		<official-title>To prohibit the Federal Government from awarding
		  contracts or grants to, entering into other agreements with, providing any
		  other Federal funds to, or engaging in activities that promote, certain
		  organizations.</official-title>

	<legis-body id="H7BCFDE3B71B342769A12A1EE50A8F58C" style="OLC">
		<section id="H5A87B3C1209648E9A24E14C23EDB032A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Defund the Crooks
			 Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H79A36CC7F5DC43238E29B5F865B7D67C" section-type="subsequent-section"><enum>2.</enum><header>Prohibitions on
			 Federal funds and other activities with respect to certain
			 organizations</header>
			<subsection id="HAC98AE6516A143F0BDA3784B6A01E421"><enum>(a)</enum><header>Prohibitions</header><text display-inline="yes-display-inline">With respect to any covered organization,
			 the following prohibitions apply:</text>
				<paragraph id="HEAADE9F7856244E7993BBCA5514B7C08"><enum>(1)</enum><text>No Federal
			 contract, grant, cooperative agreement, or any other form of agreement,
			 including the execution of a contract option, the award of a task order, or a
			 memorandum of understanding, may be awarded to or entered into with the covered
			 organization.</text>
					<subparagraph id="H4C136A7D20B14CE3B044080A150CE2E2"><enum>(A)</enum><text>Except as provided
			 in subparagraph (B), no Federal funds in any form may be provided to the
			 covered organization.</text>
					</subparagraph><subparagraph id="HC01A94713C9846449B6D032AC856CBA7"><enum>(B)</enum><text>Subparagraph (A)
			 does not apply to Federal funds provided as payment for goods or services
			 provided to the Government before the date of the enactment of this Act.</text>
					</subparagraph></paragraph><paragraph id="H3AB8B5E14AE943668DAE1C67823F3118"><enum>(2)</enum><text display-inline="yes-display-inline">No Federal employee acting in the course
			 and scope of employment and no Federal contractor during the performance of the
			 contract, may promote the covered organization in any way, including
			 recommending the covered organization to any person or referring any person to
			 the covered organization for any purpose.</text>
				</paragraph></subsection><subsection id="H9F0D3C36DE904C6DB3A20728FF2822D6"><enum>(b)</enum><header>Termination of
			 certain contracts or grants</header><text display-inline="yes-display-inline">In the case of a contract or grant
			 awarded—</text>
				<paragraph id="H02C4D8D9E2D74FBD8B28229AC9A3FE5C"><enum>(1)</enum><text display-inline="yes-display-inline">before the date of the enactment of this
			 Act to a covered organization, if the contract period or the duration of the
			 contract or grant expires more than one year after such date, such contract or
			 grant shall be terminated not later than one year after the date of the
			 enactment of this Act; or</text>
				</paragraph><paragraph id="H81ACCBAAC7544801A677B45FB1E82D00"><enum>(2)</enum><text display-inline="yes-display-inline">after the date of the enactment of this Act
			 to an organization that becomes a covered organization after the award of the
			 contract or grant, such contract or grant shall be terminated
			 immediately.</text>
				</paragraph></subsection><subsection id="HCBE470B62F814B3BA28474F4E8A9F816"><enum>(c)</enum><header>Covered
			 organization defined</header><text display-inline="yes-display-inline">In this
			 section, the term <term>covered organization</term> means any of the
			 following:</text>
				<paragraph id="HEB07EBA0944C429EAFC90E1685E170B9"><enum>(1)</enum><text>An organization
			 that has been convicted of a violation of any Federal or State law.</text>
				</paragraph><paragraph commented="no" id="H52DF8E7003F041F58C2E185554CC7889"><enum>(2)</enum><text display-inline="yes-display-inline">An organization that had its corporate
			 charter revoked by a State or other issuing authority due to the failure of the
			 organization to comply with Federal or State laws.</text>
				</paragraph><paragraph commented="no" id="H93C7894C06EA47B89E4AC7F5104F657B"><enum>(3)</enum><text>An organization
			 that has filed, submitted, or transmitted a fraudulent claim with or to any
			 Federal or State agency authorized by law to promulgate regulations, including
			 the Department of Defense, the Department of Health and Human Services, and the
			 Department of Labor.</text>
				</paragraph><paragraph id="H8F19DB132E94496184527A72B968E6B4"><enum>(4)</enum><text display-inline="yes-display-inline">An organization that knowingly—</text>
					<subparagraph id="H530566BC419F45869755540566FC59EC"><enum>(A)</enum><text>employs an
			 individual who has been convicted of a violation of Federal or State
			 law;</text>
					</subparagraph><subparagraph id="HB2F33AA69FF1441CB178F614A730344A"><enum>(B)</enum><text>hires as a
			 contractor any such individual; or</text>
					</subparagraph><subparagraph id="H20133977A1CF456F94E4138F0731132D"><enum>(C)</enum><text>extends any
			 express, implied, or apparent authority to such an individual to act on behalf
			 of the organization.</text>
					</subparagraph></paragraph><paragraph id="H3D13546E040D4C969D771AC38384EE9E"><enum>(5)</enum><text>Any organization
			 that is the parent company of, subsidiary of, or subsidiary of the parent
			 company of, and any other company that owns 50 percent or more of, an
			 organization described in paragraphs (1), (2), (3), or (4).</text>
				</paragraph></subsection><subsection id="HB87B729BC7FD459FA890E6F0EFF0B45C"><enum>(d)</enum><header>Additional
			 definitions</header><text display-inline="yes-display-inline">In this
			 section:</text>
				<paragraph id="H8EECB722EAAE4F87A89C365430B41B4C"><enum>(1)</enum><text>The term
			 <term>fraudulent </term> includes, but is not limited to any activity that
			 would establish liability under either section 1001 of title 18, United States
			 Code, or section 3729 of title 31, United States Code.</text>
				</paragraph><paragraph id="H9D01DB1E2B6642EDA87EF60508D0A670"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>claim</term>—</text>
					<subparagraph id="H12E13C1C333B41A28FC6B89360EA68BC"><enum>(A)</enum><text>means any
			 communication, such as a statement, record, or form, that includes any
			 information required by law; and</text>
					</subparagraph><subparagraph id="H5123904E04054C99885F629AF9B72FB2"><enum>(B)</enum><text>includes—</text>
						<clause id="H5A737C8A7BE8470C8C6A2C02BDEE6E59"><enum>(i)</enum><text>the
			 term <term>claim</term> as such term is defined under section 3729(c) of title
			 31, United States Code, and as such term is used in section 287 of title 18,
			 United States Code; and</text>
						</clause><clause id="HB330DF9ACC6A464FB7AFE79FE0EB0CA1"><enum>(ii)</enum><text>the
			 term <term>representation</term> and the term <term>entry</term> as such terms
			 are used in section 1001 of title 18, United States Code.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="HC8D46DD5BE6A4E6DB6CB0488EF9C8DAF"><enum>(e)</enum><header>Revision of
			 Federal Acquisition Regulation</header><text>The Federal Acquisition Regulation
			 shall be revised to carry out the provisions of this Act relating to
			 contracts.</text>
