			 Spending Limits </header>
			<section id="H8DB85EEE897E49CF8FCB6A35B20CC3AB"><enum>101.</enum><header>Discretionary
			 spending limits</header><text display-inline="no-display-inline">Section 251(c)
			 of the Balanced Budget and Emergency Deficit Control Act of 1985 is amended by
			 striking beginning with <quote>means—</quote> through paragraph (13) and
			 inserting <quote>means, for fiscal years 2011 through 2019, the baseline, minus
			 any spending designated as an emergency, for the preceding fiscal year as
			 adjusted for inflation and</quote>.</text>
			</section><section id="HAEA9A9BB38934700ACE12BE46A1F7DC5"><enum>102.</enum><header>Sequestration
			 for discretionary limits</header><text display-inline="no-display-inline">Subsection (a) of section 251 of the
			 Balanced Budget and Emergency Deficit Control Act of 1985 are amended to read
			 as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H8E4DF5C9623243BB9AB97C3931F86D36" style="OLC">
					<subsection id="H188A2F2390E8428B8AC0F8BBB228D9D3"><enum>(a)</enum><header>Sequestration</header>
						<paragraph id="HFE2F964A4ED742C4A607DE3FB2AAD445"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 45
				calendar days after Congress adjourns to end a session, OMB shall conduct a
				sequestration to eliminate the budget year breach, if any, resulting from
				budget authority and outlays in excess of the discretionary spending
				limit.</text>
						</paragraph><paragraph id="H29291EC4785F4F178C18BF29A50CDC66"><enum>(2)</enum><header>Breach
				calculation</header><text>The breach is, if greater than zero, the breach for
				the budget year, minus any adjustments pursuant to subsection (b).</text>
						</paragraph><paragraph id="H408A68E8BAD643DF9DC0C8AB66F1FA73"><enum>(3)</enum><header>Sequestration</header><text>To
				eliminate the breach in a budget year, each account shall be reduced by a
				dollar amount calculated by multiplying the level of sequesterable budgetary
				resources in that account at that time by the uniform percentage necessary to
				enforce subsection (c).</text>
						</paragraph><paragraph id="H0E73FC1AAC574D7ABDD9A0097B764C96"><enum>(4)</enum><header>Look
				back</header><text>If, after June 30, an appropriation for the fiscal year in
				progress is enacted that causes a breach, the discretionary spending limits for
				the next fiscal year shall be reduced by the amount or amounts of that
				breach.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H4698C35830F5404FBFA56B48AF9641FF"><enum>103.</enum><header>Adjustments to
			 discretionary spending limits</header><text display-inline="no-display-inline">Section 251(b) of the Balanced Budget and
			 Emergency Deficit Control Act of 1985 is amended to read as follows:</text>

