;</text>
					</subparagraph><subparagraph id="HDEE08C5411C44AC5BF0FD9769193BF6A"><enum>(C)</enum><text>by striking
			 <quote>as he may prescribe</quote> and inserting <quote>as the Secretary may
			 prescribe</quote>;</text>
					</subparagraph><subparagraph id="H969751F62C9741CC90D1BD395DAA5DBB"><enum>(D)</enum><text>by striking
			 <quote>he was paroled</quote> and inserting <quote>the alien was
			 paroled</quote>; and</text>
					</subparagraph><subparagraph id="H4C0EB377E9E742E99EFF9EFF798B6876"><enum>(E)</enum><text>by striking
			 <quote>his case</quote> and inserting <quote>the alien’s case</quote>.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
