		<section id="H9A38808CCABF4BA991F85D7D8C6213A5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Minority Entrepreneurship and Business
			 Development Act</short-title></quote>.</text>
		</section><section id="HF96440008FDE440192DA335985D4C917"><enum>2.</enum><header>Minority
			 Entrepreneurship and Business Entreprise Center Grant Program</header>
			<subsection id="H1997C1E17AA74AD991DDDAD003C5E93C"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Director may make
			 grants to an eligible educational institution or an eligible association or
			 organization—</text>
				<paragraph id="HDB6D12E143AC45399AD92F6BB1315C22"><enum>(1)</enum><text>to assist in
			 establishing an entrepreneurship curriculum for studies; and</text>
				</paragraph><paragraph id="H57BBD558D2574C69931763BE4B48A326"><enum>(2)</enum><text>for placement of a
			 Minority Business Entreprise Center within the educational institution,
			 association, or organization.</text>
				</paragraph></subsection><subsection id="HFC6CF4006F0842E1A8D7CD66E445898D"><enum>(b)</enum><header>Use of
			 funds</header>
				<paragraph id="HDF0B6D51418E4FABA5D3D55F7B9FB962"><enum>(1)</enum><header>Curriculum and
			 capacity training requirement</header><text display-inline="yes-display-inline">An eligible educational institution,
			 association, or organization receiving a grant under this section shall develop
			 a curriculum and capacity training requirement that includes training in
			 various skill sets needed by successful entrepreneurs, including—</text>
					<subparagraph id="HBAF4D3FC6A30472E98E9C69D810D5978"><enum>(A)</enum><text>business
			 management and marketing, financial management and accounting, marketing
			 analysis and competitive analysis, and innovation and strategic planning;
			 and</text>
					</subparagraph><subparagraph id="HEF5035658B954E5DB538CB77A5435848"><enum>(B)</enum><text display-inline="yes-display-inline">additional entrepreneurial skill sets
			 specific to the needs of the student population and the surrounding community,
			 as determined by the institution.</text>
					</subparagraph></paragraph><paragraph id="HB48EFEEF00C8467284BD7F0C6C3B643B"><enum>(2)</enum><header>Minority
			 Business Enterprise Center Requirement</header><text display-inline="yes-display-inline">Each eligible educational institution,
			 association or organization receiving a grant under this section shall open a
			 Minority Business Enterprise Center that follows the duties as prescibed by the
			 Director of the Minority Business Development Agency.</text>
				</paragraph></subsection><subsection id="H0C31F983B0EB4B9FB00EB70D2530F327"><enum>(c)</enum><header>Grant
			 awards</header>
				<paragraph id="HC6DFA1FF5B4C400C9B727ADD450AD9E0"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Director may not
			 award a grant under this section to a single eligible educational institution,
			 association or organization—</text>
					<subparagraph id="HACCCD7DEED8844D4836A3FEB6635EE19"><enum>(A)</enum><text display-inline="yes-display-inline">in excess of $1,500,000 in any fiscal year;
			 or</text>
					</subparagraph><subparagraph id="H3395A8AC174547009610241D99723C22"><enum>(B)</enum><text display-inline="yes-display-inline">for a term of more than 3 years.</text>
					</subparagraph></paragraph><paragraph id="HF595153C1B194485B37185D11AC47C59"><enum>(2)</enum><header>Limitation on
			 use of funds</header><text display-inline="yes-display-inline">Funds made
			 available under this section may not be used for—</text>
					<subparagraph id="H1090A55B5BBC4CA98807D2FCC2FCC9D2"><enum>(A)</enum><text display-inline="yes-display-inline">any purpose other than those associated
			 with the direct costs incurred by the eligible educational institution,
			 association or organization to—</text>
						<clause id="HFE43DABCD4574E14952BFBDD190B7EE1"><enum>(i)</enum><text display-inline="yes-display-inline">develop and implement the curriculum
			 described in subsection (b)(1); or</text>
						</clause><clause id="H3E77410A74AA4E0A9DE131F6360D49B5"><enum>(ii)</enum><text display-inline="yes-display-inline">organize and operate a minority business
			 enterprise center, as described subsection (b)(2); or</text>
						</clause></subparagraph><subparagraph id="H08D36DC952CF4FD7B3AE1B0B5B2F9D6E"><enum>(B)</enum><text display-inline="yes-display-inline">building expenses, administrative travel
			 budgets, or other expenses not directly related to the costs described in
			 subparagraph (A).</text>
					</subparagraph></paragraph></subsection><subsection id="HDDC64328753F4AE3869A20F05A1C0523"><enum>(d)</enum><header>Matching
			 requirement</header><text display-inline="yes-display-inline">Grants made under
			 this Act shall require a private matching grant of 15 percent.</text>
			</subsection><subsection id="H24FC67CB4D804989A81D7912859BAD7A"><enum>(e)</enum><header>Report</header>
				<paragraph id="H247E1D240AA34CDB82BCB44E488B3D82"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 120
			 days following the end of the fiscal year of each year in which funds are made