					<subsection id="H684F3B0EB7D541EFBE7776FD6EFB0AAF"><enum>(b)</enum><header>Adjustments to
				Discretionary Spending Limits</header>
						<paragraph id="H0B2533DB1C3D421485C1EFE4C2998FE7"><enum>(1)</enum><header>Concepts and
				definitions</header><text>When the President submits the budget under section
				1105 of title 31, United States Code, OMB shall calculate and the budget shall
				include adjustments to discretionary spending limits (and those limits as
				cumulatively adjusted) for the budget year and each outyear to reflect changes
				in concepts and definitions. Such changes shall equal the baseline levels of
				new budget authority and outlays using up-to-date concepts and definitions
				minus those levels using the concepts and definitions in effect before such
				changes. Such changes may only be made after consultation with the Committees
				on Appropriations and the Budget of the House of Representatives and the Senate
				and that consultation shall include written communication to such committees
				that affords such committees the opportunity to comment before official action
				is taken for such changes.</text>
						</paragraph><paragraph id="H1E12B0F361F645F6A845C50F6EBFDD7C"><enum>(2)</enum><header>Adjustments</header>
							<subparagraph id="H2CD5F63364DE4643913AC265E0B8608A"><enum>(A)</enum><header>Emergency
				designation</header><text display-inline="yes-display-inline">If appropriations
				for discretionary accounts are enacted that the President designates as
				emergency requirements and that the Congress so designates in statute, the
				adjustment shall be the total of such appropriations in discretionary accounts
				designated as emergency requirements and the outlays flowing in all fiscal
				years from such appropriations.</text>
							</subparagraph><subparagraph id="HBE3E508FA9EB44C2883FF6D5FA7E3CC1"><enum>(B)</enum><header>Overseas
				contingency operations designation</header><text display-inline="yes-display-inline">If appropriations for discretionary
				accounts are enacted that the President designates as overseas contingency
				operations related to the global war on terrorism, including Iraq and
				Afghanistan, that the Congress so designates in statute, the adjustment shall
				be the total of such appropriations in discretionary accounts designated as
				overseas contingency operations and the outlays flowing in all fiscal years
				from such appropriations.</text>
							</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H9E90388D479A429596607992E10B7385"><enum>(3)</enum><header>Special outlay
				allowance</header><text display-inline="yes-display-inline">If, in any fiscal
				year, outlays for a category exceed the discretionary spending limit for that
				category but new budget authority does not exceed its limit for that category
				(after application of the first step of a spending reduction described in
				subsection (a)(2), if necessary), the adjustment in outlays for a fiscal year
				is the amount of the excess but not to exceed 0.5 percent of the sum of the
				adjusted discretionary spending limits on outlays for that fiscal
				year.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H09D6245903294632970E866D9BFCF84D"><enum>104.</enum><header>Low-growth
			 report</header><text display-inline="no-display-inline">Section 254(i) of the
			 Balanced Budget and Emergency Deficit Control Act is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="H151F53BCCBB4469CB5885CC63877408A" style="OLC">
					<subsection id="HCC379DB921D1498EBAD6CBD53B0A2382"><enum>(i)</enum><header>Low-Growth
				report</header>
						<paragraph id="H19ECEE95206F406E929493B3EA38D22E"><enum>(1)</enum><header>In
				general</header><text>At any time, OMB, in consultation with the Secretary of
				Commerce, shall notify the Congress if—</text>
							<subparagraph id="HFB21D1008CF849419D780AF38FBC3B95"><enum>(A)</enum><text>during the period
				consisting of the quarter during which such notification is given, the quarter
				preceding such notification, the 4 quarters following such notification, OMB
				has determined that real economic growth is projected or estimated to be less
				than 1 percent with respect to each of any 2 consecutive quarters within such
				period; or</text>
							</subparagraph><subparagraph id="H29CBBAFC86A54EAD8B1207216EEEC229"><enum>(B)</enum><text>the most recent of
				the Department of Commerce's advance preliminary or final reports of actual
				real economic growth indicate that the rate of real economic growth for the
				following four quarters is projected or estimated to be less than 1 percent
				with respect to each of any two consecutive quarters.</text>
							</subparagraph></paragraph><paragraph id="HF22C21D25BEC4A0187475133CDBE4B38"><enum>(2)</enum><header>Suspension</header><text>Sequestration
				under sections 251 and 253A shall be suspended in any fiscal year in which
				there occur 2 quarters of low growth as described in subparagraphs (A) or (B)
				of paragraph
				(1).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H309A9465F2244E4EBFCB7F4EE632C0D7"><enum>105.</enum><header>Conforming
			 amendments</header><text display-inline="no-display-inline">Section 275(b) of
			 the Balanced Budget and Emergency Deficit Control Act of 1985 is amended by
