		  to references to an intellectual disability, and change references to a
		  mentally retarded individual to references to an individual with an

		<section id="H6B2854D523114432B73454348B9485C3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Elizabeth A. Connelly
			 Act</short-title></quote>.</text>
		</section><section id="H986609B61755447885F2FA99E4FC51EB"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="H51ED26E9F7BC4BC9B4F654935A25E72E"><enum>(1)</enum><text>The Honorable
			 Elizabeth A. Connelly was elected to the New York State Assembly in 1973 as the
			 first woman from Staten Island, New York, elected to public office.</text>
			</paragraph><paragraph id="HBC7FD3F87280436FA2BD4587F268885D"><enum>(2)</enum><text>Ms. Connelly
			 retired in 2000 making her the longest serving female legislator in the history
			 of New York State.</text>
			</paragraph><paragraph id="H3F60AEC114BC46068F9A2BD25ABC7064"><enum>(3)</enum><text>Through her work
			 on the New York State Assembly Mental Health, Mental Retardation, Developmental
			 Disabilities, Alcoholism, and Substance Abuse Committee, Elizabeth A. Connelly
			 was a champion for individuals with intellectual and other developmental
			 disabilities.</text>
			</paragraph><paragraph id="HB399AB626F414F3797AFF367D02E001C"><enum>(4)</enum><text>As an
			 Assemblywoman, Ms. Connelly was instrumental in securing funds for mental
			 health programs and in creating the New York State Commission on Quality of
			 Care for the Mentally Disabled.</text>
			</paragraph><paragraph id="HB8D9C7FC59894C35928DBAAF10FFBC65"><enum>(5)</enum><text>She worked
			 together with parents, advocates, and government leaders to make New York State
			 a leader in providing high-quality services and programs for individuals with
			 intellectual and other developmental disabilities.</text>
			</paragraph><paragraph id="HB7C58F88FC5E442598C73E4D422BB2E6"><enum>(6)</enum><text>Ms. Connelly was
			 known as the <quote>guardian angel of the mentally disabled</quote> in New York
			 State.</text>
			</paragraph><paragraph id="HD3F5C64B34AA4F84A70870FED06545EB"><enum>(7)</enum><text>Her personal
			 commitment and leadership helped redefine how individuals with intellectual and
			 other developmental disabilities are treated today throughout the United
			 States.</text>
			</paragraph></section><section id="H13752DDECAA640AD87D00BC78F3B4D3E"><enum>3.</enum><header>Individuals with
			 intellectual disabilities</header>
			<subsection id="H55EBE14D26DA411C8109019A42766AA3"><enum>(a)</enum><header>Higher education
			 act of 1965</header><text>Section 760(2)(A) of the Higher Education Act of 1965
			 (20 U.S.C. 1140(2)(A)) is amended by striking <quote>with mental retardation
			 or</quote>.</text>
			</subsection><subsection id="H0B04D71BDC2D426DA84E106A106B3EED"><enum>(b)</enum><header>Individuals With
			 Disabilities Education Act</header>
				<paragraph id="H1941A9F5E5934ACA80B280B7D6170423"><enum>(1)</enum><text>Section
			 601(c)(12)(C) of the Individuals with Disabilities Education Act (20 U.S.C.
			 1400(c)(12)(C)) is amended by striking <quote>having mental retardation</quote>
			 and inserting <quote>having intellectual disabilities</quote>.</text>
				</paragraph><paragraph id="HED60B25F26C44DD295B95756D94124B2"><enum>(2)</enum><text>Section 602 of
			 such Act (20 U.S.C. 1401) is amended—</text>
					<subparagraph id="HF4A397D3D312451699E14C9E427D365B"><enum>(A)</enum><text>in paragraph
			 (3)(A)(i), by striking <quote>with mental retardation</quote> and inserting
			 <quote>with intellectual disabilities</quote>; and</text>
					</subparagraph><subparagraph id="HA6755A6EB98241AD8448D82BC89D7CF6"><enum>(B)</enum><text>in paragraph
			 (30)(C), by striking <quote>of mental retardation</quote> and inserting
			 <quote>of intellectual disabilities</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H79D66BDA5C824B1387986F7ADCC447B1"><enum>(c)</enum><header>Elementary and
			 secondary education act of 1965</header><text>Section 7202(16)(E) of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 7512(16)(E)) is
			 amended by striking <quote>mild mental retardation,</quote> and inserting
			 <quote>mild intellectual disabilities,</quote>.</text>
			</subsection><subsection id="H7C556EF8ADC74E2BBA35F1ED36F33492"><enum>(d)</enum><header>Rehabilitation
			 Act of 1973</header>
				<paragraph id="H871BF23563334EFE91BEE2F0054D78F5"><enum>(1)</enum><text>Section
			 7(21)(A)(iii) of the Rehabilitation Act of 1973 (29 U.S.C. 705(21)(A)(iii)) is
			 amended by striking <quote>mental retardation,</quote> and inserting
