		  Emergency Assistance Act to direct the President to take actions to address the
		  needs of children and families who are victims of a major disaster, and for

		<section id="HF1E7B526B6814D75BA91941487A22709" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Kids
			 Wish II Act</quote>.</text>
		</section><section id="HC9DA1FE39E85442883B683E6032178A4"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 102 of the Robert T. Stafford
			 Disaster Relief and Emergency Assistance Act (42 U.S.C. 5122) is amended—</text>
			<paragraph id="H8C6A9FC7ACD349B5B1C87E86ECDF1343"><enum>(1)</enum><text>in paragraph
			 (9)(C) by inserting <quote>child care,</quote> after
			 <quote>educational,</quote>;</text>
			</paragraph><paragraph id="HE1AC8BB2D34748159485805B0FD30B19"><enum>(2)</enum><text>in paragraph
			 (10)(A) by inserting <quote>child care,</quote> after
			 <quote>educational,</quote>; and</text>
			</paragraph><paragraph id="HC8A5A1BEFD1F40F98C611F92D27A0494"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H54E37301A2714F78912895FFA3A90574" style="OLC">
					<paragraph id="HFA4EA11089F345E28DF53E464B9CF3B1"><enum>(11)</enum><header>Children</header><text display-inline="yes-display-inline">The term <quote>children</quote> means
				individuals who are 18 years of age or younger.</text>
					</paragraph><paragraph id="H77E8ADEEAFC743289F38B4227C5B79C4"><enum>(12)</enum><header>Emergency child
				care</header><text>The term <quote>emergency child care</quote> means
				supervision, recreation, and other services offered by a State or local
				government (or a child care provider regulated by a State) for the purpose of
				providing nonparental care for children in the event of a major disaster or
				emergency.</text>

			</paragraph></section><section id="HBBBD5347ACC6411EBBD08E2B3DF529A8"><enum>3.</enum><header>Eligibility of
			 for-profit child care facilities for disaster assistance</header><text display-inline="no-display-inline">Title I of the Robert T. Stafford Disaster
			 Relief and Emergency Assistance Act (42 U.S.C. 5121 et seq.) is amended by
			 adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H53A295AF39F745A48867B15B217B64F9" style="OLC">
				<section id="H07A14B64758A4704B0E601C0D5FEF933"><enum>103.</enum><header>For-profit
				child care facilities</header><text display-inline="no-display-inline">Notwithstanding any other provision of this
				Act, a private for-profit child care facility shall be eligible for assistance
				under this Act to the same extent as a private nonprofit child care
				facility.</text>
				</section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HC87C41D85579426498A5388BE799ABAF"><enum>4.</enum><header>Disaster
			 planning</header><text display-inline="no-display-inline">Title III of the
			 Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5141
			 et seq.) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HA92067AD347647FFB687CA1327DA2FC5" style="OLC">
				<section id="HB1ADE48C1EE342498173AD8CCEB3D221"><enum>327.</enum><header>Disaster
				planning to address needs of children and families</header>
					<subsection id="H1A1E61A4272D4649B0B60E35FFF56E77"><enum>(a)</enum><header>State and local
				disaster planning</header>
						<paragraph id="H9A796FB56FBE46CEA659F10D73FAE981"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The President shall
				encourage States and localities to include consideration of services and
				facilities for children within all phases of their disaster planning, training,
				and exercises.</text>
						</paragraph><paragraph id="HE87E737C85354174A1934A74FECC8718"><enum>(2)</enum><header>Services and
				facilities for children defined</header><text>In this subsection, the term
				<quote>services and facilities for children</quote> includes—</text>
							<subparagraph id="H58E168B047224A2A96DE613C3B149704"><enum>(A)</enum><text>health and mental
				health services and facilities for children;</text>
							</subparagraph><subparagraph id="HE4C04C2DDC3D4D2CAE0CA73B4F95F1C0"><enum>(B)</enum><text>school services
				and facilities;</text>
							</subparagraph><subparagraph id="H282E74BA55C34D40A09AF9547EC64A94"><enum>(C)</enum><text>child care
				services and facilities;</text>
							</subparagraph><subparagraph id="HFC82F9C02CF348FF8B91DE65082F1A4C"><enum>(D)</enum><text>services and
				facilities associated with early education programs, including the Head Start
				program;</text>
							</subparagraph><subparagraph id="H2DDB9E4838C64C97AE09ECBA95F56AA1"><enum>(E)</enum><text>juvenile
				corrections, detention, and court services and facilities;</text>
							</subparagraph><subparagraph id="H43BD98D9783F41FC98C5DABED4829974"><enum>(F)</enum><text>child welfare
				services and facilities; and</text>
							</subparagraph><subparagraph id="H0F4F386FBDA245E9BAA0D1A39F79BA39"><enum>(G)</enum><text>residential care
				services and facilities for children, including residential treatment centers
				and group homes.</text>
							</subparagraph></paragraph></subsection><subsection id="HAE3BC2DC3D614B60B61A279411D0BF3A"><enum>(b)</enum><header>National