			 striking <quote>2002</quote> and inserting <quote>2019</quote> and by striking
			 <quote>2006</quote> and inserting <quote>2019</quote>.</text>
			</section></title><title id="H0A561784CD0E4A959447268F205ACD0B"><enum>II</enum><header>Deficit
			 Limits</header>
			<section id="H90BC9949CE6A4D1B8AC0612DEFEDF023"><enum>201.</enum><header>Deficit
			 limits</header><text display-inline="no-display-inline">The Balanced Budget and
			 Emergency Deficit Control Act of 1985 is amended by inserting after section 253
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H3E204C2C67314BF7A89BDEEEC3F2FD53" style="OLC">
					<section id="H0126D9CDCCB2497FA1EA898494F3ED27"><enum>253A.</enum><header>Enforcing
				deficit limits</header>
						<subsection id="HF5CC701E56404F91A2C2BC81B04EAC9D"><enum>(a)</enum><header>Enforcing
				Deficit Limits</header><text display-inline="yes-display-inline">In this
				section, the term <term>deficit limit</term> means an amount, as estimated by
				OMB, that equals—</text>
							<paragraph id="HB47F40145CF34B57BA70A8320E24E920"><enum>(1)</enum><text>4 percent of GDP
				for fiscal year 2012; and</text>
							</paragraph><paragraph id="H1F2993121EE449728A44148B89445416"><enum>(2)</enum><text>3 percent of GDP
				for fiscal years 2013 through 2019.</text>
							</paragraph></subsection><subsection id="H898ADE12AABD4E88B0491ECC57E40DE4"><enum>(b)</enum><header>Determining the
				GDP</header><text>The Office of Management and Budget shall estimate the GDP at
				the outset of the fiscal year, on April 30, on August 20, and 15 days after the
				conclusion of the fiscal year. CBO shall provide advisory reports calculating
				the GDP at identical times.</text>
						</subsection><subsection id="HBDEF1C06434F418DBE8EC1CFDEE0399F"><enum>(c)</enum><header>Sequestration</header>
							<paragraph id="HE8CC13071A41410195CE6DA63AB13ACC"><enum>(1)</enum><header>In
				general</header>
								<subparagraph id="H030352246ABC43C6B23F2FC15AD88451"><enum>(A)</enum><header>Excess
				deficit</header><text>Not later than 45 calendar days after Congress adjourns,
				OMB shall conduct a sequestration to eliminate the excess deficit.</text>
								</subparagraph><subparagraph id="H329CC3C912A341AEA5387B763E7047AE"><enum>(B)</enum><header>Definition</header><text>For
				purposes of this subsection, the term <term>excess deficit</term> means the
				deficit for the preceding year minus the deficit limit as described in the
				subsection (a) and adjusted pursuant to paragraph (2).</text>
								</subparagraph></paragraph><paragraph id="H00B0C6EC0DAF4704996FEF9E3D8305C7"><enum>(2)</enum><header>Adjustments</header>
								<subparagraph id="H450C75296AE24FBBA2D7F16BFFEF150F"><enum>(A)</enum><header>Emergency
				designation</header><text display-inline="yes-display-inline">If direct
				spending or appropriations for discretionary accounts are enacted that the
				President designates as emergency requirements and that the Congress so
				designates in statute, the adjustment shall be the total of such direct
				spending or appropriations in discretionary accounts designated as emergency
				requirements and the outlays flowing in all fiscal years from such spending or
				appropriations.</text>
								</subparagraph><subparagraph id="HD08480FA9A974DC788B8FFFA4760C567"><enum>(B)</enum><header>Overseas
				contingency operations designation</header><text display-inline="yes-display-inline">If direct spending or appropriations for
				discretionary accounts are enacted that the President designates as overseas
				contingency operations related to the global war on terrorism, including Iraq
				and Afghanistan, that the Congress so designates in statute, the adjustment
				shall be the total of such direct spending or appropriations in discretionary
				accounts designated as overseas contingency operations and the outlays flowing
				in all fiscal years from such spending or appropriations.</text>
								</subparagraph></paragraph><paragraph id="H1BD17457D1EA459297125A16A22D8B69"><enum>(3)</enum><header>Preview
				report</header><text display-inline="yes-display-inline">CBO shall submit an
				advisory sequestration preview report as described in section 254(c)(4) on
				August 10 of each year. OMB shall produce an sequestration preview report on
				August 20 as described in section 254(c)(4). Fifteen days after Congress
				adjourns, the OMB shall issue an update sequestration report as described in
				section 254(e). Thirty days later, the OMB should issue its final sequestration
				report as described in section 254(f)(3). It shall be accompanied by a
				Presidential order detailing the uniform spending reductions. The reductions
				should generally follow the process set forth in section 253 and 254, except as
				provided in this section.</text>
							</paragraph><paragraph id="H1E346ABD14114C19AA18575FB54EB0AE"><enum>(4)</enum><header>Congressional
				action</header><text>If the August 20 OMB report projects a sequestration, the
				Senate and House Budget Committees may report a resolution directing their
				committees to change the existing law to achieve the goals outlined in the
				August 20 report. If the Committees report their respective resolutions, a
				reconciliation process shall be triggered in accordance with section
				258C.</text>
