		<section display-inline="no-display-inline" id="HE156CC2538A44FE085A6DB2629E07BAE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Cancer Screening Coverage Act of
			 2009</short-title></quote>.</text>
		</section><section id="H6DC2B0A3FFBB4F7A8E878317FED1335F"><enum>2.</enum><header>Cancer screening
			 coverage</header>
			<subsection id="HFB8A278BC7C041E18BB4800979DF4D19"><enum>(a)</enum><header>Group health
			 plans</header>
				<paragraph id="H837852CF5D4243C3A5A9E27AA2D354CE"><enum>(1)</enum><header><act-name parsable-cite="PHSA">Public Health Service Act</act-name> amendments</header>
					<subparagraph id="HCCFF47415FB0442AB88B3F9FCFF1445D"><enum>(A)</enum><header>In
			 general</header><text>Subpart 2 of part A of title XXVII of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
			 300gg–4 et seq.) is amended by adding at the end the following:</text>
						<quoted-block act-name="Public Health Service Act" id="H4204212FECC64CE295DF0D083E5FB9C2">
							<section id="H9AB8C5D775894A5388706B9B64E68AF9"><enum>2708.</enum><header>Coverage of
				cancer screening</header>
								<subsection id="H7F006B4DC87642B989CB62EABFD42D35"><enum>(a)</enum><header>Requirement</header><text>A
				group health plan, and a health insurance issuer offering group health
				insurance coverage, shall provide coverage and payment under the plan or
				coverage for the following items and services under terms and conditions that
				are no less favorable than the terms and conditions applicable to other
				screening benefits otherwise provided under the plan or coverage:</text>
									<paragraph id="H6F5036AC3539451E8613C96980AC503B"><enum>(1)</enum><header>Mammograms</header><text>In
				the case of a female participant or beneficiary who is 40 years of age or
				older, or is under 40 years of age but is at high risk (as defined in
				subsection (e)) of developing breast cancer, an annual mammography (as defined
				in section 1861(jj) of the <act-name parsable-cite="SSA">Social Security
				Act</act-name>) conducted by a facility that has a certificate (or provisional
				certificate) issued under section 354.</text>
									</paragraph><paragraph id="HB818A72C0A154BFABC92D7B324E797D7"><enum>(2)</enum><header>Clinical breast
				examinations</header><text>In the case of a female participant or beneficiary
				who—</text>
										<subparagraph id="HAA868CF7586144ECB64B9D2318820E04"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H6D1CE9EC3C1A45DEB906823D0CF59C19"><enum>(i)</enum><text>is 40 years of age or
				older; or</text>
											</clause><clause id="HA775009AD7B14631963BEB57119C755D" indent="up1"><enum>(ii)</enum><text>is at least 20 (but less than 40)
				years of age and is at high risk of developing breast cancer, an annual
				clinical breast examination; or</text>
											</clause></subparagraph><subparagraph id="H66216752B8E54871BE89D5B3926541C6"><enum>(B)</enum><text>is at least 20,
				but less than 40, years of age and who is not at high risk of developing breast
				cancer, a clinical breast examination each 3 years.</text>
										</subparagraph></paragraph><paragraph id="H61C2FED6DE314B4891F34CFCEBD0B1D2"><enum>(3)</enum><header>Pap tests and
				pelvic examinations</header><text>In the case of a female participant or
				beneficiary who is 18 years of age or older, or who is under 18 years of age
				and is or has been sexually active—</text>
										<subparagraph id="H84C0DDFCCE4542719BAC27764ACAC927"><enum>(A)</enum><text>an annual
				diagnostic laboratory test (popularly known as a <quote>pap smear</quote>)
				consisting of a routine exfoliative cytology test (Papanicolaou test) provided
				to a woman for the purpose of early detection of cervical or vaginal cancer and
				including an interpretation by a qualified health professional of the results
				of the test; and</text>
										</subparagraph><subparagraph id="HA1132FFB1AF64EEFA5B6F8F4460060FC"><enum>(B)</enum><text>an annual pelvic
				examination.</text>
										</subparagraph></paragraph><paragraph id="H31E3C0C3164C4F5198925A45A278DB3B"><enum>(4)</enum><header>Colorectal
				cancer screening procedures</header><text>In the case of a participant or
				beneficiary who is 50 years of age or older, or who is under 50 years of age
				and is at high risk of developing colorectal cancer, the procedures described
				in section 1861(pp)(1) of the <act-name parsable-cite="SSA">Social Security
				Act</act-name> (42 U.S.C. 1395x(pp)(1)) or section 4104(a)(2) of the
				<act-name parsable-cite="BBA97">Balanced Budget Act of 1997</act-name> (111
				Stat. 362), shall be furnished to the individual for the purpose of early
				detection of colorectal cancer. The group health plan or health insurance
				issuer shall provide coverage for the method and frequency of colorectal cancer
				screening determined to be appropriate by a health care provider treating such
				participant or beneficiary, in consultation with the participant or
				beneficiary.</text>
									</paragraph><paragraph id="H613A23E0660F455FB2B790B920DCAC17"><enum>(5)</enum><header>Prostate cancer
				screening</header><text>In the case of a male participant or beneficiary who is
				50 years of age or older, or who is younger than 50 years of age and is at high
				risk for prostate cancer (including African-American men or a male who has a
				history of prostate cancer in 1 or more first degree family members), the
				procedures described in section 1861(oo)(2) of <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395x(oo)(2))
				shall be furnished to the individual for the early detection of prostate
				cancer. The group health plan or health insurance issuer shall provide coverage
				for the method and frequency of prostate cancer screening determined to be
				appropriate by a health care provider treating such participant or beneficiary,
				in consultation with the participant or beneficiary.</text>
									</paragraph></subsection><subsection id="HB2AD8439B0DF434EB9F4E0344C1CC3B8"><enum>(b)</enum><header>Prohibitions</header><text>A
				group health plan, and a health insurance issuer offering group health
				insurance coverage in connection with a group health plan, shall not—</text>
									<paragraph id="HBEDA6C41FD3142F7B781CB59DFA04454"><enum>(1)</enum><text>deny to an
