			 participation in 340B program</header>
			<subsection id="id3AF6DFE2B5444D5EBA2B277030DD4539"><enum>(a)</enum><header>Expansion of
			 Covered Entities Receiving Discounted Prices</header><text>Section 340B(a)(4)
			 of the Public Health Service Act (42 U.S.C. 256b(a)(4)) is amended by adding at
			 the end the following new subparagraphs:</text>
				<quoted-block display-inline="no-display-inline" id="id6E1A639A325D47ACB5B72F40E0A149E8" style="OLC">
					<subparagraph id="idF3CF5343F56748B9B146ABC315B0D67F"><enum>(M)</enum><text>A children’s
				hospital excluded from the Medicare prospective payment system pursuant to
				section 1886(d)(1)(B)(iii) of the <act-name parsable-cite="SSA">Social Security
				Act</act-name> (42 U.S.C. 1395ww(d)(1)(B)(iii)) which would meet the
				requirements of subsection (a)(4)(L), including the disproportionate share
				adjustment percentage requirement under clause (ii), if the hospital were a
				subsection (d) hospital as defined by Section 1886(d)(1)(B) of the
				<act-name parsable-cite="SSA">Social Security Act</act-name>.</text>
					</subparagraph><subparagraph id="idFDFF11902CAF4AB3A923E858A6873D14"><enum>(N)</enum><text>An entity that is
				a critical access hospital (as determined under section 1820(c)(2) of the
				<act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
				1395i–4(c)(2)).</text>
					</subparagraph><subparagraph id="id3D8845F73D9B4AC4AD63612364D22B26"><enum>(O)</enum><text>An entity
				receiving funds under title V of the <act-name parsable-cite="SSA">Social
				Security Act</act-name> (relating to maternal and child health) for the
				provision of health services.</text>
					</subparagraph><subparagraph id="idA56DCD23492E48E6A0405DDEB6217012"><enum>(P)</enum><text>An entity
				receiving funds under subpart I of part B of title XIX of the
				<act-name parsable-cite="PHSA">Public Health Service Act</act-name> (relating
				to comprehensive mental health services) for the provision of community mental
				health services.</text>
					</subparagraph><subparagraph id="id64003EA8D693447F839C04379F89ECC5"><enum>(Q)</enum><text>An entity
				receiving funds under subpart II of such part B (relating to the prevention and
				treatment of substance abuse) for the provision of treatment services for
				substance abuse.</text>
					</subparagraph><subparagraph id="idC48AFF1A319B46CFAA3183FF5AF5ACDE"><enum>(R)</enum><text>An entity that is
				a Medicare-dependent, small rural hospital (as defined in section
				1886(d)(5)(G)(iv) of the <act-name parsable-cite="SSA">Social Security
				Act</act-name>).</text>
					</subparagraph><subparagraph id="idF458646C471B4191BF3767B86B273899"><enum>(S)</enum><text>An entity that is
				a sole community hospital (as defined in section 1886(d)(5)(D)(iii) of the
				<act-name parsable-cite="SSA">Social Security Act</act-name>).</text>
					</subparagraph><subparagraph id="idDF3E35A19EAE42A5A6C15B3A2DAD4A23"><enum>(T)</enum><text>An entity that is
				classified as a rural referral center under section 1886(d)(5)(C) of the
				<act-name parsable-cite="SSA">Social Security
				Act</act-name>.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id8D6723B850DD4A52AAE3E96E450A42DE"><enum>(b)</enum><header>Prohibition on
			 Group Purchasing Arrangements</header><text>Section 340B(a) of such Act (42
			 U.S.C. 256b(a)) is amended—</text>
				<paragraph id="id22E5BB7FBB264BF88712992F83D1CD1A"><enum>(1)</enum><text>in paragraph
			 (4)(L)—</text>
					<subparagraph id="id1B4ED267AB384A6CB2DBF4F2F340FE09"><enum>(A)</enum><text>by adding
			 <quote>and</quote> at the end of clause (i);</text>
					</subparagraph><subparagraph id="id2405309EF5364F6086DC2CCD83B4E974"><enum>(B)</enum><text>by striking
			 <quote>; and</quote> at the end of clause (ii) and inserting a period;
			 and</text>
					</subparagraph><subparagraph id="idFCDA9BB7DCF244F2B54B092F44B44E36"><enum>(C)</enum><text>by striking
			 clause (iii);</text>
					</subparagraph></paragraph><paragraph id="idD1760DF2D8784FE29108AA854D7B7A2F"><enum>(2)</enum><text>in subsection
			 (a)(5), by redesignating the subparagraphs (C) and (D) as subparagraphs (D) and
			 (E), respectively, and by inserting after subparagraph (B) the following new
			 subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="idD22EC854CD944FC38151EAED79598674" style="OLC">
						<subparagraph id="id9001EFF4B6E04DD5B990799F19EE98F7"><enum>(C)</enum><header>Prohibiting use
				of group purchasing arrangements</header>
							<clause id="id5D8409870FB14AD3ABEC3A5C02D0F2B9"><enum>(i)</enum><text>A
				hospital described in subparagraph (L), (M), (N), (R), (S), or (T) of
				subsection (a)(4) shall not obtain covered outpatient drugs through a group
				purchasing organization or other group purchasing arrangement, except as
				permitted or provided pursuant to clause (ii) or (iii).</text>
							</clause><clause id="id307DCBC5F9774F37B4F78BFE11145132"><enum>(ii)</enum><text>Clause (i) shall
				not apply to drugs purchased for inpatient use.</text>