				disaster planning</header><text>The President shall take such actions as may be
				necessary to include the provision of services and facilities for children
				within national planning activities, including the National Response Framework
				and the National Disaster Recovery Framework.</text>
					</subsection><subsection id="H7BAFBAB8944C435C985C305F8AA28915"><enum>(c)</enum><header>Specific
				measurable capabilities of disaster plans</header><text display-inline="yes-display-inline">The President shall ensure, to the maximum
				extent practicable, that disaster plans for services and facilities for
				children, at a minimum, incorporate specific measurable capabilities for
				shelter-in-place, evacuation, relocation, family reunification, temporary
				operating standards, and accommodation of children with disabilities and
				chronic health needs and other special needs child populations.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HAC9283B9B78543E795079D74B644B9B9"><enum>5.</enum><header>Disaster
			 assistance for child care services and facilities</header>
			<subsection id="HBEACC32296EA451B8C65157A45234688"><enum>(a)</enum><header>Essential
			 assistance</header><text display-inline="yes-display-inline">Section 403(a)(3)
			 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42
			 U.S.C. 5170b(a)(3)) is amended—</text>
				<paragraph id="H57AE7939FA32427CBB4BDDB84B3E1ED9"><enum>(1)</enum><text>in subparagraph
			 (D) by inserting <quote>, child care,</quote> after
			 <quote>schools</quote>;</text>
				</paragraph><paragraph id="H8886EB3F9CA8477388D781C003DA799B"><enum>(2)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (I);</text>
				</paragraph><paragraph id="H661BBB445EEE48A2814681FF655418C6"><enum>(3)</enum><text>by striking the
			 period at the end of subparagraph (J) and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="H700C0AEE30CE4E1EB7DB9BC922A82B76"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H8F38DF630E78494B84CD41BD9FFCCBA4" style="OLC">
						<subparagraph id="H32C0BDC759394629A43EA6CFFFE78FD7"><enum>(K)</enum><text display-inline="yes-display-inline">provision of emergency child care and
				assistance to families for child placement in emergency child
				care.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HF7F6735D49ED431DB62BC0C012652ABA"><enum>(b)</enum><header>Repair,
			 restoration, and replacement of damaged facilities</header><text display-inline="yes-display-inline">Section
			 406(a)(3)(B) of such Act (42 U.S.C. 5172(a)(3)(B)) is amended by inserting
			 <quote>child care,</quote> after <quote>education,</quote>.</text>
			</subsection><subsection id="H80F769BFF98B4B49AA18E75DE6862171"><enum>(c)</enum><header>Federal
			 assistance to individuals and households</header><text>Section 408(e)(2) of
			 such Act (42 U.S.C. 5174(e)(2)) is amended—</text>
				<paragraph id="HF62765EC46684BEFB3F6023E17A9DCEA"><enum>(1)</enum><text>in the paragraph
			 heading by inserting <quote><header-in-text level="paragraph" style="OLC">child
			 care,</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">transportation,</header-in-text></quote>; and</text>
				</paragraph><paragraph id="H9F25EB0BC5214F17A8E7501F1CA48C25"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>child care,</quote>
			 after <quote>transportation,</quote>.</text>
				</paragraph></subsection></section><section id="H1ADCCD90B6824EFDB9470D1C4800FA0D"><enum>6.</enum><header>Case management
			 services</header><text display-inline="no-display-inline">Section 426 of the
			 Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C.
			 5189d) is amended—</text>
			<paragraph id="H54C9233E14324E019A7BF2FE1A7B035B"><enum>(1)</enum><text>by inserting
			 <quote>(a) <header-in-text level="subsection" style="OLC">In
			 general</header-in-text>.—</quote> before <quote>The President</quote>;
			 and</text>
			</paragraph><paragraph id="H8AC24B9829A04481B30A72803E7F914C"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC5174ACD80204E1CA6A57399CDF2CF3A" style="OLC">
					<subsection id="HB17D13E9FAB8471C8F7F8F5D022201E5"><enum>(b)</enum><header>Program
				requirements</header>
						<paragraph id="H9C7FA7D01C9F4A3CBC26B1BA960C1A2B"><enum>(1)</enum><header>Emphasis on
				children and families</header><text>In carrying out this section, the President
				shall establish a single Federal disaster case management program with an
				emphasis on achieving tangible, positive outcomes for all children and families
				who are victims of a major disaster.</text>
						</paragraph><paragraph id="HC7229C23998048418EB74574D6923FD8"><enum>(2)</enum><header>Components</header><text>The
				program shall—</text>
							<subparagraph id="H1E1D28D8BE134F55867338F3560EC24F"><enum>(A)</enum><text>adequately address
				the physical health, mental health, nutrition, education, housing,
				transportation, and other human services needs of children and families who are
				victims of a major disaster;</text>
							</subparagraph><subparagraph id="H89B286870FE143C088026532F83BFD27"><enum>(B)</enum><text>provide for the