				individual eligibility, or continued eligibility, to enroll or to renew
				coverage under the terms of the plan, solely for the purpose of avoiding the
				requirements of this section;</text>
									</paragraph><paragraph id="H5FC8721644C749D8A0B6B65C249C1A67"><enum>(2)</enum><text>provide monetary
				payments or rebates to individuals to encourage such individuals to accept less
				than the minimum protections available under this section;</text>
									</paragraph><paragraph id="H72248048CBC14155BD12CDA61E4079A8"><enum>(3)</enum><text>penalize or
				otherwise reduce or limit the reimbursement of a provider because such provider
				provided care to an individual participant or beneficiary in accordance with
				this section; or</text>
									</paragraph><paragraph id="H6672D7C60500470CB888D8D21E444B38"><enum>(4)</enum><text>provide incentives
				(monetary or otherwise) to a provider to induce such provider to provide care
				to an individual participant or beneficiary in a manner inconsistent with this
				section.</text>
									</paragraph></subsection><subsection id="H48210C74C14547749BD53772FF467242"><enum>(c)</enum><header>Rules of
				construction</header>
									<paragraph id="H855E9730D1044A39885A0E85AA9315E4"><enum>(1)</enum><text>Nothing in this
				section shall be construed to require an individual who is a participant or
				beneficiary to undergo a procedure, examination, or test described in
				subsection (a).</text>
									</paragraph><paragraph id="H3D7A07DE33B04757AFA0C0EE05EF6322"><enum>(2)</enum><text>Nothing in this
				section shall be construed as preventing a group health plan or issuer from
				imposing deductibles, coinsurance, or other cost-sharing in relation to
				benefits described in subsection (a) consistent with such subsection, except
				that such coinsurance or other cost-sharing shall not discriminate on any basis
				related to the coverage required under this section.</text>
									</paragraph></subsection><subsection id="HEDC3644C51FF40A591559A2B9B8785AF"><enum>(d)</enum><header>Notice</header><text>A
				group health plan under this part shall comply with the notice requirement
				under section 714(d) of the <act-name parsable-cite="ERISA">Employee Retirement
				Income Security Act of 1974</act-name> with respect to the requirements of this
				section as if such section applied to such plan.</text>
								</subsection><subsection id="H1C870668219147CCA35C8E904B41073F"><enum>(e)</enum><header>High risk
				defined</header><text>For purposes of this section, an individual is considered
				to be at <quote>high risk</quote> of developing a particular type of cancer if,
				under guidelines developed or recognized by the Secretary based upon scientific
				evidence, the individual—</text>
									<paragraph id="H6761CC34881D4535B1FB33B77C761D27"><enum>(1)</enum><text>has 1 or more
				first degree family members who have developed that type of cancer;</text>
									</paragraph><paragraph id="H206F488A86684B6E93525DD8F2DCF013"><enum>(2)</enum><text>has previously had
				that type of cancer;</text>
									</paragraph><paragraph id="H634AE3354564470AA726A8DA45C39496"><enum>(3)</enum><text>has the presence
				of an appropriate recognized gene marker that is identified as putting the
				individual at a higher risk of developing that type of cancer; or</text>
									</paragraph><paragraph id="H5BA405071B2143ADB224EECCF1DA3A9B"><enum>(4)</enum><text>has other
				predisposing factors that significantly increase the risk of the individual
				contracting that type of cancer.</text>
									</paragraph><continuation-text continuation-text-level="subsection">For
				purposes of this subsection, the term <quote>type of cancer</quote> includes
				other types of cancer that the Secretary recognizes as closely related for
				purposes of establishing risk.</continuation-text></subsection></section><section id="HA95F3DE6F2A14A68AF473FD3872F6133"><enum>2709.</enum><header>Patient access
				to information</header>
								<subsection id="H1B21D16162A44A0389E892A8676DD1CA"><enum>(a)</enum><header>Disclosure
				requirement</header><text>A group health plan, and health insurance issuer
				offering group health insurance coverage shall—</text>
									<paragraph id="HD630EC52AA484CEBA219724AB6062566"><enum>(1)</enum><text>provide to
				participants and beneficiaries at the time of initial coverage under the plan
				(or the effective date of this section, in the case of individuals who are
				participants or beneficiaries as of such date), and at least annually
				thereafter, the information described in subsection (b) in printed form;</text>
									</paragraph><paragraph id="HE369500DB66741F2A421B710752D1EDD"><enum>(2)</enum><text>provide to
				participants and beneficiaries, within a reasonable period (as specified by the
				appropriate Secretary) before or after the date of significant changes in the
				information described in subsection (b), information in printed form regarding
				such significant changes; and</text>
									</paragraph><paragraph id="HCA77A9857C8F45358658FC8DEEA27A01"><enum>(3)</enum><text>upon request, make
				available to participants and beneficiaries, the applicable authority, and
				prospective participants and beneficiaries, the information described in
				subsection (b) in printed form.</text>
									</paragraph></subsection><subsection id="H00045DDE4FFA46C99C582DC7D18B89C8"><enum>(b)</enum><header>Information
				provided</header><text>The information described in subsection (a) that shall
				be disclosed includes the following, as such relates to cancer screening
				required under section 2708(a):</text>
									<paragraph id="H5BC6AF8651B046039C2786BE62E21B13"><enum>(1)</enum><header>Benefits</header><text>Benefits
				offered under the plan or coverage, including—</text>
										<subparagraph id="H7847CE4BE2234F8C9F5F5A784D535A6D"><enum>(A)</enum><text>covered benefits,
				including benefit limits and coverage exclusions;</text>
										</subparagraph><subparagraph id="H822983A740D1457BAD1AAC528D366E22"><enum>(B)</enum><text>cost sharing, such
				as deductibles, coinsurance, and copayment amounts, including any liability for
				balance billing, any maximum limitations on out of pocket expenses, and the
