		<official-title>To amend the Communications Act of 1934 to create a pilot
		  program to bridge the digital divide by providing vouchers for broadband
		  service to eligible students, to increase access to advanced telecommunications
		  and information services for community colleges and head start programs, to
		  establish a pilot program for discounted electronic books, and for other
		  purposes.</official-title>

		<section id="H1B029F1B437E42638E2DD1FB131370DF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>E-Rate 2.0 Act of
			 2010</short-title></quote>.</text>
		</section><section id="H2B34DB45248A440AB013C0B56E39DC01"><enum>2.</enum><header>E-rate 2.0
			 program for increased adoption</header><text display-inline="no-display-inline">Section 254(h) of the Communications Act of
			 1934 (47 U.S.C. 254(h)) is amended—</text>
			<paragraph id="H862F74BE7AB54688AD630D4F4BDB970A"><enum>(1)</enum><text>by redesignating
			 paragraph (7) as paragraph (10); and</text>
			</paragraph><paragraph id="HE5D5390CEC324ACE87754FAC3DCCC4B1"><enum>(2)</enum><text>by adding after
			 paragraph (6) the following:</text>
				<quoted-block id="HEEE69235C3A24AD6B6CD6FF96EE62A25" style="OLC">
					<paragraph id="H588DCFA347994BB388C893DF40241009"><enum>(7)</enum><header>Digital divide
				mitigation</header>
						<subparagraph id="H12B913FF2A0443E0A9782D4B8A4595A3"><enum>(A)</enum><header>In
				general</header><text>The Commission shall implement a pilot program to extend
				broadband service to students who—</text>
							<clause id="H38D1D1385E3E46FE9246298148507A6B"><enum>(i)</enum><text>qualify for
				funding under the federally subsidized school lunch program;</text>
							</clause><clause id="H74D6A903A5CB4B1ABCC2087001DACDDA"><enum>(ii)</enum><text>attend secondary
				schools that receive support under this section; and</text>
							</clause><clause id="HBD20A17B123C4B0C9778F94CB239083D"><enum>(iii)</enum><text>who possess a
				computer for use at home.</text>
							</clause></subparagraph><subparagraph id="HBA588B197970476C9132F1D5B1AAB45C"><enum>(B)</enum><header>Use of
				funds</header><text>The pilot program shall distribute funding to such
				secondary schools to dispense vouchers to eligible students to be used for
				monthly service fees for residential broadband service for such
				students.</text>
						</subparagraph><subparagraph id="H324E0BD3C39447A6AEED128C6A263472"><enum>(C)</enum><header>Rules</header><text>The
				Commission shall promulgate rules to implement the pilot program, including
				rules to prevent vouchers from being sold or transferred to non-qualifying
				individuals.</text>
						</subparagraph><subparagraph id="H1673F8A32ABA471A8288D9100DB4D776"><enum>(D)</enum><header>Limitations</header>
							<clause id="H9BFD20EB6BE64FDE9B4261E984776509"><enum>(i)</enum><header>Duration</header><text>The
				pilot program shall be in effect for a period of 5 years after the effective
				date of the regulations promulgated under subparagraph (C).</text>
							</clause><clause id="HDD839B0E648D4998939B9CF1A464B687"><enum>(ii)</enum><header>Maximum
				amount</header><text>There is authorized to be appropriated to the Commission
				to implement the pilot program not more than $500,000,000 per year for the
				period described in clause
				(i).</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H18A24AA5F0AC4A32B60E7ADC7113BAA8" section-type="subsequent-section"><enum>3.</enum><header>Eligibility for
			 discounted rates for community colleges and head start programs</header>
			<subsection id="H51FFCA0A59EA4A128AFF69DD32CB0713"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 254(h) of
			 such Act (47 U.S.C. 254(h)) is further amended—</text>
				<paragraph id="H02971564C84143B39B49AD1DB85161F4"><enum>(1)</enum><text>in paragraph
			 (2)(A), by striking <quote>classrooms,</quote> and inserting <quote>classrooms,
			 community colleges, head start programs</quote>; and</text>
				</paragraph><paragraph id="HD4D5BF55B70143E5B38A27550F368A71"><enum>(2)</enum><text>in paragraph (10)
			 (as redesignated under section 2(1))—</text>
					<subparagraph id="H9D1BA75DF7764B9D9A013152AC5E027C"><enum>(A)</enum><text>in subparagraph
			 (C), by striking <quote>school,</quote> and inserting <quote>school, a
			 community college, a head start program</quote>; and</text>
					</subparagraph><subparagraph id="HD428B44D587346FC8A305F68E8D0465A"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H12E77B08454A4C329BC558738F94313C" style="OLC">
							<subparagraph id="H0D54FBB324B348ECB708D1A0904754A8"><enum>(J)</enum><header>Community
				college</header><text display-inline="yes-display-inline">The term
				<quote>community college</quote> has the meaning given the term <quote>junior
				or community college</quote> in section 312 of the Higher Education Act of 1965
				(20 U.S.C. 1058).</text>
							</subparagraph><subparagraph commented="no" id="H9970994416E14545A49291448BC708A4"><enum>(K)</enum><header>Head start
				program</header><text display-inline="yes-display-inline">The term <quote>head
				start program</quote> means any local public or private nonprofit agency that
				is designated by the Secretary of Health and Human Services as a Head Start
				agency under section 641 of the Head Start Act (42 U.S.C.
