		<legis-type>A BILL</legis-type>
		<official-title>To amend the Humane Methods of Slaughter Act of 1958 to
		  ensure the humane slaughter of nonambulatory cattle, and for other
		  purposes.</official-title>

	<legis-body id="HD7FE9B015EE14A32A31FBF782426D2B1" style="OLC">
		<section id="H8C19A969D9124EC1ABC29D10217B1857" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Downed Animal and Food Safety
			 Protection Act</short-title></quote>.</text>
		</section><section id="HB72D119C1E0741E5AE8710FF9E65325D"><enum>2.</enum><header>Finding and
			 declaration of policy</header>
			<subsection id="H005A2D4031AC4982BB5E83A09CEF0300"><enum>(a)</enum><header>Finding</header><text>Congress
			 finds that the humane euthanization of nonambulatory cattle in interstate and
			 foreign commerce—</text>
				<paragraph id="HD644201BEF694453856E032A303578D2"><enum>(1)</enum><text>prevents needless
			 suffering;</text>
				</paragraph><paragraph id="H89FED2644C19498A93F0BF8B2FB06E23"><enum>(2)</enum><text>results in safer
			 and better working conditions for persons handling cattle;</text>
				</paragraph><paragraph id="H77AC59F6618A46A9A5CEC2E9590AEF18"><enum>(3)</enum><text>brings about
			 improvement of products and reduces the likelihood of the spread of diseases
			 that have a great and deleterious impact on interstate and foreign commerce in
			 cattle; and</text>
				</paragraph><paragraph id="H8262014FE46C405B801B8C317BC7A7C0"><enum>(4)</enum><text>produces other
			 benefits for producers, processors, and consumers that tend to expedite an
			 orderly flow of cattle and cattle products in interstate foreign
			 commerce.</text>
				</paragraph></subsection><subsection id="H8FCE6590AC584330A50C3B70ED6DF588"><enum>(b)</enum><header>Declaration of
			 Policy</header><text>It is the policy of the United States that all
			 nonambulatory cattle in interstate and foreign commerce shall be immediately
			 and humanely euthanized when such cattle become nonambulatory.</text>
			</subsection></section><section id="H2BB324A136F54157B5E6E3D195F710FC"><enum>3.</enum><header>Unlawful
			 slaughter practices involving nonambulatory cattle</header>
			<subsection id="H8BA5046AD3A448539CB82A9DECAFD2B1"><enum>(a)</enum><header>In
			 General</header><text>Public Law 85–765 (commonly known as the <quote>Humane
			 Methods of Slaughter Act of 1958</quote>) (7 U.S.C. 1901 et seq.) is amended by
			 inserting after section 2 (7 U.S.C. 1902) the following:</text>

					<section id="HEF99881986244B27A851034B24B56650"><enum>3.</enum><header>Nonambulatory
				cattle</header>
						<subsection id="H7AAA9F66BCBE485A81338F0FC32D56DA"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="H467ADD4F3B2E48228D7BCC2DA14FB317"><enum>(1)</enum><header>Covered
				entity</header><text>The term <quote>covered entity</quote> means—</text>
								<subparagraph id="HD58251BEF36E49D38B7859451C16C7BD"><enum>(A)</enum><text>a
				stockyard;</text>
								</subparagraph><subparagraph id="HFBE6499E4D704CD39CAC48FA1BAB7D2F"><enum>(B)</enum><text>a market
				agency;</text>
								</subparagraph><subparagraph id="HF60A46A6A1484243A520A7CC2FBC695C"><enum>(C)</enum><text>a dealer;</text>
								</subparagraph><subparagraph id="HCE0A57C645744A3DBF49A2896634F35B"><enum>(D)</enum><text>a packer;</text>
								</subparagraph><subparagraph id="HCCC0648A580E4913AA24C6EABF3AE1F9"><enum>(E)</enum><text>a slaughter
				facility; or</text>
								</subparagraph><subparagraph id="H39127F6ACA804D40A4A4311E2358D651"><enum>(F)</enum><text>an
				establishment.</text>
								</subparagraph></paragraph><paragraph id="HFEA084F5C0CB4190AB98EBA1F64D58E9"><enum>(2)</enum><header>Establishment</header><text>The
				term <quote>establishment</quote> means an establishment that is covered by the
				Federal Meat Inspection Act (21 U.S.C. 601 et seq.).</text>
							</paragraph><paragraph id="H935C608EA1DE4567947227801FF4A89B"><enum>(3)</enum><header>Humanely
				euthanize</header><text>The term <quote>humanely euthanize</quote> means to
				immediately render an animal unconscious by mechanical, chemical, or other