							</clause><clause id="idA5EED765A0CD4909B6A40BC26E14659A"><enum>(iii)</enum><text>The Secretary
				shall establish reasonable exceptions to the requirement of clause (i)—</text>
								<subclause id="id839A88B2BCC542218B4A52058B98ED02"><enum>(I)</enum><text>with respect to a
				covered outpatient drug that is unavailable to be purchased through the program
				under this section due to a drug shortage problem, manufacturer noncompliance,
				or any other reason beyond the hospital’s control;</text>
								</subclause><subclause id="id3A36ACA4D9AE46599A4143719619E17A"><enum>(II)</enum><text>to facilitate
				generic substitution when a generic covered outpatient drug is available at a
				lower price; and</text>
								</subclause><subclause id="idF4A146E13DE14FD7B0F9850D362BD6B1"><enum>(III)</enum><text>to reduce in
				other ways the administrative burdens of managing both inventories of drugs
				obtained under this section and not under this section, if such exception does
				not create a duplicate discount problem in violation of subparagraph (A) or a
				diversion problem in violation of subparagraph
				(B).</text>
								</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="id7F41A1CDA4524B458ED0DABAD24434E5"><enum>3.</enum><header>Extension of
			 discounts to inpatient drugs</header>
			<subsection id="idB32DF5FFA4274B29BD250127ADA15381"><enum>(a)</enum><header>In
			 General</header><text>Section 340B of the <act-name parsable-cite="PHSA">Public
			 Health Service Act</act-name> (42 U.S.C. 256b) is amended—</text>
				<paragraph id="id5304E8711F5C4036ACDDA2801657F762"><enum>(1)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="id41A3A6F53B114B9B8A95A3C145F7062B"><enum>(A)</enum><text>by designating
			 the matter beginning <quote>In this section </quote> as a paragraph (1) with
			 the heading <quote><header-in-text level="paragraph" style="OLC">In
			 general</header-in-text></quote>; and</text>
					</subparagraph><subparagraph id="id5761E4DE42C34417B023DF35BC49E9E8"><enum>(B)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="id749DDBB344FE44B58F7D791397AF02E4" style="OLC">
							<paragraph id="idBDEB24CF00DB4B6EBF4215D7DCC5AF0B"><enum>(2)</enum><header>Covered
				drug</header><text>In this section, the term <term>covered drug</term>—</text>
								<subparagraph id="id4EA0BC346DEC4F8AA4C36E160CA72DD8"><enum>(A)</enum><text>means a covered
				outpatient drug (as defined in section 1927(k)(2) of the
				<act-name parsable-cite="SSA">Social Security Act</act-name>); and</text>
								</subparagraph><subparagraph id="id899BDB762FB94A81BDD72D02939871AC"><enum>(B)</enum><text>includes,
				notwithstanding the section 1927(k)(3)(A) of such Act, a drug used in
				connection with an inpatient or outpatient service provided by a hospital
				described in subparagraph (L), (M), (N), (R), (S), or (T) of subsection (a)(4)
				that is enrolled to participate in the drug discount program under this
				section.</text>
								</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="id5E2C419F4F4043FFB2B7ED44E90242A2"><enum>(2)</enum><text>in paragraphs
			 (5), (7), and (9) of subsection (a), by striking <quote>outpatient</quote> each
			 place it appears.</text>
				</paragraph></subsection><subsection id="idED18EB39D60648F99D0CB93CA168E266"><enum>(b)</enum><header>Medicaid
			 Credits on Inpatient Drugs</header><text>Subsection (c) of section 340B of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
			 256b(c)) is replaced as follows:</text>
				<quoted-block display-inline="no-display-inline" id="idE26DF7DF663F42A2940F1AE764CCD4A5" style="OLC">
					<subsection id="id64514411204146D5B0DEE220DDB17497"><enum>(c)</enum><header>Medicaid
				Credits on Inpatient Drugs</header>
						<paragraph id="idEEC394681C10425B9DB9C00613CDC9EF"><enum>(1)</enum><header>In
				general</header><text>For the cost reporting period covered by the most
				recently filed Medicare cost report under title XVIII of the
				<act-name parsable-cite="SSA">Social Security Act</act-name>, a hospital
				described in subparagraph (L), (M), (N), (R), (S), or (T) of subsection (a)(4)
				and enrolled to participate in the drug discount program under this section
				shall provide to each State under its plan under title XIX of such Act—</text>
							<subparagraph id="idDB5EA5E32EAB4C59B3DE94DA782DA894"><enum>(A)</enum><text>a credit on the
				estimated annual costs to such hospital of single source and innovator multiple
				source drugs provided to Medicaid recipients for inpatient use; and</text>
							</subparagraph><subparagraph id="idD50621D6FA4145009814CB4E4FA5F31B"><enum>(B)</enum><text>a credit on the
				estimated annual costs to such hospital of noninnovator multiple source drugs
				provided to Medicaid recipients for inpatient use.</text>
							</subparagraph></paragraph><paragraph id="id9CA298252AFF40879E9ED358DED483A7"><enum>(2)</enum><header>Amount of
				credits</header>