			 <quote>intellectual disability,</quote>.</text>
				</paragraph><paragraph id="H17E234D9F22045DE8F8BD51A0280B864"><enum>(2)</enum><text>Section
			 204(b)(2)(C)(vi) of such Act (29 U.S.C. 764(b)(2)(C)(vi)) is amended by
			 striking <quote>mental retardation and other developmental disabilities</quote>
			 and inserting <quote>intellectual disabilities and other developmental
			 disabilities</quote>.</text>
				</paragraph><paragraph id="H5AB1770F2B074073B997B42A7022E955"><enum>(3)</enum><text>Section 501(a) of
			 such Act (29 U.S.C. 791(a)) is amended, in the third sentence, by striking
			 <quote>President’s Committees on Employment of People With Disabilities and on
			 Mental Retardation</quote> and inserting <quote>President’s Committee on
			 Employment of People with Disabilities and the President’s Committee for People
			 with Intellectual Disabilities</quote>.</text>
				</paragraph></subsection><subsection id="H5675912D5EDB47A892D8232B1856B48D"><enum>(e)</enum><header>Health research
			 and health services amendments of 1976</header><text>Section 1001 of the Health
			 Research and Health Services Amendments of 1976 (42 U.S.C. 217a–1) is amended
			 by striking <quote>the Mental Retardation Facilities and Community Mental
			 Health Centers Construction Act of 1963,</quote>.</text>
			</subsection><subsection id="H6278AE28528E4AEFACE56B5BB0DE0870"><enum>(f)</enum><header>Public Health
			 Service Act</header>
				<paragraph id="H433019F7936F4684B3CC58DDB25AF7AE"><enum>(1)</enum><text>Section
			 317C(a)(4)(B)(i) of the Public Health Service Act (42 U.S.C.
			 247b–4(a)(4)(B)(i)) is amended by striking <quote>mental retardation;</quote>
			 and inserting <quote>intellectual disabilities;</quote>.</text>
				</paragraph><paragraph id="HF3F172A1420A4152852C481CF58F422D"><enum>(2)</enum><text>Section 448 of
			 such Act (42 U.S.C. 285g) is amended by striking <quote>mental
			 retardation,</quote> and inserting <quote>intellectual
			 disabilities,</quote>.</text>
				</paragraph><paragraph id="H50DAC7CC8EC74C1F8DB41B71D0AB5DDE"><enum>(3)</enum><text>Section 450 of
			 such Act (42 U.S.C. 285g–2) is amended to read as follows:</text>
					<quoted-block id="H21F56101F3534CAAA8D7CB679DDDB70B" style="OLC">
						<section id="H10F4824A27B34A89A09E9D3EE562A314"><enum>450.</enum><header>Research on
				intellectual disabilities</header><text display-inline="no-display-inline">The
				Director of the Institute shall conduct and support research and related
				activities into the causes, prevention, and treatment of intellectual
				disabilities.</text>
						</section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H2F7AC4C9B77F45558B0F6D91184B3285"><enum>(4)</enum><text>Section 641(a) of
			 such Act (42 U.S.C. 291k(a)) is amended by striking <quote>matters relating to
			 the mentally retarded</quote> and inserting <quote>matters relating to
			 individuals with intellectual disabilities</quote>.</text>
				</paragraph><paragraph id="HC89495EB5963416392732D01BF8CA8CA"><enum>(5)</enum><text>Section
			 753(b)(2)(E) of such Act (42 U.S.C. 294c(b)(2)(E)) is amended by striking
			 <quote>elderly mentally retarded individuals</quote> and inserting
			 <quote>elderly individuals with intellectual disabilities</quote>.</text>
				</paragraph><paragraph id="H0D67DAEFCD4C4BBA9B7D68D191894C6D"><enum>(6)</enum><text>Section
			 1252(f)(3)(E) of such Act (42 U.S.C. 300d–52(f)(3)(E)) is amended by striking
			 <quote>mental retardation/developmental disorders,</quote> and inserting
			 <quote>intellectual disabilities or developmental disorders,</quote>.</text>
				</paragraph></subsection><subsection id="H26CF3615C9254821829BA7E3354FD839"><enum>(g)</enum><header>Health
			 professions education partnerships act of 1998</header><text>Section 419(b)(1)
			 of the Health Professions Education Partnerships Act of 1998 (42 U.S.C. 280f
			 note) is amended by striking <quote>mental retardation</quote> and inserting
			 <quote>intellectual disabilities</quote>.</text>
			</subsection><subsection id="H21F2FE6FA836447DB2B3DE8DD7AD9C8A"><enum>(h)</enum><header>Public law
			 110–154</header><text>Section 1(a)(2)(B) of Public Law 110–154 (42 U.S.C. 285g
			 note) is amended by striking <quote>mental retardation</quote> and inserting
			 <quote>intellectual disabilities</quote>.</text>
			</subsection><subsection id="H7B333EEA6AA5485EB99A5DDE101072E5"><enum>(i)</enum><header>National Sickle
			 Cell Anemia, Cooley’s Anemia, Tay-Sachs, and Genetic Diseases
			 Act</header><text>Section 402 of the National Sickle Cell Anemia, Cooley’s
