		<official-title>To direct the Secretary of Transportation to establish a
		  pilot program for evaluating technologies that are likely to prevent adverse
		  weather effects associated with freezing temperatures on bridges, improve
		  bridge safety, extend the life of bridges, and promote energy efficiency on
		  bridges on the National Highway System.</official-title>

		<section id="H3D659D6CC38E44068101CFAB44CC23E3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Bridge Ice and Snow Prevention Pilot Program Act of
			 2009</short-title></quote>.</text>
		</section><section id="HD6150DB2A2994C2495F13D8A8F4FD387"><enum>2.</enum><header>Pilot
			 Program</header>
			<subsection id="H99068ECF17DE40D6819E3B34B9BE39FD"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of Transportation shall establish and
			 implement a pilot program to evaluate the effectiveness and efficiency of the
			 use of technologies to prevent ice, snow, and other adverse weather effects
			 associated with freezing temperatures on bridges on the National Highway
			 System.</text>
			</subsection><subsection id="H3D2C64A0CB7D4569BD15804C8A58F302"><enum>(b)</enum><header>Grant</header>
				<paragraph id="H90A0205C866A474D89F8ED402DAAE33C"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may make grants to not more than 5 States
			 to conduct projects under the pilot program.</text>
				</paragraph><paragraph id="H4433AD03516C4870B0ECB13E5881109B"><enum>(2)</enum><header>Applications</header><text>A
			 State seeking a grant under the pilot program shall submit an application to
			 the Secretary in such form, and containing such information, as the Secretary
			 may require.</text>
				</paragraph></subsection><subsection id="HE9CC68DF0C804317B0C3D34959AD46B8"><enum>(c)</enum><header>Eligibility</header>
				<paragraph id="H0B58E400C8AE488D890C95F867E21622"><enum>(1)</enum><header>Selection of
			 highway bridges</header>
					<subparagraph id="HCEB84EB81E4A4FCD974D111183DD0AE3"><enum>(A)</enum><header>In
			 general</header><text>In awarding grants under the pilot program, the Secretary
			 shall select not more than 20 highway bridges for participation in the
			 program.</text>
					</subparagraph><subparagraph id="H3F7A674B1A194788BD1953677A2F8309"><enum>(B)</enum><header>Bridge
			 requirements</header><text>The Secretary may select a highway bridge under
			 subparagraph (A) only if the bridge is—</text>
						<clause id="HE5EA20CCDF9D4AD68FB9FB0E19ED928E"><enum>(i)</enum><text>not
			 greater than 500 feet in length; and</text>
						</clause><clause id="HC3C3AEDDA39A48238EA861594E76941E"><enum>(ii)</enum><text>on
			 the National Highway System.</text>
						</clause></subparagraph></paragraph><paragraph id="H4661BA5D1D754C4EA4503275C631831C"><enum>(2)</enum><header>Selection of
			 technologies</header><text display-inline="yes-display-inline">The Secretary
			 shall select technologies to be tested under the pilot program that are likely
			 to improve bridge safety, extend the life of a bridge, and promote energy
			 efficiency.</text>
				</paragraph></subsection><subsection id="H2FABD3A95A334754A67009D8E05E04ED"><enum>(d)</enum><header>Federal
			 share</header><text>The Federal share payable on account of a project carried
			 out under the pilot program shall not exceed 80 percent of the cost of the
			 project.</text>
			</subsection><subsection id="HD867A345EA504CD5B097FFEA836EBFB6"><enum>(e)</enum><header>Duration of
			 pilot program</header><text>The Secretary shall carry out the pilot program for
			 a period of no more than 5 fiscal years.</text>
			</subsection><subsection id="H93ADAAB6C1A24093A70EF8AF18FA3391"><enum>(f)</enum><header>Final
			 Report</header>
				<paragraph id="H19BA38AAA2D8469CB7783FD04F56FB53"><enum>(1)</enum><header>In
			 general</header><text>Not later than 6 months after the last day of the pilot
			 program, the Secretary shall submit to the Committee on Transportation and
