		<official-title>To temporarily expand the V nonimmigrant visa category to
		  include Haitians whose petition for a family-sponsored immigrant visa was
		  approved on or before January 12, 2010.</official-title>

		<section id="H1500D9BFBC604307B18FDA4B9D282B1B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Haitian Emergency Life Protection Act
			 of 2010</short-title></quote> or the <quote><short-title>H.E.L.P. Act</short-title></quote>.</text>
		</section><section id="HBFA54C145FAE4EF98A750F1B54DDEEE0" section-type="subsequent-section"><enum>2.</enum><header>Expansion of V Visa
			 category for Haitian immigrants</header><text display-inline="no-display-inline">Section 101(a)(15)(V) of the Immigration and
			 Nationality Act (8 U.S.C. 1101(a)(15)(V)) is amended—</text>
			<paragraph id="H56743B3D695E4A49B1E369F7D85EDC96"><enum>(1)</enum><text>in the matter
			 preceding clause (i), by striking <quote>section 203(a)(2)(A) that</quote> and
			 inserting <quote>section 203(a) that, except as provided under clause
			 (iii),</quote>;</text>
			</paragraph><paragraph id="H31FF8EDD411A4C10ADE4F24C579EFD3F"><enum>(2)</enum><text>by amending clause
			 (i) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H234318B1DC8D4086A4E3052BF3D62196" style="OLC">
					<clause id="HCE63F482AD9441EFBD41289E1DB02DF6"><enum>(i)</enum><text>the petition is
				for status under section 203(a)(2)(A) and has been pending for at least 3
				years;</text>
					</clause><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H3DC6F2CB351D41FB942EB30578CA7D46"><enum>(3)</enum><text>in clause
			 (ii)—</text>
				<subparagraph id="H0840CAAA049641A081B8C3952AEA2AA2"><enum>(A)</enum><text>by amending the
			 matter preceding subclause (I) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HABB7EB0A8A064CC0B2F47B5B8790FB83" style="OLC">
						<clause id="H43DC07BF89B04BC6B87760B0F34F5BA2"><enum>(ii)</enum><text>the petition is
				for status under section 203(a)(2)(A), has been approved, and was filed at
				least 3 years previously, and</text>
						</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="H6C030729C9474B99AD7A203DDF00877F"><enum>(B)</enum><text>in subclause (ii),
			 by striking the period at the end and inserting <quote>; or</quote>; and</text>
				</subparagraph></paragraph><paragraph id="HDC64F75301804917899F5A0227EF18F3"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HBF67C8D9CBB44B2FBCDF7FE74F6965C7" style="OLC">
					<clause id="HFAA17452AD124A09A3A9C45A98818FFD" indent="up1"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HCA09628B26A94FDD85EE83B931EDC315"><enum>(I)</enum><text>such petition was
				approved on or before January 12, 2010; and</text>
						</subclause><subclause id="H932D3FB9E9794CB09C7C7F87C5BF87C4" indent="up1"><enum>(II)</enum><text>the alien is a national and
				resident of
				Haiti.</text>
						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H20C148D654734F27BCB8BB0111BD4ED6"><enum>3.</enum><header>Use of secondary
			 evidence for eligibility verification</header><text display-inline="no-display-inline">The Department of State, in coordination
			 with United States Citizenship and Immigration Services, may issue travel
			 documents (including a nonimmigrant visa) to any alien in Haiti—</text>
			<paragraph id="HBB6E80CF64AC47AD9FB0AE2B87E96A68"><enum>(1)</enum><text display-inline="yes-display-inline">who is described in—</text>
				<subparagraph id="H9F657D7B76E74575922379C278F17778"><enum>(A)</enum><text display-inline="yes-display-inline">section 101(a)(15)(V)(iii) of the
			 Immigration and Nationality Act, as added by this Act; or</text>
				</subparagraph><subparagraph id="H38B98DD1D1604D39BE32A909824B6072"><enum>(B)</enum><text display-inline="yes-display-inline">section 201(b)(2)(A) of such Act;</text>
				</subparagraph></paragraph><paragraph id="HEFE735E2000044468048EEE86C898433"><enum>(2)</enum><text display-inline="yes-display-inline">whose eligibility for such documents has
			 been evaluated by a consular officer after reviewing the best available
			 evidence of such eligibility, including secondary evidence, if necessary;
			 and</text>
			</paragraph><paragraph id="HB7E7F7B66F314335AC916EEB54D410E8"><enum>(3)</enum><text display-inline="yes-display-inline">who meets all criteria required for—</text>
				<subparagraph id="HE18ED9A26D2040B0AF6395EBD3AA3793"><enum>(A)</enum><text display-inline="yes-display-inline">a family-sponsored immigrant visa under
			 section 203(a) of the Immigration and Nationality Act (8 U.S.C. 1153(a));
			 or</text>
				</subparagraph><subparagraph id="HB970CC039E294974A1AF7A5074D4E547"><enum>(B)</enum><text display-inline="yes-display-inline">admission into the United States as an
			 immediate relative of a United States citizen (as defined in section
			 203(b)(2)(A)(i) of such Act).</text>
				</subparagraph></paragraph></section><section id="H050196158EF647F7856C505C9D4F1D1B"><enum>4.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as may be necessary for each of the
			 fiscal years 2010 through 2012 to process—</text>
			<paragraph id="H36AAC5510F594D73853E947D1FE442FA"><enum>(1)</enum><text display-inline="yes-display-inline">nonimmigrant visa applications authorized
			 under section 101(a)(15)(V)(iii) of the Immigration and Nationality Act, as
			 added by this Act; and</text>
			</paragraph><paragraph id="H4FFF1BC657084D09BA4AF61395CD5556"><enum>(2)</enum><text display-inline="yes-display-inline">immigrant visa applications for immediate
			 relatives (as defined in section 203(b)(2)(A)(i) of such Act).</text>
			</paragraph></section><section id="H9A69650886574AEBA64B9FB824ECD7C2"><enum>5.</enum><header>Sunset
			 provision</header><text display-inline="no-display-inline">This Act and the
			 amendments made by this Act shall be effective during the 2-year period
			 beginning on the date of the enactment of this Act.</text>