				maximum out of pocket costs for services that are provided by nonparticipating
				providers or that are furnished without meeting the applicable utilization
				review requirements;</text>
										</subparagraph><subparagraph id="HB871CA240D2D40B6B12DACFEE744D292"><enum>(C)</enum><text>the extent to
				which benefits may be obtained from nonparticipating providers; and</text>
										</subparagraph><subparagraph id="HCE517ECB5FF3430C8C46CEE8B17B6891"><enum>(D)</enum><text>the extent to
				which a participant, beneficiary, or enrollee may select from among
				participating providers and the types of providers participating in the plan or
				issuer network.</text>
										</subparagraph></paragraph><paragraph id="HF31E41660F87462583E0093B32FE5FE5"><enum>(2)</enum><header>Access</header><text>A
				description of the following:</text>
										<subparagraph id="HE1F9A1BCAF0946A4A55F1C29A81F615E"><enum>(A)</enum><text>The number, mix,
				and distribution of providers under the plan or coverage.</text>
										</subparagraph><subparagraph id="H76C43DADDD3A404A9269DDCCF16298BC"><enum>(B)</enum><text>Out-of-network
				coverage (if any) provided by the plan or coverage.</text>
										</subparagraph><subparagraph id="HD82B5023026847A9B3C094963E6F83B4"><enum>(C)</enum><text>Any
				point-of-service option (including any supplemental premium or cost-sharing for
				such option).</text>
										</subparagraph><subparagraph id="H31D0702DB25E406BAD36CFB74C20F9FE"><enum>(D)</enum><text>The procedures for
				participants, beneficiaries, and enrollees to select, access, and change
				participating primary and specialty providers.</text>
										</subparagraph><subparagraph id="HCB3E220006494FB19F595FB3907BBAC9"><enum>(E)</enum><text>The rights and
				procedures for obtaining referrals (including standing referrals) to
				participating and nonparticipating providers.</text>
										</subparagraph><subparagraph id="HA2F93C259AD04B45991B91E046DE6C34"><enum>(F)</enum><text>The name, address,
				and telephone number of participating health care providers and an indication
				of whether each such provider is available to accept new patients.</text>
										</subparagraph><subparagraph id="HB578DC035C8C4C699EF554F227528D84"><enum>(G)</enum><text>How the plan or
				issuer addresses the needs of participants, beneficiaries, and enrollees and
				others who do not speak English or who have other special communications needs
				in accessing providers under the plan or coverage, including the provision of
				information under this
				subsection.</text>
										</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HAA06C9F39640493D91A5C0379BE29B3E"><enum>(B)</enum><header>Technical
			 amendment</header><text>Section 2723(c) of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
			 300gg–23(c)) is amended by striking <quote>section 2704</quote> and inserting
			 <quote>sections 2704 and 2708</quote>.</text>
					</subparagraph></paragraph><paragraph id="HE79CD2BC918846B19F5B1A53111C5BDA"><enum>(2)</enum><header>ERISA
			 amendments</header>
					<subparagraph id="H61A215C347DD4FEEA35604CC083DC63A"><enum>(A)</enum><header>In
			 general</header><text>Subpart B of part 7 of subtitle B of title I of the
			 <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of
			 1974</act-name> (29 U.S.C. 1185 et seq.) is amended by adding at the end the
			 following new section:</text>
						<quoted-block act-name="Employee Retirement Income Security Act of 1974" id="H64412840021D4FC6B9A60A17CDF08730">
							<section id="H2A2DD20149274D6E83AD2A222118D31C"><enum>715.</enum><header>Coverage of
				cancer screening</header>
								<subsection id="HCC0CF1B4E02846C3A799DC6DD2791EA9"><enum>(a)</enum><header>Requirement</header><text>A
				group health plan, and a health insurance issuer offering group health
				insurance coverage, shall provide coverage and payment under the plan or
				coverage for the following items and services under terms and conditions that
				are no less favorable than the terms and conditions applicable to other
				screening benefits otherwise provided under the plan or coverage:</text>
									<paragraph id="H0BD7AB200FCF45AC801BDDF5295C1C6B"><enum>(1)</enum><header>Mammograms</header><text>In
				the case of a female participant or beneficiary who is 40 years of age or
				older, or is under 40 years of age but is at high risk (as defined in
				subsection (e)) of developing breast cancer, an annual mammography (as defined
				in section 1861(jj) of the <act-name parsable-cite="SSA">Social Security
				Act</act-name>) conducted by a facility that has a certificate (or provisional
				certificate) issued under section 354 of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name>.</text>
									</paragraph><paragraph id="H35006856699C4C29BF39504C6C85FF1C"><enum>(2)</enum><header>Clinical breast
				examinations</header><text>In the case of a female participant or beneficiary
				who—</text>
										<subparagraph id="H15B10E96FD6A4A1BB65105049B0320C7"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="HB029E57DDBE74CB493148ED1B1359F4B"><enum>(i)</enum><text>is 40 years of age or
				older; or</text>
											</clause><clause id="H322A0A6290B14562A25B2CA4FF2CC67D" indent="up1"><enum>(ii)</enum><text>is at least 20 (but less than 40)
				years of age and is at high risk of developing breast cancer, an annual
				clinical breast examination; or</text>
											</clause></subparagraph><subparagraph id="H8B32D861480348BC9041C413300C3273"><enum>(B)</enum><text>is at least 20,
				but less than 40, years of age and who is not at high risk of developing breast
				cancer, a clinical breast examination each 3 years.</text>
										</subparagraph></paragraph><paragraph id="HD0EA087BB3544D4D817530BBC9D99988"><enum>(3)</enum><header>Pap tests and
				pelvic examinations</header><text>In the case of a female participant or
				beneficiary who is 18 years of age or older, or who is under 18 years of age
				and is or has been sexually active—</text>
										<subparagraph id="H893DB14CAEDF4B3F893B54AF5E390C24"><enum>(A)</enum><text>an annual
				diagnostic laboratory test (popularly known as a <quote>pap smear</quote>)
				consisting of a routine exfoliative cytology test (Papanicolaou test) provided