							<subparagraph id="id60BF9898733748A395D79C654206131D"><enum>(A)</enum><header>Single source
				and innovator multiple source drugs</header><text>For purposes of paragraph
				(1)(A)—</text>
								<clause id="idFFD0097A10CD4FA5AB2A6A5DED0D61AC"><enum>(i)</enum><text>the credit under
				such paragraph shall be equal to the product of—</text>
									<subclause id="id363BE482B556452EA7B5ECCFEDF227F7"><enum>(I)</enum><text>the annual value
				of single source and innovator multiple source drugs purchased under this
				section by the hospital based on the drugs’ average manufacturer price;</text>
									</subclause><subclause id="id92DE99D672984A07854D0B3E7AA3B834"><enum>(II)</enum><text>the estimated
				percentage of the hospital’s drug purchases attributable to Medicaid recipients
				for inpatient use; and</text>
									</subclause><subclause id="id3A043BED368F4FEBB473EA4BF05B7D82"><enum>(III)</enum><text>the minimum
				rebate percentage described in section 1927(c)(1)(B) of the
				<act-name parsable-cite="SSA">Social Security Act</act-name>;</text>
									</subclause></clause><clause id="id02829B0A2CBE42C0BA2E972D636C99F3"><enum>(ii)</enum><text>the reference in
				clause (i)(I) to the annual value of single source and innovator multiple
				source drugs purchased under this section by the hospital based on the drugs’
				average manufacturer price shall be equal to the sum of—</text>
									<subclause id="id8796E2D70BBE4DFE90C016A533063646"><enum>(I)</enum><text>the annual
				quantity of each single source and innovator multiple source drug purchased
				during the cost reporting period, multiplied by</text>
									</subclause><subclause id="id1F4A53C6867C46BF9617F3FA1FEDCF86"><enum>(II)</enum><text>the average
				manufacturer price for that drug;</text>
									</subclause></clause><clause id="id8FF2702A562D4D13A293DBFC0A54BAE8"><enum>(iii)</enum><text>the reference
				in clause (i)(II) to the estimated percentage of the hospital’s drug purchases
				attributable to Medicaid recipients for inpatient use; shall be equal
				to—</text>
									<subclause id="id4C72F6A8C01447ABA597B84F4E9B59E9"><enum>(I)</enum><text>the Medicaid
				inpatient drug charges as reported on the hospital’s most recently filed
				Medicare cost report, divided by</text>
									</subclause><subclause id="id9BFF3BFB0A214288BA0C773B512D2B91"><enum>(II)</enum><text>total drug
				charges reported on the cost report; and</text>
									</subclause></clause><clause id="id34BA23CF3B7344EE945939F19841B4B9"><enum>(iv)</enum><text>the terms
				<term>single source drug</term> and <term>innovator multiple source drug</term>
				have the meanings given such terms in section 1927(k)(7) of the
				<act-name parsable-cite="SSA">Social Security Act</act-name>.</text>
								</clause></subparagraph><subparagraph id="idEDFD3EBD8FA14921B04E62D18451BB80"><enum>(B)</enum><header>Noninnovator
				multiple source drugs</header><text>For purposes of subparagraph (1)(B)—</text>
								<clause id="id31AFA3E31F5847F190FA01F6EA1A952F"><enum>(i)</enum><text>the credit under
				such paragraph shall be equal to the product of—</text>
									<subclause id="idE8A9E9DF1FCC4016B6D8F65AB678E216"><enum>(I)</enum><text>the annual value
				of noninnovator multiple source drugs purchased under this section by the
				hospital based on the drugs’ average manufacturer price;</text>
									</subclause><subclause id="idA0CCAF43CAE049DF93026FC2A93C4E1F"><enum>(II)</enum><text>the estimated
				percentage of the hospital’s drug purchases attributable to Medicaid recipients
				for inpatient use; and</text>
									</subclause><subclause id="id67E2F42BE6FE4A5084EF4A1DC15BAEA6"><enum>(III)</enum><text>the applicable
				percentage as defined in section 1927(c)(3)(B) of the
				<act-name parsable-cite="SSA">Social Security Act</act-name>;</text>
									</subclause></clause><clause id="id1B2B1DB4C6694B82B550382A65F7E187"><enum>(ii)</enum><text>the reference in
				clause (i)(I) to the annual value of noninnovator multiple source drugs
				purchased under this section by the hospital based on the drugs’ average
				manufacturer price shall be equal to the sum of—</text>
									<subclause id="idA8F167EE126141F48A787CB43A06D394"><enum>(I)</enum><text>the annual
				quantity of each noninnovator multiple source drug purchased during the cost
				reporting period, multiplied by</text>
									</subclause><subclause id="idFFA6F87E74C6489C8663C902D4F8F970"><enum>(II)</enum><text>the average
				manufacturer price for that drug;</text>
									</subclause></clause><clause id="idC3E7ED360E0441B5BBA5EDC429E51985"><enum>(iii)</enum><text>the reference
				in clause (i)(II) to the estimated percentage of the hospital’s drug purchases
				attributable to Medicaid recipients for inpatient use shall be equal to—</text>
									<subclause id="idC273D7405DE94A1ABF65698258039FF0"><enum>(I)</enum><text>the Medicaid
				inpatient drug charges as reported on the hospital’s most recently filed
				Medicare cost report, divided by</text>
