		<official-title>To amend the Buy American Act with respect to certain
		  waivers under that Act, to provide greater transparency regarding exceptions to
		  domestic sourcing requirements, and for other purposes.</official-title>

		<section id="H43133CA4EF394A9180EE2128E98C8DE1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>21st Century Buy American
			 Act</short-title></quote>.</text>
		</section><section id="H941341CA1AA544A3A4F174C12F21B786"><enum>2.</enum><header>Grants to
			 domestic manufacturers</header>
			<subsection id="H2C74F59E177545BE9AAC4C14DCDB31E2"><enum>(a)</enum><header>Program
			 authorized</header><text>The Secretary of Commerce is authorized to establish
			 and carry out a program to award grants to eligible entities in accordance with
			 this section.</text>
			</subsection><subsection id="H81D2E585FDEC41588A3C3DBD3F6561A3"><enum>(b)</enum><header>Eligibility
			 requirements</header><text>The Secretary of Commerce shall establish
			 eligibility requirements for purposes of the grants under this section in order
			 to provide assistance to any entity that—</text>
				<paragraph id="H911D942DA41D472D9B4EBE9D106B1CDE"><enum>(1)</enum><text>is a manufacturer
			 in the United States;</text>
				</paragraph><paragraph id="HC794F181A1DD482CBA3FC167BCE72BE4"><enum>(2)</enum><text display-inline="yes-display-inline">is a firm certified as eligible to apply
			 for adjustment assistance under section 251(c) of the Trade Act of 1974 (19
			 U.S.C. 2341(c)); and</text>
				</paragraph><paragraph id="HE431A54FC2CF46FDBFE8DD6B5D63CD9B"><enum>(3)</enum><text>meets one of the
			 following criteria:</text>
					<subparagraph id="HB63B62F156F745A1B898D3BFEBCC565F"><enum>(A)</enum><text>The entity mines,
			 produces, or manufactures a nonavailable item.</text>
					</subparagraph><subparagraph id="H39ECD83AFEB547548A64BCD03CC046C5"><enum>(B)</enum><text>The entity is the
			 last remaining manufacturer of an item in the United States, as determined by
			 the Secretary of Commerce, and can prove hardship because of foreign
			 competition.</text>
					</subparagraph><subparagraph id="H94C77D70A49E459387E5AC8EBD19CE73"><enum>(C)</enum><text>The entity is the
			 last remaining manufacturer of an item in the United States and that item is
			 considered to be vital for national security purposes by the Department of
			 Defense or another department or agency of the United States.</text>
					</subparagraph></paragraph></subsection><subsection id="HBCF50AADE7D24A05BDF226125A2EB60B"><enum>(c)</enum><header>Amount of
			 grant</header><text>The amount of any grant under this section may not exceed
			 $5,000,000 per entity.</text>
			</subsection><subsection id="H696C6E49BFEA45E8BA0C1492DDE0008C"><enum>(d)</enum><header>Use of
			 funds</header>
				<paragraph id="H7042A48C70E44592967F1020727641B7"><enum>(1)</enum><header>In
			 general</header><text>Each eligible entity receiving a grant under this section
			 shall use the grant funds for any of the following purposes:</text>
					<subparagraph id="H087C14B52F4E475184A43ABBF61740C3"><enum>(A)</enum><text>Increasing its
			 ability to compete for a Government contract for a nonavailable item.</text>
					</subparagraph><subparagraph id="H255F63C429754FA484E970B94EF748CB"><enum>(B)</enum><text>Increasing its
			 ability to produce a nonavailable item.</text>
					</subparagraph><subparagraph id="H2EE3728DB1BA42629D2FDFA529F4BAC1"><enum>(C)</enum><text>Increasing its
			 capacity to produce items that are vital to national security.</text>
					</subparagraph><subparagraph id="H39F4659A89A7424E9ED78BA1BC1AA7F5"><enum>(D)</enum><text>Increasing its
			 capacity to create additional or retain existing jobs.</text>
					</subparagraph><subparagraph id="HBAE77E271F3749DC884ECA3BC3FE05AC"><enum>(E)</enum><text>Modernizing or
			 renovating existing manufacturing facilities using domestically made
			 equipment.</text>
					</subparagraph><subparagraph id="HA8AB90F137C04C368CC85B7B919FE55F"><enum>(F)</enum><text>Covering costs
			 associated with obtaining access to adjustment assistance under chapter 3 of
			 title II of the Trade Act of 1974 (19 U.S.C. 2341 et seq.).</text>
					</subparagraph></paragraph><paragraph id="H6751679CBDD042AE91A0F55EF23946DD"><enum>(2)</enum><header>Limitation</header><text>No
			 funds in a grant awarded under this section may be used for profits of an
			 eligible entity.</text>
				</paragraph></subsection><subsection id="H4B481D12BE754CB39E8AFA2796329CC6"><enum>(e)</enum><header>Application
			 requirements</header><text>To receive a grant under this section, an eligible
			 entity shall submit an application to the Secretary of Commerce at such time,
			 in such manner, and containing such information as the Secretary may require.
