		<section id="H06DA313879654DD890ED63EC3C9E7B10" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Small
			 Business <short-title>Innovation to Job Creation Act of
			 2010</short-title></quote>.</text>
		</section><section id="H20FE855526DC4630ABE3C4A55E211E54"><enum>2.</enum><header>Commercialization
			 grants to small businesses receiving SBIR second phase funds</header>
			<subsection id="HC8C50CA52AAC4C79A7BF0E15AC4D7AC0"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator of the Small Business
			 Administration is authorized to make grants on a competitive basis to small
			 business concerns to assist the commercialization of research developed by such
			 small business concerns with funds received under the second phase of the Small
			 Business Innovation Research Program.</text>
			</subsection><subsection id="H1D11CA1569DB4A8E9B513CD564C5697C"><enum>(b)</enum><header>Eligibility</header><text display-inline="yes-display-inline">The Administrator may only award a grant
			 under this section to a small business concern that—</text>
				<paragraph id="H9929D6D9A57243FCBB35143E0E8B4AEF"><enum>(1)</enum><text>received second
			 phase funds during fiscal year 2007 or 2008, or both;</text>
				</paragraph><paragraph id="H709A5F2A5FD847C9934B826B8D403C79"><enum>(2)</enum><text>continues to meet
			 the criteria for receiving second phase funds at the time the grant is awarded,
			 except for any such criteria that the Administrator determines are no longer
			 applicable;</text>
				</paragraph><paragraph id="HD3E18CE59C594F9B96D5E0C55D3F7832"><enum>(3)</enum><text display-inline="yes-display-inline">has obtained from the Federal agency from
			 which the small business concern received second phase funds a recommendation
			 that the small business concern be made a grant under this section;</text>
				</paragraph><paragraph id="H6494C942095A4CE2B6E385E6AE810B5B"><enum>(4)</enum><text>has not previously
			 received a grant under this section for the commercialization of the same
			 research; and</text>
				</paragraph><paragraph id="H349F2AEF55474A51B7D5D7388F87F818"><enum>(5)</enum><text>submits an
			 application at such time and in such form as the Administrator may require,
			 including—</text>
					<subparagraph id="H111A689F01244F3FA20A61C1CF6C5D01"><enum>(A)</enum><text>a description of
			 the commercialization project for which the small business concern will use the
			 grant funds;</text>
					</subparagraph><subparagraph id="H9DC7051FBB49462D97ED448AEA8A3DA8"><enum>(B)</enum><text>the budget for
			 such project; and</text>
					</subparagraph><subparagraph id="HF396458CC1D849C1BD85C2D56CC992C8"><enum>(C)</enum><text>a certification
			 that the small business concern meets the criteria described in paragraph
			 (2).</text>
					</subparagraph></paragraph></subsection><subsection id="HE200D5820169429CA6EA229A498F5124"><enum>(c)</enum><header>Grant
			 amount</header><text>A grant under this section shall be in an amount the
			 Administrator, in consultation with the Federal agency from which the small
			 business concern received second phase funds, considers appropriate, but such
			 grant shall not exceed the amount of the second phase funds received by such
			 small business concern with respect to the research involved.</text>
			</subsection><subsection id="H1DFCD5F66E90437181366BE1ED932501"><enum>(d)</enum><header>Definitions</header><text>In
			 this section—</text>
				<paragraph id="H0B794E1DC7104EC3B3B8333940D15151"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Administrator</term> means
			 the Administrator of the Small Business Administration; and</text>
				</paragraph><paragraph id="H1FA1726D337445EFB847A57F5F0ECC4D"><enum>(2)</enum><text>the terms
			 <term>Federal agency</term>, <term>research</term>, <term>second phase</term>,
			 and <term>Small Business Innovation Research Program</term> have the meanings
			 given such terms in section 9(e) of the Small Business Act (15 U.S.C.
			 638(e)).</text>
				</paragraph></subsection><subsection id="HF28DD264F2164294AEE8087F28313BA8"><enum>(e)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to carry
			 out this section $2,000,000,000 for fiscal year 2011.</text>