							</paragraph><paragraph id="H0BDC6593F9B64D9E8E8B4180D20A51D8"><enum>(5)</enum><header display-inline="yes-display-inline">Reducing nonexempt budgetary resources by a
				uniform percentage</header><text display-inline="yes-display-inline">OMB shall
				calculate the uniform percentage by which the budgetary resources of nonexempt
				direct and discretionary spending programs are to be sequestered such that the
				outlay savings resulting from that sequestration, as calculated under this
				subsection, to eliminate the excess deficit. If the uniform percentage
				calculated under the prior sentence exceeds 4 percent, the Medicare programs
				described in section 256(d) shall be reduced by 4 percent and the uniform
				percentage by which the budgetary resources of all other nonexempt direct and
				discretionary spending programs are to be sequestered shall be increased, as
				necessary, so that the sequestration of Medicare and of all other nonexempt
				direct and discretionary spending programs together produce the required outlay
				savings.</text>
							</paragraph></subsection><subsection id="H9ADB18A4C92E4BCCA4B96306C7B7E181"><enum>(d)</enum><header>Look
				back</header><text display-inline="yes-display-inline">If, after June 30, a
				bill resulting in outlays for the fiscal year in progress is enacted that
				causes an excess deficit, the excess deficit for the next fiscal year shall be
				increased by the amount or amounts of that
				breach.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HEBE593C48C8C4E678EDDCF15244040B5"><enum>202.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This title shall apply to
			 fiscal year 2012 and subsequent fiscal years through fiscal year 2019.</text>
			</section></title><title id="H38572958E5A848E58E99D1EC30799B13"><enum>III</enum><header>General
			 Provisions</header>
			<section commented="no" display-inline="no-display-inline" id="HDB0BE1655FB442FAB511FCBDA6A4F8B8" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Exempt programs and activities</header>
				<subsection commented="no" display-inline="no-display-inline" id="HF5EDF76118AE440799E63E7A90204931"><enum>(a)</enum><header display-inline="yes-display-inline">Designations</header><text display-inline="yes-display-inline">Section 255 of the Balanced Budget and
			 Emergency Deficit Control Act of 1985 is amended by redesignating subsection
			 (i) as (j) and striking <quote>1998</quote> and inserting in lieu thereof
			 <quote>2010</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H628487BA8694464E8F833C74224D751F"><enum>(b)</enum><header display-inline="yes-display-inline">Social security, veterans programs, net
			 interest, and tax credits</header><text display-inline="yes-display-inline">Subsections (a) through (d) of section 255
			 of the Balanced Budget and Emergency Deficit Control Act of 1985 are amended to
			 read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HF70084A9933B42DB9198D550C7462F2A" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="HCEA121F0C726464FB6D9CCF526E2FBC6"><enum>(a)</enum><header display-inline="yes-display-inline">Social security benefits and tier I
				railroad retirement benefits</header><text display-inline="yes-display-inline">Benefits payable under the old-age,
				survivors, and disability insurance program established under title II of the
				Social Security Act (42 U.S.C. 401 et seq.), and benefits payable under section
				231b(a), 231b(f)(2), 231c(a), and 231c(f) of title 45 United States Code, shall
				be exempt from reduction under any order issued under this part.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="H7D339B9CB2C644F295D7748E263F3230"><enum>(b)</enum><header display-inline="yes-display-inline">Veterans programs</header><text display-inline="yes-display-inline">The following program shall be exempt from
				reduction under any order issued under this part:</text>
							<list level="paragraph" list-type="none">
								<list-item>All programs administered by the Department of
				  Veterans Affairs.</list-item>
								<list-item>Special Benefits for Certain World War II Veterans
				  (28–0401–0–1–701).</list-item></list>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="H09F9255F45224D87AEDB104214B56A87"><enum>(c)</enum><header display-inline="yes-display-inline">Net interest</header><text display-inline="yes-display-inline">No reduction of payments for net interest
				(all of major functional category 900) shall be made under any order issued
				under this part.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="H42462B7C712F4D318B7AAA4360D79914"><enum>(d)</enum><header display-inline="yes-display-inline">Refundable income tax credits</header><text display-inline="yes-display-inline">Payments to individuals made pursuant to
				provisions of the Internal Revenue Code of 1986 establishing refundable tax
				credits shall be exempt from reduction under any order issued under this
				part.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H878660F2AD68458D8955C117F5437794"><enum>(c)</enum><header display-inline="yes-display-inline">Other programs and activities, low-Income
			 programs, and economic recovery programs</header><text display-inline="yes-display-inline">Subsections (g) and (h) of section 255 of
			 the Balanced Budget and Emergency Deficit Control Act of 1985 are amended to
			 read as follows:</text>