									</subclause><subclause id="idC47B1155496647BFAEC4F2DCC5BD588C"><enum>(II)</enum><text>total drug
				charges reported on the cost report; and</text>
									</subclause></clause><clause id="id742BA19AF2854601B17571E9E7BEFAD7"><enum>(iv)</enum><text>the term
				<term>noninnovator multiple source drug</term> has the meaning given such term
				in section 1927(k)(7) of the <act-name parsable-cite="SSA">Social Security
				Act</act-name>.</text>
								</clause></subparagraph></paragraph><paragraph id="id9E427C32C95E4FFDB392D4320F113AEB"><enum>(3)</enum><header>Calculation of
				credits</header>
							<subparagraph id="id0B49DA83924548ADB65F7B4F97DB05DF"><enum>(A)</enum><header>In
				general</header><text>Not later than 30 days after receiving the information
				specified in subparagraph (B), the State shall calculate the credits owed by
				the hospital under paragraph (1) and provide the hospital with both the amounts
				and an explanation of how it calculated the credits. In performing the
				calculations specified in paragraphs (2)(A)(ii) and (2)(B)(ii), the State shall
				use the average manufacturer price applicable to the calendar quarter in which
				the drug was purchased by the hospital.</text>
							</subparagraph><subparagraph id="id6CEC1C0F80494FC4B0DD358030F758A5"><enum>(B)</enum><header>Hospital
				provision of information</header><text>Not later than 30 days after the date of
				the filing of the hospital’s most recently filed Medicare cost report, the
				hospital shall provide the State with the information described in paragraphs
				(2)(A)(ii) and (2)(B)(ii). With respect to each drug purchased during the cost
				reporting period, the hospital shall provide the dosage form, strength, package
				size, date of purchase and the number of units purchased.</text>
							</subparagraph></paragraph><paragraph id="id976A5BF4E38B408B832B4371E95023B3"><enum>(4)</enum><header>Payment
				deadline</header><text>The credits provided by a hospital under paragraph (1)
				shall be paid within 60 days after receiving the information specified in
				paragraph (3)(A).</text>
						</paragraph><paragraph id="id787BBC04E6874634A14B56B2C2665A7B"><enum>(5)</enum><header>Opt
				out</header><text>A hospital shall not be required to provide the Medicaid
				credit required under paragraph (1) if—</text>
							<subparagraph id="idE2A77CA97E8E47D5850AC398EEE3FD95"><enum>(A)</enum><text>it can
				demonstrate to the State that it will lose reimbursement under the State plan
				resulting from the extension of discounts to inpatient drugs under subsection
				(b)(2) and that the loss of reimbursement will exceed the amount of the credit
				otherwise owed by the hospital; or</text>
							</subparagraph><subparagraph id="idFE498DCCB4C54F7A84D063CF1D60633E"><enum>(B)</enum><text>the hospital and
				State agree to an alternative arrangement.</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">Any
				dispute between the hospital and the State under this paragraph shall be
				adjudicated through the administrative dispute resolution process under this
				section.</continuation-text></paragraph><paragraph id="id883F7CB751A44D129215EB0A74A87118"><enum>(6)</enum><header>Offset against
				medical assistance</header><text>Amounts received by a State under this
				subsection in any quarter shall be considered to be a reduction in the amount
				expended under the State plan in the quarter for medical assistance for
				purposes of section 1903(a)(1) of the <act-name parsable-cite="SSA">Social
				Security
				Act</act-name>.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id2910A9CEBFAB4FC198B64CA43E137687"><enum>(c)</enum><header>Conforming
			 Amendments</header><text>Section 1927 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1396r–8), is
			 amended—</text>
				<paragraph id="id3A05F614745D4BEB8545DBC20F2F9435"><enum>(1)</enum><text>in subsection
			 (a)(5)(A), by striking <quote>covered outpatient drugs</quote> and inserting
			 <quote>covered drugs (as defined in section 340B(b)(2) of the
			 <act-name parsable-cite="PHSA">Public Health Service
			 Act</act-name>)</quote>;</text>
				</paragraph><paragraph id="idBE7775AAA307449D8DCEAA60C9766B9F"><enum>(2)</enum><text>by striking
			 subsection (a)(5)(D) in its entirety;</text>
				</paragraph><paragraph id="id23FF9E40834F4C4BBA9AB11830B7E99C"><enum>(3)</enum><text>in subsection
			 (c)(1)(C)(i), by redesignating subclauses (II) through (IV) as subclauses (III)
			 through (V), respectively and by inserting after subclause (I) the following
			 new subclause:</text>
					<quoted-block display-inline="no-display-inline" id="idD510A2FE101C4594A8AD77FD51E4C7C9" style="OLC">
						<subclause id="id8BAAA2AD31FC49BAB22F19D165C7D866"><enum>(II)</enum><text>any prices
				charged for a covered drug as defined in section 340B(b)(2) of the Public
				Health Service Act;</text>
						</subclause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idAB4F46E483854DF7B038CB9DF5544ACE"><enum>(4)</enum><text>in subsection
