		<official-title>To amend the Federal Election Campaign Act of 1971 to
		  require certain campaign-related communications which are paid for by certain
		  tax-exempt organizations or political organizations to include a statement
		  naming their five largest donors, and for other purposes.</official-title>

		<section id="H6B32F5390E1D4A7989E3C6F143C5A2DA" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Stand By Your Ad Act of 2010</short-title></quote>.</text>
		</section><section id="H0600A684355B4B10AF0FC25C4720F5AF"><enum>2.</enum><header>Statements
			 Included in Campaign Communications Funded by Certain Tax-Exempt Organizations
			 or Political Organizations</header>
			<subsection id="H4768F2EE9EC74B89BF80287628C520EB"><enum>(a)</enum><header>Requiring
			 Statement Identifying Largest Donors</header><text display-inline="yes-display-inline">Section 318(d) of the Federal Election
			 Campaign Act of 1971 (2 U.S.C. 441d(d)) is amended—</text>
				<paragraph id="HEDAE357755DF483AB54BF6D2108D9B55"><enum>(1)</enum><text>in paragraph (2),
			 by striking <quote>Any communication</quote> and inserting <quote>Except as
			 provided in paragraph (3), any communication</quote>; and</text>
				</paragraph><paragraph id="H2CF2401BBE224520A1D793D624440378"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HBD7F203BBEE84FF2A345BE118A2FAF9E" style="OLC">
						<paragraph id="HDD4B109ABAC64B878BE39C4A79F902CB"><enum>(3)</enum><header>Special rules
				for communications paid for by certain tax-exempt or political
				organizations</header>
							<subparagraph id="HA4D46C95F741490DBD835CF918CDB0CA"><enum>(A)</enum><header>Disclosure
				statement required</header><text display-inline="yes-display-inline">Any
				communication described in paragraph (3) of subsection (a) which is funded in
				whole or in part by a covered section 501(c) organization or a political
				organization and which is transmitted through radio or television shall
				include, in addition to the requirements of that paragraph, the disclosure
				statement described in subparagraph (C).</text>
							</subparagraph><subparagraph id="HABCFD086F6DF498F953E483C048B4FFA"><enum>(B)</enum><header>Method of
				conveyance of statement</header>
								<clause id="H001998920B81431CB6B3FA1BC11BE93F"><enum>(i)</enum><header>Communications
				transmitted through radio</header><text display-inline="yes-display-inline">In
				the case of a communication to which this paragraph applies which is
				transmitted through radio, the disclosure statement described in subparagraph
				(C) shall be made by audio in a clearly spoken manner.</text>
								</clause><clause id="H076A44CF394043D686D8FF3571F001CC"><enum>(ii)</enum><header>Communications
				transmitted through television</header><text display-inline="yes-display-inline">In the case of a communication to which
				this paragraph applies which is transmitted through television, the disclosure
				statement described in subparagraph (C) shall be conveyed by an unobscured,
				full-screen view of a representative of the organization, or by a
				representative of the organization making the statement in voice-over. The
				statement, together with clearly readable logos of the organization and each
				donor identified in the disclosure statement (if any), shall also appear in
				writing at the end of the communication in a clearly readable manner with a
				reasonable degree of color contrast between the background and the printed
				statement and logos, for a period of at least 4 seconds.</text>
								</clause></subparagraph><subparagraph id="HE41EF3633BEE4410BEE2994D11072A12"><enum>(C)</enum><header>Disclosure
				statement described</header><text>The disclosure statement described in this
				subparagraph is the following: <quote>This advertisement was paid for by
				_______, whose funders include _______. For a full list of donors, go to
				_______.</quote>, with—</text>
								<clause id="HCBF87A57ECE747C1903DA7BC8AC51AAB"><enum>(i)</enum><text>the first blank to
				be filled in with the name of the covered section 501(c) organization or
				political organization involved;</text>
								</clause><clause id="HC632EE555FBE443CB5F7B703D2158F66"><enum>(ii)</enum><text>the second blank
				to be filled in with the names of the 5 persons who provided the largest amount
				of funding to the organization for any purpose during the 12-month period which
				ends on the date on which the organization paid for the communication;
				and</text>
								</clause><clause id="HDE73AB4D3D2348F2A413A15DB7F17876"><enum>(iii)</enum><text>the third blank
				to be filled in with the Internet address of the website of the organization
				which includes the information the organization is required to post and
				maintain under subsections (c)(4) and (f)(8) of section 304.</text>
								</clause></subparagraph><subparagraph id="H234910BBCE824A0EAA1C1C9040829454"><enum>(D)</enum><header>Definitions</header><text>In
				this paragraph—</text>
								<clause id="H8A5B107A50DB4270866ABDC6CF689575"><enum>(i)</enum><text>the term
				<term>political organization</term> means a political organization described in
				section 527 of the Internal Revenue Code of 1986, except that such term does
				not include a political committee of a political party; and</text>
								</clause><clause id="H0DA734C4F46E468F8FF32B49DC69CB7B"><enum>(ii)</enum><text>the term
				<term>covered section 501(c) organization</term> means—</text>
