		  misrepresentation through the use of a pass-through business, and for other

		<section id="HA2AE67B236644312A9D298ACBC375961" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Small Business Contracting Protection Act of
			 2010</short-title></quote>.</text>
		</section><section id="HB14716D2648A40368CF4C756ACC762AB"><enum>2.</enum><header>Misrepresentation
			 through use of a pass-through business</header>
			<subsection id="H42135960644D4E5A8CE503694E9B8826"><enum>(a)</enum><header>Pass-through
			 business defined</header><text>Not later than 180 days after the date of
			 enactment of this Act, the Administrator of the Small Business Administration
			 shall issue regulations defining the term <term>pass-through business</term>
			 for purposes of section 16(d) of the Small Business Act (15 U.S.C. 645(d)), as
			 amended by subsection (b) of this section. Such definition shall include one or
			 more of the following as criteria for determining whether an entity is a
			 pass-through business with respect to another business:</text>
				<paragraph id="HFE87975185A2438C9A52251CFB9BA46F"><enum>(1)</enum><text>The business
			 shares a location with such other business.</text>
				</paragraph><paragraph id="H89957E9691634A289F0E0251109DC2D5"><enum>(2)</enum><text>The business
			 shares ordering or personnel systems with such other business.</text>
				</paragraph><paragraph id="H428DA4D4C20147F99061CF31E3AF9739"><enum>(3)</enum><text>An officer,
			 director, principal, stockholder, managing member, or key employee of the
			 business participates in the business decisions of such other business.</text>
				</paragraph><paragraph id="HF223EDBC3A3E493EB44982F755CA1D37"><enum>(4)</enum><text>Equity interest in
			 the business owned by such other business.</text>
				</paragraph><paragraph id="HAE560BE6CBF94194B427040D4B1F2A74"><enum>(5)</enum><text>The accounts
			 receivable of the business is directly or indirectly controlled by such other
			 business.</text>
				</paragraph><paragraph id="HE2C10DF8E37342E1B6C6F050B7AC673A"><enum>(6)</enum><text display-inline="yes-display-inline">The relationship with the business
			 generates more than 50 percent of the income of such other business.</text>
				</paragraph></subsection><subsection id="HF1EB63A3E4704874935EB799A7E82C64"><enum>(b)</enum><header>Penalties for
			 misrepresentation</header>
				<paragraph id="H171CE8E3263D450DAF95A33908F453EA"><enum>(1)</enum><header>Amendment</header><text>Section
			 16(d)(1) of the Small Business Act (15 U.S.C. 645(d)(1)) is amended by striking
			 <quote>, in order</quote> and inserting <quote>, including through the use of a
			 pass-through business, in order</quote>.</text>
				</paragraph><paragraph id="H009D380722C541B0B5E5BA3D42583698"><enum>(2)</enum><header>Effective
			 date</header><text>The amendment made under paragraph (1) shall take effect on
			 the date that is 180 days after the date of enactment of this Act.</text>
