		<legis-type>A BILL</legis-type>
		<official-title>To amend title 38, United States Code, to direct the
		  Secretary of Veterans Affairs to take into account each child a veteran has
		  when determining the veteran’s financial status when receiving hospital care or
		  medical services.</official-title>

		<section id="H0677B9865A634C26AD199058F3B7616B" section-type="section-one"><enum>1.</enum><header>Determination of attributable
			 income for veterans with children</header><text display-inline="no-display-inline">Section 1722(f)(1) of title 38, United
			 States Code, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="HBBB371F274D94B4D9B4C64E2A99ACD38" style="OLC">
				<paragraph id="HF493E8C6FEFF4B75B577A92F7FF2D81A"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>attributable income</term>
				means the income of a veteran for the previous year determined in the same
				manner as the manner in which a determination is made of the total amount of
				income by which the rate of pension for such veteran under section 1521 of this
				title would be reduced if such veteran were eligible for pension under that
				section, except that in determining such income, the Secretary shall treat as a
				child an unmarried person who—</text>
					<subparagraph id="H895CEF373DF041C4ACDBCF6452A693AA"><enum>(A)</enum><text>is placed in the
				legal custody of the veteran as a result of an order of a court of competent
				jurisdiction in the United States (or possession of the United States) for a
				period of at least 12 consecutive months;</text>
					</subparagraph><subparagraph id="HE7EC348E1A424079A18A4C1E61ADA034"><enum>(B)</enum><text>either—</text>
						<clause id="HC230B15E78414096941862FCC17B70A8"><enum>(i)</enum><text display-inline="yes-display-inline">has not attained the age of 21;</text>
						</clause><clause id="HC4E95A11445E40508EB05158164D36B4"><enum>(ii)</enum><text display-inline="yes-display-inline">has not attained the age of 23 and is
				enrolled in a full time course of study at an institution of higher learning
				approved by the Secretary; or</text>
						</clause><clause id="H9BDCF62DF6EB4B2E9441310AE2C40A1F"><enum>(iii)</enum><text display-inline="yes-display-inline">is incapable of self support because of a
				mental or physical incapacity that occurred while the person was considered a
				child of the veteran under this subparagraph pursuant to subclause (i) or
				(ii);</text>
						</clause></subparagraph><subparagraph id="H5D52A37EBD9642E19DB8EEA1BAE8313D"><enum>(C)</enum><text display-inline="yes-display-inline">is dependent on the veteran for over
				one-half of the person’s support; and</text>
					</subparagraph><subparagraph id="HAB3ED4EBE8B94C7B98662D0C9D7D54DD"><enum>(D)</enum><text display-inline="yes-display-inline">resides with the veteran unless separated
				to receive institutional care as a result of disability or incapacitation or
				under such other circumstances as the Secretary may by regulation
				prescribe.</text>