									<subclause display-inline="no-display-inline" id="H19B0047DA6894F03ACDF99FA3FAA4F4D"><enum>(I)</enum><text>an organization
				described in paragraph (4), (5), or (6) of section 501(c) of the Internal
				Revenue Code of 1986 and exempt from taxation under section 501(a) of such
				Code; or</text>
									</subclause><subclause display-inline="no-display-inline" id="HDDB055CD806D46A38BF34AF32C74BEC0"><enum>(II)</enum><text>an organization
				which has submitted an application to the Internal Revenue Service for
				determination of its status as an organization described in subclause
				(I).</text>
									</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H4C2DFB4361AC46D59EEB99C496715B07"><enum>(b)</enum><header>Effective
			 Date</header><text>The amendment made by subsection (a) shall apply with
			 respect to communications made on or after the date of the enactment of this
			 Act.</text>
			</subsection></section><section id="HB87DC42045C34512A15A1A6A4FADC1F1"><enum>3.</enum><header>Requiring
			 Organizations to Include Information on Largest Donors in Reports on
			 Independent Expenditures and Electioneering Communications</header>
			<subsection id="H58E942ACDF024E51B7213AD178A2ABAF"><enum>(a)</enum><header>Reports on
			 Independent Expenditures</header>
				<paragraph id="H59E158DE96A5438786D0D83F7EC6FA17"><enum>(1)</enum><header>Contents of
			 statements</header><text>Section 304(c)(2) of the Federal Election Campaign Act
			 of 1971 (2 U.S.C. 434(c)(2)) is amended—</text>
					<subparagraph id="HC59A5CCBCF5E40B181A7D06C453AE63C"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (B);</text>
					</subparagraph><subparagraph id="H8DB55A539D8E420AAA1A3421485A09D2"><enum>(B)</enum><text>by striking the
			 period at the end of subparagraph (C) and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="H77AE10E6F0B8465CAD7079165F223B7E"><enum>(C)</enum><text>by adding at the
			 end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="H1A3D5E378F5C4185B2922B179ABB37DD" style="traditional">
							<subparagraph id="H26E41454889446F1A97E18617B0534F6" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">if
				the person making the independent expenditure is a covered section 501(c)
				organization or a political organization (as such terms are defined in section
				318(d)(3)(D)), the identification of the 5 persons who provided the largest
				amount of funding to the organization for any purpose, together with the amount
				of funding each such person provided, during the 12-month period which ends on
				the date on which the organization made the independent expenditure.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HD0F6E8936A3348F29F2FE5B699AB976E"><enum>(2)</enum><header>Posting of
			 information on website</header><text>Section 304(c) of such Act (2 U.S.C.
			 434(c)) is amended by adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H60AD466FD8D44242BDF16DF7907B4649" style="traditional">
						<paragraph id="HBC9A9BB340B44B7A920D3B5C50AFF602" indent="up1"><enum>(4)</enum><text>Each covered section 501(c)
				organization or political organization which is required to include the
				information described in paragraph (2)(D) in the statements required to be
				filed under this subsection shall post and maintain such information on a
				publicly available official website of the organization.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H4DDE72DBFE534AEFB8EC1F6C6E37A19A"><enum>(b)</enum><header>Reports on
			 Electioneering Communications</header>
				<paragraph id="H1F0263B579824734A63A780C0304D2F7"><enum>(1)</enum><header>Contents of
			 statements</header><text>Section 304(f)(2) of the Federal Election Campaign Act
			 of 1971 (2 U.S.C. 434(f)(2)) is amended by adding at the end the following new
			 subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="HAC1DC10686D74C4B97D0397D7665CEE7" style="OLC">
						<subparagraph id="H6E4170442D92406B8B20CC64C41CFCA7"><enum>(G)</enum><text display-inline="yes-display-inline">If the person making the disbursement is a
				covered section 501(c) organization or a political organization (as such terms
				are defined in section 318(d)(3)(D)), the identification of the 5 persons who
				provided the largest amount of funding to the person for any purpose, together
				with the amount of funding each such person provided, during the 12-month
				period which ends on the date on which the organization made the disbursement.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HF6107AB4B22D48FEB1CBDFA2EBA25416"><enum>(2)</enum><header>Posting of
			 information on website</header><text>Section 304(f) of such Act (2 U.S.C.
			 434(f)) is amended by adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HFEFA0A54190747DA91C64D30672D4115" style="traditional">
						<paragraph id="HAD0E39B1C9014B5B8D505A8B025EADE0"><enum>(8)</enum><header>Posting certain
				donor information on website</header><text>Each covered section 501(c)
				organization or political organization which is required to include the
				information described in paragraph (2)(G) in the statements required to be
				filed under this subsection shall post and maintain such information on a
				publicly available official website of the organization.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HC64C590CB3064C0BA66F3AB96C7B03A1"><enum>(c)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall apply with respect
			 to statements filed after the date of the enactment of this Act.</text>