			 Anemia, Tay-Sachs, and Genetic Diseases Act (42 U.S.C. 300b–1 note) is amended
			 by striking <quote>leading to mental retardation</quote> and inserting
			 <quote>leading to intellectual disabilities</quote>.</text>
			</subsection><subsection id="HED00328BD3AF4A5C92B44FC7EEE04295"><enum>(j)</enum><header>Genetic
			 information nondiscrimination act of 2008</header><text>Section 2(2) of the
			 Genetic Information Nondiscrimination Act of 2008 (42 U.S.C. 2000ff note) is
			 amended by striking <quote>mental retardation,</quote> and inserting
			 <quote>intellectual disabilities,</quote>.</text>
			</subsection><subsection id="H32573BC68B724C99AF481B58DBE3CB8E"><enum>(k)</enum><header>Developmental
			 Disabilities Assistance and Bill of Rights Act of 2000</header>
				<paragraph id="H78A151FB292C4E5C85E44CBA262ACB21"><enum>(1)</enum><text>Section
			 109(a)(4)(B)(i) of the Developmental Disabilities Assistance and Bill of Rights
			 Act of 2000 (42 U.S.C. 15009(a)(4)(B)(i)) is amended by striking <quote>the
			 mentally retarded</quote> and inserting <quote>individuals with intellectual
			 disabilities</quote>.</text>
				</paragraph><paragraph id="H76AA046B70AF49A29474A4EB549CE779"><enum>(2)</enum><text>Sections
			 124(c)(3)(C)(vii) and 143(a)(3)(A) of such Act (42 U.S.C. 15024(c)(3)(C)(vii),
			 15043(a)(3)(A)) are amended—</text>
					<subparagraph id="H818BEF89D487433ABED0E62468FCB9EC"><enum>(A)</enum><text>by striking
			 <quote>(a)(30)(C)</quote> each place it appears and inserting
			 <quote>(a)(31)</quote>; and</text>
					</subparagraph><subparagraph id="H27F6B376C60A48E4A55B4A5525C28D07"><enum>(B)</enum><text>by striking
			 <quote>Intermediate Care Facility (Mental Retardation)</quote> and inserting
			 <quote>intermediate care facility described in that section</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H6703139B41D3490095B73EA467026B47"><enum>(l)</enum><header>References</header><text>For
			 purposes of each provision amended by this section—</text>
				<paragraph id="H33B13A1A8B4F49EC89064D355217CD4D"><enum>(1)</enum><text>a
			 reference to an intellectual disability shall be considered to refer to mental
			 retardation, as defined for that provision on the day before the date of
			 enactment of this Act; and</text>
				</paragraph><paragraph id="HFCCB03B1296F4258AB210720A393EDA3"><enum>(2)</enum><text>a
			 reference to individuals with intellectual disabilities shall be considered to
			 refer to the mentally retarded, or individuals who are mentally retarded, as
			 defined for that provision on that day.</text>
				</paragraph></subsection></section><section id="H96054CBEB27943BF80926101298734EA"><enum>4.</enum><header>Regulations</header><text display-inline="no-display-inline">For purposes of regulations issued to carry
			 out a provision amended by this Act—</text>
			<paragraph id="H4C92B3B41970472BB94C958459BB9EBD"><enum>(1)</enum><text>before the
			 regulations are amended to carry out this Act—</text>
				<subparagraph id="H10DF08C29D674E3CA6E60D2BAEB157AB"><enum>(A)</enum><text>a reference in the
			 regulations to mental retardation shall be considered to be a reference to an
			 intellectual disability; and</text>
				</subparagraph><subparagraph id="H62BB5B9A3D444272B3AC6A188E071BDC"><enum>(B)</enum><text>a reference in the
			 regulations to the mentally retarded, or individuals who are mentally retarded,
			 shall be considered to be a reference to individuals with intellectual
			 disabilities; and</text>
				</subparagraph></paragraph><paragraph id="H5A07A3B7B10E4F6380F61471EEEDAFEA"><enum>(2)</enum><text>in amending the
			 regulations to carry out this Act, a Federal agency shall ensure that the
			 regulations clearly state—</text>
				<subparagraph id="HD61AA537B2974575A719122CFD392D01"><enum>(A)</enum><text>that an
			 intellectual disability was formerly termed mental retardation; and</text>
				</subparagraph><subparagraph id="HF35BB8A4473E4A71952E93C0D1E8033B"><enum>(B)</enum><text>that individuals
			 with intellectual disabilities were formerly termed individuals who are
			 mentally retarded.</text>
				</subparagraph></paragraph></section><section id="H75C62FA0278A4CFE9672867597C4B268"><enum>5.</enum><header>Rule of
			 construction</header><text display-inline="no-display-inline">Nothing in this
			 Act shall be construed to alter or otherwise affect the eligibility for
			 services or the rights or responsibilities, under a provision amended by this
			 Act, of individuals covered by the provision on the day before the date of
			 enactment of this Act.</text>