			 available for grants under this section, the Director shall submit to the
			 Committee on Small Business and Entrepreneurship of the Senate and the
			 Committee on Small Business of the House of Representatives, a report
			 evaluating the success of the program under this section during the preceding
			 fiscal year.</text>
				</paragraph><paragraph id="H45521646680A496880ABAC06BAB9F3C5"><enum>(2)</enum><header>Contents of
			 report</header><text display-inline="yes-display-inline">Each report under
			 paragraph (1) shall include—</text>
					<subparagraph id="H6F7D8B3CB03445659AECB66CB7EF8F9F"><enum>(A)</enum><text display-inline="yes-display-inline">a description of each entrepreneurship
			 program developed with grant funds, the date of the award, and the number of
			 participants in each such program;</text>
					</subparagraph><subparagraph id="HCD1FF95FB0C6406CA95EE35BD62A88BF"><enum>(B)</enum><text display-inline="yes-display-inline">the number of small business assisted
			 through the minority business enterprise center with grant funds; and</text>
					</subparagraph><subparagraph id="H01E90D820459493999AA8C1DA7FF0F14"><enum>(C)</enum><text display-inline="yes-display-inline">data regarding the economic impact of
			 minority business enterprise center with grant funds.</text>
					</subparagraph></paragraph></subsection><subsection id="H98275D0D1B634204A63396FEB448AB01"><enum>(f)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to carry out this section $40,000,000 for each of
			 fiscal years 2010 through 2012, to remain available until expended.</text>
			</subsection><subsection id="HD257A059FEAD4124A0741B191EDFF0E5"><enum>(g)</enum><header>Limitation on
			 use of funds</header><text display-inline="yes-display-inline">The Director
			 shall carry out this section only with amounts appropriated in advance
			 specifically to carry out this section.</text>
			</subsection></section><section id="H3432F452C7374A36898FDD7F6D7437F2"><enum>3.</enum><header>Office of
			 Minority Entrepreneurship and Business Development</header>
			<subsection id="HDD8355293B8A49168E72DE272A250622"><enum>(a)</enum><header>Office of
			 Minority Entrepreneurship and Business Development</header><text display-inline="yes-display-inline">There
			 is established in the Minority Business Development Agency an Office of
			 Minority Entrepreneurship and Business Development, which shall be administered
			 by an Associate Director for Minority Entrepreneurship and Business Development
			 appointed under section 3(b)(1) (in this section referred to as the
			 <quote>Associate Director</quote>).</text>
			</subsection><subsection id="H1A550C7DF3214D5AA0EFEB6C08B522E6"><enum>(b)</enum><header>Associate
			 Director for Minority Entrepreneurship and Business Development</header><text display-inline="yes-display-inline">The Associate Director shall—</text>
				<paragraph id="H416508F5841147B69308A43E0A83EA6A"><enum>(1)</enum><text display-inline="yes-display-inline">be—</text>
					<subparagraph id="H141DB5090CB3479EB96B7725C8CDB67A"><enum>(A)</enum><text display-inline="yes-display-inline">an appointee in the Senior Executive
			 Service who is a career appointee; or</text>
					</subparagraph><subparagraph id="HED07464595214C90B12F1DAD2224B8D2"><enum>(B)</enum><text display-inline="yes-display-inline">an employee in the competitive
			 service;</text>
					</subparagraph></paragraph><paragraph id="H1F1A9CE630CD4CE4B88DA768332A9DC3"><enum>(2)</enum><text display-inline="yes-display-inline">increase the proportion of counseling and
			 training that goes to minority start-ups and the Agency’s entrepreneurial
			 development programs;</text>
				</paragraph><paragraph id="H13B3F03459B643D2BDB7D70F569DDFF0"><enum>(3)</enum><text display-inline="yes-display-inline">increase the proportion of the Agency’s
			 contracts to minority entrepreneur and new businesses;</text>
				</paragraph><paragraph id="H66E5B8E7CC18426C88D674B49AA096FF"><enum>(4)</enum><text display-inline="yes-display-inline">work with the partners of the Agency, trade
			 associations, and business groups to identify and carry out policies and
			 procedures to more effectively market the resources of the Agency to new and
			 small minority-owned businesses;</text>
				</paragraph><paragraph id="H7CFDAC8A84F3438DAB91DE7E14515879"><enum>(5)</enum><text display-inline="yes-display-inline">ensure that the Agency’s district offices
			 and regional offices have adequate staff, funding, and other resources to
			 market the grant program to newly formed and emerging minority-owned businesses
			 and eligible institutions of higher education;</text>
				</paragraph><paragraph id="H7E6CD9CD31F8437DBA4618A70B0A535A"><enum>(6)</enum><text display-inline="yes-display-inline">report to and be responsible directly to
			 the Director.</text>
				</paragraph></subsection><subsection id="H965B751D38C74F91904D987A5DCD53D7"><enum>(c)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to carry out this section—</text>
