							</subparagraph><subparagraph id="HE8A6F4459995448CA59B2BB54C7FB546" indent="up1"><enum>(B)</enum><text>The Secretary of Energy shall offer
				Schedule D contingency capacity and firm energy to entities not receiving
				contingent capacity and firm energy under subparagraphs (A) and (B) of
				paragraph (1) (referred to in this section as <quote>new allottees</quote>) for
				delivery commencing October 1, 2017 pursuant to this subsection. In this
				subsection, the term <term>the marketing area for the Boulder City Area
				Projects</term> shall have the same meaning as in appendix A of the General
				Consolidated Power Marketing Criteria or Regulations for Boulder City Area
				Projects published in the Federal Register on December 28, 1984 (49 Federal
				Register 50582 et seq.) (referred to in this section as the
				<quote>Criteria</quote>).</text>
							</subparagraph><subparagraph id="H452437C39A754497BEB11AB496FD43FC" indent="up1"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H7A3CF4A2078749FFBD079542B1ACE241"><enum>(i)</enum><text>Within 36 months of the
				date of enactment of the <short-title>Hoover Power
				Allocation Act of 2010</short-title>, the Secretary of Energy shall allocate
				through the Western Area Power Administration (referred to in this section as
				<quote>Western</quote>), for delivery commencing October 1, 2017, for use in
				the marketing area for the Boulder City Area Projects 66.7 percent of the
				Schedule D contingent capacity and firm energy to new allottees that are
				located within the marketing area for the Boulder City Area Projects and that
				are—</text>
									<subclause id="H0537E809BB24479F8657F5F2A7FCE096" indent="up1"><enum>(I)</enum><text>eligible to enter into contracts under
				section 5 of the Boulder Canyon Project Act (<external-xref legal-doc="usc" parsable-cite="usc/43/617d">43 U.S.C. 617d</external-xref>); or</text>
									</subclause><subclause id="H7EC993884EE04C718F7B7528DEF923A4" indent="up1"><enum>(II)</enum><text>federally recognized Indian
				tribes.</text>
									</subclause></clause><clause id="HB819D2C6F0BD46C38B859C04F6D1FBA4" indent="up1"><enum>(ii)</enum><text>In the case of Arizona and Nevada,
				Schedule D contingent capacity and firm energy for new allottees other than
				federally recognized Indian tribes shall be offered through the Arizona Power
				Authority and the Colorado River Commission of Nevada, respectively. Schedule D
				contingent capacity and firm energy allocated to federally recognized Indian
				tribes shall be contracted for directly with Western.</text>
								</clause></subparagraph><subparagraph id="H5D0E480D09AB4428A076E1CD6375AA17" indent="up1"><enum>(D)</enum><text>Within 1 year of the date of
				enactment of the <short-title>Hoover Power Allocation Act
				of 2010</short-title>, the Secretary of Energy also shall allocate, for
				delivery commencing October 1, 2017, for use in the marketing area for the
				Boulder City Area Projects 11.1 percent of the Schedule D contingent capacity
				and firm energy to each of—</text>
								<clause id="HCFBC018798A7493D9B767A73F042051B"><enum>(i)</enum><text>the Arizona Power Authority for
				allocation to new allottees in the State of Arizona;</text>
								</clause><clause id="HC1A6A0119FBC488B8DC616D01DA3ECD1"><enum>(ii)</enum><text>the Colorado River Commission of
				Nevada for allocation to new allottees in the State of Nevada; and</text>
								</clause><clause id="H4F0D0F99289446BCA7CE0243DCA41CE7"><enum>(iii)</enum><text>Western for allocation to new
				allottees within the State of California, provided that Western shall have 36
				months to complete such allocation.</text>
								</clause></subparagraph><subparagraph id="H589E663EED734092BED9B5C969A9BB42" indent="up1"><enum>(E)</enum><text>Each contract offered pursuant to
				this subsection shall include a provision requiring the new allottee to pay a
				proportionate share of its State’s respective contribution (determined in
				accordance with each State’s applicable funding agreement) to the cost of the
				Lower Colorado River Multi-Species Conservation Program (as defined in section
				9401 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law
				111–11</external-xref>; 123 Stat. 1327)), and to execute the Boulder Canyon
				Project Implementation Agreement Contract No. 95–PAO–10616 (referred to in this
				section as the <quote>Implementation Agreement</quote>).</text>
							</subparagraph><subparagraph id="H7F3528E6BD024B70877D6C43E6970FCD" indent="up1"><enum>(F)</enum><text>Any of the 66.7 percent of Schedule D
				contingent capacity and firm energy that is to be allocated by Western that is
				not allocated and placed under contract by October 1, 2017, shall be returned
				to those contractors shown in Schedule A and Schedule B in the same proportion
				as those contractors’ allocations of Schedule A and Schedule B contingent
				capacity and firm energy. Any of the 33.3 percent of Schedule D contingent
				capacity and firm energy that is to be distributed within the States of
				Arizona, Nevada, and California that is not allocated and placed under contract
				by October 1, 2017, shall be returned to the Schedule A and Schedule B
				contractors within the State in which the Schedule D contingent capacity and
				firm energy were to be distributed, in the same proportion as those
