		<official-title>To amend the Internal Revenue Code of 1986 to deny a
		  deduction for image advertising expenses for any trade or business the gross
		  receipts of which exceed $100 million.</official-title>

		<section id="H9533A4C432B14427810782853568E260" section-type="section-one"><enum>1.</enum><header>Denial of deduction for
			 certain advertising</header>
			<subsection id="HCC6413C59C9942ABBDCBC39A40D3EC3E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part IX of subchapter
			 B of chapter 1 of the Internal Revenue Code of 1986 (relating to items not
			 deductible) is amended by adding at the end the following new section:</text>

					<section id="H356A3A023A6042F09E2B7912877DC62D"><enum>280I.</enum><header>Denial of
				deduction for certain advertising</header>
						<subsection id="H96B281BF937B4FFE920DAD018194227A"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of a
				person who is not a qualified small business, no deduction shall be allowed
				under this chapter for any amount paid or incurred for advertising anything
				other than a service or product.</text>
						</subsection><subsection id="HD74FDBF20DCF423BB35AFC37183F307A"><enum>(b)</enum><header>Qualified small
				business</header><text>For purposes of this section, the term <term>qualified
				small business</term> means any person engaged in a trade or business the gross
				receipts of which for the preceding taxable year did not exceed
				$100,000,000.</text>
						</subsection><subsection id="H7D28C4F6B6AF4489964975C3D9ABE394"><enum>(c)</enum><header>Common
				control</header><text display-inline="yes-display-inline">All members of the
				same controlled group of corporations (within the meaning of section 52(a)) and
				all persons under common control (within the meaning of section 52(b)) shall be
				treated as 1 person for purposes of this section.</text>
						</subsection></section><after-quoted-block>. </after-quoted-block></quoted-block>
			</subsection><subsection id="H33765953807B482EA77A5611B8B82F4D"><enum>(b)</enum><header>Clerical
			 Amendment</header><text>The table of sections for part IX of subchapter B of
			 chapter 1 of such Code is amended by adding at the end thereof the following
			 new item:</text>

			</subsection><subsection id="HFA4716FFDF92426683627292D7E8DD09"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to amounts paid or incurred after the date of the
			 enactment of this Act in taxable years ending after such date.</text>
