		<legis-type>A BILL</legis-type>
		<official-title>To amend the Federal Election Campaign Act of 1971 to
		  apply the ban on contributions and expenditures by foreign nationals to
		  domestic corporations which are owned or controlled by foreign principals, to
		  increase the civil penalties applicable to foreign nationals who violate the
		  ban, and for other purposes.</official-title>

		<section id="H0F8FC8321C4748A984DAD4AE29E2E7C5" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Freedom From Foreign-Based Manipulation in American
			 Elections Act of 2010</short-title></quote>.</text>
		</section><section id="H0E23A3F82B124C459AFAC620E3AA1A1E"><enum>2.</enum><header>Application of
			 Ban on Contributions and Expenditures by Foreign Nationals to
			 Foreign-Controlled Domestic Corporations</header>
			<subsection id="H0133E0F0B8254F868AD2D8EB2AE5A19E"><enum>(a)</enum><header>Application of
			 Ban</header><text display-inline="yes-display-inline">Section 319(b) of the
			 Federal Election Campaign Act of 1971 (2 U.S.C. 441e(b)) is amended—</text>
				<paragraph id="H3FB6FAB3F92E45B0A9104E9F87DBBDB9"><enum>(1)</enum><text>by striking
			 <quote>or</quote> at the end of paragraph (1);</text>
				</paragraph><paragraph id="HA03CA43412ED474ABEDC0ABE2AD68A55"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (2) and inserting <quote>; or</quote>;
			 and</text>
				</paragraph><paragraph id="H246C7ADA24FF468CBCFE33E087D47895"><enum>(3)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HBDA44EDE85AE418A8D0AD5E6BF0B2262" style="OLC">
						<paragraph id="HCB9C2B7179754933A2E0474A7C670EB9"><enum>(3)</enum><text>a corporation
				(other than a foreign principal, as so defined) with respect to which—</text>
							<subparagraph id="HE4FA833357224720A54722A066C27F76"><enum>(A)</enum><text>the number of
				shares which are owned directly or indirectly by foreign principals is equal to
				or greater than 5 percent of the total number of outstanding shares of the
				corporation;</text>
							</subparagraph><subparagraph id="HEE0F095ABD8043538F6C5DEFAA023D0B"><enum>(B)</enum><text display-inline="yes-display-inline">one or more foreign principals serves on
				the board of directors; or</text>
							</subparagraph><subparagraph id="H383274101D4D4D149E2276E67879C19D"><enum>(C)</enum><text>one or more
				foreign principals is employed in a senior executive
				position.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H96330ECC7A92426FAA51A8FC2055AE9A"><enum>(b)</enum><header>Increase in
			 Civil Money Penalties for Violations</header>
				<paragraph id="H6B77141348E545BBB8C52BC679D35A31"><enum>(1)</enum><header>In
			 general</header><text>Section 319 of such Act (2 U.S.C. 441e) is amended by
			 adding at the end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HBB8D2385CAE74DF690F4601728BD82A4" style="OLC">
						<subsection id="H075DFF07F04C462893555A404FBA9F46"><enum>(c)</enum><header>Civil Money
				Penalty for Violations</header>
							<paragraph id="H5350412CA0F348E3BA1B7D4D2C447537"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">A foreign national
				who violates subsection (a) shall pay a civil money penalty of
				$1,000,000.</text>
							</paragraph><paragraph id="H3AD1F69AFA304689AD7D91DB3626A167"><enum>(2)</enum><header>Additional
				penalty for making disbursements for electioneering
				communications</header><text>In addition to the penalty under paragraph (1), a
				foreign national who makes a disbursement for an electioneering communication
				shall pay a civil money penalty equal to the product of—</text>
								<subparagraph id="H8759C9EE1C2C42EFADC98ACFF4F34D2D"><enum>(A)</enum><text>$50,000;
				and</text>
								</subparagraph><subparagraph id="H407259A589444ED688891474ABF1F12C"><enum>(B)</enum><text>the number of days
				on which the communication was aired.</text>
								</subparagraph></paragraph><paragraph id="HE4513FC34DC848C6A459F1CE0FBDC39F"><enum>(3)</enum><header>Ineligibility
				for government contract</header><text>A foreign national who violates
				subsection (a) shall be ineligible to enter into any contract with the United
				States for the provision of any goods, supplies, or services.</text>
							</paragraph><paragraph id="H90AA5998B32F4DDD9D5160D70A8301C7"><enum>(4)</enum><header>No effect on
				criminal penalties</header><text>Nothing in this subsection shall be construed
				to affect the application of any criminal penalty to a foreign national who
				violates subsection
				(a).</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HD379C914A38B4755BDFCE13B8B32B74F"><enum>(2)</enum><header>Conforming
			 amendments</header><text>Section 309(a) of such Act (2 U.S.C. 437g(a)) is
			 amended—</text>
					<subparagraph id="H85AD4D1A1FB74D2FB5907FEA0CA96CBA"><enum>(A)</enum><text>in paragraph
			 (5)(B), by striking <quote>If the Commission</quote> and inserting
			 <quote>Subject to section 319(c) in the case of a violation of such section, if
			 the Commission</quote>; and</text>
					</subparagraph><subparagraph id="H20FD052C39CD47E592374F1C5C8C7608"><enum>(B)</enum><text>in paragraph
			 (6)(C), by striking <quote>In any civil action</quote> and inserting
			 <quote>Subject to section 319(c) in the case of a violation of such section, in
			 any civil action</quote>.</text>
					</subparagraph></paragraph></subsection></section><section id="HEC865B8DE5784756B122483FD32659EF"><enum>3.</enum><header>Effective
			 Date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall apply with respect to contributions, donations, expenditures,
			 independent expenditures, and disbursements for electioneering communications
			 under the Federal Election Campaign Act of 1971 which are made on or after the
			 date of the enactment of this Act.</text>