			 At a minimum, the application shall include a statement regarding the number of
			 direct full-time domestic jobs expected to be created or retained as a result
			 of the grant, but such statement shall not be the sole factor used in
			 determining the award of the grant.</text>
			</subsection><subsection id="HB2F44E8DA7DC4A7C8750AC701396217F"><enum>(f)</enum><header>Annual
			 evaluation of grant recipients by Department of Commerce</header><text>The
			 Secretary of Commerce each year shall evaluate recipients of grants under this
			 section to determine the proper allocation of grant funds.</text>
			</subsection><subsection id="H5CB47ABCA981462082C8DBC7C771E7D4"><enum>(g)</enum><header>Definition of
			 nonavailable item</header><text>In this section, the term <quote>nonavailable
			 item</quote> means an article, material, or supply—</text>
				<paragraph id="HDE07ED9CF4F04B4691EACE86340D1BBF"><enum>(1)</enum><text>that has been
			 determined by a Federal agency, pursuant to the Buy American Act (41 U.S.C. 10a
			 et seq.), to not be mined, produced, or manufactured in the United States in
			 sufficient and reasonably available commercial quantities of a satisfactory
			 quality;</text>
				</paragraph><paragraph id="H5A9AC1F9B0684D889A83C6B82B117499"><enum>(2)</enum><text>that has been
			 subject to a waiver under section 1605 of the American Recovery and
			 Reinvestment Act of 2009 (Public Law 111–5; 123 Stat. 303); or</text>
				</paragraph><paragraph id="H297C411747B547E3A0094BEB2780D2A8"><enum>(3)</enum><text>that is listed on
			 the list of nonavailable articles under subpart 25.104 of the Federal
			 Acquisition Regulation.</text>
				</paragraph></subsection></section><section id="HBB0C61DB99D2457EAE792D149D3EA26B"><enum>3.</enum><header>Requirements
			 relating to certain waivers of Buy American Act</header>
			<subsection id="HA5DBACE035DA4CB7A594977FB5846D95"><enum>(a)</enum><header>Special rules
			 relating to certain waivers</header><text display-inline="yes-display-inline">Section 2 of the Buy American Act (41
			 U.S.C. 10a) is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HA2B0028338214588A5F08E215051BD57" style="OLC">
					<subsection id="HDEB4F874F65940D68028F061EBEB1622"><enum>(c)</enum><header>Special
				rules</header><text display-inline="yes-display-inline">The following rules
				apply in carrying out the provisions of subsection (a):</text>
						<paragraph id="HC958BE006EEB4DA29879F0378847FF88"><enum>(1)</enum><header>Use outside the
				United States</header>
							<subparagraph id="H710A0C55EBD243C299C258E719815F68"><enum>(A)</enum><header>In
				general</header><text>Subsection (a) shall apply without regard to whether the
				articles, materials, or supplies to be acquired are for use outside the United
				States if the articles, materials, or supplies are not needed on an urgent
				basis or if they are acquired on a regular basis.</text>
							</subparagraph><subparagraph id="HAFCB4F7EA2A14EECBB7FF5CA36A3C274"><enum>(B)</enum><header>Cost
				analysis</header><text display-inline="yes-display-inline">In any case in which
				the articles, materials, or supplies are to be acquired for use outside the
				United States and are not needed on an urgent basis, before entering into a
				contract an analysis shall be made of the difference in the cost of acquiring
				the articles, materials, or supplies from a company manufacturing the articles,
				materials, or supplies in the United States (including the cost of shipping)
				and the cost of acquiring the articles, materials, or supplies from a company
				manufacturing the articles, materials, or supplies outside the United States
				(including the cost of shipping).</text>
							</subparagraph></paragraph><paragraph id="H3FF6C55D011342078D11DCB9F8827677"><enum>(2)</enum><header>Effect on
				domestic employment</header><text>In determining whether a public interest
				waiver, or waiver for use outside the United States, shall be granted under
				subsection (a), the head of a Federal agency shall—</text>
							<subparagraph id="H616B2AF8BEBE44C598CC4F30900B1AF8"><enum>(A)</enum><text>consider the
				short-term and long-term effects of granting such a waiver on employment within
				the United States, taking into account information provided by entities that
				manufacture the articles, materials, or supplies concerned in the United
				States; and</text>
							</subparagraph><subparagraph id="HB0966ADA3F08466285F6CC0F354C7CFB"><enum>(B)</enum><text>determine that
				preserving or increasing employment within the United States is consistent with
				the public
				interest.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4CDC04BE2B694CD6A4AC78237A3A87B2"><enum>(b)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 1 of the Buy American Act (41
			 U.S.C. 10c) is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H47CFBFFBADCD4D8E939EEA18C8046C34" style="OLC">
					<subsection id="H8BD4BC4F1C6A4B04886FF71FCC05ED02"><enum>(c)</enum><header>Substantially
				all</header><text display-inline="yes-display-inline">Articles, materials, or
				supplies shall be treated as made substantially all from articles, materials,
				or supplies mined, produced, or manufactured in the United States, if the cost
