<official-title>To amend the Public Health Service Act to authorize a program for the training of medical residents in community-based settings.</official-title>

<section id="H7ADDE86A0D7145B3A2B718CACA3BAA6B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Community-Based Residency Training Act of 2009</short-title></quote>.</text> </section>
<section id="H358296DA01804E0898F008F6FCFFAE85"><enum>2.</enum><header>Training of medical residents in community-based settings</header><text display-inline="no-display-inline">Part C of title VII of the Public Health Service Act (42 U.S.C. 293k et seq.) is amended by adding at the end the following:</text>

<section id="H975D65494E954C04828DEFC8644CA177"><enum>749.</enum><header>Training of medical residents in community-based settings</header> 
<subsection id="H6DDE991ECEB3442B900FBFE46860F509"><enum>(a)</enum><header>Program</header><text>The Secretary shall establish a program for the training of medical residents in community-based settings consisting of awarding grants and contracts under this section.</text> </subsection>
<subsection id="H835FD353B6C1461B87655DF41D6B7B04"><enum>(b)</enum><header>Development and operation of community-Based programs</header><text>The Secretary shall make grants to, or enter into contracts with, eligible entities—</text> 
<paragraph id="HF7272C1E6F3F48E8B0F77D0045C29278"><enum>(1)</enum><text>to plan and develop a new primary care residency training program, which may include—</text> 
<subparagraph id="H4366B33E6BC6428FA1D778AD9563394D"><enum>(A)</enum><text>planning and developing curricula;</text> </subparagraph>
<subparagraph id="H47AEA8464D194C5C96564BEAC4F5CB46"><enum>(B)</enum><text>recruiting and training residents and faculty; and</text> </subparagraph>
<subparagraph id="H361CD793595D489281587A441AD120C7"><enum>(C)</enum><text>other activities designated to result in accreditation of such a program; or</text> </subparagraph></paragraph>
<paragraph id="H6AEADA88846B4120847DFC619B27CB89"><enum>(2)</enum><text>to operate or participate in an established primary care residency training program, which may include—</text> 
<subparagraph id="HBB3966A355EC4AE2A4B5A6818FC2141B"><enum>(A)</enum><text>planning and developing curricula;</text> </subparagraph>
<subparagraph id="HAA6911F388BE48AF8F00605E161B38FA"><enum>(B)</enum><text>recruitment and training of residents; and</text> </subparagraph>
<subparagraph id="H26D12450FB3A43DEB790D64D324BD805"><enum>(C)</enum><text>retention of faculty.</text> </subparagraph></paragraph></subsection>
<subsection id="H13EABEB5ABE6485CB5D3A48E4C5CA8FB"><enum>(c)</enum><header>Eligible entity</header><text>To be eligible to receive a grant or contract under subsection (b), an entity must be designated as eligible to receive payment for the direct costs of medical education under section 1886(k) of the Social Security Act.</text> </subsection>
<subsection id="H6987DCEAB56245D1B55532A378946538"><enum>(d)</enum><header>Preferences</header><text>In awarding grants and contracts under paragraph (1) or (2) of subsection (b), the Secretary shall give preference to entities that—</text> 
<paragraph id="H4E034A2BB3974DA998104797F6DDDD73"><enum>(1)</enum><text>support teaching programs that address the health care needs of vulnerable populations; or</text> </paragraph>
<paragraph id="HF5AACB41B9A4424D8A0DA6647570BE9E"><enum>(2)</enum><text>are a Federally qualified health center (as defined in section 1861(aa)(4) of the Social Security Act) or a rural health clinic (as defined in section 1861(aa)(2) of such Act).</text> </paragraph></subsection>
<subsection id="H7A000A43E07A438EAFF5338BAE6F49E4"><enum>(e)</enum><header>Additional preferences for established programs</header><text>In awarding grants and contracts under subsection (b)(2), the Secretary shall give preference to entities that have a demonstrated record of training—</text> 
<paragraph id="H19236BB43B8246B08056ABF844DFBC97"><enum>(1)</enum><text>a high or significantly improved percentage of health professionals who provide primary care;</text> </paragraph>
<paragraph id="HA9775EA1D9BD4C97B001FC7FA6508729"><enum>(2)</enum><text>individuals who are from disadvantaged backgrounds (including racial and ethnic minorities underrepresented among primary care professionals); or</text> </paragraph>
<paragraph id="H9849255197A64A00A06C1311E2C1EEA0"><enum>(3)</enum><text>individuals who practice in settings having the principal focus of serving underserved areas or populations experiencing health disparities (including serving patients eligible for medical assistance under title XIX of the Social Security Act or for child health assistance under title XXI of such Act or those with special health care needs).</text> </paragraph></subsection>