				involvement of nonprofit agencies that provide disaster case management
				services;</text>
							</subparagraph><subparagraph id="H2D1279C6CAA24D81AD54B3D7B96D9926"><enum>(C)</enum><text>provide access to
				funding that supports all aspects of disaster case management, including direct
				services to survivors;</text>
							</subparagraph><subparagraph id="H40567D3937AA4DA1AF38247CD85BEFDA"><enum>(D)</enum><text>provide for a
				single point of contact for disaster assistance applicants who need a wide
				variety of services that may be provided by many different organizations;
				and</text>
							</subparagraph><subparagraph id="H5C1DD7E91C094422B311C4C569D4351C"><enum>(E)</enum><text>provide funding to
				support case manager
				training.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H11B1DCAF591847BDA82496FA1921BCEC"><enum>7.</enum><header>Assistance to
			 meet needs of children and families</header><text display-inline="no-display-inline">Title IV of the Robert T. Stafford Disaster
			 Relief and Emergency Assistance Act (42 U.S.C. 5170 et seq.) is amended—</text>
			<paragraph id="HC414039852D2451283998CEE2DD4E432"><enum>(1)</enum><text>by redesignating
			 the second section 425, relating to essential service providers, as section
			 427; and</text>
			</paragraph><paragraph id="HA139691990334A468E48C8456F7EBAD4"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H591D7C4D5DFE4C568C95ABDFE2D1B1F6" style="OLC">
					<section id="H10B86E4728B043AEBE6BF3C32C640DA4"><enum>428.</enum><header>Assistance to
				meet needs of children and families</header>
						<subsection id="H20C46175D11D4D80A9A2F27946B9491E"><enum>(a)</enum><header>Mass care
				shelters</header>
							<paragraph id="H42A8E9D87E5E4AC99C90DC78E8387448"><enum>(1)</enum><header>In
				general</header><text>The President may provide mass care shelters for victims
				of major disasters. Such shelters shall provide a safe and secure mass care
				shelter environment for children, including appropriate access to essential
				services and supplies.</text>
							</paragraph><paragraph id="H98EF346B8E7E4FB69414E9CE48AE1C36"><enum>(2)</enum><header>Standards</header><text>In
				carrying out this subsection, the President shall—</text>
								<subparagraph id="H861DAFEC9AF14BBEA05A7CB2916C0CEF"><enum>(A)</enum><text>develop and
				implement national standards and indicators for mass care shelters that are
				specific and responsive to children;</text>
								</subparagraph><subparagraph id="HA6AB97CD65A84F478FE1D4311C4D5EE4"><enum>(B)</enum><text>develop a list of
				essential age-appropriate shelter supplies for infants and children and fund
				the addition of child-specific supplies to caches for immediate deployment to
				support shelter operations;</text>
								</subparagraph><subparagraph id="HFA205512D4E54BE59E771A031D78C7A5"><enum>(C)</enum><text>ensure the
				implementation of standards and training to mitigate risks unique to children
				in shelters, including child abduction and sex offenders; and</text>
								</subparagraph><subparagraph id="H2F03B14A2CF84937B7DBED14FEA79D2E"><enum>(D)</enum><text>ensure all shelter
				operators have access to a fast, accurate, and low-cost system for conducting
				national fingerprint-based criminal history background checks for shelter
				workers and volunteers.</text>
								</subparagraph></paragraph></subsection><subsection id="H5ECB340B1D4D4A6FA47C5F744AFB801E"><enum>(b)</enum><header>Housing</header><text display-inline="yes-display-inline">The President—</text>
							<paragraph id="HFEEF723A1AFE4A329A00AF4626F8E4CF"><enum>(1)</enum><text>shall give
				priority to families with children in providing disaster housing assistance
				under this title; and</text>
							</paragraph><paragraph id="H6E06BE7C9A3B41FD98A35C2E17C07324"><enum>(2)</enum><text>may provide
				financial and other assistance for individuals and families who are victims of
				a major disaster to ensure an expedited transition into permanent housing,
				especially for families with children who have disabilities or other special
				health, mental health, or educational needs.</text>
							</paragraph></subsection><subsection id="H0F815B9C9EA2437ABB72F7605071428A"><enum>(c)</enum><header>Evacuation</header><text display-inline="yes-display-inline">The President, in coordination with the
				heads of other appropriate Federal agencies, shall develop a standardized,
				interoperable national evacuee tracking and family reunification system that
				ensures the safety and well-being of
				children.</text>
						</subsection></section><after-quoted-block>.
				</after-quoted-block></quoted-block>
			</paragraph></section><section id="H1035AE99191F4A7C8E4F7655A41F5401"><enum>8.</enum><header>Disaster related
			 information services</header><text display-inline="no-display-inline">Section
			 616(a)(2)(B) of the Robert T. Stafford Disaster Relief and Emergency Assistance
			 Act (42 U.S.C. 5196f(a)(2)(B)) is amended by inserting <quote>children
			 and</quote> before <quote>individuals with disabilities</quote>.</text>