			 (k)(1)—</text>
					<subparagraph id="id5DCD046E3B074C499FA84E4B892A4FFA"><enum>(A)</enum><text>in subparagraph
			 (A), by striking <quote>subparagraph (B)</quote> and inserting
			 <quote>subparagraphs (B) and (D)</quote>; and</text>
					</subparagraph><subparagraph id="id97EEBCB72DF04A149E587F891BDE48BE"><enum>(B)</enum><text>by adding at the
			 end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="id51592F4E7B534DCDBDDD200638B66E52" style="OLC">
							<subparagraph id="id9395B48433C54EE89990F6EDF1301A61"><enum>(D)</enum><header>Calculation for
				covered drugs</header><text>With respect to a covered drug (as defined in
				section 340B(b)(2) of the <act-name parsable-cite="PHSA">Public Health Service
				Act</act-name>), the average manufacturer price shall be determined in
				accordance with subparagraph (A) except that, in the event a covered drug is
				not distributed to the retail pharmacy class of trade, it shall mean the
				average price paid to the manufacturer for the drug in the United States by
				wholesalers for drugs distributed to the acute care class of trade, after
				deducting customary prompt pay
				discounts.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection></section><section id="idCBDDB7D84C3B4D23A35775274B532EF9"><enum>4.</enum><header>Improvements to
			 340B program integrity</header>
			<subsection id="id26A5923F2F8843C2AD72A60EF6E12515"><enum>(a)</enum><header>Integrity
			 Improvements</header><text>Subsection (d) of section 340B of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
			 256b) is replaced as follows:</text>
				<quoted-block display-inline="no-display-inline" id="idC8064963E65840C99966932E28C80C0F" style="OLC">
					<subsection id="idC5FC59E16E2C45B392C0D76344783917"><enum>(d)</enum><header>Improvements in
				Program Integrity</header>
						<paragraph id="idB0E2BA645BE5434594AB028322F1635D"><enum>(1)</enum><header>Manufacturer
				compliance</header>
							<subparagraph id="id82D7693DDEB94E0F9DC4FECA9AE32F53"><enum>(A)</enum><header>In
				general</header><text>From amounts appropriated under paragraph (4), the
				Secretary shall provide for improvements in compliance by manufacturers with
				the requirements of this section in order to prevent overcharges and other
				violations of the discounted pricing requirements specified in this
				section.</text>
							</subparagraph><subparagraph id="idC27EFF685B5242BABEE0280C6C5B7097"><enum>(B)</enum><header>Improvements</header><text>The
				improvements described in subparagraph (A) shall include the following:</text>
								<clause id="id3BE236221F454A599DAFD5EB86DD8565"><enum>(i)</enum><text>The development
				of a system to enable the Secretary to verify the accuracy of ceiling prices
				calculated by manufacturers under subsection (a)(1) and charged to covered
				entities, which shall include the following:</text>
									<subclause id="id72A08DE8BAEE4F788F40486FF32A71C9"><enum>(I)</enum><text>Developing and
				publishing through an appropriate policy or regulatory issuance, precisely
				defined standards and methodology for the calculation of ceiling prices under
				such subsection.</text>
									</subclause><subclause id="id43CBED050AF94688AFC82C0ACF1B192C"><enum>(II)</enum><text>Comparing
				regularly the ceiling prices calculated by the Secretary with the quarterly
				pricing data that is reported by manufacturers to the Secretary.</text>
									</subclause><subclause id="idCCA76544F0CD442EA1D3194CF02021AF"><enum>(III)</enum><text>Performing spot
				checks of sales transactions by covered entities.</text>
									</subclause><subclause id="id803E8C02A5BF472AB10DFE945B52C6C8"><enum>(IV)</enum><text>Inquiring into
				the cause of any pricing discrepancies that may be identified and either
				taking, or requiring manufacturers to take, such corrective action as is
				appropriate in response to such price discrepancies.</text>
									</subclause></clause><clause id="id030A915B938345A9A2FB613D45E95C32"><enum>(ii)</enum><text>The
				establishment of procedures for manufacturers to issue refunds to covered
				entities in the event that there is an overcharge by the manufacturers,
				including the following:</text>
									<subclause id="idB3BB246F965F4E13BF801F17DAC5E8D6"><enum>(I)</enum><text>Providing the
				Secretary with an explanation of why and how the overcharge occurred, how the
				refunds will be calculated, and to whom the refunds will be issued.</text>
									</subclause><subclause id="idD28DC47795E646CD958674534452FC2B"><enum>(II)</enum><text>Oversight by the
				Secretary to ensure that the refunds are issued accurately and within a
				reasonable period of time, both in routine instances of retroactive adjustment
				to relevant pricing data and exceptional circumstances such as erroneous or
				intentional overcharging for covered drugs.</text>
									</subclause></clause><clause id="id100BDE82F24C4F06BA04C1FBABE10AB0"><enum>(iii)</enum><text>The provision
