		<legis-type>A BILL</legis-type>
		<official-title>To require the President to submit certain certifications
		  to Congress before transferring or releasing an individual detained at Naval
		  Station, Guantanamo Bay, Cuba, to the custody of another
		  country.</official-title>

		<section id="H25406F758CC248C092D5CE15E0F446B4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Detainee Transfer and Release Security
			 Act of 2010</short-title></quote>.</text>
		</section><section id="H5A8E67FB1FC34EAFAA48362F4E0E3008"><enum>2.</enum><header>Limitation on the
			 transfer or release of individuals detained at Naval Station, Guantanamo Bay,
			 Cuba</header>
			<subsection id="H781120E3FC8946FD88A573FE3F340AEF"><enum>(a)</enum><header>Transfer or
			 release limitation</header><text display-inline="yes-display-inline">The
			 President or the President’s designee may not release or transfer an individual
			 currently detained at Guantanamo to the custody of the individual’s country of
			 origin or to a third country unless the President makes the certification
			 described in subsection (b).</text>
			</subsection><subsection id="H454E5EEB64F0464B86A03634DD7AD5D5"><enum>(b)</enum><header>Presidential
			 certification</header><text display-inline="yes-display-inline">The
			 certification described in this subsection is a written certification that the
			 President submits to Congress that contains each of the following with respect
			 to an individual currently detained at Guantanamo or an individual covered by
			 this section who is proposed to be transferred to or released into the custody
			 of another country:</text>
				<paragraph id="H52880AC2A22A4731AE660C12A716B11E"><enum>(1)</enum><text>A
			 certification that the country to which the individual is to be transferred or
			 released is not a designated state sponsor of terrorism.</text>
				</paragraph><paragraph id="H39584310ACE247E88907823BC93EA610"><enum>(2)</enum><text>A
			 certification that such country’s government can secure and exercise control
			 over all of its territory.</text>
				</paragraph><paragraph id="HBD9A33555DCE4C5486D5C63DD0A2E092"><enum>(3)</enum><text>A
			 certification that no portion of such country’s territory serves as a safe
			 haven for terrorists or insurgent groups in the region, particularly al Qaeda,
			 in which such a group may be able to plan, organize, and support terrorist
			 operations.</text>
				</paragraph><paragraph id="H0F00DEF5FA98495AB3140BC362DC3673"><enum>(4)</enum><text>A
			 certification that there is no confirmed case of any individual who had been
			 detained at Guantanamo who reengaged in terrorist activities subsequent to
			 being transferred or released to such country.</text>
				</paragraph></subsection><subsection id="H0C6CC9BD0F43429C9B189D087FC66FA7"><enum>(c)</enum><header>Definition</header><text>For
			 purposes of this section, the term <quote>individual currently detained at
			 Guantanamo</quote> has the meaning given such terms under section 1(c) of
			 Executive Order 13492.</text>