				contractors’ allocations of Schedule A and Schedule B contingent capacity and
				firm
				energy.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HFDCE7D2010734997AFCA7A155FB00060"><enum>(e)</enum><header>Total
			 obligations</header><text>Paragraph (3) of section 105(a) of the Hoover Power
			 Plant Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/43/619a">43 U.S.C. 619a(a)</external-xref>) (as redesignated
			 as subsection (d)(1)) is amended—</text>
				<paragraph id="H44DD3579615A4064B0969EF16CD07EBD"><enum>(1)</enum><text>in the first
			 sentence, by striking <quote>schedule A of section 105(a)(1)(A) and schedule B
			 of section 105(a)(1)(B)</quote> and inserting <quote>paragraphs (1)(A), (1)(B),
			 and (2)</quote>; and</text>
				</paragraph><paragraph id="H369D1DB65429425786A907CD9CD8A9E1"><enum>(2)</enum><text>in the second
			 sentence—</text>
					<subparagraph id="H4C841D4502B44B92B070467B9786188F"><enum>(A)</enum><text>by striking
			 <quote>any</quote> and inserting <quote>each</quote>;</text>
					</subparagraph><subparagraph id="H1EAF71362AB54ADEB028A9C75C28A43A"><enum>(B)</enum><text>by striking
			 <quote>schedule C</quote> and inserting <quote>Schedule C</quote>; and</text>
					</subparagraph><subparagraph id="HAE65BCEABE674822BC06D6B8B7D8FB6D"><enum>(C)</enum><text>by striking
			 <quote>schedules A and B</quote> and inserting <quote>Schedules A, B, and
			 D</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="HC7258B5955384BC19E9FBF6BE0206721"><enum>(f)</enum><header>Power marketing
			 criteria</header><text>Paragraph (4) of section 105(a) of the Hoover Power
			 Plant Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/43/619a">43 U.S.C. 619a(a)</external-xref>) (as redesignated
			 as subsection (d)(1)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H83BEB2130E5A4F0AB3D817BF32076435" style="OLC">
					<paragraph id="H41053220EB5E4C248A159793C33B1C9D" indent="up1"><enum>(4)</enum><text>Subdivision E of the Criteria shall
				be deemed to have been modified to conform to this section, as modified by the
				<short-title>Hoover Power Allocation Act of
				2010</short-title>. The Secretary of Energy shall cause to be included in the
				Federal Register a notice conforming the text of the regulations to such
				modifications.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H061AFCE921154166A8270A6044ED4881"><enum>(g)</enum><header>Contract
			 terms</header><text>Paragraph (5) of section 105(a) of the Hoover Power Plant
			 Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/43/619a">43
			 U.S.C. 619a(a)</external-xref>) (as redesignated as subsection (d)(1)) is
			 amended—</text>
				<paragraph id="H748FEF97E49B4C1BA6151BD1C32188E1"><enum>(1)</enum><text>by striking
			 subparagraph (A) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H8E843DB12176414FBC6CE3A95B2B33CF" style="OLC">
						<subparagraph id="HFFB0AF32362B408B84C60D6274C1AE07" indent="up1"><enum>(A)</enum><text>in accordance with section 5(a) of the
				Boulder Canyon Project Act (<external-xref legal-doc="usc" parsable-cite="usc/43/617d">43 U.S.C. 617d(a)</external-xref>), expire
				September 30,
				2067;</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H5E7DE33285754116B21EDC24340CC928"><enum>(2)</enum><text>in the proviso of
			 subparagraph (B)—</text>
					<subparagraph id="H9CDC020826B74254A904F9202855627E"><enum>(A)</enum><text>by striking
			 <quote>shall use</quote> and inserting <quote>shall allocate</quote>;
			 and</text>
					</subparagraph><subparagraph id="HB9646AA098784F79A11E2B45F68E60A1"><enum>(B)</enum><text>by striking
			 <quote>and</quote> after the semicolon at the end;</text>
					</subparagraph></paragraph><paragraph id="HA656FB18C66347F7A618423481402D6C"><enum>(3)</enum><text>in subparagraph
			 (C), by striking the period at the end and inserting a semicolon; and</text>
				</paragraph><paragraph id="HB83388D92C9F405D9906E1D9DF88EC9E"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HB2B79DA3ED0A475785CFEF9C515ED9AF" style="OLC">
						<subparagraph id="H8E8B73D8A0CE4F119CA3F247BFE6BCC6" indent="up1"><enum>(D)</enum><text>authorize and require Western to
				collect from new allottees a pro rata share of Hoover Dam repayable advances
				paid for by contractors prior to October 1, 2017, and remit such amounts to the
				contractors that paid such advances in proportion to the amounts paid by such
				contractors as specified in section 6.4 of the Implementation Agreement;</text>
						</subparagraph><subparagraph id="HE0F1EAEB0F2E43DD916C669FC88AFC9B" indent="up1"><enum>(E)</enum><text>permit transactions with an
				independent system operator; and</text>
						</subparagraph><subparagraph id="HF9F67FF8C0274A0AB67E147BD8DFB02F" indent="up1"><enum>(F)</enum><text>contain the same material terms
				included in section 5.6 of those long-term contracts for purchases from the
				Hoover Power Plant that were made in accordance with this Act and are in
				existence on the date of enactment of the <short-title>Hoover Power Allocation Act of
				2010</short-title>.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H380FB91A09D046789BA70CDAF2B58476"><enum>(h)</enum><header>Existing
			 rights</header><text>Section 105(b) of the Hoover Power Plant Act of 1984
			 (<external-xref legal-doc="usc" parsable-cite="usc/43/619a">43 U.S.C.