				of access through the Internet website of the Department of Health and Human
				Services to the applicable ceiling prices for covered drugs as calculated and
				verified by the Secretary in accordance with this section, in a manner (such as
				through the use of password protection) that limits such access to covered
				entities and adequately assures security and protection of privileged pricing
				data from unauthorized re-disclosure.</text>
								</clause><clause id="idD4818CA191554D03918A8BA49FA2E68D"><enum>(iv)</enum><text>The development
				of a mechanism by which—</text>
									<subclause id="id20AB9FBB92864CAAAF286FB400B5CE74"><enum>(I)</enum><text>rebates and other
				discounts provided by manufacturers to other purchasers subsequent to the sale
				of covered drugs to covered entities are reported to the Secretary; and</text>
									</subclause><subclause id="id9202829F1603479EA8880175EE4764BB"><enum>(II)</enum><text>appropriate
				credits and refunds are issued to covered entities if such discounts or rebates
				have the effect of lowering the applicable ceiling price for the relevant
				quarter for the drugs involved.</text>
									</subclause></clause><clause id="idA9E991BBB8D84EAEA6A76AF76AFFA8DB"><enum>(v)</enum><text>Selective
				auditing of manufacturers and wholesalers to ensure the integrity of the drug
				discount program under this section.</text>
								</clause><clause id="id8A6171F751C44F5F9BA4F868B7F095A8"><enum>(vi)</enum><text>The imposition
				of sanctions in the form of civil monetary penalties, which—</text>
									<subclause id="id92A70FBAB3594BCBADC944DED779E1EF"><enum>(I)</enum><text>shall be assessed
				according to standards established in regulations to be promulgated by the
				Secretary within 180 days of enactment of this subsection;</text>
									</subclause><subclause id="id52B1298ADF924198842EE54830386446"><enum>(II)</enum><text>shall not exceed
				$5,000 for each instance of overcharging a covered entity that may have
				occurred; and</text>
									</subclause><subclause id="id0FE43A9F2ABF4B6E954E866B8E995C92"><enum>(III)</enum><text>shall apply to
				any manufacturer with an agreement under this section that knowingly and
				intentionally charges a covered entity a price for purchase of a drug that
				exceeds the maximum applicable price under subsection (a)(1).</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="idAB07476D89C64ABDAD9F27EC2E800F5D"><enum>(2)</enum><header>Covered entity
				compliance</header>
							<subparagraph id="id0D1ADE954AC34047806E695D2FA7528E"><enum>(A)</enum><header>In
				general</header><text>From amounts appropriated under paragraph (4), the
				Secretary shall provide for improvements in compliance by covered entities with
				the requirements of this section in order to prevent diversion and violations
				of the duplicate discount provision and other requirements specified under
				subsection (a)(5).</text>
							</subparagraph><subparagraph id="idD54EEB75A35F4FE58941B932148283FB"><enum>(B)</enum><header>Improvements</header><text>The
				improvements described in subparagraph (A) shall include the following:</text>
								<clause id="id169118C9F09848BFA822AF7DDE9087B5"><enum>(i)</enum><text>The development
				of procedures to enable and require covered entities to regularly update (at
				least annually) the information on the Internet website of the Department of
				Health and Human Services relating to this section.</text>
								</clause><clause id="idB8E2D947CE814BD3AC15818E2EF01834"><enum>(ii)</enum><text>The development
				of a system for the Secretary to verify the accuracy of information regarding
				covered entities that is listed on the website described in clause (i).</text>
								</clause><clause id="idCA944CAE54674EE69B5A3EB5C3F46CD7"><enum>(iii)</enum><text>The development
				of more detailed guidance describing methodologies and options available to
				covered entities for billing covered drugs to State Medicaid agencies in a
				manner that avoids duplicate discounts pursuant to subsection (a)(5)(A).</text>
								</clause><clause id="idAC627059E8CA4D5B8B6B36CC65B97384"><enum>(iv)</enum><text>The
				establishment of a single, universal, and standardized identification system by
				which each covered entity site can be identified by manufacturers,
				distributors, covered entities, and the Secretary for purposes of facilitating
				the ordering, purchasing, and delivery of covered drugs under this section,
				including the processing of chargebacks for such drugs.</text>
								</clause><clause id="id0894653ABF99481886BF82B866AC8F1E"><enum>(v)</enum><text>The imposition of
				sanctions, in appropriate cases as determined by the Secretary, additional to
				those to which covered entities are subject under subparagraph (a)(5)(E),
				through one or more of the following actions:</text>
									<subclause id="id7B4DE8EF95CD43F18F2180BD6AC196D2"><enum>(I)</enum><text>Where a covered