				to a woman for the purpose of early detection of cervical or vaginal cancer and

										</subparagraph></paragraph><paragraph id="HFCD5EFEC6F934674A62FB67BD394FC41"><enum>(4)</enum><header>Colorectal
				cancer screening procedures</header><text>In the case of a participant or
				beneficiary who is 50 years of age or older, or who is under 50 years of age
				and is at high risk of developing colorectal cancer, the procedures described
				in section 1861(pp)(1) of the <act-name parsable-cite="SSA">Social Security
				Act</act-name> (42 U.S.C. 1395x(pp)(1)) or section 4104(a)(2) of the
				<act-name parsable-cite="BBA97">Balanced Budget Act of 1997</act-name> (111
				Stat. 362), shall be furnished to the individual for the purpose of early
				detection of colorectal cancer. The group health plan or health insurance
				issuer shall provided coverage for the method and frequency of colorectal

				treating such participant or beneficiary, in consultation with the participant
				or beneficiary.</text>
									</paragraph><paragraph id="H4CA91360AFFC455D90BCDEBCC7AB34CA"><enum>(5)</enum><header>Prostate cancer
				screening</header><text>In the case of a male participant or beneficiary who is
				50 years of age or older, or who is younger than 50 years of age and is at high
				risk for prostate cancer (including African-American men or a male who has a
				history of prostate cancer in 1 or more first degree family members), the
				procedures described in section 1861(oo)(2) of <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395x(oo)(2))
				shall be furnished to the individual for the early detection of prostate
				cancer. The group health plan or health insurance issuer shall provide coverage
				for the method and frequency of prostate cancer screening determined to be
				appropriate by a health care provider treating such participant or beneficiary,
				in consultation with the participant or beneficiary.</text>
									</paragraph></subsection><subsection id="H25BAC05231144C9E9D5D32F4F56DFC05"><enum>(b)</enum><header>Prohibitions</header><text>A
				group health plan, and a health insurance issuer offering group health
				insurance coverage in connection with a group health plan, may not—</text>
									<paragraph id="H632CB94CCDEC47188600A19949E119D5"><enum>(1)</enum><text>deny to an
				individual eligibility, or continued eligibility, to enroll or to renew
				coverage under the terms of the plan, solely for the purpose of avoiding the
				requirements of this section;</text>
									</paragraph><paragraph id="HB3BD118D3B4B495B9F93CA430FE4179D"><enum>(2)</enum><text>provide monetary
				payments or rebates to individuals to encourage such individuals to accept less
				than the minimum protections available under this section;</text>
									</paragraph><paragraph id="HB98D61C28F46436583E133C4E3A843C4"><enum>(3)</enum><text>penalize or
				otherwise reduce or limit the reimbursement of a provider because such provider
				provided care to an individual participant or beneficiary in accordance with
				this section; or</text>
									</paragraph><paragraph id="H645F0F9BE0C340E69A0C2BCCFEF39831"><enum>(4)</enum><text>provide incentives
				(monetary or otherwise) to a provider to induce such provider to provide care
				to an individual participant or beneficiary in a manner inconsistent with this
				section.</text>
									</paragraph></subsection><subsection id="HDB3DD8D0A67A409CAB38D8A2B5483E1B"><enum>(c)</enum><header>Rules of
				construction</header>
									<paragraph id="H34E6E656F7844847A9E80CA2DDF992F5"><enum>(1)</enum><text>Nothing in this
				section shall be construed to require an individual who is a participant or
				beneficiary to undergo a procedure, examination, or test described in
				subsection (a).</text>
									</paragraph><paragraph id="H537256ED211F4B8D99D4FAB21B06A436"><enum>(2)</enum><text>Nothing in this
				section shall be construed as preventing a group health plan or issuer from
				imposing deductibles, coinsurance, or other cost-sharing in relation to
				benefits described in subsection (a) consistent with such subsection, except
				that such coinsurance or other cost-sharing shall not discriminate on any basis
				related to the coverage required under this section.</text>
									</paragraph></subsection><subsection id="H1187F015AB02494985ABA073D63D5A34"><enum>(d)</enum><header>Notice under
				group health plan</header><text>The imposition of the requirement of this
				section shall be treated as a material modification in the terms of the plan
				described in section 102(a), for purposes of assuring notice of such
				requirements under the plan; except that the summary description required to be
				provided under the last sentence of section 104(b)(1) with respect to such
				modification shall be provided by not later than 60 days after the first day of
				the first plan year in which such requirement apply.</text>
								</subsection><subsection id="HA32D0817104241A79A8E38752FCA6671"><enum>(e)</enum><header>High risk
				defined</header><text>For purposes of this section, an individual is considered
				to be at <quote>high risk</quote> of developing a particular type of cancer if,
				under guidelines developed or recognized by the Secretary based upon scientific
				evidence, the individual—</text>
									<paragraph id="HB63CF7220D6F475AB3B705036C97A972"><enum>(1)</enum><text>has 1 or more
				first degree family members who have developed that type of cancer;</text>
									</paragraph><paragraph id="H2E801ED56C7743759E3F0EF242F4F1DD"><enum>(2)</enum><text>has previously had
				that type of cancer;</text>
									</paragraph><paragraph id="HF99C9123F4D5482B91A9A7099571D331"><enum>(3)</enum><text>has the presence
				of an appropriate recognized gene marker that is identified as putting the
				individual at a higher risk of developing that type of cancer; or</text>
									</paragraph><paragraph id="H23EB9BB0541449A2886B06F579E8C30A"><enum>(4)</enum><text>has other
				predisposing factors that significantly increase the risk of the individual
				contracting that type of cancer.</text>
									</paragraph><continuation-text continuation-text-level="subsection">For
				purposes of this subsection, the term <quote>type of cancer</quote> includes