				of the domestic components of such articles, materials, or supplies exceeds 60
				percent of the total cost of all components of such articles, materials, or
				supplies.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H0062A84CF8FB4C86A01DD85EE16966B8"><enum>4.</enum><header>Transparency
			 requirements</header>
			<subsection id="HD43B82827D8645B98E8665DD2327B716"><enum>(a)</enum><header>Requirement for
			 agencies To notify OMB</header><text display-inline="yes-display-inline">Each
			 agency that applies an exception to the Buy American Act (41 U.S.C. 10a et
			 seq.) shall submit to the Director of the Office of Management and Budget a
			 notification of the application of the exception and a statement describing the
			 procurement and the exception being applied.</text>
			</subsection><subsection id="H74367C412D3C44519453BC12D6C54569"><enum>(b)</enum><header>Requirement for
			 Director of OMB To post on Web site</header><text>Within 7 days after receipt
			 of any notification under subsection (a), the Director of the Office of
			 Management and Budget shall post the notification on a central, publicly
			 accessible Web site of the Office.</text>
			</subsection><subsection commented="no" id="H913CBD292B944757922A0954D5152DF4"><enum>(c)</enum><header>Definition of
			 agency</header><text>In this section, the term <quote>agency</quote> has the
			 meaning given under section 551 of title 5, United States Code.</text>
			</subsection></section><section id="HA7479F7AC77C4E10BC2EBA62CB93A911"><enum>5.</enum><header>Requirement for
			 annual report by Comptroller General on exceptions to Buy American Act and
			 other domestic source requirements</header>
			<subsection id="HF3627A7CB3BD415F9D6DA64C468BCEB2"><enum>(a)</enum><header>Report
			 requirement</header>
				<paragraph id="H8CAA6E1079294036A23E3A5A73F08E61"><enum>(1)</enum><header>In
			 general</header><text>Not later than 60 days after the end of a fiscal year,
			 the Comptroller General of the United States shall submit to Congress a report
			 on the amount of the acquisitions made by each agency in that fiscal year of
			 articles, materials, or supplies purchased from entities that manufacture the
			 articles, materials, or supplies outside of the United States.</text>
				</paragraph><paragraph id="H5BC37789C75B402FBEA50DCEBB5FD8AB"><enum>(2)</enum><header>Contents of
			 report</header><text>The report required by paragraph (1) shall separately
			 include, for the fiscal year covered by such report—</text>
					<subparagraph id="HB42930C670EB41EFB0324A49AE25E0A3"><enum>(A)</enum><text>the dollar value
			 of any articles, materials, or supplies that were manufactured outside the
			 United States;</text>
					</subparagraph><subparagraph id="H1BBEC233393546F09FAEAD1BF79C9119"><enum>(B)</enum><text>an itemized list
			 of all waivers granted with respect to such articles, materials, or supplies
			 under the Buy American Act (41 U.S.C. 10a et seq.), section 1605(a) of the
			 American Recovery and Reinvestment Act of 2009 (123 Stat. 303), or any other
			 law that requires procurement of goods or services from a domestic source, and
			 a citation to the treaty, international agreement, or other law under which
			 each waiver was granted;</text>
					</subparagraph><subparagraph id="H2D376E9A1CA54AB5BE4ADF36FA12BB19"><enum>(C)</enum><text>if any articles,
			 materials, or supplies were acquired from entities that manufacture articles,
			 materials, or supplies outside the United States, the specific exception under
			 section 2 of the Buy American Act (41 U.S.C. 10a), section 1605(a) of the
			 American Recovery and Reinvestment Act of 2009 (123 Stat. 303), or any other
			 law that requires procurement of goods or services from a domestic source, that
			 was used to purchase such articles, materials, or supplies; and</text>
					</subparagraph><subparagraph id="H21A4495AD96B4621A7789D0120687F1C"><enum>(D)</enum><text>a summary
			 of—</text>
						<clause id="H7C2EA80F445F42B592C4B012E28029DA"><enum>(i)</enum><text>the
			 total procurement funds expended on articles, materials, and supplies
			 manufactured inside the United States; and</text>
						</clause><clause id="H9E759BEEACDE41CA822631FE6FDF6A47"><enum>(ii)</enum><text>the
			 total procurement funds expended on articles, materials, and supplies
			 manufactured outside the United States.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="HC60960D188CE4767A4626F9D88208384"><enum>(b)</enum><header>Public
			 availability</header><text>The Comptroller General shall make the report
			 publicly available to the maximum extent practicable.</text>
			</subsection><subsection id="H10BDFCA83C4A414698DFF44389A5DC08"><enum>(c)</enum><header>Exception for
			 intelligence community</header><text>The report required under this section
			 shall not cover acquisitions made by an agency, or component thereof, that is
			 an element of the intelligence community as specified in, or designated under
			 section 3(4) of the National Security Act of 1947 (50 U.S.C. 401a(4)).</text>
			</subsection><subsection id="H73ABF4FFBCAA49F5B364FE50868B926A"><enum>(d)</enum><header>Definition of
			 agency</header><text>In this section, the term <quote>agency</quote> has the
			 meaning given under section 551 of title 5, United States Code.</text>