				entity knowingly and intentionally violates subparagraph (a)(5)(B), the covered
				entity shall be required to pay a monetary penalty to a manufacturer or
				manufacturers in the form of interest on sums for which the covered entity is
				found liable under paragraph (a)(5)(E), such interest to be compounded monthly
				and equal to the current short term interest rate as determined by the Federal
				Reserve for the time period for which the covered entity is liable.</text>
									</subclause><subclause id="idAEC718B00E594AA5A39ECA16C9B61790"><enum>(II)</enum><text>Where the
				Secretary determines a violation of subparagraph (a)(5)(B) was systematic and
				egregious as well as knowing and intentional, removing the covered entity from
				the drug discount program under this section and disqualifying the entity from
				re-entry into such program for a reasonable period of time to be determined by
				the Secretary.</text>
									</subclause><subclause id="id729BA982AF4C4356BF2993F577B1135F"><enum>(III)</enum><text>Referring
				matters to appropriate Federal authorities within the Food and Drug
				Administration, the Office of Inspector General of Department of Health and
				Human Services, or other Federal agencies for consideration of appropriate
				action under other Federal statutes, such as the Prescription Drug Marketing
				Act (21 U.S.C. 353).</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="idE3F7B456ABD34619BAA621DE73D56E9A"><enum>(3)</enum><header>Administrative
				dispute resolution process</header>
							<subparagraph id="id4622B5F9248B40A4B10E56944E835FDB"><enum>(A)</enum><header>In
				general</header><text>Not later than 180 days after the date of enactment of
				this subsection, the Secretary shall promulgate regulations to establish and
				implement an administrative process for the resolution of claims by covered
				entities that they have been overcharged for drugs purchased under this
				section, and claims by manufacturers, after the conduct of audits as authorized
				by subsection (a)(5)(D), of violations of subsections (a)(5)(A) or (a)(5)(B),
				including appropriate procedures for the provision of remedies and enforcement
				of determinations made pursuant to such process through mechanisms and
				sanctions described in paragraphs (1)(B) and (2)(B).</text>
							</subparagraph><subparagraph id="idCFBCD686AD7443D8BB5BC93925C1C81E"><enum>(B)</enum><header>Deadlines and
				procedures</header><text>Regulations promulgated by the Secretary under
				subparagraph (A) shall—</text>
								<clause id="idA784CAFFFB2D4F00A9673F3661734B11"><enum>(i)</enum><text>designate or
				establish a decisionmaking official or decisionmaking body within the
				Department of Health and Human Services to be responsible for reviewing and
				finally resolving claims by covered entities that they have been charged prices
				for covered drugs in excess of the ceiling price described in subsection
				(a)(1), and claims by manufacturers that violations of subsection (a)(5)(A) or
				(a)(5)(B) have occurred;</text>
								</clause><clause id="id381F9F3E0A41474EAA772A443A287842"><enum>(ii)</enum><text>establish such
				deadlines and procedures as may be necessary to ensure that claims shall be
				resolved fairly, efficiently, and expeditiously;</text>
								</clause><clause id="id9851E49036A247148438D9015C9D546C"><enum>(iii)</enum><text>establish
				procedures by which a covered entity may discover and obtain such information
				and documents from manufacturers and third parties as may be relevant to
				demonstrate the merits of a claim that charges for a manufacturer’s product
				have exceeded the applicable ceiling price under this section, and may submit
				such documents and information to the administrative official or body
				responsible for adjudicating such claim;</text>
								</clause><clause id="id7E733151BFA047BC9D8B527CF35532F1"><enum>(iv)</enum><text>require that a
				manufacturer must conduct an audit of a covered entity pursuant to subsection
				(a)(5)(D) as a prerequisite to initiating administrative dispute resolution
				proceedings against a covered entity;</text>
								</clause><clause id="id118485FE4A014D37868B3B3F8DA5AD04"><enum>(v)</enum><text>permit the
				official or body designated in clause (i), at the request of a manufacturer or
				manufacturers, to consolidate claims brought by more than one manufacturer
				against the same covered entity where, in the judgment of such official or
				body, consolidation is appropriate and consistent with the goals of fairness
				and economy of resources; and</text>
								</clause><clause id="idC6BEB7EDEAD94740B18F85ED4A0660BD"><enum>(vi)</enum><text>include
				provisions and procedures to permit multiple covered entities to jointly assert
				claims of overcharges by the same manufacturer for the same drug or drugs in
				one administrative proceeding, and permit such claims to be asserted on behalf