				activities shall be exempt from reduction under any order issued under this

										<list-item>Activities financed by voluntary payments to the
				  Government for goods or services to be provided for such

				  Islands Covenant grants (14–0412–0–1–808).</list-item>
										<list-item>Advances to the Unemployment Trust Fund and Other
				  Funds (16–0327–0–1–600).</list-item>

				  (16–0329–0–1–601).</list-item>
										<list-item>Bonneville Power Administration Fund and borrowing
				  authority established pursuant to section 13 of Public Law 93–454 (1974), as

			 of 1974 is amended by adding after section 315 the following new
			 section:</text>

							<subsection id="H0307EED2BEF64FE9ACB6AC059003E3B7"><enum>(a)</enum><header>Discretionary
				Spending Limits</header><text display-inline="yes-display-inline">It shall not
				be in order in the House of Representatives or the Senate to consider any bill,
				joint resolution, amendment, or conference report that includes any provision
				that would cause the discretionary spending limits as set forth in section
				251(c) of the Balanced Budget and Emergency Deficit Control Act of 1985 to be
				exceeded.</text>
							</subsection><subsection id="H18A32D1E56744A76AC6BB6950AC6C4E7"><enum>(b)</enum><header>Deficit
				limits</header><text>It shall not be in order in the House of Representatives
				or the Senate to consider any bill, joint resolution, amendment, or conference
				report that includes any provision that would cause the most recently reported,
				current deficit limits set forth in section 253A of the Balanced Budget and
				Emergency Deficit Control Act of 1985 to be exceeded.</text>
							</subsection><subsection id="HFF0F839EF31C42C2A4F1110DA56D7611"><enum>(c)</enum><header>Waiver or
				Suspension</header>
								<paragraph id="H379224ED29794826990128122307DB5B"><enum>(1)</enum><header>In the
				Senate</header><text>The provisions of this section may be waived or suspended
				in the Senate only by the affirmative vote of three-fifths of the Members, duly
				chosen and sworn.</text>
								</paragraph><paragraph id="H57E5E40F5A85406BA204C56542450E3B"><enum>(2)</enum><header>In the
				House</header><text>The provisions of this section may be waived or suspended
				in the House of Representatives only by a rule or order proposing only to waive
				such provisions by an affirmative vote of three-fifths of the Members, duly
				chosen and sworn.</text>
								</paragraph></subsection><subsection id="H15FDD37F2FB341E8A90BAF61A78461F5"><enum>(d)</enum><header>Point of Order
				Protection</header><text>In the House, it shall not be in order to consider a
				rule or order that waives the application of paragraph (2) of subsection
				(c).</text>

				Suspend</header><text>It shall not be in order for the Speaker to entertain a

				<term>spending reduction</term> refers to the cancellation of budgetary
				resources provided by discretionary appropriations or mandatory
				spending.</text>
					</paragraph><paragraph id="H38B6472CC3064E7E871E9118D38404B6"><enum>(20)</enum><text>The term
				<term>GDP</term>, for any fiscal year, means the gross domestic product during
				such fiscal year consistent with Department of Commerce definitions.</text>
					</paragraph><paragraph id="HFDFEC747751245EEBA9B783E2E29F081"><enum>(21)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H0107E926C87F4DBFB4AD9AAAB7A5C358"><enum>(A)</enum><text>The term <term>emergency
				requirement</term> means any provision that provides new budget authority and
				resulting outlays for a situation that poses a threat to life, property, or
				national security and is—</text>

				and not building up over time;</text>

				compelling need requiring immediate action;</text>