			 619a(b)</external-xref>) is amended by striking <quote>2017</quote> and
			 inserting <quote>2067</quote>.</text>
			</subsection><subsection id="HBF7BA89C22244AABB804908B9BEFBA50"><enum>(i)</enum><header>Offers</header><text>Section
			 105(c) of the Hoover Power Plant Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/43/619a">43 U.S.C. 619a(c)</external-xref>) is amended to
			 read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HE9ACFB213D80497096CA352755DFA933" style="OLC">
					<subsection id="H787342DF630D494894B8F2D5E851A94A"><enum>(c)</enum><header>Offer of
				contract to other entities</header><text>If any existing contractor fails to
				accept an offered contract, the Secretary of Energy shall offer the contingent
				capacity and firm energy thus available first to other entities in the same
				State listed in Schedule A and Schedule B, second to other entities listed in
				Schedule A and Schedule B, third to other entities in the same State which
				receive contingent capacity and firm energy under subsection (a)(2) of this
				section, and last to other entities which receive contingent capacity and firm
				energy under subsection (a)(2) of this
				section.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD5DDEB63D00C4D3F9711AE60C95F419A"><enum>(j)</enum><header>Availability of
			 water</header><text>Section 105(d) of the Hoover Power Plant Act of 1984
			 (<external-xref legal-doc="usc" parsable-cite="usc/43/619a">43 U.S.C.
			 619a(d)</external-xref> is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H8A225DAD7D93466788035B3576F718C6" style="OLC">
					<subsection id="HDBE63EE2DD954989B282FF4B17893C7D"><enum>(d)</enum><header>Water
				availability</header><text>Except with respect to energy purchased at the
				request of an allottee pursuant to subsection (a)(3), the obligation of the
				Secretary of Energy to deliver contingent capacity and firm energy pursuant to
				contracts entered into pursuant to this section shall be subject to
				availability of the water needed to produce such contingent capacity and firm
				energy. In the event that water is not available to produce the contingent
				capacity and firm energy set forth in Schedule A, Schedule B, and Schedule D,
				the Secretary of Energy shall adjust the contingent capacity and firm energy
				offered under those Schedules in the same proportion as those contractors’
				allocations of Schedule A, Schedule B, and Schedule D contingent capacity and
				firm energy bears to the full rated contingent capacity and firm energy
				obligations.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H96499AC710F94BDCA5F16F0B346161D4"><enum>(k)</enum><header>Conforming
			 amendments</header><text>Section 105 of the Hoover Power Plant Act of 1984
			 (<external-xref legal-doc="usc" parsable-cite="usc/43/619a">43 U.S.C.
			 619a</external-xref>) is amended—</text>
				<paragraph id="HFA712672A7F74D4FB23FA727B7CD13BF"><enum>(1)</enum><text>by striking
			 subsections (e) and (f); and</text>
				</paragraph><paragraph id="H1620341A75DE41BE86D02CDD01480FA6"><enum>(2)</enum><text>by redesignating
			 subsections (g), (h), and (i) as subsections (e), (f), and (g),
			 respectively.</text>
				</paragraph></subsection><subsection id="H777B280703D345ADAAA3415DF6B621B4"><enum>(l)</enum><header>Continued
			 congressional oversight</header><text>Subsection (e) of section 105 of the
			 Hoover Power Plant Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/43/619a">43 U.S.C. 619a</external-xref>)) (as redesignated
			 by subsection (k)(2)) is amended—</text>
				<paragraph id="HCDBFB2F93C054EEB99C008D4A5654508"><enum>(1)</enum><text>in the first
			 sentence, by striking <quote>the renewal of</quote>; and</text>