				other types of cancer that the Secretary recognizes as closely related for
				purposes of establishing risk.</continuation-text></subsection></section><section id="H53431A6B288942B99F426F377601C9AB"><enum>716.</enum><header>Patient access
				to information</header>
								<subsection id="H0B3C4254BCA74D2FA986526DF2B39E5A"><enum>(a)</enum><header>Disclosure
				requirement</header><text>A group health plan, and health insurance issuer
				offering group health insurance coverage shall—</text>
									<paragraph id="H62FB6D46CCB0408CB710966D5E94BC86"><enum>(1)</enum><text>provide to
				participants and beneficiaries at the time of initial coverage under the plan
				(or the effective date of this section, in the case of individuals who are
				participants or beneficiaries as of such date), and at least annually
				thereafter, the information described in subsection (b) in printed form;</text>
									</paragraph><paragraph id="H9895C7C75E06477DBFFFCFF79B8EEFF8"><enum>(2)</enum><text>provide to
				participants and beneficiaries, within a reasonable period (as specified by the
				appropriate Secretary) before or after the date of significant changes in the
				information described in subsection (b), information in printed form regarding
				such significant changes; and</text>
									</paragraph><paragraph id="HA7F805C9C9E142EF8896EE7815B7AF10"><enum>(3)</enum><text>upon request, make
				available to participants and beneficiaries, the applicable authority, and
				prospective participants and beneficiaries, the information described in
				subsection (b) in printed form.</text>
									</paragraph></subsection><subsection id="HDD5B33C69E2D4ABF906990C7B5B26B08"><enum>(b)</enum><header>Information
				provided</header><text>The information described in subsection (a) that shall
				be disclosed includes the following, as such relates to cancer screening
				required under section 715(a):</text>
									<paragraph id="HF1B920ADC99A4333A31B5CB2AF01A585"><enum>(1)</enum><header>Benefits</header><text>Benefits
				offered under the plan or coverage, including—</text>
										<subparagraph id="H6D5C7EDFA9604B78A5D4BEC1BC5CE5B7"><enum>(A)</enum><text>covered benefits,
				including benefit limits and coverage exclusions;</text>
										</subparagraph><subparagraph id="H11019E3F1F3540898F7187626C630862"><enum>(B)</enum><text>cost sharing, such
				as deductibles, coinsurance, and copayment amounts, including any liability for
				balance billing, any maximum limitations on out of pocket expenses, and the
				maximum out of pocket costs for services that are provided by nonparticipating
				providers or that are furnished without meeting the applicable utilization
				review requirements;</text>
										</subparagraph><subparagraph id="HD1791953EC494D51BCED04F3B923EE2F"><enum>(C)</enum><text>the extent to
				which benefits may be obtained from nonparticipating providers; and</text>
										</subparagraph><subparagraph id="H3F43D649BC7B487CBA9392DCAD56E495"><enum>(D)</enum><text>the extent to
				which a participant, beneficiary, or enrollee may select from among
				participating providers and the types of providers participating in the plan or
				issuer network.</text>
										</subparagraph></paragraph><paragraph id="H2963133CF9944A95805AAE847873A5F0"><enum>(2)</enum><header>Access</header><text>A
				description of the following:</text>
										<subparagraph id="H49FB3ACA167C4245B41DD4F58A47ED88"><enum>(A)</enum><text>The number, mix,
				and distribution of providers under the plan or coverage.</text>
										</subparagraph><subparagraph id="HB2EBBBB7C3224B9CAF99AD8A79D5F1D3"><enum>(B)</enum><text>Out-of-network
				coverage (if any) provided by the plan or coverage.</text>
										</subparagraph><subparagraph id="H4868A4212AB04D4AA895625912E8CBAF"><enum>(C)</enum><text>Any
				point-of-service option (including any supplemental premium or cost-sharing for
				such option).</text>
										</subparagraph><subparagraph id="HF6412DA2E3BB4D1EA8974BB811357876"><enum>(D)</enum><text>The procedures for
				participants, beneficiaries, and enrollees to select, access, and change
				participating primary and specialty providers.</text>
										</subparagraph><subparagraph id="HA850F712D2764C5086F9D8F6B404D23D"><enum>(E)</enum><text>The rights and
				procedures for obtaining referrals (including standing referrals) to
				participating and nonparticipating providers.</text>
										</subparagraph><subparagraph id="HD60E061C17394AF08C0E44C49A3D9AFB"><enum>(F)</enum><text>The name, address,
				and telephone number of participating health care providers and an indication
				of whether each such provider is available to accept new patients.</text>
										</subparagraph><subparagraph id="H410A3D1436B5433D8F7FB867E29FFB92"><enum>(G)</enum><text>How the plan or
				issuer addresses the needs of participants, beneficiaries, and enrollees and
				others who do not speak English or who have other special communications needs
				in accessing providers under the plan or coverage, including the provision of
				information under this
				subsection.</text>
										</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HB9DF6B8E0C694DCEADA2C2F9604FB1EC"><enum>(B)</enum><header>Technical
			 amendments</header>
						<clause id="HE88CE69513914915AE5C46C495E10FF9"><enum>(i)</enum><text>Section 731(c) of
			 the <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of
			 1974</act-name> (29 U.S.C. 1191(c)) is amended by striking <quote>section
			 711</quote> and inserting <quote>sections 711 and 715</quote>.</text>

			 general</header><text>Subchapter B of chapter 100 of the Internal Revenue Code
			 of 1986 is amended by inserting after section 9813 the following:</text>

							<section id="HDFBE4482C3F74A85B880F84D8E8EB38F"><enum>9814.</enum><header>Coverage of
				cancer screening</header>
								<subsection id="H41F6AF5D42BE4C9F8AA2699092CD851C"><enum>(a)</enum><header>Requirement</header><text>A
				group health plan shall provide coverage and payment under the plan for the
				following items and services under terms and conditions that are no less
				favorable than the terms and conditions applicable to other screening benefits
				otherwise provided under the plan:</text>