			 Infrastructure of the House of Representatives and the Committee on Environment
			 and Public Works of the Senate a report that describes the effectiveness and
			 benefits of the technologies tested under the pilot program.</text>
				</paragraph><paragraph id="H4B336B48B4304810B51A00EAA4825B3F"><enum>(2)</enum><header>Contents</header><text>The
			 report shall describe, at a minimum, the following:</text>
					<subparagraph id="H695D0278ABB043A38D6A2B6B13A7DBBE"><enum>(A)</enum><text>The cost
			 effectiveness of each technology used.</text>
					</subparagraph><subparagraph id="H66864D53BC43471F867629BBE0B8901B"><enum>(B)</enum><text>The safety impacts
			 of each technology tested and of the pilot program as a whole.</text>
					</subparagraph><subparagraph id="HD9AF06AAF1C644B6861162259E187212"><enum>(C)</enum><text>Any change in the
			 expected life span of each bridge participating in the pilot program due to the
			 technologies used.</text>
					</subparagraph><subparagraph id="H4EAA5609C63B4E8B9F90D154FA4F8397"><enum>(D)</enum><text>The net effect of
			 the pilot program on job creation or job loss.</text>
					</subparagraph><subparagraph id="HDA78F3C661194151A41A8CC7082837C0"><enum>(E)</enum><text>Recommendations
			 for—</text>
						<clause id="HC15F5A3185AE4C4BA407C366AA3B00F6"><enum>(i)</enum><text>an
			 improved or expanded program, if appropriate; and</text>
						</clause><clause id="HF368969A0024461596D23831AE70A24D"><enum>(ii)</enum><text>the
			 use of advanced bridge technology to prevent ice, snow, and other adverse
			 weather effects associated with freezing temperatures on bridges on the
			 National Highway System.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H0B1C0A16F6B941468BB214625BE64E6F"><enum>(g)</enum><header>Authorization of
			 appropriations</header><text>To carry out this section, there is authorized to
			 be appropriated out of the Highway Trust Fund (other than the Mass Transit
			 Account) $5,000,000 for fiscal year 2011.</text>
			</subsection><subsection id="H16C12E4482C7440B97B012778AF67AAB"><enum>(h)</enum><header>Availability of
			 amounts</header>
				<paragraph id="H36C660CD346F48DAA2BDA1BE8BF9AE5A"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Amounts made
			 available to carry out this section shall be available for obligation in the
			 same manner as funds apportioned under chapter 1 of title 23, United States
			 Code, except that the Federal share payable on account of a project carried out
			 under the pilot program shall be determined in accordance with this section and
			 such funds shall not be transferable and shall remain available for the
			 duration of the pilot program.</text>
				</paragraph><paragraph id="HACB896600373424E9FC3C48994D69BB1"><enum>(2)</enum><header>Limitation</header><text>A
			 State may not receive a total of more than $2,000,000 in grants under the pilot
			 program.</text>
				</paragraph><paragraph id="H8074203BB96945109C5DF1AFFC8136DE"><enum>(3)</enum><header>Prohibition of
			 earmarks</header><text>None of the funds appropriated to carry out this section
			 may be used for a congressional earmark, as defined in clause 9(e) of Rule XXI
			 of the Rules of the House of Representatives of the 111th Congress.</text>
				</paragraph></subsection><subsection id="H778D63F0C15A4412845B8B22DCF9DEA7"><enum>(i)</enum><header>Report to
			 Congress relating to competitive procedures</header><text display-inline="yes-display-inline">If grants are awarded under this section
			 using procedures other than competitive procedures, the Secretary shall submit
			 to Congress a report explaining why competitive procedures were not
			 used.</text>
			</subsection></section><section id="HEA17DEB82E764CB3A13AA26B3C1C5673"><enum>3.</enum><header>Definition</header><text display-inline="no-display-inline">In this Act, the term <quote>State</quote>
			 has the meaning given that term in section 101(a) of title 23, United States
			 Code.</text>