				means, with this state remaining until the death of the animal.</text>
							</paragraph><paragraph id="H13137EEB9FD443C8ABF38C696E2E42A4"><enum>(4)</enum><header>Nonambulatory
				cattle</header><text>The term <quote>nonambulatory cattle</quote> means any
				cattle (including a calf) that will not stand and walk unassisted.</text>
							</paragraph><paragraph id="HD761E2719EDB48C49ECE7BBA45B11D93"><enum>(5)</enum><header>Secretary</header><text>The
				term <quote>Secretary</quote> means the Secretary of Agriculture.</text>
							</paragraph></subsection><subsection id="H89FB09F5EB144035AFE342B1AD672CC2"><enum>(b)</enum><header>Humane
				Treatment, Handling, and Disposition</header><text>The Secretary shall
				promulgate regulations to provide for the humane treatment, handling, and
				disposition of all nonambulatory cattle by covered entities, including a
				requirement that nonambulatory cattle be humanely euthanized.</text>
						</subsection><subsection id="H61985A90C3364140AC33624D1610581E"><enum>(c)</enum><header>Humane
				Euthanasia</header>
							<paragraph id="HB76CD1F0509C45A9A699C896BB787971"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), when an animal becomes
				nonambulatory, a covered entity shall immediately humanely euthanize the
				nonambulatory cattle.</text>
							</paragraph><paragraph id="H9BCCA95A42B0400E8025772E6D09B3D8"><enum>(2)</enum><header>Disease
				testing</header><text>Paragraph (1) shall not limit the ability of the
				Secretary to test nonambulatory cattle for a disease, such as Bovine Spongiform
				Encephalopathy.</text>
							</paragraph></subsection><subsection id="H2500508D41C643588347AC2F09E060D0"><enum>(d)</enum><header>Movement</header>
							<paragraph id="H43D2DE65404643C588ABBC796455BE35"><enum>(1)</enum><header>In
				general</header><text>A covered entity shall not move nonambulatory cattle
				while the nonambulatory cattle are conscious.</text>
							</paragraph><paragraph id="H0C76A63F0BEC49808CD2AA2776E55495"><enum>(2)</enum><header>Unconsciousness</header><text>In
				the case of any nonambulatory cattle that are moved, the covered entity shall
				ensure that the nonambulatory cattle remain unconscious until death.</text>
							</paragraph></subsection><subsection id="H5B69C38A19C54981BCFE663DAB885332"><enum>(e)</enum><header>Inspections</header>
							<paragraph id="H2254F448D2FD4453BB6268F08589700F"><enum>(1)</enum><header>In
				general</header><text>It shall be unlawful for an inspector at an establishment
				to pass through inspection any nonambulatory cattle or carcass (including parts
				of a carcass) of nonambulatory cattle.</text>
							</paragraph><paragraph id="H26150BE80BB14AF2B93F38BCF6F80C55"><enum>(2)</enum><header>Labeling</header><text>An
				inspector or other employee of an establishment shall label, mark, stamp, or
				tag as <quote>inspected and condemned</quote> any material described in
				paragraph (1).</text>
							</paragraph></subsection><subsection id="H1897E339F17A40AC861A6CB4AE06E886"><enum>(f)</enum><header>Effect on State
				law</header><text display-inline="yes-display-inline">This section shall not be
				construed to preempt any law or regulation of a State or a political
				subdivision of a State containing requirements that are greater than the
				requirements of this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE8E25DE01176423D860E94ECB4E7B783"><enum>(b)</enum><header>Effective
			 Date</header>
				<paragraph id="H9CD01F67BF144FA9B842C76477CA707B"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the amendment made
			 by subsection (a) takes effect on the date that is 1 year after the date of
			 enactment of this Act.</text>
				</paragraph><paragraph id="H4EAFC257851D4C878C663105F39771FE"><enum>(2)</enum><header>Regulations</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Secretary of
			 Agriculture shall promulgate final regulations to implement the amendment made
			 by subsection (a).</text>
				</paragraph></subsection></section></legis-body>