				9836).</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H49A8E53551AE463F83ACFD17F8DCD1BB"><enum>(b)</enum><header>Pilot
			 Project</header><text>Section 254(h) of such Act (47 U.S.C. 254(h)) is further
			 amended by inserting after paragraph (7), as added by section 2, the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H76E64EB0FE094FAB95EEED03C09464B8" style="OLC">
					<paragraph id="HE34B6AC9A6334EAEAF3A9A8F43829FC0"><enum>(8)</enum><header>Community
				Colleges and Head Start Programs Pilot Project</header>
						<subparagraph id="HAAB7E3B740EB47969CDD03C11B01B6C6"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Commission shall
				implement a pilot project, not to exceed $150,000,000 in any one year, to
				extend funding for broadband equipment and services under this section to those
				community college or head start program applicants who best demonstrate need,
				maximization potential of broadband use consistent with their educational
				mission, and innovation with respect to use of broadband, web-based information
				and applications.</text>
						</subparagraph><subparagraph id="H02FDD54BDB2A4C4D8CCCDDBB2A477886"><enum>(B)</enum><header>Rulemaking
				required</header><text>The Commission shall adopt rules as necessary to
				implement this paragraph.</text>
						</subparagraph><subparagraph id="H9FB7BC6138E64A98B559E9BFCA9C1CF6"><enum>(C)</enum><header>Specification</header><text>For
				the first 5 years after the date of enactment of the
				<short-title>E-Rate 2.0 Act of 2010</short-title>,
				community colleges and head start programs shall receive funding for broadband
				equipment and services from the Federal government exclusively through this
				pilot
				project.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H3D3C4442A7834383BBF2D12F363D491E"><enum>4.</enum><header>Electronic Books
			 Pilot Project</header><text display-inline="no-display-inline">Section 254(h)
			 of the Communications Act of 1934 (47 U.S.C. 254(h)) is further amended by
			 inserting after paragraph (8), as added by section 3, the following:</text>
			<quoted-block display-inline="no-display-inline" id="H93845C3D2E4B45C3931FD9923407D10A" style="OLC">
				<paragraph id="H15EA58E6B8D047798FFFB39ACDBEA9F0"><enum>(9)</enum><header>E-Books for
				E-rate</header>
					<subparagraph id="HD6A37E353B6947CC92F2264E74B92CB8"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Commission shall
				implement a pilot project, not to exceed $50,000,000 in any one year, to extend
				to those secondary school applicants for funding under this section that are
				eligible for the highest percentage discounted rates under the Commission’s
				regulations implementing this section an opportunity to apply for meaningfully
				discounted services and technologies for the use of electronic books.</text>
					</subparagraph><subparagraph commented="no" id="HE7B48220BB1D4EE5B905B9390AA92936"><enum>(B)</enum><header>Rulemaking
				required</header><text display-inline="yes-display-inline">The Commission shall
				adopt such rules as may be necessary to implement this paragraph, including
				rules assuring that such technologies and services are incorporated into the
				course curricula of the applying secondary school and that implementation is on
				a technology-neutral basis.</text>
					</subparagraph><subparagraph id="H1FEB85F7ECCB4667B7D3444307FFDB99"><enum>(C)</enum><header>Duration;
				Report</header>
						<clause id="H11C5401A230B41A1B82B002C565C2188"><enum>(i)</enum><header>In
				general</header><text>The pilot project shall last 4 years in duration.</text>
						</clause><clause id="HC2DE68578ED24C178130ECC2E8E80173"><enum>(ii)</enum><header>Report</header><text>At
				the end of the third year of the operation of the pilot project, the Commission
				shall prepare and submit to Congress a report assessing the project. The report
				shall include metrics to gauge the impact on digital literacy and overall
				learning associated with the student use of the electronic books
				project.</text>