									<paragraph id="HFDA826519DC843B2BC582F9A0CB3D9E8"><enum>(1)</enum><header>Mammograms</header><text>In
				the case of a female participant or beneficiary who is 40 years of age or
				older, or is under 40 years of age but is at high risk (as defined in
				subsection (d)) of developing breast cancer, an annual mammography (as defined
				in section 1861(jj) of the <act-name parsable-cite="SSA">Social Security
				Act</act-name>) conducted by a facility that has a certificate (or provisional
				certificate) issued under section 354 of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name>.</text>
									</paragraph><paragraph id="HFBD318885A1D477D80D135329EE724C8"><enum>(2)</enum><header>Clinical breast
				examinations</header><text>In the case of a female participant or beneficiary
				who—</text>
										<subparagraph id="H3BDD14AD373A40668AF445F1D908BA85"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="HD37D845619844F7095B7900CA18A4AFF"><enum>(i)</enum><text>is 40 years of age or
				older; or</text>
											</clause><clause id="H5A157EBAA4BA44BEB99ECC09910A4850" indent="up1"><enum>(ii)</enum><text>is at least 20 (but less than 40)
				years of age and is at high risk of developing breast cancer, an annual
				clinical breast examination; or</text>
											</clause></subparagraph><subparagraph id="HD43F911AEE844ED998C03628EA22DC63"><enum>(B)</enum><text>is at least 20,
				but less than 40, years of age and who is not at high risk of developing breast
				cancer, a clinical breast examination each 3 years.</text>
										</subparagraph></paragraph><paragraph id="HC78442DF44CD487D87736897F2523081"><enum>(3)</enum><header>Pap tests and
				pelvic examinations</header><text>In the case of a female participant or
				beneficiary who is 18 years of age or older, or who is under 18 years of age
				and is or has been sexually active—</text>
										<subparagraph id="HAC49AF49CF3240C9A98E23B5C874A52A"><enum>(A)</enum><text>an annual
				diagnostic laboratory test (popularly known as a <quote>pap smear</quote>)
				consisting of a routine exfoliative cytology test (Papanicolaou test) provided
				to a woman for the purpose of early detection of cervical or vaginal cancer and
				including an interpretation by a qualified health professional of the results
				of the test; and</text>
										</subparagraph><subparagraph id="H21BF0DEFA70348CE8A258C70F0737203"><enum>(B)</enum><text>an annual pelvic
				examination.</text>
										</subparagraph></paragraph><paragraph id="HFE3BAD4BF5154E57B19705007B7E15C3"><enum>(4)</enum><header>Colorectal
				cancer screening procedures</header><text>In the case of a participant or
				beneficiary who is 50 years of age or older, or who is under 50 years of age
				and is at high risk of developing colorectal cancer, the procedures described
				in section 1861(pp)(1) of the <act-name parsable-cite="SSA">Social Security
				Act</act-name> (42 U.S.C. 1395x(pp)(1)) or section 4104(a)(2) of the
				<act-name parsable-cite="BBA97">Balanced Budget Act of 1997</act-name> (111
				Stat. 362), shall be furnished to the individual for the purpose of early
				detection of colorectal cancer. The group health plan or health insurance
				issuer shall provide coverage for the method and frequency of colorectal cancer
				screening determined to be appropriate by a health care provider treating such
				participant or beneficiary, in consultation with the participant or
				beneficiary.</text>
									</paragraph><paragraph id="H54F2975AAD1C442194823C961D333612"><enum>(5)</enum><header>Prostate cancer
				screening</header><text>In the case of a male participant or beneficiary who is
				50 years of age or older, or who is younger than 50 years of age and is at high
				risk for prostate cancer (including African-American men or a male who has a
				history of prostate cancer in 1 or more first degree family members), the
				procedures described in section 1861(oo)(2) of <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395x(oo)(2))
				shall be furnished to the individual for the early detection of prostate
				cancer. The group health plan or health insurance issuer shall provide coverage
				for the method and frequency of prostate cancer screening determined to be
				appropriate by a health care provider treating such participant or beneficiary,
				in consultation with the participant or beneficiary.</text>
									</paragraph></subsection><subsection id="HC98F2F5BAD0047D490AD184EFE4E80C2"><enum>(b)</enum><header>Prohibitions</header><text>A
				group health plan may not—</text>
									<paragraph id="H2D81B91284294807BA46DE73E5B32025"><enum>(1)</enum><text>deny to an
				individual eligibility, or continued eligibility, to enroll or to renew
				coverage under the terms of the plan, solely for the purpose of avoiding the
				requirements of this section;</text>
									</paragraph><paragraph id="H208CB24FBED743819214FD77B738F82A"><enum>(2)</enum><text>provide monetary
				payments or rebates to individuals to encourage such individuals to accept less
				than the minimum protections available under this section;</text>
									</paragraph><paragraph id="H89BDE4E4DCE74E0EB474515D696056A7"><enum>(3)</enum><text>penalize or
				otherwise reduce or limit the reimbursement of a provider because such provider
				provided care to an individual participant or beneficiary in accordance with
				this section; or</text>
									</paragraph><paragraph id="H2AF4FF6CAC2B46AC84DDBEF8E7487786"><enum>(4)</enum><text>provide incentives
				(monetary or otherwise) to a provider to induce such provider to provide care
				to an individual participant or beneficiary in a manner inconsistent with this
				section.</text>
									</paragraph></subsection><subsection id="HCC2D84807FA8444C912327E027F1B218"><enum>(c)</enum><header>Rules of
				construction</header>
									<paragraph id="H07326471F89E47D180DEF744F92D8BEE"><enum>(1)</enum><text>Nothing in this
				section shall be construed to require an individual who is a participant or
				beneficiary to undergo a procedure, examination, or test described in
				subsection (a).</text>
									</paragraph><paragraph id="H99DCDB49BB3B4FBA89EDEC2836CECB23"><enum>(2)</enum><text>Nothing in this
				section shall be construed as preventing a group health plan from imposing