<subsection id="H74F14EEFFABF44B5A13A0F9155777990"><enum>(f)</enum><header>Period of Awards</header> 
<paragraph id="H4315A6ABF485420883CD261BA26F0F38"><enum>(1)</enum><header>In general</header><text>The period of a grant or contract under this section—</text> 
<subparagraph id="HAEF369435CEF4EE98B3F47F04A8584FD"><enum>(A)</enum><text>shall not exceed 3 years for awards under subsection (b)(1); and</text> </subparagraph>
<subparagraph id="H7F02730330B348B7BF124F76C7B05266"><enum>(B)</enum><text>shall not exceed 5 years for awards under subsection (b)(2).</text> </subparagraph></paragraph>
<paragraph id="HB4FDEDEF724C4740B8E9E03512DED9B3"><enum>(2)</enum><header>Special rules</header> 
<subparagraph id="H01F6857E6A024EF8AE6502B87A1A8203"><enum>(A)</enum><text>An award of a grant or contract under subsection (b)(1) shall not be renewed.</text> </subparagraph>
<subparagraph id="H9449F41C966949B59F455EB65EEAC8D5"><enum>(B)</enum><text>The period of a grant or contract awarded to an entity under subsection (b)(2) shall not overlap with the period of any grant or contact awarded to the same entity under subsection (b)(1).</text> </subparagraph></paragraph></subsection>
<subsection id="H818E4475B9AE4B8393A0D33BF311B324"><enum>(g)</enum><header>Report</header><text>The Secretary shall submit to the Congress an annual report on the program carried out under this section.</text> </subsection>
<subsection id="H54FE7F14AB514FEA8E73BDAA1A6B69C9"><enum>(h)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HA452C390658E4C3583E44868DB5D0D5C"><enum>(1)</enum><header>Health disparities</header><text display-inline="yes-display-inline">The term <term>health disparities</term> includes health and health care disparities and means population-specific differences in the presence of disease, health outcomes, or access to health care. For purposes of the preceding sentence, a population may be delineated by race, ethnicity, primary language, sex, sexual orientation, gender identity, disability, socioeconomic status, or rural, urban, or other geographic setting, and any other population or subpopulation determined by the Secretary to experience significant gaps in disease, health outcomes, or access to health care.</text> </paragraph>
<paragraph id="H3BE6D5E9B36445C99437630D18D78AFF"><enum>(2)</enum><header>Primary care resident</header><text>The term <term>primary care resident</term> has the meaning given the term in section 1886(h)(5)(H) of the Social Security Act.</text> </paragraph>
<paragraph id="HEC559FE0FC504F01B41384B4D9EE8380"><enum>(3)</enum><header>Primary care residency training program</header><text>The term <term>primary care residency training program</term> means a program that—</text> 
<subparagraph id="HB6564D111C304197AFF802B0922C373F"><enum>(A)</enum><text display-inline="yes-display-inline">is an approved medical residency training program described in section 1886(h)(5)(A) of the Social Security Act for primary care residents; and</text> </subparagraph>
<subparagraph id="H90839565D4334A0297B669B042882DE4"><enum>(B)</enum><text>in the case of entities seeking awards under subsection (b)(2), is accredited, or operates in partnership with a program that is accredited, by the Accreditation Council for Graduate Medical Education or the American Osteopathic Association.</text> </subparagraph></paragraph></subsection>
<subsection commented="no" id="H62CEAC95997542E5B12D814B2893FD6D"><enum>(i)</enum><header>Authorization of Appropriations</header><text display-inline="yes-display-inline">To carry out this section, there are authorized to be appropriated the following:</text> 
<paragraph commented="no" id="H53900CCFD97E40689589A730E3202D5E"><enum>(1)</enum><text display-inline="yes-display-inline">$40,800,000 for fiscal year 2011.</text> </paragraph>
<paragraph commented="no" id="HA1DBA93831354624BA4DEE98AC6CA3F4"><enum>(2)</enum><text display-inline="yes-display-inline">$43,010,000 for fiscal year 2012.</text> </paragraph>
<paragraph commented="no" id="HF3721D29B3134CABA14600AFE0DAAE72"><enum>(3)</enum><text display-inline="yes-display-inline">$45,050,000 for fiscal year 2013.</text> </paragraph>
<paragraph commented="no" id="HA8F762083A444726A7BA60F430A2F85B"><enum>(4)</enum><text display-inline="yes-display-inline">$47,260,000 for fiscal year 2014.</text> </paragraph>
<paragraph commented="no" id="HC65353ACB3ED4B1ABE76D92304E7ED87"><enum>(5)</enum><text display-inline="yes-display-inline">$49,640,000 for fiscal year 2015.</text> </paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section>
