		<section id="HC63D0F28680A42B8B398D156A6378A34" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Earmark Performance and Accountability
			 Act of 2010</short-title></quote>.</text>
		</section><section id="HFE78A8497B414EF08A3D71D03A30667C"><enum>2.</enum><header>Earmark audits by
			 non-Federal entities</header>
			<subsection id="HE12B1DF55AC74F419A241169DF078C94"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">A non-Federal entity
			 shall conduct an audit using an independent external auditor, as determined by
			 the Comptroller General, of any program, project, or activity that is
			 administered by such non-Federal entity and is funded through an
			 earmark.</text>
			</subsection><subsection id="H060851539A9E4D26988329A340FBFF85"><enum>(b)</enum><header>Funding for
			 audit</header><text>Each non-Federal entity that administers a program,
			 project, or activity that is funded through an earmark shall set aside such
			 sums as may be necessary to conduct an audit under subsection (a) of such
			 program, project, or activity.</text>
			</subsection><subsection id="H915AC7745831473D8044B97D77479C9B"><enum>(c)</enum><header>Report to
			 Congress</header><text display-inline="yes-display-inline">Each non-Federal
			 entity that conducts an audit under subsection (a) of a program, project, or
			 activity shall, not later than 180 days after the earmarked funds for the
			 program, project, or activity are received by the entity, submit to Congress a
			 report about such audit that includes a determination from the audit whether
			 the earmarked funds are being spent efficiently and effectively and whether the
			 program, project, or activity is meeting any applicable stated purpose.</text>
			</subsection><subsection id="HD1FF3A8AB8B34A2FB2D316070610756C"><enum>(d)</enum><header>Definitions</header>
				<paragraph id="H452CFCF5D2954B498CE8027C9C43F41B"><enum>(1)</enum><header>Funded through
			 an earmark</header><text display-inline="yes-display-inline">The term
			 <term>funded through an earmark</term>, with respect to a program, project, or
			 activity, means that the program, project, or activity is included on—</text>
					<subparagraph id="HC4BFBF021E074D6C9419D89233DE8AB6"><enum>(A)</enum><text>a list of
			 <term>congressional earmarks</term> generated under the Rules of the House of
			 Representatives;</text>
					</subparagraph><subparagraph id="H7009E38FA38D450581DB8235056D3BF7"><enum>(B)</enum><text>a list of
			 <term>congressionally directed spending</term> generated under the Standing
			 Rules of the Senate; or</text>
					</subparagraph><subparagraph id="HFCF6BE25F80F46C3AC84C019C7E5B3C5"><enum>(C)</enum><text>on both such
			 lists.</text>
					</subparagraph></paragraph><paragraph id="HD643D2D390104B919F7F398C53FE08B3"><enum>(2)</enum><header>Non-Federal
			 entity</header><text>The term <term>non-Federal entity</term> means a State, a
			 local government, a nonprofit organization, or a private entity.</text>
				</paragraph></subsection></section><section id="H1EDF0FFA99BF4CFC8EE25EB6487ED059"><enum>3.</enum><header>Earmark audits by
			 agencies</header><text display-inline="no-display-inline">Section 3521 of title
			 31, United States Code, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H07CE2DA3A15F4F7B8A690BCF5A669B2C" style="OLC">
				<subsection id="H0AD8DD8F255845F38507A5E52DD61D64"><enum>(j)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H62746E3A5F494685AEB81ACF52DB36EB"><enum>(1)</enum><text display-inline="yes-display-inline">Except as provided under paragraph (2), an
				agency that conducts an audit of any program, project, or activity that is
				administered by the agency and is funded through an earmark shall submit to
				Congress the results of the audit, not later than 30 days after the audit is
				completed.</text>
					</paragraph><paragraph id="H83B243E0D6C343F09FBCEB02A24189AF" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In the case of any program, project, or
				activity that is administered by an agency and is funded through an earmark for
				an amount greater than $5,000,000, the agency shall conduct an audit of the
				program, project, or activity, and shall, not later than 180 days after the
				earmarked funds for the program, project, or activity are received by the
				agency, submit to Congress the results of the audit. Such audit shall include a
				determination from the audit whether the earmarked funds are being spent
				efficiently and effectively and whether the program, project, or activity is
				meeting any applicable stated purpose.</text>
					</paragraph><paragraph id="H4BD42AB8A56F41F084E5FAD82B2A9AE8" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">For purposes of this subsection, the term
				<term>funded through an earmark</term>, with respect to a program, project, or
				activity, means that the program, project, or activity is included on—</text>
						<subparagraph id="HAE9301075A5F420BAB832EB805C6592F"><enum>(A)</enum><text>a list of <term>congressional
				earmarks</term> generated under the Rules of the House of
				Representatives;</text>
						</subparagraph><subparagraph id="H56AC3E38CDD24337B58C361A3412F6B5"><enum>(B)</enum><text>a list of <term>congressionally
				directed spending</term> generated under the Standing Rules of the Senate;
				or</text>
						</subparagraph><subparagraph id="H97807304A805474AABAB99138930F605"><enum>(C)</enum><text>on both such
				lists.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.
				</after-quoted-block></quoted-block>
		</section><section id="H8AB752C2C49A46879627CF1062B4F489"><enum>4.</enum><header>Public
			 availability of audit results</header><text display-inline="no-display-inline">Each report submitted to Congress under
			 section 2, and the results of any audit submitted to Congress under section
			 3521(j) of title 31, United States Code, as added by section 3, shall also be
			 transmitted to the Government Accountability Office, and the Government
			 Accountability Office shall make the report available to the public through a
			 Web site.</text>