				deductibles, coinsurance, or other cost-sharing in relation to benefits
				described in subsection (a) consistent with such subsection, except that such
				coinsurance or other cost-sharing shall not discriminate on any basis related
				to the coverage required under this section.</text>
									</paragraph></subsection><subsection id="HF36FE46CAEDB419DA4270F7DA0830340"><enum>(d)</enum><header>High risk
				defined</header><text>For purposes of this section, an individual is considered
				to be at <quote>high risk</quote> of developing a particular type of cancer if,
				under guidelines developed or recognized by the Secretary based upon scientific
				evidence, the individual—</text>
									<paragraph id="H82DA4AE2376C4EA88E890AC729A91EC0"><enum>(1)</enum><text>has 1 or more
				first degree family members who have developed that type of cancer;</text>
									</paragraph><paragraph id="H9F292551143442F9AAEFDB564AD74F62"><enum>(2)</enum><text>has previously had
				that type of cancer;</text>
									</paragraph><paragraph id="HB7704F57EC0345BD8ABEB7E5758AAB81"><enum>(3)</enum><text>has the presence
				of an appropriate recognized gene marker that is identified as putting the
				individual at a higher risk of developing that type of cancer; or</text>
									</paragraph><paragraph id="H8F37D622A54044489171B35B67DD2B7D"><enum>(4)</enum><text>has other
				predisposing factors that significantly increase the risk of the individual
				contracting that type of cancer.</text>
									</paragraph><continuation-text continuation-text-level="subsection">For
				purposes of this subsection, the term <quote>type of cancer</quote> includes
				other types of cancer that the Secretary recognizes as closely related for
				purposes of establishing risk.</continuation-text></subsection></section><section id="HF4F9A978824748F28D2594271648D5FF"><enum>9815.</enum><header>Patient access
				to information</header>
								<subsection id="H32CD8F9D0A5940DE84F6DC84CCA50C53"><enum>(a)</enum><header>Disclosure
				requirement</header><text>A group health plan, and health insurance issuer
				offering group health insurance coverage shall—</text>
									<paragraph id="HD14277DFAD874BC999625B2B8536047A"><enum>(1)</enum><text>provide to
				participants and beneficiaries at the time of initial coverage under the plan
				(or the effective date of this section, in the case of individuals who are
				participants or beneficiaries as of such date), and at least annually
				thereafter, the information described in subsection (b) in printed form;</text>
									</paragraph><paragraph id="H4F846E56C66A4DF98C2D8CE623D4B79D"><enum>(2)</enum><text>provide to
				participants and beneficiaries, within a reasonable period (as specified by the
				appropriate Secretary) before or after the date of significant changes in the
				information described in subsection (b), information in printed form regarding
				such significant changes; and</text>
									</paragraph><paragraph id="H32ADF31B403A4F8CBD8B356A8A4667E1"><enum>(3)</enum><text>upon request, make
				available to participants and beneficiaries, the applicable authority, and
				prospective participants and beneficiaries, the information described in
				subsection (b) in printed form.</text>
									</paragraph></subsection><subsection id="H7E09AF59CA6347229A8CD8065E478BCF"><enum>(b)</enum><header>Information
				provided</header><text>The information described in subsection (a) that shall
				be disclosed includes the following, as such relates to cancer screening
				required under section 9814(a):</text>
									<paragraph id="H1DC6850D7732471FB39B58A378632EF2"><enum>(1)</enum><header>Benefits</header><text>Benefits
				offered under the plan or coverage, including—</text>
										<subparagraph id="HF4151EA83F934D719D784AF3BD077AAD"><enum>(A)</enum><text>covered benefits,
				including benefit limits and coverage exclusions;</text>
										</subparagraph><subparagraph id="H762956F7C3A94A01831F6E6C1E319A5F"><enum>(B)</enum><text>cost sharing, such
				as deductibles, coinsurance, and copayment amounts, including any liability for
				balance billing, any maximum limitations on out of pocket expenses, and the
				maximum out of pocket costs for services that are provided by nonparticipating
				providers or that are furnished without meeting the applicable utilization
				review requirements;</text>
										</subparagraph><subparagraph id="H2133D237268B47F0A330D90F93CA3861"><enum>(C)</enum><text>the extent to
				which benefits may be obtained from nonparticipating providers; and</text>
										</subparagraph><subparagraph id="H75C06FCFFE704B7781113CC433423E5B"><enum>(D)</enum><text>the extent to
				which a participant, beneficiary, or enrollee may select from among
				participating providers and the types of providers participating in the plan or
				issuer network.</text>
										</subparagraph></paragraph><paragraph id="H468934D036474854A6102250EC6692F7"><enum>(2)</enum><header>Access</header><text>A
				description of the following:</text>
										<subparagraph id="H4F8EA51A1D0244F185219D6EAA799C52"><enum>(A)</enum><text>The number, mix,

				issuer addresses the needs of participants, beneficiaries, and enrollees and

				in the same manner as they apply to health insurance coverage offered by a
				health insurance issuer in connection with a group health plan in the small or
				large group market to a participant or beneficiary in such plan.</text>
							</subsection><subsection id="HF45C1E3A3D9D4108BC16ECC02CFC1E0F"><enum>(b)</enum><header>Notice</header><text>A
				health insurance issuer under this part shall comply with the notice
				requirement under section 714(d) of the <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of
				1974</act-name> with respect to the requirements referred to in subsection (a)
				as if such section applied to such issuer and such issuer were a group health
				plan.</text>
							</subsection></section><section id="H4FC4A851E751412CBA68BF0A87CB2E33"><enum>2755.</enum><header>Patient access
				to information</header><text display-inline="no-display-inline">The provisions
				of section 2709 shall apply health insurance coverage offered by a health
				insurance issuer in the individual market with respect to an enrollee under