						</clause></subparagraph><subparagraph commented="no" id="H99475543F6AD4794B5C86D41EE303131"><enum>(D)</enum><header>Rulemaking
				required</header><text>The Commission shall commence and complete a rulemaking
				in the final year of the pilot project and determine whether the program should
				be extended or terminated, and if extended, what additional entities should be
				eligible for funding, what level of funding is reasonable and affordable for
				such program, and what other modifications to the program are warranted
				consistent with the public
				interest.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H49C3C6C1A0E74885A5F4715416964B82"><enum>5.</enum><header>Improved
			 Administration of E-Rate Application Process</header>
			<subsection id="HD407BB9CA8F847678B9D5D69698C0E18"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 6
			 months after the date of enactment of this Act, the Federal Communications
			 Commission shall develop and implement policies and procedures to streamline
			 and simplify the application process under section 254(h) of the Communications
			 Act of 1934 (commonly known as the <quote>E-Rate program</quote>) for the
			 purpose of—</text>
				<paragraph id="H2F3AF3196F4C4A9489830DC4EF78C850"><enum>(1)</enum><text>improving
			 administration of the program;</text>
				</paragraph><paragraph id="HB94D54EC2CDD480FAD9429075DAA0AB1"><enum>(2)</enum><text>increasing access
			 to the benefits of the program;</text>
				</paragraph><paragraph id="H97CCBDA118704575BA1C2B0655D61E4F"><enum>(3)</enum><text>minimizing the
			 burden on applicants; and</text>
				</paragraph><paragraph id="H6FBD5692CAF844899C730C5A87FDFABA"><enum>(4)</enum><text>maintaining
			 measures to eliminate waste, fraud, and abuse.</text>
				</paragraph></subsection><subsection id="H45CE7D87F974440BB1201EB9EF8CD7B2"><enum>(b)</enum><header>Specific
			 modifications</header><text display-inline="yes-display-inline">In carrying out
			 subsection (a), the Federal Communications Commission shall consider whether
			 the mission and goals of the E-Rate program would be better served by the
			 following modifications to the administration of the program:</text>
				<paragraph id="HE3F4A5C6F76948F98B7D3ABC97A543C0"><enum>(1)</enum><text display-inline="yes-display-inline">The establishment of a multi-year
			 application for Priority One services such that applicants would be required to
			 submit funding requests only once every 3 years for recurring services (such as
			 telephone and Internet access services).</text>
				</paragraph><paragraph id="HA126D8C155AA475B858ACCA217CBFD6F"><enum>(2)</enum><text display-inline="yes-display-inline">The use of an interactive Web site for
			 communicating with applicants.</text>
				</paragraph><paragraph id="H53DC62BC0C054182AE28DE20AC2F6931"><enum>(3)</enum><text>The deployment of
			 interactive technology tools, such as online application forms, as part of the
			 application process to reduce the use of paper-based means of communication and
			 to improve the ability of applicants to receive clear and current information
			 regarding their applications and the E-Rate program.</text>
				</paragraph></subsection></section><section id="H8231692341BF4E1ABD7DB1C02CA22355"><enum>6.</enum><header>E-Rate Fund Cap
			 Modification</header>
			<subsection id="H2F75C804055B40C68AAE0B58A15A8E78"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 6
			 months after the date of enactment of this Act, the Federal Communications
			 Commission shall complete a proceeding to revise the amount of the cap provided
			 for in section 54.507(a) of title 47, Code of Federal Regulations, to account
			 for inflation.</text>
			</subsection><subsection id="HC8B516F22F424831A4CFED5C6CA2FD2B"><enum>(b)</enum><header>Report to
			 Congress</header><text display-inline="yes-display-inline">Not later than 30
			 days after completing the proceeding required by subsection (a), the Federal
			 Communications Commission shall submit a report to Congress explaining what
			 methodology the Commission will use to determine the appropriate adjustment
			 under such subsection.</text>
