		<official-title>To amend section 1502 of title 5, United States Code, to
		  permit law enforcement officers to be candidates for sheriff, and for other

		<section id="H153EE097CA0140B7B5EC778780D4EB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>State and Local Law Enforcement Hatch Act Reform Act of
			 2010</short-title></quote>.</text>
		</section><section id="HE116533BB0D74A25A3B4E747508E4DEA"><enum>2.</enum><header>Hatch Act
			 Reform</header>
			<subsection id="H7173915C90724D3EAA39AFB324A5E7F0"><enum>(a)</enum><header>Permitting law
			 enforcement officers To be candidates for sheriff</header><text display-inline="yes-display-inline">Section 1502(c) of title 5, United States
			 Code, is amended—</text>
				<paragraph id="HF49C67EF063D4F1380B24277A13242F3"><enum>(1)</enum><text>in paragraph (3),
			 by striking <quote>or</quote> after the semicolon;</text>
				</paragraph><paragraph id="H6E811E4B9C0444EEA2BDF844AE3E421"><enum>(2)</enum><text>in
			 paragraph (4), by striking the period and inserting <quote>; or</quote>;
			 and</text>
				</paragraph><paragraph id="HD7FCDBBAEEDF46E5B8D878AFD232CDD3"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H8BE45AB8688E49408D944EB25B837093" style="USC">
						<paragraph id="H9AAA704A4C25438E9F80F79ECA7E86E"><enum>(5)</enum><text display-inline="yes-display-inline">a law enforcement officer who is a
				candidate for
				sheriff.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HACEE6236D8554B0794317C831D1E43D1"><enum>(b)</enum><header>Political
			 activities</header><text>Section 1502 of title 5, United States Code, is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H99B0DB5EA7CD4B15A6BDEE11C2106FF5" style="USC">
					<subsection id="H9394EDCC1B9347EC008B785C0059EEED"><enum>(d)</enum><text display-inline="yes-display-inline">Subsection (a)(1) of this section does not
				prohibit a sheriff from participating in political campaigns for, or endorsing,
				political candidates running for elective office by—</text>
						<paragraph id="H06F44B6C5C4D41CB8DF57500C40809F"><enum>(1)</enum><text>attending or
				speaking at political campaign rallies or events;</text>
						</paragraph><paragraph id="H4F337C73445D4854A997DA4F10C2B813"><enum>(2)</enum><text>holding or
				sponsoring political fundraisers; or</text>
						</paragraph><paragraph id="HEA08071CEB88459093990615346C5DD6"><enum>(3)</enum><text>appearing on
				political advertisements, including print, radio, television, or any other form
				of
				advertising.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H96DAAA21A9CB43148B9CC491ABFFB9B"><enum>(c)</enum><header>Amendment to
			 definitions</header><text display-inline="yes-display-inline">Section 1501 of
			 title 5, United States Code, is amended—</text>
				<paragraph id="H30E9216BF4B74E3CADA33D7445F5A67"><enum>(1)</enum><text>in
			 paragraph (3), by striking <quote>and</quote> after the semicolon;</text>
				</paragraph><paragraph id="H41965EAAF92B41A59E34CEA907EB8C62"><enum>(2)</enum><text>in paragraph (4),
			 by striking the period and inserting a semicolon; and</text>
				</paragraph><paragraph id="H1FCA5885552A490FB4F8CE4BC0CAD415"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H6D3192635AFB4820BAF2D066800D313" style="OLC">
						<paragraph id="H08AA6226E2944A4F9591DEF5736EB35"><enum>(5)</enum><text display-inline="yes-display-inline"><quote>law enforcement officer</quote>
				means a State or local officer or employee whose duties are primarily the
				investigation, apprehension, or detention of individuals suspected or convicted
				of offenses against the criminal laws of a State or local jurisdiction,
				including an officer or employee engaged in this activity who is transferred to
				a supervisory or administrative position; and</text>
						</paragraph><paragraph id="H1AA53EA6770E40B1A4A174C69C5F56EF"><enum>(6)</enum><text><quote>sheriff</quote>
				means an individual who holds an elected office and is the chief law
				enforcement officer of a county, town, township, parish, village, or other
				general purpose political subdivision of a
				State.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="HEA047D84E0B8491DA7995EBCB77C5DA"><enum>3.</enum><header>Statute of
			 limitations</header><text display-inline="no-display-inline">Section 1504 of
			 title 5, United States Code, is amended—</text>
			<paragraph id="HB73EDC56924349519C372F472BEB3000"><enum>(1)</enum><text>by inserting
			 <quote>(a) <header-in-text level="subsection" style="OLC">In
			 general.—</header-in-text></quote> before <quote>When</quote>; and</text>
			</paragraph><paragraph id="HB6C7E620472443F5A583335C8CB8EC5B"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="HD17AF1EDE7694D0499AA003478CA50CD" style="OLC">
					<subsection id="HA3C5968244B841C9A57B1204D5000669"><enum>(b)</enum><header>Statute of
				limitations for law enforcement officers</header><text>With respect to
				paragraphs (1) and (3) of section 1502(a), the Special Counsel may not present
				any charges against a law enforcement officer under subsection (a) after the
				end of the 6-month period beginning on the later of—</text>
						<paragraph id="HAE6AE5D5E6B64F33BECB00D03C56626E"><enum>(1)</enum><text display-inline="yes-display-inline">the date of the alleged violation of
				paragraph (1) or (3) of section 1502(a), as the case may be; or</text>
						</paragraph><paragraph id="H788AE99ACB7E4212A42698C1A4946109"><enum>(2)</enum><text>the date of the
				enactment of the State and Local Law Enforcement Hatch Act Reform Act of
				2010.</text>