				such coverage in the same manner as they apply to health insurance coverage
				offered by a health insurance issuer in connection with a group health plan in
				the small or large group market to a participant or beneficiary in such
				plan.</text>

			 plans</header><text>Subject to paragraph (3), the amendments made by subsection
			 (a) shall apply with respect to group health plans for plan years beginning on
			 or after January 1, 2010.</text>
				</paragraph><paragraph id="H1959A5E1AB9544D394B77D3B8469CFAD"><enum>(2)</enum><header>Individual
			 plans</header><text>The amendment made by subsection (b) shall apply with
			 respect to health insurance coverage offered, sold, issued, renewed, in effect,
			 or operated in the individual market on or after such date.</text>
				</paragraph><paragraph id="H12407EE3E0224D9BA36BDD6EB349AD59"><enum>(3)</enum><header>Collective
			 bargaining agreement</header><text>In the case of a group health plan
			 maintained pursuant to 1 or more collective bargaining agreements between
			 employee representatives and 1 or more employers ratified before the date of
			 enactment of this Act, the amendments made to subsection (a) shall not apply to
			 plan years beginning before the later of—</text>
					<subparagraph id="HEAD3272F554F43CF903468915F19D5AF"><enum>(A)</enum><text>the date on which
			 the last collective bargaining agreements relating to the plan terminates
			 (determined without regard to any extension thereof agreed to after the date of
			 enactment of this Act), or</text>
					</subparagraph><subparagraph id="HBD8EF5F1BF6F401D9917DE4F3EA397C1"><enum>(B)</enum><text>January 1,
			 2010.</text>
					</subparagraph><continuation-text continuation-text-level="paragraph">For purposes
			 of subparagraph (A), any plan amendment made pursuant to a collective
			 bargaining agreement relating to the plan which amends the plan solely to
			 conform to any requirement added by subsection (a) shall not be treated as a
			 termination of such collective bargaining agreement.</continuation-text></paragraph></subsection><subsection id="HA809C4D23BDE4E9687EF40B4A5B9B1AB"><enum>(d)</enum><header>Coordinated
			 regulations</header><text>Section 104(1) of <act-name parsable-cite="HIPAA">Health Insurance Portability and Accountability Act of
			 1996</act-name> (Public Law 104–191) is amended by striking <quote>this
			 subtitle (and the amendments made by this subtitle and section 401)</quote> and
			 inserting <quote>the provisions of part 7 of subtitle B of title I of the
			 <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of
			 1974</act-name>, the provisions of parts A and C of title XXVII of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name>, and
			 chapter 100 of the Internal Revenue Code of 1986</quote>.</text>
			</subsection><subsection id="H017BCF5A39A34FC98E6F9BE73056EDA1"><enum>(e)</enum><header>Modification of
			 coverage</header>
				<paragraph id="HF80B6C1E30384A7B8F09BB0C4F31C11A"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Health and Human Services may modify the
			 coverage requirements for the amendments under this Act to allow such
			 requirements to incorporate and reflect new scientific and technological
			 advances regarding cancer screening, practice pattern changes in such
			 screening, or other updated medical practices regarding such screening, such as
			 the use of new tests or other emerging technologies. Such modifications shall
			 not in any way diminish the coverage requirements listed under this Act. Such
			 modifications may be made on the Secretary’s own initiative or upon petition to
			 the Secretary by an individual or organization.</text>
				</paragraph><paragraph id="H6BF74B98B1EC45A2A84BBCD2F95AAF91"><enum>(2)</enum><header>Consultation</header><text>In
			 modifying coverage requirements under paragraph (1), the Secretary of Health
			 and Human Services shall consult with appropriate organizations, experts, and
			 agencies.</text>
				</paragraph><paragraph id="H2A605B55E1BB4FB7B1F8A071CF1562C5"><enum>(3)</enum><header>Petitions</header><text>The
			 Secretary of Health and Human Services may issue requirements for the
			 petitioning process under paragraph (1), including requirements that the
			 petition be in writing and include scientific or medical bases for the
			 modification sought. Upon receipt of such a petition, the Secretary shall
			 respond to the petitioner and decide whether to propose a regulation proposing
			 a change within 90 days of such receipt. If a regulation is required, the
			 Secretary shall propose such regulation within 6 months of such determination.
			 The Secretary shall provide the petitioner the reasons for the decision of the
			 Secretary. The Secretary may make changes requested by a petitioner in whole or
			 in part.</text>
				</paragraph></subsection></section><section id="H4A1A7F7D78984A0CA072CD5CFFA604CC"><enum>3.</enum><header>Application to
			 other health care coverage</header><text display-inline="no-display-inline">Chapter 89 of title 5, United States Code,
			 is amended by adding at the end the following:</text>
			<quoted-block id="H27AD5F32129E4A2D8D2163B29D332443" style="USC">
				<section id="H7BDB52EBC1CD42D197492C455FED618C"><enum>8915.</enum><header>Standards
				relating to coverage of cancer screening and patient access to
				information</header>
					<subsection id="H7ABFBE8671AD47CAA0067385C6A893BE"><enum>(a)</enum><text>The provisions of
				sections 2708 and 2709 of the <act-name parsable-cite="PHSA">Public Health
				Service Act</act-name> shall apply to the provision of items and services under
				this chapter.</text>
					</subsection><subsection id="H0787FE0559624C0C9AEBED9D2BBD278A"><enum>(b)</enum><text>Nothing in this
				section or section 2708(c) of the <act-name parsable-cite="PHSA">Public Health
				Service Act</act-name> shall be construed as authorizing a health insurance
				issuer or entity to impose cost sharing with respect to the coverage or
				benefits required to be provided under section 2708 of the
				<act-name parsable-cite="PHSA">Public Health Service Act</act-name> that is
				inconsistent with the cost sharing that is otherwise permitted under this
				chapter.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