				of covered entities by associations or organizations representing the interests
				of such covered entities and of which the covered entities are members.</text>
								</clause></subparagraph><subparagraph id="idE4EEE24EBB3E474EB7FF7CA0B5CA3801"><enum>(C)</enum><header>Finality of
				administrative resolution</header><text>The administrative resolution of a
				claim or claims under the regulations promulgated under subparagraph (A) shall
				be a final agency decision and shall be binding upon the parties involved,
				unless invalidated by an order of a court of competent jurisdiction.</text>
							</subparagraph></paragraph><paragraph id="idD8281A6619724BBAA288D89B36174C10"><enum>(4)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated to
				carry out this subsection, such sums as may be necessary for fiscal year 2010
				and each succeeding fiscal
				year.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id836704461DD846BD84E70555177BE5FA"><enum>(b)</enum><header>Conforming
			 Amendments</header><text>Section 340B(a) of such Act (42 U.S.C. 256b(a)) is
			 amended—</text>
				<paragraph id="idA7E4223C84A94D45BA4B968BB08C61CA"><enum>(1)</enum><text>in subsection
			 (a)(1), by adding at the end the following: <quote>Each such agreement shall
			 require that the manufacturer furnish the Secretary with reports, on a
			 quarterly basis, of the price for each covered drug subject to the agreement
			 that, according to the manufacturer, represents the maximum price that covered
			 entities may permissibly be required to pay for the drug (referred to in this
			 section as the <quote>ceiling price</quote>), and shall require that the
			 manufacturer offer each covered entity covered drugs for purchase at or below
			 the applicable ceiling price if such drug is made available to any other
			 purchaser at any price.</quote>; and</text>
				</paragraph><paragraph id="id3154A6FE76A248779D209D684F3EC2B8"><enum>(2)</enum><text>in the first
			 sentence of subsection (a)(5)(E), as redesignated by section 2(b), by inserting
			 <quote>after audit as described in subparagraph (D) and </quote> after
			 <quote>finds,</quote>.</text>
				</paragraph></subsection></section><section id="id0A1452155A564DAD94747A451AA812C8"><enum>5.</enum><header>Other
			 improvements in 340B program</header><text display-inline="no-display-inline">Section 340B of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
			 256b), as amended by section 4(a), is further amended by adding at the end the
			 following new subsections:</text>
			<quoted-block display-inline="no-display-inline" id="idE976118EA0124DC4AB54D101A9FC1CD2" style="OLC">
				<subsection id="id74E2882F4B4342CDB8013AA9144BCF68"><enum>(f)</enum><header>Use of Multiple
				Contract Pharmacies Permitted</header><text>Nothing in this section shall be
				construed as prohibiting a covered entity from entering into contracts with
				more than one pharmacy for the provision of covered drugs, including such a
				contract that supplements the use of an in-house pharmacy arrangement or as
				requiring the approval of the Secretary for entering into such a
				contract.</text>
				</subsection><subsection id="idB467E3B5174642C786DE23DD3D5AC302"><enum>(g)</enum><header>Intra-Agency
				Coordination</header><text>The Secretary shall establish specific measures,
				policies, and procedures to ensure effective communication and coordination
				between the Centers for Medicare &amp; Medicaid Services and the Health
				Resources and Services Administration with respect to all agency actions and
				all aspects of policy and administration affecting or pertaining to the drug
				discount program under this section and in which the functions and
				responsibilities of those agency components are interrelated or interdependent,
				including by establishment of a permanent working group, composed of
				representatives of both the Health Resources and Services Administration and
				the Centers for Medicare &amp; Medicaid Services, to identify and oversee
				matters requiring such
				coordination.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id8A6380EF63A0413392E568D5652AC6C6"><enum>6.</enum><header>Effective
			 dates</header>
			<subsection id="id37C0AD51564546F7BC7D6B4E94A705D1"><enum>(a)</enum><header>In
			 general</header><text>The amendments made by this Act shall take effect on
			 January 1, 2010, and shall apply to drugs purchased on or after January 1,
			 2010.</text>
			</subsection><subsection id="id8C05F07B784147F28EEC53421AF8C5E6"><enum>(b)</enum><header>Effectiveness</header><text>The
			 amendments made by this Act shall be effective, and shall be taken into account
			 in determining whether a manufacturer is deemed to meet the requirements of
			 section 340B(a) of the <act-name parsable-cite="PHSA">Public Health Service
			 Act</act-name> (42 U.S.C. 256b(a)) and of section 1927(a)(5) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1396r–8(a)(5)), notwithstanding any other provision of law.</text>
