		<official-title>To amend title XVIII of the Social Security Act to
		  stabilize and modernize the provision of partial hospitalization services under
		  the Medicare Program, and for other purposes.</official-title>

		<section id="H4C6E9BEF4E404D96925A586CD24D92BA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Outpatient Mental Health Modernization
			 Act of 2009</short-title></quote>.</text>
		</section><section id="H7E81CF60E9D24AB9BCCECAA6DCD9A5A3"><enum>2.</enum><header>Allowable partial
			 hospitalization services</header>
			<subsection id="H3BBE90F9E0554B65AA6A2D38EA0ED10F"><enum>(a)</enum><header>In
			 general</header><text>Section 1861(ff)(2) of the Social Security Act (42 U.S.C.
			 1395x(ff)(2)) is amended—</text>
				<paragraph id="HBFA1C8CEBCD648EBA134937CCDA22ADD"><enum>(1)</enum><text>in subparagraph
			 (H) by striking <quote>, and</quote> at the end;</text>
				</paragraph><paragraph id="H4BCD8E38963644DCA4A5413B7C92B6B2"><enum>(2)</enum><text>by redesignating
			 subparagraph (I) as subparagraph (J);</text>
				</paragraph><paragraph id="H1AD767217F1A43799CE615B6DF2AB7F3"><enum>(3)</enum><text>in subparagraph
			 (J), as redesignated by paragraph (2), by striking <quote>(but in no event to
			 include meals and transportation)</quote>;</text>
				</paragraph><paragraph id="H4421D9BCE3A04C7C85ED715AAA56C730"><enum>(4)</enum><text>by inserting after
			 subparagraph (H) the following new subparagraph:</text>
					<quoted-block id="H8448927F797749C48B5300CCC092343C" style="OLC">
						<subparagraph id="H7D6B9D8462854D099D1C5AE0B7139AC6"><enum>(I)</enum><text>nutritional
				planning, meals, and transportation,
				and</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H99E5A9E52266454B9C6CA321BEFA95D2"><enum>(5)</enum><text>by adding at the
			 end the following new sentence: <quote>The guidelines established under the
			 preceding sentence shall not allow for nutritional planning, meals, and
			 transportation to be considered as meeting the minimum number of services
			 requirement in order to receive payment for such items and
			 services.</quote>.</text>
				</paragraph></subsection><subsection id="H7E7B1A5257F9402F94966FA751A3156A"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to services
			 furnished on or after January 1, 2011.</text>
			</subsection></section><section id="H33E4C99127484F9B9430ED67751994F2"><enum>3.</enum><header>Behavioral Health
			 Advisory Committee</header>
			<subsection id="H7050B5BB8A654BA6A073AA4753879EF7"><enum>(a)</enum><header>In
			 general</header><text>Not later than January 1, 2011, the Secretary of Health
			 and Human Services shall convene a Behavioral Health Advisory Committee (in
			 this section referred to as the <quote>Advisory Committee</quote>) composed of
			 stakeholders in the behavioral health community.</text>
			</subsection><subsection id="H248C8547421A443FB44CFB3F2C57061C"><enum>(b)</enum><header>Duties</header><text>The
			 Advisory Committee shall address issues relating to—</text>
				<paragraph id="HEEC3305996F74E0E92DF8E841A120078"><enum>(1)</enum><text>discrimination
			 against the chronically mentally ill, elderly, and United States veterans as it
			 relates to receiving treatment for mental illness;</text>
				</paragraph><paragraph id="H087C5420C83F4365B1083D7438D11390"><enum>(2)</enum><text>the establishment
			 of conditions of participation for community mental health centers (as defined
			 in paragraph (3)(B) of section 1861(ff) of the Social Security Act (42 U.S.C.
			 1395x(ff)) that provide partial hospitalization services (as defined in
			 paragraph (1) of such section) under the Medicare program under title XVIII of
			 such Act; and</text>
				</paragraph><paragraph id="H6742AA1DFC374FF994BC513704A1C040"><enum>(3)</enum><text>other matters to
			 be determined jointly by the Secretary and the Advisory Committee.</text>
				</paragraph></subsection><subsection id="H37A84785938C4A5F81A90440014B5532"><enum>(c)</enum><header>Implementation</header><text>Not
			 later than January 1, 2012, the Secretary of Health and Human Services, in
			 consultation with the Advisory Committee, shall implement conditions of
			 participation for community mental health centers (as so defined) that provide
			 partial hospitalization services (as so defined) under the Medicare program
			 under title XVIII of the Social Security Act.</text>