				<paragraph id="HB3FDCCF95EF24C83AE6628228653AEE5"><enum>(1)</enum><text display-inline="yes-display-inline">$7,000,000 for fiscal year 2010;</text>
				</paragraph><paragraph id="H668D1091ED6D4EF0BA9F8E8D3CE2D1BE"><enum>(2)</enum><text display-inline="yes-display-inline">$7,000,000 for fiscal year 2011; and</text>
				</paragraph><paragraph id="HF35A72EFCC1842D1A71985E7E9F8C2FB"><enum>(3)</enum><text display-inline="yes-display-inline">$7,000,000 for fiscal year 2012.</text>
				</paragraph></subsection></section><section id="H4EF8EA549BDA4E209496C6E89556A7B7"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
			<paragraph id="H03E69144EE4F4DB3A751530C89DAF4AB"><enum>(1)</enum><text display-inline="yes-display-inline">the terms <term>Agency</term> and
			 <term>Director</term> mean the Minority Small Business Development Agency and
			 the Director thereof, respectively;</text>
			</paragraph><paragraph id="H813A1C8CFE3B4408B14B33395E493962"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>eligible association or
			 organization</term> means an association or organization that—</text>
				<subparagraph id="HC35471AD2D1649C0AEE18F3398DC70AB"><enum>(A)</enum><text>is—</text>
					<clause id="H13E44EA02B2249C49054A09B472821CC"><enum>(i)</enum><text display-inline="yes-display-inline">a minority business association described
			 under paragraph (3) or (6) of section 501(c) of the Internal Revenue Code of
			 1986 and exempt from taxation under section 501(a) of such Code; or</text>
					</clause><clause id="HB52A30768127419CA22C00190CFD0DB2"><enum>(ii)</enum><text display-inline="yes-display-inline">a foundation of minority business
			 associations described under section 501(c)(3) of the Internal Revenue Code of
			 1986 and exempt from taxation under section 501(a) of such Code; and</text>
					</clause></subparagraph><subparagraph id="HBD2137068A024C26807E92D53AC8D446"><enum>(B)</enum><text display-inline="yes-display-inline">has been in existence for at least the
			 5-year period before the date of awarding a grant under section 2;</text>
				</subparagraph></paragraph><paragraph id="HE137ECFD475D4F21B5BFA243CC641F1A"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>eligible educational
			 institution</term> means an institution that is—</text>
				<subparagraph id="H8611E9A52FD54D388D8031ECCDB763CB"><enum>(A)</enum><text display-inline="yes-display-inline">a public or private institution of higher
			 education (including any land-grant college or university, any college or
			 school of business, engineering, commerce, or agriculture, or community college
			 or junior college) or any entity formed by 2 or more institutions of higher
			 education; and</text>
				</subparagraph><subparagraph id="H05F85DFF7FCD48F4B6CFF2360A082549"><enum>(B)</enum><text>a—</text>
					<clause id="HA1FFB171791D48488389968377897B58"><enum>(i)</enum><text display-inline="yes-display-inline">historically Black college;</text>
					</clause><clause id="HFE0F054188CD45C095DC78D155542A35"><enum>(ii)</enum><text display-inline="yes-display-inline">Hispanic-serving institution;</text>
					</clause><clause id="H10477D84B2C54545B14A44E854650904"><enum>(iii)</enum><text display-inline="yes-display-inline">Asian-serving institution;</text>
					</clause><clause id="H0E0BB2E1D9AC46CB987E1DAA5AB0BEE1"><enum>(iv)</enum><text display-inline="yes-display-inline">Native Hawaiian-serving institution;
			 or</text>
					</clause><clause id="H78C6F67B716C4F5F93F5E7558539F59C"><enum>(v)</enum><text display-inline="yes-display-inline">tribal college;</text>
					</clause></subparagraph></paragraph><paragraph id="H5D17E8F9A2EC42FEB9AD139489BE2B66"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>historically Black
			 college</term> means a part B institution, as that term is defined in section
			 322 of the Higher Education Act of 1965 (20 U.S.C. 1061);</text>
			</paragraph><paragraph id="HE139899C956A49408DBBFE203CBA3A30"><enum>(5)</enum><text display-inline="yes-display-inline">the term <term>Hispanic-serving
			 institution</term> has the meaning given that term in section 502 of the Higher
			 Education Act of 1965 (20 U.S.C. 1101a);</text>
			</paragraph><paragraph id="HAE7B46D13B30493AAFC1722B54A076FA"><enum>(6)</enum><text display-inline="yes-display-inline">the term <term>institution of higher
			 education</term> has the meaning given that term in section 101 of the Higher
			 Education Act of 1965 (20 U.S.C. 1001);</text>
			</paragraph><paragraph id="H240B0869253942AE97FCBA1D17B0E2EB"><enum>(7)</enum><text display-inline="yes-display-inline">the term <term>small business
			 concern</term> has the meaning given that term in section 3 of the Small
			 Business Act (15 U.S.C. 632); and</text>
			</paragraph><paragraph id="H054DC91EAA4949E28C5AE2DDDECB1609"><enum>(8)</enum><text display-inline="yes-display-inline">the term <term>tribal college</term> has
			 the same meaning as the term <term>tribally controlled college or
			 university</term> under section 2(a)(4) of the Tribally Controlled Community
			 College Assistance Act of 1978 (25 U.S.C. 1801(a)(4)).</text>
