		<legis-type>A BILL</legis-type>
		<official-title>To require, as a condition for modification of a home
		  mortgage loan held by Fannie Mae or Freddie Mac or insured under the National
		  Housing Act, that the mortgagor be verified under the E-Verify
		  program.</official-title>

		<section id="H9634CE88C1DC40ADA8E2A50CE2E848FE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Mortgage E-Verify Act of
			 2010</short-title></quote>.</text>
		</section><section id="H1DD1B64C3ECF4C86B3EA72CA346CAC6B"><enum>2.</enum><header>Verification
			 under E-Verification program</header>
			<subsection id="H3D40435C5A524E1498D55500BF1C314D"><enum>(a)</enum><header>Fannie
			 Mae</header><text display-inline="yes-display-inline">Subsection (b) of section
			 302 of the Federal National Mortgage Association Charter Act (12 U.S.C.
			 1717(b)) is amended by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H147AB5F63F6B4387A5467750E195ABDE" style="OLC">
					<paragraph id="H386B940A547B4C7D9D0308E507F16B89" indent="up1"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HD27AAB2B4EBB4054B72EAB671C962777"><enum>(A)</enum><text>Notwithstanding any
				other provision of law, the corporation may not—</text>
							<clause id="H8C3FF044CDA947088EE76A2FAE39A5D5" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">refinance, restructure, or modify, or
				otherwise authorize or enter into any agreement for the refinancing,
				restructuring, or modification of any single-family housing mortgage that is
				held by or that backs any security issued by the corporation, or</text>
							</clause><clause id="HD665867B615C4346AFD2CA703F4A403E" indent="up1"><enum>(ii)</enum><text>purchase, or issue any security that
				is backed by, any single-family housing mortgage made for the refinancing,
				restructuring, or modification of the mortgagor’s previous single-family
				housing mortgage on the same property,</text>
							</clause></subparagraph><continuation-text continuation-text-level="paragraph" indent="paragraph">unless the identity and work eligibility of the
				mortgagor under such mortgage has been confirmed by an inquiry under
				subparagraph (B).</continuation-text><subparagraph id="H93CC598A58344336B2B6EC56B8DABCAE" indent="up1"><enum>(B)</enum><text>An inquiry under this subparagraph is
				an inquiry made through the basic pilot program under section 403(a) of the
				Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C.
				1324a note; commonly referred to as the E-Verify program). Notwithstanding any
				other provision of law, lenders for single-family housing mortgages and the
				corporation may submit such inquiries regarding the identities and work
				eligibility of mortgagors under such mortgages, and may be provided
				confirmations and nonconfirmations pursuant to such inquiries, under such basic
				pilot program.</text>
						</subparagraph><subparagraph id="HED07C6C4F3124AFC854540926B84C2D7" indent="up1"><enum>(C)</enum><text>For purposes of this paragraph, the
				term <term>single-family housing mortgage</term> means a mortgage that is
				secured by a 1- to 4-family
				residence.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H75DE3E67FB1A4B04868A433D411E0B87"><enum>(b)</enum><header>Freddie
			 Mac</header><text>Subsection (a) of section 305 of the Federal Home Loan
			 Mortgage Corporation Act (12 U.S.C. 1454(a)) is amended by adding at the end
			 the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HCB88CBDC3AC941E49FD31448791E33D2" style="OLC">
					<paragraph id="H3B2213C2F438484B9C2B86F88373386E" indent="up1"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H5962FF8A990447BE8255F219CD77E068"><enum>(A)</enum><text>Notwithstanding any
				other provision of law, the Corporation may not—</text>
							<clause id="HC2FED35F81D64549857C874216AC2C2D" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">refinance, restructure, or modify, or
				otherwise authorize or enter into any agreement for the refinancing,
				restructuring, or modification of any single-family housing mortgage that is
				held by or that backs any security issued by the Corporation, or</text>
							</clause><clause id="H9F9ACB2F249B49E58F625637E16C92C6" indent="up1"><enum>(ii)</enum><text>purchase, or issue any security that
				is backed by, any single-family housing mortgage made for the refinancing,
				restructuring, or modification of the mortgagor’s previous single-family
				housing mortgage on the same property,</text>
							</clause></subparagraph><continuation-text continuation-text-level="paragraph" indent="paragraph">unless the identity and work eligibility of the
				mortgagor under such mortgage has been confirmed by an inquiry under
				subparagraph (B)</continuation-text><subparagraph id="H8F86F753AE574FF88FA363F4A26205C3" indent="up1"><enum>(B)</enum><text>An inquiry under this subparagraph is
				an inquiry made through the basic pilot program under section 403(a) of the
				Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C.
				1324a note; commonly referred to as the E-Verify program). Notwithstanding any
				other provision of law, lenders for single-family housing mortgages and the
				Corporation may submit such inquiries regarding the identities and work
				eligibility of mortgagors under such mortgages, and may be provided
				confirmations and nonconfirmations pursuant to such inquiries, under such basic
				pilot program.</text>
						</subparagraph><subparagraph id="H2AC891C829B34EC184C833DDC16AA81E" indent="up1"><enum>(C)</enum><text>For purposes of this paragraph, the
				term <term>single-family housing mortgage</term> means a mortgage that is
				secured by a 1- to 4-family
				residence.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H35F8D7109B654205A01128DE0DD88C70"><enum>(c)</enum><header>FHA</header><text>Title
			 II of the National Housing Act (12 U.S.C. 1707 et seq.) is amended by adding at
			 the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HA3DE0A85F5A2498A8D1CFDE16FB73684" style="OLC">
					<section id="H75D995A4B2FA4C27B5183F97578C918B"><enum>543.</enum><header>E-Verification
				requirement for modification of mortgages</header>
						<subsection id="HCF10B856459D49AF9906DEABE203E858"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
				the Secretary may not—</text>
							<paragraph id="HE22D274015954E608FAFB057D958BC7D"><enum>(1)</enum><text>authorize or enter
				into any agreement for the refinancing, restructuring, or modification of any
				single-family housing mortgage that is insured by the Secretary under this Act,
				or</text>
							</paragraph><paragraph id="H1CFD7D8434CC48F986FFA0DECFBBC335"><enum>(2)</enum><text>insure any
				single-family housing mortgage made for the refinancing, restructuring, or
				modification of the mortgagor’s previous single-family housing mortgage on the
				same property,</text>
							</paragraph><continuation-text continuation-text-level="subsection">unless
				the identity and work eligibility of the mortgagor under such mortgage has been
				confirmed by an inquiry under subsection (b).</continuation-text></subsection><subsection id="HD20B7637147744CCA212539040D2ABB6"><enum>(b)</enum><header>E-Verify
				inquiries</header><text>An inquiry under this subsection is an inquiry made
				through the basic pilot program under section 403(a) of the Illegal Immigration
				Reform and Immigrant Responsibility Act of 1996 (8 U.S.C. 1324a note; commonly
				referred to as the E-Verify program). Notwithstanding any other provision of
				law, lenders for single-family housing mortgages and the Secretary may submit
				such inquiries regarding the identities and work eligibility of mortgagors
				under such mortgages, and may be provided confirmations and nonconfirmations
				pursuant to such inquiries, under such basic pilot program.</text>
						</subsection><subsection id="HA5D8805DCE1942369C9C38676B5D4353"><enum>(c)</enum><header>Single-Family
				housing mortgage</header><text>For purposes of this paragraph, the term
				<term>single-family housing mortgage</term> means a mortgage that is secured by
				a 1- to 4-family
				residence.</text>
